  1. I would be grateful for some help in how to respond to a county court summons issued by Santander's solicitors. The summons is for £902 plus solicitors and court costs and I need to reply to it by Monday. The amount is made uo of £690 on a Debenhams store card (originally through GE Money), late/missed payment fess and interest. I do owe the money but have had to give priority to my secured debts, council tax and utility bills leaving nothing for credit cards (all defaulted) and this one credit card. I haven;t requested a CCA or queried the late fees etc. - have I left it too late to do so? Should I reply online or by recored delivery? How should I respond to the summons? Any advice would be greatly appreciated, as I have not had to answer one before. Many thanks, Ruth
  2. hi there i would like your help and advice please my sister in law was stoped in a debenhams store by the security of the store and the police was called. she had her baby with her so the police let go her with a fine of £80 i was surprised about this cos she is not a bad person never had any problem she is more of a housewife as she has 3 kids and my brother to look after cos he is ill., anyway she did pay the fine but she's been so down since than and scared if debenhams will send any more bills she doesn't want her husband to find out?? my question is what will hapen? she also was benned from debenhams they said forever but in a ban leter they gave her it only says 12 months?? and will they put any picture of hers on the walls of the store?? baring in mind she had never any ppicture taken only cctv i think was in opertaion ?? kind regards
  3. Morning All My mum recently found a load of statements from Debenhams, Bhs, Dorothy Perkins and Evans store cards that she had a few years back. All of which had Account Cover attached to them. Until recently she didnt realise that in fact she didnt need it as her employer would of paid her for any illness/accident for at least 18 months on full pay. So we started to reclaim. In filling the forms we realised that it was GE Money that the complaints went to She had all statements so we filled in the FOS questionaire and attached the spreadsheet with the maths and sent them off. We have had two replies both from Santander for Bhs and Dorothy Perkins. The both said get lost pretty much you wont be getting a penny from us. This is the final response, case closed go to FLA ??? I done all my charges a few years ago and was pretty successful. Since then however it seems to have changed quite a bit. I am now at a loss as to what to do next. Do I write to Santander ? Do i contact FLA (not sure who they are in fact)? of do I go straight to FOS?? Any help will be greatly appreciated as I am at a total loss and I reckon mum will be getting a few more of these letters this week. Thans Olives xx
  4. Hi I bought a jacket in Glasgow Debenhams last weekend. It was fairly expensive, for me at least, £110. Its never actually been worn yet, but my partner was looking at it and noticed stitching is burst around the inside pocket. To be fair I had never noticed this when I tried on in the store. I did look at the out side and under the sleeves but not on the inside. I took back to my local store in Falkirk, however they dont sell the jacket. Staff member said they could send it away to get fixed. I reasonably believe if spending that money on a jacket I dont want it repaired, however they said that was the company policy, which sounds totally ridiculous to me. Initially I was looking to exchange, which I explained to the member of staff, however now I'm so peaved off I'm thinking I want a refund and I'll get a jacket elsewhere. I'm going to go through to Glasgow tomorrow assuming but would appreciate if someone could explain what my rights are rather than what Debenhams want them to be. Thanks in advance
  5. Been looking to reclaim PPI for my wife. Amongst a few others she had a Debenhams card which was repaid in full in 2003 or 2004. My wife doesn't have all statements, but those we have show £45 per month account cover premiums. Those "nice" people at Santy have now replied to an initial letter (not using any CAG templates etc) saying effectively "it's too old, we no longer hold the records for that account, go away". My question is what are the record keeping requirements on them - how long do they have to keep this information? I don't want to waste money on an SAR if they have binned everything and done so legitimately. Thanks
  6. Hi all, I started a general post (http://www.consumeractiongroup.co.uk...-needed-please) but was advised to post in individual forums - so here goes..... There appears to be some fishy goings-on with regards to an old Debenhams store card agreement to which I have been making token payments since June 06. I received a default notice from the initial lending company in Nov 06, and again in Apr 07. In June 07 I received notification that the ownership of my account had been assigned to CL Finance. I received a default notice from CL Finance in August 07. This agreement recently disappeared off Equifax, presumably as the 6th birthday of the default had been met (or approaching?!?). I have recently received an alert (text/email) advising that a credit limit had been changed from £0 to £900, which I thought was weird as I haven't applied for credit for years. On checking Equifax an agreement to pay has re-appeared from 'CL Finance' with a balance of £903 and a credit limit of £900. I have signed up for a 30-day trial from Experian which shows an agreement to pay since July 08 but repeatedly stating that I am 6 payments late? Surely this is wrong. I understand that my Statute Barred calender has not started, due to my continuing token payments, but I have been informed that all references to a defaulted debt must be removed from credit files after 6 years has passed from date of default, whether paid off or not. I can't see any historical records on Equifax or Experian, if such things exist, so can't see exactly what has taken place. Will the CRAs be able to assist with this? If an agreement to pay has been added, surely this is the debtors doing and the CRAs innocent? Who do I query this with? The CRAs or CL Finance? Any advice on what to say? Thanks all, DD

Although RobWay have failed to provide me with a enforceable credit agreement (just an application form) , and despite several letters to them telling them the account is in dispute they sent me an email the other day asking me to contact them. Well, I'm not too bothered about the contents of the email, but how on earth did they get my email address? I can forsee worrying consequences if DCA's start emailing all on sundry, especially if they are work email addresses. So, just how did they get my email address? Been dealing with them for years, and never emailed before.
  8. Hi, As part of my SAR request, Santander have sent only a statement of charges, not an actual statement(s) with opening and closing balances. How can I calculate the PPI due back?

I had a Debenhams store card that was opened in a rush, the PPI was added, she thrust the application form at me and put crosses where I sign, I cancelled when I realized but was diagnosed with cancer shortly after so it was 3 years before I cancelled. Debt was sold to Link and I am paying back monthly but having done my rolling credit, once the PPI is off the card went into credit and would have stayed in credit if it were not for interest and over limit fees etc. So do I draw attention to this or just claim PPI for now? And once again do I go to Santander who sold the debt or Link who will probably equally ignore this one.
  10. Like many people I have had a rejection letter from Santander regarding PPI on a 10 yrs plus Debenhams card. They have sent me my original credit agreement where I have signed agreeing to PPI. I usually NEVER agree to PPI as I dont want it or need it - God knows why I signed all those years ago .... any idea where I go from here? I know its rare that Santander pay up .....:|

  12. Hi, Wonder if anyone can help me. I sent a ppi claim form to Santander who have now taken over Debenham store cards, in July and received their so called 'final' response on Saturday. I was making my misselling claim on the grounds that I had a previous illness which I now know I would never have been covered for. Here is an extract:( I haven't scanned the doc yet so have to type out) "I can confirm Account cover insurance was set up on your account on 15th March 2001 after a discussion that took place on the telephone with our telemarketing department... The policy applied to your account was Account Cover Insurance and comprised of price, purchase and payment protection. Our telemarketing department sold this policy to you and one of our advisers explained the main features of the product and price. The insurance was added to your account because you chose to do so. However you had an opportunity to change your mind as once you decided to take the product a policy summary and policy document was mailed to you for your review... I understand that you believe that Account Cover Insurance does not cover you as you had a pre existing medical condition at the time of opening. However, please understand that having an illness prior to the cover being taken out does not exclude you from the insurance; this simply may mean that you cannot claim for this condition in the future...I can confirm that Account Cover Insurance was cancelled on 26 August 2011..." I am perplexed as I cannot remember the detail of such a conversation with a telesales person since it was so long ago. Do you think this is what seems to me to be tactics to fob me off? They did not provide me with any other evidence such as signed agreements to the effect that I wanted the ppi. Can I request copies of the agreements and take this to the FOS? I have so many questions I want to ask them based on this response. I would really appreciate some guidance as to what to do next. Thanks in advance! JS
