  1. Hey guys, First of all, I'd like to thank all the people here who do a bang-up job of helping others with their issues. Unfortunately, it's now my turn to ask for help because while I think I understand the basics, I need some support with this issue. I've recently gotten a letter out of the blue from Triton Credit Services demanding that I pay them £450 immediately. They have not yet threatened court action, but they're robocalling me 3-4 times a day often at obscene hours (such as 7am all the way up to 8pm). This debt was originally a Natwest Student Credit Card. Like I said, this was literally out of the blue, no warning from Natwest at all. Most of this (especially given the credit limit was £350) seems to be Natwest's lovely £12 charges every time you annoy them. The life of a student, eh? Anyway, I'm going to proceed with this on the basis it isn't enforceable to start off with. Am I right in thinking there are 3 things I need to do? 1) Send a CCA request with a £1 postal order to Triton 2) Send a cease-and-desist letter telling them to stop calling me and to use letters instead 3) Send a SAR with £10 (does this need to be a postal order too?) to Natwest. Any help here would be much appreciated - rest assured that if this works in my favour, a donation will be made when I am able!
  2. Hi, Hopefully I'm posting on the right forum! Long and complex story involving the Coop, and briefly there are four accounts on which fraud was reported to the Coop. Police investigated and left this open to further disclosure about a year ago, it has a crime reference number. The Coop customer complaints acknowledged that they cooperated with the Police, so in my opinion there has been some acknowledgement on their part of fraud. I had been intending to take this to the IC office, to request the removal of this and the other debts, but due to ill health and disability, I haven't yet. The debt went into default last March, as I will not pay off a fraudulent debt. I'm registered with CIFAS, have notices of correction on my credit report etc. The case went through the FO initially, and although the Coop failed to disclose all that was requested, the FO decided that the matter was better left to the Courts rather than their decision. Anyway to cut a long story short, they have issued several default notices on this particular debt of approx £2,500, and today I was contacted by a 2nd debt collection agency threatening to take me to court send bailiffs around. I've scheduled a telephone call with the Coop customer care woman tomorrow. Any help advice that anyone can give would be greatly appreciated.
  3. Hi there, I’ve been reading these forums for some time now, and find them extremely helpful and informative . I have a long-standing loan for a substantial amount (student loan: over 30k including interest and counting) with Natwest. They’ve recently passed it on to Capquest, who have been inordinately unhelpful and obdurate to say the least. (Listening is not one of their strong points evidently.) I’ve sent the CCA request already, as well as deed of assignment request. The CCA came back already as requested, and the deed of assignment was not provided as they say they are acting on behalf of NatWest. I’ve offered Natwest token payments; offered a full and final settlement amount; and have made clear to them that I am in no position to repay such a vast amount, as I am unemployed. Moreover, Natwest refuse to freeze the interest charges, so the amount just keeps snowballing further. I’m not sure quite what to do at this point, except that I would like to have the matter passed back to Natwest, as CQ are very unreasonable and have already harassed me several times with nuisance calls and doorstep visit threats. Would it be best at this point to: • Offer token payments to Natwest again? • Offer a full and final settlement to Natwest again? • Actively petition for my own bankruptcy? (I am reluctant to do this, as I am afraid it may affect my career chances in the future). Any and all advice would be much appreciated. Cheers.
  4. Hello all, I'm new to this forum and the threat of DCA's, so just wondered if someone could point me in the right direction! I have come home from work today, and found a card from iQor with a telephone number on with the name of their representative. It has their client as wessex water with a £350 balance. I am assuming that this is from a previous property as I moved earlier last year. The debt is almost certainly mine, and have no hangups in paying (if I can pay in installments) but is it best to phone this representative, his office or wessex water directly? and will they accept a repayment package? Any advice will be gratefully received. Regards StorkyIV
  5. Hi everyone Received a doorstep visit from an 'agent' of Credit Security today, in respect of a disputed M&S Money agreement. M&S were CCA'd in September 2008 and failed to comply. (They sent only a copy of T's&C's). This is the culmination of long ignored correspondence from Credit Security, which has now reached the point of them threatening Court and the doorstep visit. I've now compiled the attached letter, partially using a CAG template. Any comments and observations would be much appreciated before I send on Monday 17 Jan. Letter.140111.Anon1.pdf
  6. Hello All, Firstly, I'd like to say what a great job you guys do here. I've never been one to get intimidated by DCA's and the like, however I know that many people can and I think having somewhere to turn, especially anonymously, could be a great help to many people - hats off! That said, I'm attempting to sweep the floor of my credit files and have recently requested same from Experian and Equifx. After a few rip-roaring years I've decided it's probably about time to sober up and buy a house, and am attempting to get my affairs in order. Looking at them I see two defaults for the same account, one from Orange and one from Arrow Global, both for an amount under £100 (don't want to be too specific!). The Orange default (Jan 2007) is with Equifax and the Arrow Global (June 2006) is with Experian. I recently contacted Orange and informed them that... Dear Orange, Upon recent examination of my Equifax and Experian credit reports I was surprised to find two default notices, one on each file, from yourselves and your collections department Arrow Global Ltd, dated from January 2007 for the amount of £ the **th of August 2005 had been satisfied in full and closed and there were no outstanding sums remaining on the account; I left the country and asked for this to be settled on my behalf and am assured that this was done. Whilst I am unable to acknowledge the debt from yourselves without seeing the appropriate paperwork, I am currently attempting to get my financial affairs in order and feel that a default of which I was not aware, for a small amount such as this can have serious long lasting implications, of which you are no doubt aware. With this in mind, I would like to propose that I pay this debt in full, immediately, with the proviso that Orange and Arrow Global contact any and all relevant credit reference agencies to remove the default notice registered against my name and record the account as "Settled". I await your positive response in the hope that we can come to a mutually beneficial arrangement. With Warm Regards, devandy. Now, the first email I received from O told me to send them a copy of my credit file (no chance) and write in as they couldn't discuss this by means other than postal. However, yesterday I received, from a lady at O, an email thus... Dear devandy Thank you for your email attached in reference to your Orange account and the defaulted amount of £ I can confirm that this default is correctly recording as this relates to your invoices raised from the **/02/2006 to **/06/2006 that still remains unpaid. The account disconnected for non payment which resulted in debt collection action and a default on your credit file. The account has now been sold onto a company called Arrow Global Ltd who now own this account therefore Orange can not come to any agreement over the payment and your credit file. Yours sincerely orange lady. Now the query I have is this. I have two defaults registered with different agencies, so I am assuming that the chances of them communicating that these are for the same account to each other are nil, and a DPA request to them would be unsuccesful. However, orange lady told me that they passed the debt to AG and could no longer help me but the default from O was registered AFTER this was sold and AG got their piece of the action. How can they record this default if, by their own admission, they no longer are able to deal with the debt once it is sold and it is not their account to settle? Should I contact them and tell them to remove it as the debt was not theirs to record? I'm hoping that AG may be more receptive to removing the default if I offer payment than O were. Anyway, apologies for such a long first post, however I thought it best to give as much information as I possibly could. I hope somebody out there can help me, but even if not then keep up the good work and words of support! devandy
