  1. Hi Just looking for some advice for a friend. A friend has just received a letter to attend a compliance interview and she's worried big style - its NOT an interview under caution. Four years ago she received some inheritance that took her close to the £16000 mark but not over, she was on incapacity benefit at the time and she was told the savings would not affect her benefits - pretty much all of the money was spent on adapting her home. She was moved to ESA last year and then onto income based ESA a few moths back and her savings have been pretty much zero since 2011. The Job Centre now want her to provide bank statements for the short period she had the inheritance in her account four years ago. She has spoken to welfare rights and they didn't know why she would be pulled in for that as the benefits she was receiving were not means tested at the time. They suggested that she may have been on some smaller component that was means tested but she has every letter ever sent to her regarding benefits and she has never been on anything that was means tested. Other than that it could be a mistake on their part. Has anyone else been through a similar situation?

  3. I normally post in the debt/bailiff forums so hope this is the right place for this debt. I have a friend that had a current account with a large overdraft facility defaulted and this was then sold to a DCA in this case Cabot. I have sent the usually prove it letters and had a response of pay up or else. Ok right I say time to SAR Lloyds. Some time later the pack duly arrived, Full of all the statements and almost everything else. But, no agreement for the overdraft, no letter of sale and no details of the agreement whatsoever just the balance. Right here goes. 1. Overdraft £2,500, over the overdraft by just £297.22 2. Debt sold to Cabot 3. Sar'd Lloyds 4. Pack returned not everything was in the pack 5. Final balance shown as £0.00 account closed 6. Final entries as follows (a) Paid in £2,797.22 (not by the debtor) shown as a cash deposit (b) Next line shows "Account now closed" © Amount owed £0.00 (d) The amount shown by Cabot £3197.22 6(d) I assume is Cabot adding a fee 7. Cabot own the debt Now I have been through every single line of in/outs on the account no late fees except 2 for a total of just £40.00 no other fees. Next letter to Cabot stating that there is a zero balance on the account as a cash payment was made on a day or two before the account was closed, Still waiting for a reply from Cabot. I have dealt with bank debts before but have never seen this one before where a cash payment was made credited and a debt then sold. I do have the statement issued by Lloyds showing this, I was wandering what next to do.
  4. Hi all, not posted here for years! So I've been working away an being young have neglected my credit as I've always been disinterested. Now I'm home and settling down I have decided to pull my Experian Credit Report. It is DIRE! My score is 141 which translates as VERY Poor! I have a total current debt of £4315.00 Individually American Express: 2475.00 EE trading as T-Mobille: 1074.00 Royal Bank of Scotland: 500.00 Wonga: 266.00 The RBS is being paid at £50 a month at the moment. But I'm currently tracking down details to contact the other companies or the agencies handling the debts. I want these clearing ASAP so I can get my credit back on track. I thought a good way of doing this would be with a debt consolidation loan. Tesco have refused me already however a company called Aspire has 'Accepted Me' I am to wait for a phone call. What are the odds of this coming through? And how would you suggest I manage these debts to get my report better? I am working at the moment, I just jumped into a shift job with a family member, Making anything between £800 - £1500 a month depending on shifts. Any help would be appreciated greatly! I am supporting my Girlfriend and could do with a credit boost here and there, so far the only people who have given me a chance are Vanquis and I am managing the card very well.
  5. Hi. I had a current account opened with Lloyds TSB in Scotland in July 2006. It has been closed and made 'defaulted' in April 2009. According to my credit file report from Equifax, the debt has been sold to Capquest. I did ignore the correspondence from Capquest for a few years due to stress caused by loop of charges over charges I was torn in by Lloyds TSB. In July 2013 I received a letter from Debt Managers (Services) Ltd in Edinburgh for the recovery of this debt. As it felt to me getting too close to court action, I decided to start a payment plan. Since July 2013 I am making payments every month to Debt Managers (Services) Ltd. I intend to try and recover some of the charges included in this debt, because I think they were unfair (several wages in a raw were 'swallowed' by bank to clear just a part of the charges over charges, also giving me a kind of Agreed Overdraft to cover the rest of negative balance). My first question is: after I will receive a response to my SAR, to whom will I have to right a claim for charges repayment? will it be Lloyds Bank or Capquest? I am sure, I will have some more questions regarding to what charges I would try and claim to be repaid back. Thank You all kindly for replying to this!

Hi just a quick question i have a bad credit score and was wondering if my bank (santander) would give me a credit card? my credit report is near enough clear apart from 2 ccjs that are due to expire the 6 year period at the end of this year. They have given me an overdraft a few years ago when i had loads of stuff on my credit report, according to noddle credit my score is 1 out of 5 1 being the worst, but i thought as my bank see a monthly amount going in to my account every 4 weeks and monthly direct debits etc if its worth a try to get one, the reason i want one is for travelling as paying with a debit account isn't always accepted.   7. Tesco has today announced the introduction of a current account. It will cost £5 per month unless you deposit £750 per month. Although it will pay interest on credit balances, this is one not to get involved with unless you can guarantee funds deposits exceeding £750 per month every month or have funds left over at the end of each month. There will also be an 18.9% charge on arranged overdrafts plus fees on top of that for unarranged. So if you went over by £50 and could only afford to repay at £15 per month, you overdraft will continue to increase plus the fees on top.
  8. All creditors were written to by letter dated 21.08.06, to inform them of financial difficulties. I enclosed £1 token payment and cont’d to pay this for some months until payments increased. The original payments amounted to £500-£550 per month. I am still currently making all reduced payments as below. I would like to resolve all this but, as I have not had any statements etc from and have still been paying them, I am unsure where I stand and what I can do, if anything, and do not want to open a can of worms as I have been off work with bereavement/stress/anxiety and as a result I am now unemployed. As such I am doubting my ability to deal with all these debts. Details below, any help appreciated. Thanks. Barclays Bank - Central Debt Collection Services (a division of Barclays) Current Acct Overdraft Not showing on Equifax file No idea of balance outstanding - was £2429.47 on 24.11.06 I pay £6.31 per month and have been paying this since 2007 I have not heard from them [CDCS] since 24.11.06 Last contact from Barclays was Termination Notice dated 13.10.06 I have the original Termination Notice stating, “daily interest charges of £0.68 will accrue from the date shown below [13.10.06] until full payment is made, assuming no change in the interest rate.” I have lived at the same address with the same name and telephone number for 17 years.

Hi I have a Lloyds current account, with no overdraft facility and I keep noticing £1 going missing, almost everyday, I haven't a clue where this goes or what its for as nothing shows up on my statement? Also noticed the same happening with my Halifax account (£300 overdraft) Does anyone have any clue? Experience? I will ring them but thought I'd ask on here before I make a wally of myself on the phone!! Thanks in advance x

  12. I got a letter from Santander a couple of months ago telling me that I have to change my current account from a Premier account to another. This poses huge problems for me as I have used the same account since I became an account holder with A&L in 1986. My mortgage, home and contents insurance, salary and esa and dla all operate through this account, not even taking my overdraft into account, but there is an even more pressing matter. On May 3rd, my 50th birthday, I will be pensioned off on ill health grounds from work. I received word yesterday, March 7th, that I will have a hefty lump sum paid on that date and I have to nominate a bank account to have it paid to. This should now be a time of joy as I will be paying off my mortgage, overdraft, credit cards, credit union loans, all the regular monthly bills that hang over our heads, leaving us debt free for the rest of our lives. Instead I have the worry of having to find a new suitable current account, have it activated and all our regular incoming and outgoing expenses set up. And to make matters worse, my sister works for Santander and even she has told me that theres no way I could possibly be operating a new account in this timescale. Can anyone give me any hints or tips for what I can do ?
  13. Hi Everyone, Would appreciate if someone could give me some advice on this one. I had a Barclays Loan for which got into arrears since October. In November, I managed to get a temporary suspension of the repayments by paying only £15/month for 3 months and then review the loan in January. Due to several factors and due to my work ( travel abroad frequently ), this didn't happen so i was sent a Notice of Default Letter letter dated from 4th February requesting repayment in full or contacting by the 4th march to renegotiate the loan. I contacted them only on the 4th march and was informed that there was no negotiation possible and that they would cancel my loan and then also close my current account with barclays. I offered to repay my normal instalments plus £100 every fortnight to clear the £748 in arrears but was completely refused. I'll now lose my current account and will only be able to get a cash card account which is basically useless... On the other hand, I had a previous loan with Barclays for which I received approximately £2000 refund. This was due to an apparent inadvertent incorrect information sent to customers about the loan. They reviewed it and refunded me. With this current loan being cancelled, how can I find out if I'm in the same situation and am due a refund?
  14. Hi everyone, I have a problem with Default on Joint Current Account with my ex-partner. I really what to know if there any chances that I can remove it. The account was started on Dec 1998 by my ex-partner. She asked me to joint with her later to built up her credit. I don't know exactly when I was jointed with her. We cohabitted in 2000. I broke up with her in 2011 and I have asked Lloyds to removed me out from that account before we seperated. The bank collected my card and my cheque book on that day. Last year in 2013, I had been chased from Wescot about this debt. I wondered why they were chasing me because I have already taken my name out. I tried so hard to contact her and asked what happened. I am so mad at her because she has been in £3000 overdraft and she has already went through the IVA (she said she will pay back within 5 years) It seems the bank didn't remove me from that account so they try to chase me in full amount of her debt which they didn't mention anything about her. They charge me all of that debt with my sole name. I have sent 3 letters to Wescot then they couldn't provide me any copy of the agreement or a signed true and certified copy of the original default notice. After 3 months of chasing they has gone. They don't try to contact me again. But the default is still there on my credit report. What should I do after this? I really need to get morgage and have a new life with my wife. This is the only default I have and I had have a very good credit for long time before this happened. Any Advice? Help me pleaseeeee Chayapa

I have holiday booked for the 26th,27th,28th &29th August, therefor i have to return to work for the 30th Aug, 2nd,3rd,4th Sept. ive got the potential to go on holiday during the days im supposed to be back. if i had my holidays and didnt return what can they do?
  17. Hi guys, Haven't been here for a while. Not since you all helped me out with some Excel Parking issues a couple of years ago. Anyhoo, I've now received one from Highview Parking for outstaying our welcome in a Tesco car park. In light of all the 'New law effective from 1st October 2012' malarky, what is the current advice? Back when I was dealing with Excel it was to just ignore and not to communicate with them in any way. Is that still the case? Or do these jokers have a bit more clout now? Thanks in advance.

  19. I currently have a 'together' mortgage with Nram, so this is part secured and part unsecured. The unsecured loan is in breach of cca regulations and have notified all customers affected. I am affected and due redress, how much still to find out, others have already had redress and terms changed to reduce X amount of years. Now my questions is - can they (Nram) decide how this repayment of interest is paid? Also can they change terms without your consent? Thank you in advance. C
  20. Hello, I would be very grateful for some help or advice with a Halifax current account. I am self-employed. At the moment, due to general health issues and personal problems, I have been keeping my business fairly low-key so there isn't much money going in and out, and some months I go very close to my overdraft limit. I admit that some months I have gone over the limit and into what Halifax calls an 'unplanned overdraft'. I have copped the charges for this, added on or around the 1st. day of the following month. I have no objection to paying bank charges where the fault is with myself. I do think the charges are disproportionate, but that is a separate issue. The problem I have with Halifax is that, having reviewed my bank statements over the last 12 months, in the majority of cases it is the Halifax 'unplanned overdraft charges' that have sent me over the limit. For instance, just today, Halifax have added around £90.00 in charges. This is because last month I went around £12.00 over the limit for about 6 days, but I only went over the limit because Halifax had added £22.00 in charges, and those £22.00 in charges were only added because the month before that I had gone over the limit due again to Halifax charges, and so on and so on and so on....back it goes. I stress again that I have no objection to paying bank charges where the fault is with myself, but Halifax's totally ridiculous and disproportionate charges are creating a vicious cycle, and it's not easy to get out of it. The sums involved are modest. The OD limit is only £70.00. However, this is a very annoying situation and I would be grateful for some advice on whether Halifax are adding these charges unlawfully or I otherwise have a basis to challenge them.   21. Hey guys, bit of advice would be very helpful. To cut a long story short circumstance-wise, last year while I was a student, I was in and out of hospital in Aberdeen from June - September, as a result of this I lost my job due to the fact they needed someone in full-time (I wasn't on a full time contract so I did not get any sick benefits). My grandmother also suffered a stoke, and my parents were in the process of repossesion proceedings....great few months. Anyway... This resulted in my finances getting a bit behind, I missed about 1 or 2 months payments with my other cards etc, which was ok and got them back on track. With Clydesdale however, I missed 3 payments on my current account with a £500 overdraft limit. It went up to about £30 over limit. In October I made a payment of £70 to bring my account back above the £500 limit. However, as I have now been told, after various charges and fees by Clydesdale that month my account ended up being £1 over the limit even after my payment.... After paying that I thought everything was in order, as I had set up a direct debit. When I checked my credit rating at the end of January....it was showing as defaulted. My payments in December and January had been bounced back to my account (obviously as they had closed the account). After making my October payment I had to leave my apartment and return to my parents to recover from my hospital time. I informed the Aberdeen branch to change my address...which they did not. I'm very angry as you can imagine. Although they might have already been in the process of closing the account after 3 missed payments, without having any knowledge of this in my new address, I assumed all was in order. They also never attempted to call me about the account either. The fact I informed them in-branch to change my address, and they did not do, is ridiculous. So I had no notice at all of any termination / default letters. If I had known this, I have the funds to blooming arrange a plan with them and could have been avoided. I also note they continued to charge me £20 in December and £20 in January, even though they have told me they 'closed the account'. All the woman in branch offered was 'Oh, that is probably an admin charge'. So in total my account ended at £541 before this 'default' was applied. To have my credit ruined for 6 years for being £1 overlimit is an utter disgrace, especially after their charges put me overlimit by that amount anyway. The maximum that account was overlimit was £30.....Just cannot believe the sheer arrogance of the bank in-branch and on the phone, totally unwilling to help me and rather rude about my whole situation. I have to say, when I had a similar issue with RBS they were very understanding and removed a default notice on my credit card completely after I paid it off in full. I've written a letter of complaint to Clydesdale, explaining the circumstances and asking them as a gesture of goodwill to remove the default....what advice, if any, do you guys have? Do you think I have a case at all legally? Or do they have no culpability in this legally. Kind Regards Greg

  23. Howdi Folks Long Time Fan Fkofilee Here.... Heres one for the books. Went into Barclay's to ask for a standard current account with their Chequebook and Contactless Card Facility. The Sales Guy; Manish.... In all his glory, went through the application and there wasnt a problem. And he tries his usual contents insurance sale ^__^, which i decline as Im not interested. Now i leave the branch with my Sort Code & Account Number, But Before I Leave I Ask About The Cash Card Account. He says its a normal account and no charge. I get home and I speak to CS regarding this and they say the following; - No Overdraft - No Contactless Debit Card - No Chequebook - Debit Card Is Limited And the cheek of it is , the guy ive just spoken to has just tried to sell me Contents Insurance Again?!?!?!? Under what terms do i have the right to challenge this as a mis-sell as I specifically requested a Standard Current Account. He Hadnt advised me a credit check had been run and also didnt say that I had been accepted only for a Cash Card Account? (Its almost like i should assume XYZ when applying for certain things). Luckily for me I'm quite knowledgeable about internal processes and can see how its done but shouldn't they make clear to me that certain things cannot be offered to me? Filee
  24. Hi Everyone, Have recieved SAR back from Barclays today. Alot of information they have sent regarding Statments all the way back from 1998 to 2006 when the account was closed. They also sent Service Point ODP, regarding to a credit card. Dont know where to start with this all doesnt make any sense apart from the statments. Been looking through but there is nothing containing Overdraft limits etc. Can someone help please and point me in right direction. thanks gchads

Hi All First of all, if this is not in the correct place I apologise and could an admin move it as appropriate A bit of history: Whilst at Uni in the early 2000's I ran up a debt of approx £7000. After many years of ignoring this I entered into an agreement with Gregory Pennington Ltd for debt management. Scroll forward to Dec 2010 I finally paid everything off. Scroll forward to now, I signed up to Noddle to check my credit rating for the first time in years . On it there is a defaulted debt for approx £700. Now I am pretty sure this was included in my plan. The original debt was closer to £2000 and the only payments I paid to my creditors were via GPL. So I believe this is an error. The default date is 24/01/2007, but the record was last updated on 30/11/2012. Now the first thing I would normally do is to check my correspondence from GPL, however we had a fire last year and I lost approx 99% of this. So my questions are: 1) I believe this debt is Statute Barred as the default date is 24/01/2007 (6 years 10 days ago). This as I understand would make the debt unenforceable i.e.. a CCJ. Is this correct? 2) If the debt is SB it should be removed from my Credit Report, however if I request this and it is not SB does this count as acknowledging the debt in writing, therefore resetting the SB clock? 3) if the debt was included on my payment plan by GPL and it has not been cleared are GPL liable for it (obvs I will have to speak to GPL to get copies of my statements etc)? 4) Has anybody got any advise or ideas that I can use (I ran up the debt and have no wish to avoid paying it if I am liable however if it is SB then I will not pay it as its Lloyds mess not mine or GPL if they included it on my plan but did not pay it)?
