  4. Hi everyone, Id be extremely grateful for some help with a PCN I have recieved from ParkingEye for overstaying in a shop carpark. I didnt even realise there was a parking meter/charge...its a new thing they must have in. It says we stayed 2hrs 19minutes in a '1 hr 30 mins maximum free stay' carpark. can someone advise the best course of action please.....its £85 by 2nd July OR £50 if paid by 18th June. Im swimming in issues with debt, stress and lots of other things I have to tackle on top of this which is just another dig in the ribs.. ..and is actually the second one we've received from these robbing sods, two different occasions.. ....last one I ignored because I mistakenly thought that was the correct thing to do.. ..my mistake..... .but I would be so grateful for some help with this one before it goes to court. We havnt got £50 or £85 and I think the amount of the charge is ridiculous Thank you very much.
  5. I have received a Summons, having overstayed approx. 20 mins in B & Q car park, Sutton on 12/12/13. I ignored the initial correspondence, having looked at advice which I think was out of date. Can someone help me to deal with this. The time limit was 2hrs and 45 mins. The summons is for £85 amount claimed, court fee £15, solicitor's costs £50 - total £150.

HI,i just need some clarification on what step to take next please. ive read through various posts and the sticky on private land pcn etc,some say ignore, the sticky says do not ignore, i got a PCN from morrisons parking eye,it arrived today,dated 6 days after the alleged offence,the last time i received a PCN on private land (not morrisons) i never responded at all and eventually they gave up,is this still the way to go now ? any info would be much appreciated thanks for reading
  7. Hey all - this is my first time to post so any advice would be much appreciated. My husband works for a large utility company who has an agreement with a nearby business for overflow parking for their staff. The agreement is that the utility company emails the business the registration numbers of staff who will use the overflow car park and these are then passed on to Parking Eye, the parking enforcement for the business. On Monday my husband checked his credit report and noticed a CCJ from parking company Parking Eye - he contacted the court and established that this was for parking in the overflow car park. He checked with his workplace and they confirmed that they had emailed the business who offers overflow parking with his details in October 2012. He has copies of these emails. As such, he should never have been issued a charge. We moved address in November last year and so all the correspondence from Parking Eye re: this issue went to the old address. Both the business and Parking Eye have sent my husband emails stating that they will cancel any other parking charges and would have cancelled this one if he had contacted them but now it has gone to court they can do nothing about this. Is this correct? It is our position that the business or Parking Eye should be responsible for having this CCJ set-aside as they have admitted to erroneously issuing the fine in the first place. It will cost us £155 to have the judgement set aside - the CCJ itself is only for £190. My husband has a perfect credit score apart from this and so it is not an option to just leave the CCJ on there. Can anyone advise me as to whether the business or Parking Eye are able to have this judgement set aside or if it is true that there is nothing they can do? If we do apply to have this set aside ourselves, can we claim court costs from them and are we likley to be successful in this?

Just had a call from Father in law, he parked in a car park near the town center (free car park) for a 13 min overstay its one hes used for a long time and theres never been an issue before, turns out they have recently (so recently i havent seen them yet) put anpr in hes a little panicked as they have written to them (notice to keeper) and requested £90 or £54 if its paid within 14 days, ive reassured him best i can (basically promised if it came to court i would pay myself) I know that we need to appeal - they will refuse then to appeal to popla with GPEOL just thinking of writting the appeal to parking eyes along the lines of The Driver would like to appeal the notice to keeper provided for ticket number xxxxxxxx You have stated that the reason for the ticket is parking for a duration of longer than 2 hours, however The Driver was actually parked for less than the two hours due to the fact that the car park was busy and The Driver had to wait inside the carpark for a car to vacate a bay, as you are aware the terms and conditions on your sign state that i am only in breach of contract if The Driver is parked for over 2 hours, although you have entrance and exit pictures showing The Driver was inside the carpark for over 2 hours this does not relate to the amount of time parked The Driver would also like to point out that as the car park is a free carpark and your systems are automated needing no human intervention that the parking charge is not a genuine pre-estimate of loss, and is infact over 3 times the cost of a council charge in the same area, it is also not allowed to include the general costs of business susch as installing cameras and signs but can only be losses caused by the parking in question, these can only be items such as the fee to the DVLA and the cost of postage for your notices, therefore The Driver is offering a goodwill total of £10 in costs, if you accept this then please reply as such and write the ticket off, if not please reply with a full breakdown of your actual costs specific to this case if you wish to deny this appeal then the driver requires that you do so within 14 days and provide a full and correct popla number so we can appeal further
  9. I parked overnight at Asda Living in Maidstone from 22:49 to 06:30 on 14/15 August 2013 on my way to France and have received a parking notice for £90 dated 20/8/2013. During my absence in France I also received a reminder dated 23/09/2013 and a "Letter before county court claim" dated 8/10/2013. I have subsequently received a letter warning of court action. On my return to the UK on 14/10/2013 I responded to the correspondence on 16/10/2013 advising of my absence, pointing out that the business was closed (Opening hours 9am to 8pm) and asking for calculations of the charge, confirmation of their entitlement to raise the court action and the name of the landowner. PE has now replied (See attachments) and stated that the appeal period had elapsed, and included 7pages of legal cases and why they are entitled to pursue the claim. I have now replied and asked for a POPLA number and asked for confirmation that the court action has been suspended pending the POPLA appeal. Suggestions for future action would be appreciated
  10. Had a PCN from Parking Eye for 10/01/14 ......2.5 hours Issue is, they have sent demand to employer (company car) I spent an hour explaining to MD, and extolling the virtues, of CAG. But he wants me to deal with it. Should I send PE a note, to forward correspondence to me? So I can ignore them? Or tell em, as a company we can't hand over driver details.... Data Protection etc I have the ability to use company headers. I notice, advise is changing a little, on the ignore front.
  11. Had a similar issue sometime last year, which was ultimately cancelled. Without going into too much detail: Got a Parking Charge Notice end of 2013, again in my friends dads name (car is registered to the dad, who is out of the country). Didn't want the hassle of it all being in his name, so sent a letter naming the son as driver. Eventually Parking Eye sent the Parking Charge Notice in sons name. Sent a short appeal denying that anything is owed and asked for a POPLA code. Yesterday, received a letter with the POPLA code, but its been sent in the dads name. Considering the son was named as driver, can it be ignored until the 35 days are up and therefore canceled for being out of time? Or should we inform them it has been sent in the wrong name again, get them to correct it and then send a full appeal to POPLA? I'm not sure which way to go at the moment. Thanks
  12. Hi All Today my wife received court papers relating to a parking eye invoice. Its the normal amount £85 plus fees =£150 My wife can not drive nor does she have a licence to drive so could not of been her driving. The driver was parked for 16mins to long in a supermarket car-park in the evening when car-park was almost empty I have just sent a letter to the CEO of the supermarket to complain about parking eye and there signage.How is someone supposed to make a choice to enter a "contract" while driving in to a car-park with writing 3mm .you can not read it from 3ft away Any advice on what to do now. Thanks
  13. Hi there, Firstly, great site. Secondly, I received a summons from Parking Eye for parking at an Hotel in Peterborough whilst I went in for a business meeting. Unfortunately, I threw away all the correspondence recently as I thought the fine had 'gone away' as I wrote to them in disgust in the summer. I arranged to meet a potential client at the Hotel on 24th May 2013 and when I parked I noticed that I had to pay. I wrongly assumed that the hotel would reimburse me as I was parked there whilst I used their facilities. However, I did pay via my phone and do admit that the meeting went on longer than anticipated and so a few weeks later received a parking charge from Parking Eye and wrote to them explaining that I had paid for parking (I think 1 hour) and that I had used the Hotel's facilities as a meeting place and that I felt that although I was late, I should not pay the excess they were claiming. I heard no more until just before Christmas when I received a summons for £165.00. I have filled in the acknowledgement of service online via www.moneyclaim.gov.uk and stated that I intend to defend all the claim and am now looking at the correct defence to submit. Part of their claim states 'parking without authority', which I find strange as how can I get authority before I park? and also 'captured entering and leaving the car park, parking without a pay and display ticket'. If I recall, no ticket was necessary and the implication seems that I paid nothing, which I did. Any suggestions ? Many thanks.
  14. I know this has probably been asked but I really need some advice. A couple of weeks ago I received a notice from Northampton County Court bulk centre to say that I am being taken to court etc by parking eye due to overstaying in a free car park. I submitted a defence saying that I had not received any letters from them (which I honestly hadn't otherwise I would have done something about it esp as over Christmas period) I didn't realise about the 2 hour only free parking as the last time I used the car park it was free for longer periods. Even though I have since checked there are signs, I just didn't notice them. I was in the local shops (costa to be exact lol) for the 2 1/2 hours that they state I was there. I was meeting someone who got there about 10 mins later & left at same time but didn't get any notices either. I have now received a letter saying that parking eye are proceeding with the county court claim. What should I do now, just wait till they take me to court, but I cant get to Northampton as its too far & I am a single parent with children and school runs etc or should I contact them & try to sort out.
  15. the incident happened at a ikea retail carpark nottingham there are also many other stores. the carpark was absolutely rammed, cars were queuing to get in and get out the lanes inbetween the parking bays had cars queuing to get out etc and the driver could not see any spaces to park. the driver parked outside of a bay, there was no obstuction caused and it caused no restriction to any traffic as the section was very wide. we ate at a restaurant there then had a quick look in the shops, it was not untill we had actually left the car park the driver noticed the ticket on the windscreen, the reason for issue is obstructive parking and unauthorized parking charge £85 reduced to £50 if paid in 14days. should the driver pay or appeal? if the driver appeals what would be the defense?
  16. Hi can anybody advise as to whether this latest type of begging letter, received from parking eye, has lead to court papers being issued. I have received many in the past but never one that has said will. See attached pdf. In this case the Addressee was not the driver, no correspondence has been entered into with PE. Any help as to correct defence wording if this does go to court would be appreciated. Many thanks MD.
  17. Hi I received notice of county court summons from Parking Eye after my husband ( in my car) overstayed at a Hotel car park we regularly visit- he didn't buy a ticket from one of their machines. I received demand for payment many times and foolishly thought it would just go away, as I read up on this and thought they where illegal?. Not so, next thing I received 2 county court summons. I read the advice given on this forum and put in a defence using some of the information I had read, e.g. the defendant denies entering into a contract with ParkingEye and that the charges we disproportionate. I also got in touch with the hotel and asked for their help, but unfortunately they said it wasn't anything to do with them! found that very strange as ParkingEye say that they are working for their "clients". Today I received a bucket load of paperwork from PE stating that they wish to proceed with these County Court Claims, there must be about 30 pages of lots of drivel and photographs of hotel, signage etc. What should I do know, I have no idea if the court will send for me and when? Can I choose my local court? Any help will be appreciated, and thank you in advance.
  18. Hi, I have been reading through all the relevant threads and don't know where to start! My son received a PE charge a couple of months ago for parking in a free retail car park for 25 minutes longer than he should. On researching, I found that most advice seemed to be to ignore everything (now seems that may not have been the case!) so I advised him to do this, which he did, and now has received a county court claim for £165!! I am now feeling guilty for advising him to ignore the initial charge, am wanting to help as much as possible to fight this unfair situation. Hoping that you can help? I am just completing the Acknowledgement of service, as this appears to definitely be the route to start, but will not send it until I have hopefully heard from someone.   19. i know i have just finished dealing with an athena parking charge and won but have now received in the post a court claim form from parking eye about an incident in october last year. as the husband is away working his post still comes to the flat, but i dont open it. i only opened this letter as i saw the word defendant. when i opened the letter i saw the words county court claim form i have just opened the rest of his letters to find 2 other letters from parking eye that i knew nothing about. one dated 6th december and the other 21st december. i have only a few days to fill out the claim form for the court on my husbands behalf and im really stuck on what to write. the form is confusing me no end, and im starting to really stress about it. the whole bill is for £165, and i wil not pay a penny. HELP!!!!!
  20. Hello I have just received a county court summons from Parking Eye who are claiming £165 from me. I parked in a private car park in Newquay last year and paid for a ticket. the signs were very busy and it was dark so I must have read it wrong and not paid enough. The ticket itself does show an expiry time but it was not labelled as such. In fact it is under a title of 'issue time'. Anyway a few weeks later I got a letter through the post for a £100 fine. I marked it 'NO CONTRACT' and sent it back. I then ignored future correspondence. I have now completed an 'acknowledgement of service' online disputing the whole claim and need to prepare my defence. I dispute the ticket on 3 key grounds: 1. I do not believe the ticket prices were clearly marked and illuminated. 2. I do not think the ticket itself was clear with the expiry time. 3. And this is the main one, I do not see how Parking Eye can charge £100 for overstaying in a car park by 45 mins. Do you have any advice on what I should put in my defence before responding?
  21. Hi all Please help!! Today received a county court claim form regarding a parking eye ticket I was issued a while back after parking in my doctors surgery to go the adjoining pharmacy! I have followed advice found on forums and ignored the letters but have now been hit by this!? They are asking for a total of £165 which I cannot afford! What do I do???? Li
  22. Hello all, I received a 'fine' back in June last year, and after some research I decided to ignore all 3 letters they sent. I have just walked through the door and 8 months later I have received a letter from debt collection plus, regarding that I pay £140 pounds within 14 days. Any ideas on what to do or shall I just keep ignoring? Thanks very much
  23. Hi, got a parking 'invoice' last year from Parking Eye for overstaying in a 2 hours free car park by 20mins. I read a few forum posts at the time and following the advice suggested ignored PE's letter and the 2 that followed. Thought it was all forgotten about until this week -I have received a suitably threatening letter from Dept Recovery Plus Ltd asking for £150. Having looked at various forums tonight I now get the feeing that I should have appealed at the time - hindsight is a wonderful thing. But too late now, as it stands I have done nothing- no correspondence to them, no appeal, nothing acknowledging who was driving etc Need a bit of reassurance about what I should do now? Is it too late to appeal? Should I continue ignoring? Should I just pay up? I really don't need the stress of being taken to court or filing court papers if they take it that far as I have enough on my plate at the moment.... In the same way I work hard for my money and don't want to be giving it away! Looks like PE are taking people through the court process so what should I be doing? Oh by the way I have no excuses just didn't register the signage and time ran away with me, although fair to say the carpark was far from full! Appreciate your advice ladies and gents, thank you
  24. Afternoon all! I received a Parking Eye 'charge' for an overstay at a motorway service station. I sadly, using the outdated advice and not this website, chose to ignore the 3 letters until I received my first letter from Debt Recovery Plus! After receiving my DRP letter I then chose to write to PE with an appeal of my £150 parking charge, outlining a case for safety as I was asleep (on a longish journey and had been working through the night). I also included proof of my working duties by enclosing my roster/logbook. I also included the legal case in my appeal asking for the loss flowing from my breach and that to see the signs I needed to be out of the car, which I never was, no contract with PE etc etc... My question is, as the 14 days have now come and gone for PE to even acknowledge my appeal as per the BPA Code of Practice, and i've heard nothing, does the 28 day appeal window now mean i'm wasting my time writing again to PE acknowledging their breach of their CoP and appealing again or do I now just wait for the court papers and/or look big and pay up? According to the Welcome Break Group Plc website and their own website, "they welcome appeals" and 28 days isn't mentioned - obviously is was on the back of my charge!   25. Hi I wonder if anyone could give me a bit of advice. I received a parking charge notice last June from Parking Eye and from looking online I took the advice given at the time to ignore it. But in January I received a County Court Summons from Northampton. I have sent in a defence to the Court but also sent a copy to Parking Eye. Parking Eye have written back with a letter headed "Without Prejudice Save as to Costs" saying that they require me to pay £50 for the Court costs. I am unsure what to do now. Does this mean that if I pay the £50 the case will be dropped? Can anyone help with advice as to what to do next? Thanks
