Dear All Am going through a long and drawn out battle with Barclaycard re my old Egg credit card - I have posted a letter alongside so that yo can see their thoughts/ My main pointer is that I took out ppi in 1999 (tick box scandal) and at the same time had an existing medical condition asthma which would have negated any claims whatsoever. They have written back now and said that I made an informed decision how? Any advice on a plan of attack would be great Regards Alan
  2. Hi All Hope everyone is well.. I have had a Barclaycard from November 2005 until now and just today my PPI was cancelled. I did not even know i was paying PPI. Last year, (approx July 2013) I wrote to Barclaycard regarding this and they gave me a decision based on the letter i sent saying that i had not been mis sold PPI as i had applied online. Guys, I did not even know i was paying it - no recollection of how it happened.. what can I do? Thanks, Adam..
  3. Hi, I received a claim form from MKDP for an old Barclaycard debt. I acknowledge service online but now need to submit a defence today - any advice please on how to construct it. issue date 29/5/14 Particulars of Claim the claimant claims the sum of 3,175.32 being monies due from the defendant to the claimant under a regulated agreement originally between the defendant and Barclaycard. The defendants account number was xxxxxxxxxx and was assigned to the claimant on 16/1 2012, notice of this has been provided to the defendant. The defendant has failed to make any payments in accordance with the terms of the agreemen t and a default notice has been served pursuant to CCA 1974. The claimant claims the sum of 3,175.32 and costs. The claimant has complied, as far as is necessary, with the pre-action conduct practice direction.

I have received the following response to my CCA request from Barclaycard (Formally Egg), they have placed a default on my credit file and their letter seems to be saying the agreement in not enforceable. Couple of questions Is it possible to remove the default from my file as i do not believe they ever issued a default notice? I am currently paying a small monthly amount what should i do next? Hi, hoping someone may be able to advise I currently owe Barclaycard credit cards - £22,000 Barclaycard overdraft - £3000 BOS credit card - £600 debt has become difficult to deal with, monthly payments etc. I'm self employed and live in the UK. How receptive are Barclaycard and would I be able to write off some of the debt? I've had the barclaycards for over 10 years. I got PPI back from one of them and used that to pay off some of the debts. I used to earn a lot more money so wasn't really a problem until now. Maybe missed payments only a few times in all that time. thanks in advance
  6. Hello, I need some advice! I am helping a friend with their debts and although have done this before for someone else about 5 years ago I am rather rusty and not sure what has changed! I have been through the site reading threads and have now got some templates but want to make sure I'm on the right track and to get some advice on the POCs as I haven't come across one this long!.... Claim form received - date of issue 30th May Northants CCBC Claimant: IDR Finance ~(London address) Claimant contact for all paperwork - IDR Finance (Scotland address) POC: The claimant claims the whole of the outstanding balance due and payable under an agreement referenced **acc number** and opened effective from 18/04/2001. The agreement is regulated by the Consumer Credit Act 1974, was signed by the Defendant and from which credit was extended to the Defendant. The Defendant failed to make payment as required and by 25/10/2013 a default was recorded. As of 14/10/2013 the Defendant owed Barclaycard PLC the sum of £12808.14. By an agreement in writing the benefit of the debt has been legally assigned to the Claimant effective 14/10/2013 and made regular upon the claimant serving a Notice of Assignment upon the Defendant shortly thereafter. And the claimant claims:- 1. 12938.12 2. Interest pursuant to Section 69 County Court Act (!984) at a rate of 8% per annum from 14/10/2013 to 30/05/2014 of 539.09 and thereafter a daily rate of 2.71 to date of judgment or sooner payment. dated 30/05/2014 I think I need to send a CCA request to IDR. Do I need to send one to Link too? they were the one's handling it prior although I understand the two companies work together? I am planning to do a CPR 31.14 to IDR Going to send off acknowledgement of service and have ticked that intend to defend all of the claim and also contest jurisdiction... By my calculations the defence must be in by the 2nd July which I think is fine providing the above letters go asap and they don't respond within 12 days of receipt? Any advice really appreciated!   7. Hello All, Can anyone help me with analysing the attached recon agreements. They are for a Barclaycard credit card agreement from Oct 2006. They were provided by a DCA and are subject to a court case at the moment. There are a total of 7 pages. So far I have found the following errors with the docs, when compared against Carey v HSBC 1. The cancellation notice on page 1. Doesn’t comply with any such notices as per Statutory Instrument 2004 no. 2619 The Consumer Credit (Miscellaneous Amendments) Regulations 2004. 2. Both agreements have the incorrect heading. 3. The second one states - The agreement is between Barclays Bank PLC and You, the person who signed the agreement as shown on the attached letter!!! 4. Condition 1 is missing on both of them. 5. Also, On the top left of page 2 of the first agreement is a date and time 26/06/07 3.40pm and In the second agreement it is 22/09/09 19:08. Surely this can't be the t&c's at inception which was Oct 2006. 6. In the first agreement, the front page in the section headed TOTAL CHARGE FOR CREDIT. An example of a standard balance payable equally over 12 months states that the total charge for credit will be £138.44. This works out at a rate of 9.23% and not standard rate of 17.9% quoted in the first box of the same document. (138.44/1500x100) Anyone know how this is worked out, as it is a prescribed term, my understanding is that it cannot be misstated. 7. In the second agreement the third box top left for APR states - Not applicable see below and in the bottom left the box for total charge for credit states Not applicable see below The DCA reckons that barclaycard advised them that i signed the agreement even though one was never ever presented to me even when I queried it several times in 2006/07 Would be grateful for any input regarding enforceability and any more errors especially in the prescribed terms.   8. Dear All, After breaking my back in 2002, I was left incapacitated and unable to work and a HMRC debt of £20K inc interest, the principal is approx £10k. By 2007 I was physically back on my feet and earning money again and with an agreement in place, I started to repay the HMRC debt at £300 a month. I started a new business which was doing well within a year and by the end of 2007, I took out credit cards and a loan. The economy hit and by 2011 things became very difficult indeed, I paid everyone in the company but myself and continued to repay the debts, another learning curve. Ironically the customers who went bust on me due to theft and misappropriation of funds were both financial and spread betting institutions, I owned an IT support company. By 2011 I lost the business and panicking and under the advice of my friend Financial Adviser, I borrowed £5k from family to pay Credit Card Killer and a Mr Basil Rankine to transfer the debts to his company, as you know this failed miserably. Lots of other things happened as they do with life and I fell into a serious depression and I’m now coming out of the other side and want to get a job and get my financial feet sorted out, s o I’ve signed up to Equifax and there is some confusing things. Currently I have no way of entering into any repayment plans with creditors or HMRC . I’m hoping for advice that either I’ve done everything as best I can, or there is possibly that I can do more, either way, thank you for your time. Nov 2009: BarclayCard was £9849.81 on nothing has been paid since. May 2010: Mercers served a default notice ( attached ) different date than Equifax NB: Within 6 months I received many notices of intended litigation, I stated to all creditors that this is an excellent idea and I looked forward to going to court and having my entire situation reviewed, needless to say none of them did anything April 2011: I sent BarclayCard a letter stating my position and that I required a resolution by May 2011, in other words, go to court or stop contacting me. (attached) April 2011 – Barclaycard sent a letter of assignment and transfer to MKDP LLP, balance of account now £11028.51 (attached) May 2011 – MKRR Stated I could not assign the debt to another company. May 2011: MKRR Reitterated the same and stated that I knew they had been assigned the debt now and I should contact them to discuss payment, I insisting on court. Aug 2011: MKRR Disagreed there was any dispute and I never heard from them again. Nov 2011: Raven recoveries letter, no mention of MKRR Feb 2012: MKDP creates a credit card agreement on Equifax, I knew nothing about Mar 2012: Barclays letter,, I never sent one. again no mention of MKDP. May 2014: MKDP registered a Gone Away notice – I’ve not heard anything from them Any thoughts on if I can make any changes to improve the situation or if they have done anything wrong? I have attached some relevant documentation that should help, do let me know if you require more. thanks very much everyone for your help, Kind regards
  9. I received a letter regarding a successful PPI claim from barclaycard. It's for 197.67 PPI premiums and 612.61 interest which is inclusive of 8% interest after tax . Now this debt has been bought by a Dca and is for approx 2400 which includes lots of charges . Now barclaycard reckon they are sending me the money . But I am going to claim back or try to claim unfair charges on this account can I still do this . They did once give me some charges refund of approx 300 which they refunded back into my account I at no point wrote and accepted this they just did it . So not sure if I can still claim the charges . I thought the money would go straight to the Dca
  10. I recently applied for PPI with Barclaycard and this is the feedback from them (attached). I was not sure I had a PPI when i took the credit card in 2006 with a limit of £250 so i decided to apply to see what happens and from the feedback it looks like I had PPI and I do not understand how they how have analysed the payments. Can someone adviced me if Barclaycard are correct with their decision. Please view the attachments.......
  11. Please can someone help me? Today I checked my credit report for the first time in years and there is an entry from an old debt I had ten years ago. In 2004 I got into financial difficulties and whilst I negotiated with my other creditors Barclaycard never chased me for the debt so I ignored it and I have never contacted them since. I originally opened the account in 1994 and the final debt was over 10K. The account is marked as delinquent on my report and it is updated every month (non-payment) and the account has never defaulted. Please can someone tell me a) Is this debt statute barred b) Can they collect it should they wish to c) Can I get it removed from my file as it is seriously damaging my credit score? Grateful for any advice - thank you.
  12. Hi all I owe £5700 on my barclaycard. I used this to pay off my sisters back rent, bailiff charges and council tax as she was going to be evicted. She is repaying it at a reduced rate now of £50pcm as she cannot afford the full repayments. barclaycard have frozen interest on the account for a period of 12 months which is almost up and they are expecting full payments to resume which we cannot meet. I was wondering if there is any way to make the interest freeze permanent to allow the debt to continue decreasing as if we cannot do this it will just keep increasing. Thanks in advance for any advice also are the any letter templates that may help with this.
  13. Hi I’d be very grateful for any help/advice with the following problem. Four years ago, I asked Goldfish if they could write-off my credit card debt due to my circumstances (which I’d explained to them). They wrote back saying that they couldn’t do this, however they stated, due to my circumstances, that they wouldn’t pursue me ever again for any further payments. However,the debt would still show on my credit file. Not so long after that was agreed, Barclays bought all the Goldfish accounts,including mine – and it wasn’t too long before they requested payments from me again. However, once they saw a copy of my letter from Goldfish they agreed that they shouldn’t be pursuing me for payments – and they haven’t done so. However, it still leaves my credit file in a bit of a mess (please see attached). It continually shows 6 payments in arrears, and I think it’s going to do that until I die or I somehow manage to clear the debt. If the account had had a default, then at least I’d know it would drop-off my credit file after 6 years, but it looks like this will never drop off. Does anyone know if there is there anything I can do to have these entries removed? Thanks in advance. Florish
  14. Hello, I was hoping for a little advise regarding a PPI claim against Barclaycard from any experts on these matters. The current status is that the Financial Ombudsman Service found in our favour and recommended to Barclaycard that our claim should be fully upheld and reimbursed accordingly. The basis of our claim was that Barclaycard were guilty of systematic selling of our PPI, they had implied our application for the card would be more successful should we take it out, a familiar and well established tactic. Barclaycard however have rejected the FOS initial findings and appealed against the FOS decision. The reason Barclaycard cite is that along with the application for the card comprehensive information regarding the PPI was included within a leaflet in the application package. We asked Barclaycard to produce a copy of this leaflet, they said they cannot due to passing of time. That is where we are currently. I was hoping someone could advise what is likely to happen next: 1. Are the FOS likely to change their mind? 2. Will the FOS make a final decision which Barclaycard cannot challenge? Thanks, Charlie
  15. Hi Folks, Ok I have a Barclaycard, (worst decision I have ever made). On a recent trip to Berlin I inadvertantly used it when checking out of the hotel. I was not quite sure as to what balance was on it but the payment went through. Today I received a letter stating that it was over its balance by £32.00 and I need to pay the £32.00 immediately and there will be a charge applied. Now, to me this is not responsible lending but simply a way for them to extort money. If they were responsible they would have declined the payment and I could have used another card. Surely there has to be laws out there preventing them from doing this. Joe
  16. Morning all, my first post but I've been lurking for some time! I have recently sent off 3 CCA requests to my Credit Card companies with no satisfactory reply. I sent the account in dispute letter to all 3 on Tuesday, they all received them yesterday. My question is, Barclaycard have issued me a Default Notice last week, all done properly as I can make out, after not sending any payment for the last 3 months. Can I, by making one months payment, render this Default Notice void or do I have to pay the full arrears? Any opinions please guys? Thanks in advance
  17. Hi Guys, Could someone please have a look at this attached spreadsheet - I am not sure what I am doing wrong. The 8% interest isn't adding on, and I must have made a mistake somewhere, but for the life of me can't figure out what it is. Also - my understanding is that you can claim the 8% up to todays date, when it comes to the contractual interest it has to be thill the account closed. If this is correct how do we show this on the spreadsheet? I am assuming that the total CI tallied up to todays date and not the last transaction/statement date. Got a few of these spreadsheets to fill in and wanted to make sure I was using it correctly! Cheers peeps!
  18. Hi, I have been paying PPI on a Barclaycard credit card for a few years. I would like to make a claim, but I'm not sure how I applied for the card, and what grounds to use. Is it possible to find out what process I used to apply from them, i.e. online or postal/phone? Is there any general information available about any mis-selling perpetrated by them around September 2009 I can make use of? I would like to take the time to give myself the best chance of getting some money back. Should I get the SAR first? Is there any other information I should request? They have an online form for applying, but I am reluctant to just use that. Seems a conflict of interest that they would make that the most likely route for success for me. I understand some might say I have no right to claim as I don't apparently have any grounds, but hopefully someone will side with me against Barclaycard and offer some pointers. I have been paying Barclaycard by payment book for last 10 years and now Barclays bank has advised me that they no longer re-issue new payment books as they want to have every one on paperless billing. this is a 10 year old debt I am paying off at £3.85 per month,and I have had no contact with Barclays since I set up the original payment plan 10 years ago. and the payment book now has only one payment slip left in it. any advice on how I should go about getting another payment card from Barclay card would be greatly appreciated .i am reluctant to call them by phone to get a card as advised by the bank .i have their telephone number but no address .and should I also now ask them for the original CCA?
  20. Hi another two of our debts are with barclaycard. Sent off cca request but nothing back within the 14 days sent account in dispute letter. Oh and in between also had to send telephone harresment letter due to constant calls that have now stopped. Had response today saying that they only have to provide a reconstituted one but there was nothing in the envelope with the letter! I need to fire a letter right back to them tomorrow but as the agreement was taken out in 2002 don,t they need to send the original? I have been reading conflicting advice on posts as to whether the no coca no pay rule will still apply. Can anyone help as if they need to provide the original then I need to put it in the letter.   21. I currently have three credit cards which I currently owe in the region of £35k in total on. I have recently been unable to make the minimum payments on them in the last 3 months due to work drying up, and not looking much better in the forseeable future. One of which is with BC. I wrote to them saying that I am having trouble paying, and they gave me 30 days to sort out a plan and that they will freeze the interest for one month and that I should send them an Income and Expenditure breakdown asap so that they can sort out a payment plan. What I really want to find out is what I should do next, seeing that I can't pay them the amounts that they want in the near future, but I would really like to pay off the amounts in the future, but not sure when that would be. Therefore, I would appreciate any help that anyone can provide me, as I really want to take control of this situation, from a process perspective and a financial perspective. Thanks Ed
  22. I was wondering if anyone could advise on a possible PPI claim? My husband had 2 credit cards a long time ago. One with Providian (approx taken out 2001), and one with Barclaycard (approx taken out 1998/97). We have no statements, but do have both account numbers. The Providian one was sold to Cabot in approx 2004. These were both cleared in approx Aug-Dec 2007. I think both had PPI on them, but I'm not 100% sure, and can't check statements as we have none now. We would like to try to claim back the PPI, but are not sure how to go about it. I cannot use the calculators as I have no idea how much the PPI may have been. We haven't pursued this before as we thought accounts older than 6 years didn't qualify, but have found out today that it doesn't matter how old. As we're not 100% if there was PPI on these, should I just send initial letters to both companies and see what comes back? or do we have to be certain there was PPI? And which letters would we send first?
  23. I am in a similar boat to many people here - had an Egg card from 2000, became overwhelmed by debt and signed up with a debt management company in November 2006. The debt management company advised me in 2010 that the debt was unenforceable and wrote to Egg asking for a copy of the CCA, which Egg said (when they were still Egg) they were unable to provide. Egg was bought by Barclaycard, Barclays sold the debt to Marlin and now they've started chasing me. In reply to their first letter, I emailed to say that I would like to see a signed credit agreement for the debt they are trying to enforce, and today (a month later), I've had a print-off of an 'online application' which includes no mention of interest rates, etc. Curiously, they've also detailed an unknown credit card number on the letter (which is also handwritten on the 'application') which looks like a Barclaycard number (starts in 4929) and is certainly not the number of any Egg card I have held. I've sent them a formal CCA request for any account for which they're seeking to enforce a debt. I've spent a long time paying off and settling with creditors, and my credit record is looking better, which is important as I set up my own business 18 months ago. This debt no longer appears on my Experian credit report. I guess what I want to know is: - can Marlin do anything to further affect my credit record, given that the original debt is not on there? - can they enforce any action against me to reclaim the money? - Is there any benefit in making a SAR application? I have not, at any stage, acknowledged the debt is mine, and given that they have now tried to give me an erroneous account number, suspect that this may get tied up in their systems!   24. Lowells are chasing me for debt re: Barclaycard. Have written requesting the CCA, they've sent this direct to Barclaycard. Have received said agreement from Barclaycard It appears to simply be a copy of their conditions? Can they argue this is sufficient and then provide a signature down the line if they wanted to issue a CCJ? If not, should I write back to them? Thanks
  25. I am just wondering whether kind folks on here think I have a case. First I am registered disabled and have been for many years. Back in 2003 I was quite poorly and in March 2003 had just begun taking medication which had some horrendous side effects. I banked at Woolwich at that time already part of Barclays. We were very tight financially and due to my medication was not in a good place mentally. One day I went into Woolwich to withdraw money. The cashier said would you like a Barclaycard. Not really with it I accepted and the form was filled in there and then. One of the worst decisions of my life. Within 5 days I was given this card with a £3k limit. No checks had been made that I was disabled and in receipt of benefits. We used the money to live on as we had two teenage kids at this time. They progressively upped the limit to £7k without asking us over two years and we used the money to live on and then of course eventually couldn't make the repayments We came to an arrangement with Barclaycard who then sold the debt to Cabot in 2011 which is now down to £4950. What I wanted to know should I apply to Barclaycard for mis-selling of a credit card and complain? If they refuse to address the issue take it to the Ombudsman. I have already taken Cabot and it was decided that they have bought the debt in accordance with the rules and my application was deemed to be the credit agreement. Any replies will be helpful
