  1. Hi all, I have received a letter from Debt and Revenue Services threatening a Home Visit, because I have not contacted them regarding repayment of an account.... They are demanding payment of £328.33 in relation to a debt with a company called 'Opal'. I have absolutely no idea what this is for and have never heard of Opal. What do you think would be the best way forward with this? Should I send an email asking for details of the debt or ignore them? I had a similar one for £130 a few weeks ago from another DCA and when I challenged them they said they would just pass it back to their client as I had been un-cooperative. Do these people think they can just demand money and you will just give them it without questioning it??

Sent my appeal off with some brief details of why i was appealing , Had a Letter from DWP confirming that they received my appeal, and about how much ESA i will get until it's heard, But so far over 1mth since requesting the full written statement of the Atos wca Form IB /ESA85, But so far i have not been sent it, The person that i recently spoke with from DWP ,Confirmed that they could see that i had previously requested it, but could not understand why i had not yet received it, What can be done to force them to supply this info,(assuming it actually exists) ?

Hi, I use to have a royalmail account for posting items as I had a shop on ebay, i would send 500 items a month but 30 of them items would go missing and I would have to send replacement items out again. I have disputed the bill with royalmail but all they keep on saying is i need to pay the bill before they can issuse any refunds. I have refused to pay my bill of £2100 I sent all my items recorded the ones that have gone missing are still showing as in transit, I have proof of posting of the none deliverd items. the cost of all the items I have lost the double costs of postage add up to more than what royalmail are asking me to pay where do I stand if they attempt to take me to a civil court. Thanks

Hi there , i desperately need some help , i have received a letter from marston bailiffs stating that they will use force to gain entry and remove goods in order to pay fine of 600 pounds court fine ( fail to give information about driver identity ) sentencing date 19/06/2009 , i was not in the country at that time and received no letters no phone calls from the court since this happened , i also need to mention that i have moved few times from the address that i lived in 2007-2008 , in 2008 June i left Britain and returned on December 2009 the letter states Fine value 600.00 compliance fee 85.00 and attendance fee 215.00, please any advice will be extremely appreciated.

Hello all, I am new to this forum and need some urgent advice please, quite a few yrs ago I got into trouble for various motoring offences, I was unemployed at the time and the court fines I received were somewhere over £1000, because I was unemployed the payments were taken out of my social security payments then later my JSA and all was well, I started working a couple of yrs ago and had to make payments out of my wages (£5 pw as I'm on a low wage) my payments always got paid though not always on time sometimes I would pay every wk other times I wouldn't pay for a couple of wks then pay the arrears to catch up again and the courts seemed fine with this so I guess I became a little lax with my payments, over Christmas last yr, I knew I had gotten behind with my payments so I paid £30 (phone call, automated service) and thought I was probably up to date again, then yesterday a man from Marstons came round and issued me with a final notice unless my fines are paid in full he will remove my goods for sale sometime this wk, I didn't let him into my house although he asked and he left. I immediately called the courts but the man I spoke to was very unhelpful and told me to deal with Marstons, I asked him if Marstons could use a locksmith to get into my home and he told me 'of course, you haven't paid your fines' he also told me that the final notice letter had been returned to the courts (I'd changed address) which was my fault because I hadn't told them my new address. I called the bailiff who had visited me and asked if I could make payments, he said no and he'd be back this wk to take my belongings. Last night I found your forum and read for hrs but still not sure what to do next, called the court again today and spoke to a nice lady who told me even though I hadn't received a final steps letter it was out of their hands and I would have to deal with Marstons, I asked her how much I owe on the original fines and exactly what they were for, she told me the amount owing is £510 for driving without insurance x 2, keeping a motor vehicle on the road without tax and not wearing a seatbelt. Marstons are asking for £810.50 Should I carry on making payments to the court? beg Marstons for more time to pay or what? can they get a locksmith to let them into my house as my debt is from court fines (there seem to be many conflicting answers to this) do I have to pay the extra £300.50 added by Marstons? Don't know where to turn and I'm worried sick, any advice would be greatly appreciated, Many thanks
  6. i feel like im being a pain with all these questions lately. so ive came downstairs and found one of those "we called and you weren't in" leaflets from TVL. the time wrote on the card is 20.42 my question is,do i need to answer the door to them? i live myself with my kids,4 and 2 years old and i don't answer the door at night full stop unless i know someone is coming over.i honestly just about wet myself if my door goes at night and no one is meant to be visiting i fully admit that ive not kept up with the weekly payments because i simply couldn't/cant afford it. We've went without gas for nearly 6months apart from on a few occasions because i can't afford it so why would i pay them
  7. hi.. any advice please ..got home yesterday and found a card in door from an agent from moorcroft re HALIFAX..asking for total of 235.00 and please ring.. .i havent a clue what this is for. ..i used to have a halifax account about 2 years ago ..it was a basic account with no overdraft or anything. ..havent used this account for a few years. ..i know i didnt ask for a visit. ..and dont know what to do. ..i know also i will not be ringing him. ..as i dont want to converse with these....

RE: Outstanding credit card debt with vanquis bank Hi I recieved a letter from resolve call saying that if I did not contact their client Vanquis bank within 3 days they will send someone round to my house to discuss repayment offers. I phoned them up today and said that I have sent a letter to Vanquis bank today as I do not want to negotiate over the phone with them. I also said to them that I do not invite anyone from their company to my home to discuss this and if anyone does come around I will phone the police for trespassing. The women got very annoyed and said that as I have revoked the agreement under the CCA a third party has the right to resume collections as they see fit including door stop visits without invitation and that because I haven't spoken to vanquis over the phone she or they are sending someone round to the house to discuss this with me. she also said I should read the cca. Now I really don't want a doorstep visit I have an elderly father who lives with me and although I can shoo them off this will probably scare him especially if its some meathead they send round. So should I just phone vanquis and give in? Is she right in what she says?

I received this email 2 days ago and have no way of contacting them especially by phone on a charging number. They have no email to contact them on. I did set up a £50 repayment plan from 31.12.12 but was unable to pay due to work problems. I am in contact with Citizens Advice but don't have an appointment until Wednesday 9th Jan 2013 to get any payday loans settled. Is this email legit and will they turn up at my house this week?   11. How long do they normally take to investigate an error? I had savings over the £6k (about £2k over) for about 6 months. I did explain that it was because I borrowed the money so I could lock it up for 5 years to earn 6% interest PA. My account showed that money being paid in viA my dad, then paid out 6 months later.
  12. Flat mate had a letter from powerless 2 contact stating they would be making a visit about an account. He wrote the std letter withdrawing his consent for them to visit but they have ignored it and visited on wednesday just gone. However I went to the door and stated that I wasnt the person he was asking for. The p2c rep stated I must have been him as I came to the door. He didn't ask amy security questions or supply any identification and proceeded to discuss the account, arrears and tried to get me to speak to the oc on the p2c reps phone and take a payment. I told him I wouldnt be doing anything or even discussing the account and so he left in a huff. My flat mate is livid and has wrote a complaint to p2c and the ICO. However he is not happy with just doing that as p2c will just ignore the complaint and the ico are toothless. So he has issued a LBA for breach of data protection and intends to commence proceedings in 14 days from last wednesday. He want to complain to the OFT but I cant find the email address so does anybody have the postal or email address to complain to the OFT?.
  13. My son had a visit from two officers from TV licencing he did not have a licence in place and told them that he froze it back in September because he was going to Scotland which he did. He contacted them a few weeks back to reinstate the licence and was spoken to like a criminal, the guy was most unhelpful and demanded payment eventhough he asked for a payment card, he did not have any cash in the bank as he is on JSA. The guy was so rude my son put the phone down on him, being a hot headed person. Hence the visit, they asked for his reasons which he explained and they seemed to be quite understanding. But I have my doubts as they read him his rights and gave him a Tv payment card. Do you think it will still go to court? Any advise would be greatly accepted. Not sure where to post this? mashmallow
  14. Well these are jokers, the CCCS sent a settlement payment to them on the 20th of November. No word from Joseph xxxxxxx as to if this has been received despite 5 emails to him to make sure this is the case. I returned from work yesterday to find a letter through the door from "Ground Collect" stating i MUST contact them right away etc, I called MHB who say they have not received payment, CCCS confirm it was sent. Set of clowns down at MHB that's for sure. Would of loved to of been in when they came round, It would of been fun that's for sure. Id of been knocking on 2 of my neighbors doors who are police officers to have them removed from my property.
  15. MMF are trying to collect on 2 accounts, both Payday loans. I have sent several requests to MMF asking for proof of my liability to the alleged debt plus a full breakdown. MMF have continued to ignore my requests and have continued to send emails and letters with their usual threats of court and doorstep collection. I sent a recorded letter on Monday 26th November and was received and signed for by MMF on Tuesday 27th November telling MMF that ALL Communication MUST BE IN WRITTING by post, and no telephone, e-mail or text contact will be tolerated, Furthermore I expressly state that I have no wish to make any appointment for any agent, representative or employee of MMF Ltd to visit my home, should such a visit occur the person will be invited to leave failure to do so and will result in their removal using any necessary means. I have requested a full explanation and proof of my liability for this alleged debt along with a full breakdown of the alleged debt and MMF have failed to provide any data in this regard; therefore I do not acknowledge any debt to MMF Ltd., or any company you may claim to represent. I have also sent an email to Baranby Page & home visits with the same information which has been read... Fast forward to this morning whilst in the shower I heard a knock at the door and Ignored it. Through my letter box was 2x letters from MMF, hand delivered. The leter states "I have now been instructed to visit your property to discuss repayment. I am your local MMF Doorstep Agent and although disappointed that I could not meet you today, I am constantly in your area and a revisit can be booked. Why are these people ignoring me?
  16. Hi. Motormile have ignored all my emails to them so I took the details from their website and set up a standing order for £5 per month. I missed a payment last month so I emailed them to say I'd pay £10 next month to make up for the missed payment. I then received the following email - 'Thank you for your email on 19/11/2012. Due to the fact that you missed your payment there is a broken arrangement now, hence, further collections activity will incur on the account. MMF have reviewed your account and here are a few options for you to avoid any further legal action: Offer 1: we will accept 60% of the balance - £115.35 Offer 2: we will accept 70% over 2 equal instalments - £67.29 per month Offer 3: we will accept 85% over 4 equal instalments - £40.85 per month The above offers are available on the proviso: · The payment is made via debit card · The first payment is received in November · The payment plan or settlement figure to close the account is set up for a date in this month by Friday 23rd November 2012. Please fill out the below details in order to setup the arrangement, Please note that default interest may be added to the account which you will be liable for until a valid payment plan is put in place. So it appears that because I missed a payment, they now think they have the right to theaten me by phone, email and at my own front door.   17. Hi Each Had an odd request from my neighbour that she has received a letter for a home vist for JC+ via a customer compliance officer. Would this just be to satisfy a recent claim ? I have stated that as it is not being held under caution it is probably just to as I say to assess a recent claim, but thought I would check Andy G

Several weeks ago I received a visit from a man form Rossendales explaining that we had an oustanding Council Tax bill that had been passed on to them and they had a Magistrates Order to recoup the money. I agreed to send an income and expenditure breakdown and come to an agreement over paying it in installments. I filled this in and sent it back. Today a man appeared on my doorstep with a piece of paper explaining that I hadnt kept to the deal, and he was here with the van. He told me I have to pay over 1200 pounds or he will be back with the van and the police. I explained that its not possible, and said that I could get 300 tomorrow, and he said, that he'll take that and give me to the end of the month to come up with the rest or it will be van/boys in blue/bye bye furniture/car. The piece of paper is form Rossendales and not the court. I explained that I'd sent the paperwork back, and phoned the office and was told its not their fault, and that i should have either sent it recorded delivery, or phoned to make sure it got there. I asked if I have any recourse to appeal, and was told that the only thing I can do to avoid them coming back and forcing entry is to pay the full amount by the end of this month. He said he was "being nice" by doing this for me. I was quite stressed out at the time, and didnt want to get into a confrontation that might make him change his mind and take the stuff there and then, so I kind of capitulated and said I'd have the 300 tomorrow and see what I could do about the rest. Is there ANYTHING I can do to get them to take the installment plan? Their paperwork says: "No further arrangements are acceptable and payment is now required in full by CLEAR FUNDS ONLY." I was helped out over a mortgage issue by some of the guys here a few years ago, and hope someone can point me the right way...
  19. Hi all, On 25th May 2012, I received a visit from a TV License Officer. He proceeded to ask me questions about my TV Usage and set me up with a new TV License paying by regular installments. I signed the necessary forms, he handed over my new TV License card and left. I never got a copy of the form I signed and I never received anything after that from TV License other than my new TV License document, which I still have. I have now received a summons and the offense has been written as: On 23/05/2012 used a COLOUR television receiver without a license at the above address. Contrary to section 363(2) and (4) of the Communications Act 2003. Note, the date of the offense is recorded as 2 days prior to the visit. However, no proof was obtained on this date that I was watching a live broadcast of any kind. I have read through the form, which I signed on the day of the visit and have noted the following: Can I come in and inspect the set: NO Programmes Seen/Heard: NONE Channels Tested: 1, 2, 3, 4, 5 + Cable When did you last use the set for watching TV Programmes here? 2 days ago. So the reason I have highlighted the above particular questions is because: 1) He did not come in and inspect the set 2) He did not hear or see any channels being watched, the TV was OFF when he visited. 3) How could he test the said channels if he did not come in to inspect 4) I did not admit to watching Live TV Programmes 2 days prior. He asked when I last USED the TV which was 2 days prior. The form also states that I have a Cable Box with a basic Cable TV Package. This is true because I was subscribed to Virgin Media at the time. It was cheaper to purchase a bundle with them and get TV, Phone and Internet all rolled into one than it would have been to get Phone & Internet from a different provider. I opted for the basic TV package because I did not need a TV Package at all but it was a cheaper option than getting the two services I did need (Phone & Internet) outside of a bundle. This is the honest truth - I do NOT watch Live TV Broadcasts. My TV is used ONLY as an output monitor for my Laptop (which has a broken screen that I cannot afford to replace). I watch DVD's and use the computer via the TV Screen. Yes, I have a TV Set and Receiver Equipment that is CAPABLE of picking up TV Programs so I realized on the day of the visit that I do need a license and that is why I purchased one there and then with the man at the door. So my question is this - Taking the above into account, is it really possible for TV Licensing to prosecute me for watching TV 2 days prior to the officer's visit when: a) They were not present and have no evidence other than a signed statement. b) The signed statement they have produced is questionable based on the fact they say they tested the channels available to me when they admitted to not being allowed to enter the property to do so. Furthermore, since the property is now licensed and has been since the day of the visit. Is it really beneficial to them to prosecute for 1 instance of TV Usage? They aren't claiming a period of watching TV without a license, literally just 1 instance of using it on 23/05/2012. How much am I likely to be fined if the courts agree with them for this infringement?
  20. Hi guys, Today I received a visit from a doorstep collector from Robinson Way. I didn't answer the door because I thought it ws somebody trying to sell me something! She dropped a card through the door asking to call to arrange a new appointment etc etc It is in relation to a debt of over £1000 that I ran up with O2. I can't be sure of the exact dates that I was a customer of O2, but I do know that it would've been late 2003/ early 2004. There is no record of this debt on my credit reports from Experian, Noddle, or annualcreditreport.co.uk. I have no idea what the date of default was, but the earliest correspondence that I had was from 18/05/07. the million dollar question is, what do I do? I can reasonably assume that the account defaulted at the latest on 18/05/07, which means at most it will be statute barred in less than 7 months. Would this visit from them suggest that their 6 year limit is running out, or is it just a routine visit? Do Robinson Way\ Horwich Farrelly\ or 02 share information with credit reference agencies, or is there no record of it on my credit reports because it is already likely to be statute barred?   21. Hi Guys Any advice / help would be very much appreciated. A few weeks ago i returned home to find a hand posted brown envelope from a field representative from Scotcall asking me to phone him urgently on a mobile number. I have also had numerous phonecalls from Scotcall to my work mobile number which are becoming more frequent. As i didn't know what the debt was for or who for i ignored them. Tonight i was at work but my wife returned home from the weekly shop to be approached by a man from Scotcall asking for me, she explained that i wasn't in and didn't know when i'd be back. He once again left the same card and left. Am i right in thinking they are not allowed to do this, for one it was dark and my wife wasn't best pleasede to be approached by a big balding man wearing a high-vis jacket in an obvious attempt to look official. This time he had written the debt details on the card, its showing as £806.11 on a TOPMAN storecard which i had years ago (for my sins). This is an old debt that i stopped paying a few years back as with interest the debt just wasn't coming down. For example i think the original debt was for about £300, i paid £20 per month for over 2 years and a few years later the debt is now over £800. I appreciate that i stopped making payments but how i see it i've probably already paid back the original debt amount, its just the interest and lack of payments has now ramped up to a stupid amount. Where do i go from here ? Any help would be very much appreciated,
  22. Hello and many thanks in advance for any advice that can be given. In June 2006 I moved from my parents address into my own home (which I own with a mortgage). All of my finances were transfered to my new address without any exceptions. In 2010 I lost my job and started incurring some finacial difficulties and since then have accrued 3 CCJ's This last week a letter from county court was sent in my name to my parents address and today a bailiff knocked at the door. The letter was returned 'not at this address' and my father sent the bailiff packing with 'I very rarely see him' and 'we are not on good talking terms' I know that whoever is chasing has used an old address instead of a current one. Should I chase down the problem and correct the issue or an I better off letting the bailiffs do their own job and wait to see what happens? Many Thanks
  23. Hi everyone, First of all, I want to apologizes for my bad English, I'm Spanish. I moved recently to UK, my landlord told me that if I have a TV I must to pay the TV License no matter if you watch it. I only use my TV for playing videogames and watch lovefilm via xbox, the TV License website said that I don't need the license but I should inform them and then an officer comes to my home in order to check that I don't need it. Anyone knows what kind of questions they usually made or what they 'check'? My tv is very old and it even need a freeview device that I don't have. I'm a little afraid and I don't know if I should pay the licence, as my landlord says, or if I should said that I don't need it and receive the visit. Thank you very much.
  24. Hello, I received a hand delivered letter, from Newlyn PLC saying they had attended my property to "seize and distrain" possessions to satisfy my council tax bill. No one knocked on my door, this letter was simply posted through. I emailed Newlyn as soon as I received this, making an offer to pay, but they did not respond. Today I telephoned the office, and attempted to make payments. The lady I spoke to said that my offer was not acceptable, and they would be sending a bailiff to me today if I could not pay in full. I have ignored the telephone call, made an initial payment and set up a SO with my bank to pay this anyway. I have printed proof of these. My main concern is if the bailiff indeed visits my house, and I open the door to show them I am making payments etc, will they try to force their way into my home? Also I have a dog, who is friendly with people he knows, but will attack anyone he doesnt. When I answer my door, the bailiff will be able to clearly hear the dog, as he tends to attack an inner door like mad until I go back in my house. What will happen if the bailiff forces entry and my dog attacks him? Am I liable for this? Thanks
  25. Hello All, My 16 year old son was at home babysitting my 5 year old autistic grandson while his mother popped to the Doctors. A man came to the door and asked to speak to his parents and he explained they were at work. The Bailiff said and I quote "Well son, you need to get them on the phone right now as a van full of men are on there way round now to take all your goods" My son very very anxious ( he is a quiet shy boy ) stuttered that he dare not ring us at work he might get in trouble, but the baliff persisted at the door becoming louder each time stating over and over the men in the van were on their way and would take goods whether his parents were there or not. MY son explained that is was 3.50pm and Dad ( my husband ) finished work at 4 and would be here soon and the baliff just said "lets hope he gets back in time" My son came inside, burst into tears which set off my 5 year old grandson having a meltdown and my son and he tried to call us at work. I was in mweeting without my mobile, but husband managed to pick up his phone, finished work straight away and ran home. My husband seeing our son in bits and my grandson having a meltdown was very anxious and angry. He explained to the baliff the story ( see below ) but the baliff would not except ANY payment unless it was the full amount and failure to do so within the next five minutes meant he would clamp our car and that would cost even more. About the debt: Council Tax, 3 weeks worth £125 from last year which we did not realise we had missed until 14 days ago when the council tax people sent a letter saying they had passed to a baliff. We rang the council and they gave us the baliffs number. We rang the number but without a case number they could do nothing and the lady at the council said we would here about it in the post from the baliffs first. 14 days later, not letter from Baliffs but this visit that happened today. My husband today explained to the baliff that his wife ( me ) handled the bank accounts and he was trying to ring me to ask which bank to take it from, but of course I was in a meeting. IN the end, because the baliff was trying to clamp the car my husband rang our office and got someone to disturb me in the meeting. I Spoke to the baliff on the phone and trust me he was not listening when I explained we had received no letter. He said that everyone says that, and this infuriated me. I did not know at this stage how he had spoken to my son. I gave my husband the instructions on the account we had money in. Payday not until 28th we had only 340 left and the baliff took £330. I agree, I should have maybe tried to contact the baliffs again and again to say not recieved letter yet, but I didnt. I was not aware it could ge this agreesive. I know have my son so upset he wont stop shaking. My daughter has took her son home in complete frenzy and the whole family in shock. Can this happen?
