  1. Will give that another try . Do I just wait now to hear from Court? I'm bit nervous as I've never been to court for anything and wondered how I can fight this ? Bottom line is I don't have £365 they are claiming. Can you give me any suggestions as to what I can defend myself with in court? Much appreciated.
  2. Hi I received notice of county court summons from Parking Eye after my husband ( in my car) overstayed at a Hotel car park we regularly visit- he didn't buy a ticket from one of their machines. I received demand for payment many times and foolishly thought it would just go away, as I read up on this and thought they where illegal?. Not so, next thing I received 2 county court summons. I read the advice given on this forum and put in a defence using some of the information I had read, e.g. the defendant denies entering into a contract with ParkingEye and that the charges we disproportionate. I also got in touch with the hotel and asked for their help, but unfortunately they said it wasn't anything to do with them! found that very strange as ParkingEye say that they are working for their "clients". Today I received a bucket load of paperwork from PE stating that they wish to proceed with these County Court Claims, there must be about 30 pages of lots of drivel and photographs of hotel, signage etc. What should I do know, I have no idea if the court will send for me and when? Can I choose my local court? Any help will be appreciated, and thank you in advance.

Hi, no didn't have credit card, but am almost certain that they where loan accounts( at least part of outstanding balance is) which therefore means I must have signed for them and a CCA could still be asked for . Also even so, my point is , can someone just come along albeit a dca and say that you owe us money without proof?
  5. Hi The account was in my name and also "trading as..." I ran a shop at the time I held this account. Does this make a difference? Thanks for help with thread title!

  7. Hi I am new to this- so please be patient! Just hoping someone will help if possible. I was paying a dca (Apex) for a sum of money i owed to Natwest Bank, all was going well up until I asked them for a deed of assignment letter(?), did'nt hear from them again. About a month ago Westcot wrote me a letter saying that they were now collecting for Natwest Bank (their Clients!), getting a bit wise now I also asked them to produce the deed of assignment letter. Nothing until yesterday when I received through the post an envelope with ALL of my bank statements in (Natwest), ..."as requested by you..." I did not. Firstly I am horrified that anyone, including this company who I have had no dealings with, can get hold of such personal data ( more so if Natwest gave them to Westcot!) and secondly can this company enforce the said debt? I have written to them again requesting to see the original credit agreement. Is there anything else I should be doing? Shall I just wait to see what happens next, and who actually owns this debt?
