  1. Of course the private parking industry is really just a type of extraordinary rendition. In the same way that legitimate governments which are not prepared to get involved in torture or other unsavoury practices against people who they suspect of having committed crimes, but instead have them whisked off to countries which are far less scrupulous, the big retail names such as Asda, Lidl, Aldi, Morrisons, Tesco and the rest prefer not to get their hands dirty with the business of inflicting punishments on their ordinary everyday customers for minor infractions such as overstaying five minutes or 10 minutes in a car park for whatever reason so instead they get the private parking industry to do the work for them. The private parking companies are in the business of being hated. They're not bothered about their reputation. Their job is apparently to wage the proxy war on the ordinary customers of the big retail brands and at the same time to keep their big retail clients out of the picture so that the reputations and the goodwill of those big retail clients don't get dragged into the mud. If you have a look at this private parking forum, you will see that the name of the retailer who owns the car park is scarcely ever mentioned – pretty well never. Everything is focused on the private parking company and of course that means that there simply doing their job rather well. However, it has come to our notice that some of the retail names are starting to become a little troubled about possible damage to their reputation. If the victims of private parking companies were more prepared to focus on the retail brand behind the car parking facility as well as the private parking company which is operating on their behalf, it might help to force the big retail brands to face up to the damage they are doing to the lives and the economy of the people who are falling foul of Draconian parking measures. We understand that some of the retail brands are very receptive when their customers appealed to them directly to intervene in the levying of a parking fine by one of the parking management companies. Names which have cropped up in various conversations have included Lidl and also Morrisons. However, it is very likely that the others also do not want trouble and we feel that if you have become the victim of some parking fine which has been levied as a result of some insignificant infraction of some alleged contractual terms and conditions, that it would be worth your while writing to the supermarket or retailer concerned – at their trading address (meaning at the car park address) with a copy also to the head office complaining about what has happened and asking for them to intervene and to have a parking fine cancelled. We think that it is very important not to let the big retail brand clients benefit any more from the extraordinary rendition trick with their reputations are preserved even though at the end of the day, it is they who have decided to employ the private parking company. If you have received a parking ticket then you should write to the retailer both that they local branch as well as the head office

Hi all, I've looked through and tried to find a similar case, and was wondering if someone could help shed some light on the issue I detail below: 1 - my wife received a letter stating a £65 private parking charge from NGP (New Generation Parking) for supposedly parking in an unauthorised area of Capital Retail Park (Cardiff) in October/November 2012.......subsequently ignored the letter as per instructions elsewhere on the web. This letter had been sent to an old address for my wife. 2 - received a letter from DCBL saying they had been instructed to claim the 'debt' by NGP, and had added charges so the new sum 'owed' was £180. This letter had been sent to an old address for my wife. 3 - as my wife had not received the letter in point 2, we were not aware of the charges/actions, and have recently been sent another letter stating (something along the lines of) ''as all attempts of contact have been ignored, more charges, now totalling £340 are payable immediately to DCBL, or they shall instruct their client to file for a CCJ. If possible, could someone please advise on the following points? 1 - What right do NGP have to chase the debt and what proof do they need to provide? 2 - My wife's name is spelt incorrectly (2 letters different) on all correspondence, is this a 'strike out' and therefore unenforceable? 3 - My wife has changed her name, as we got married in the 2 years during the time where there was no contact from NGP/DCBL. Should either/both parties have conducted any relevant identity/address checks? Again, can this be struck out and therefore unenforceable? 4 - My wife sold the car around 18 months ago, therefore she is no longer the registered keeper, is the 'debt' therefore enforceable? 5 - Are DCBL legally allowed to add on £275 in charges if they are now returning to NGP and advising them to try and obtain a CCJ? 6 - Would NGP/DCBL be successful in obtaining a CCJ if (as per above) my wife has changed name, address and sold the vehicle? Sorry for all the questions, am hoping that I've covered all the points and some of you experienced people will be able to help! Thanks
  3. Ok, so first of all please feel free to re-direct this post of in the wrong place. I am relating this to the new consumer rights acts 2015 and how this may be used We bought a new car in a private sale at the weekend, the car was described though an advert we still have a copy of. We took the vehicle for a test drive, though very busy so only had a chance to drove a few miles and all appeared in order, we paid cash for the purchase £7500 and the we have a receipt, which just states for the sale of x registration etc. Once we got the vehicle to a garage for a fuel, it would not restart and then did with a big judder, but seemed ok, we got home dropped in the shopping when to move the car same problem. After speaking to the local toyota garage they believe without doing a full diagnostics which I will arrange for later this week that it likely to be a fuel pump problem, as hot starting only,and the cost is £1000s. So we emailed the seller, who said yes it did have a problem but never bother them, they also said took to local garage who said might be this or that (did not mention what a main dealer has said to us) but never got sorted. In any event it has a problem that was known to the seller that they did not disclose. Of course if this was a garage sale I would have more rights, but my question is, as the private seller has confirmed that there was a known fault but did not disclose this, I have challenged this my email but no response, do I have any protection at all. my email seIf so what are the next steps, what are the options?
  4. Hi, I am a new member and this is my first post. There is something that is bugging me for few days. I am studying in London Middlesex University, and free parking is very limited. There are only 3 short streets half a mile away from the university, which are unmarked. As the parking space is limited, sometimes many park outside the pavement, on the grass and the platform I marked in the street view outputs below. 2 days ago when i was looking for a parking, I saw a guy with an unmarked vehicle writing ticket to all the vehicles in the platform and the grass. But ignored the vehicle parked on the pavement. Also I saw a no parking sign on the wall,which was not there before. I can understand that the platform can be a private land (which I doubt), but can a company issue a private ticket to vehicles parked on the grass. Isn't the grass a council land? Would you be able to advice me whether it is unlawful or not, as every day tens of students are getting ticket at this area. I have uploaded and marked the points in question.   5. Hi there Caggers... Debt Recovery Plus are the latest people trying to swindle by sending me letters such as the one attached. I park in this Excel car park at least 3 times a week. Last week in May 2015, they dotted these small notices around the car park saying that the cost to park was going up by 50p. Of course the signs were so small, hardly anyone saw them and then they did a massive swoop looking for all of those poor people in the carpark who had not seen the sign and paid £2.50 like myself. No intentions of paying them because they are con-men and stealth tactic was devious. I wrote to them saying that I know my rights and that the PCN is an invoice to pay, they do not have the right to prosecute me, it is down to the land owner, etc .. and then wrote me this letter. I'm growing weary.. can they do anything? and is there anything else I can do to help them get the message that 'I AIN'T PAYING IT' because at the moment they ain't listening.
  6. Hello, Earlier this month, I was arrested in Central London for drink driving. I had attended my cousin's wedding reception near the Old Bailey and as is typical of the limited parking options in the city, after a tedious and lengthy search for parking places, I eventually managed to park my car a considerable distance away from the venue and walked to the event. Later that night when there were parking spaces available at the venue, I went to get my car so I could park it there. As it happened, and not being that familiar with that part of town, I ended up taking a wrong turn and in no time at all got lost and was struggling to find my way back. Unfortunately, I got stopped by the police, was breathalysed at the scene and ended up spending the night in a police cell, having been charged for drink driving. My reading by the way was 75mg. I had never been in any trouble with the law until this incident. I now have a court hearing in just over a week's time and I'm desperate for advice on whether it is worth seeking a private solicitor or simply use the services of the duty solicitor on the day. Secondly, if the general recommendation is for me to employ the services of a private solicitor, could anyone recommend some solicitors who aren't too expensive to use? Finally, what sort of punishment can I expect to receive for my offence if found guilty? Thank you.

Morning all after some advice as to what my daughters rights are regarding a privately rented flat that is suffering from extreme mould and damp, this has left the 2 bedrooms as uninhabitable and she is having to live in the living room. The property maintenance company originally said it was condensation but the letting agency sent around someone who confirmed it is caused by damp. She is now stuck in a property that she cannot use half of and paying full rent with £1000's of personal furniture and clothing ruined. Would it be worth with holding rent? who would we claim her personal belongings that have been destroyed? any advice would be gratefully received
  8. Hi, I bought a £3 all day parking ticket for a Link Parking maintained carpark. The ticket moved when I closed the door and flipped up side down displaying the blank side (back of the ticket). I received a fine for this (£60 now or £100 if left). I followed their appeals procedure and was rejected, I appealed to IPC who sympathised but also rejected. Is there anything else I can do?
  9. Hi, Decided to post here as after googling ANPR it seems a lot of people here have relevant experience. Went out Sunday morning to find a ticket on my car. I live on a private road (with what I believe are ANPR signs at regular intervals). The ticket says I was parked on double yellow lines in the early hours. I checked their website and the photo they have as evidence doesn't show my wheel over the line (of course there may be more photos?) - I didn't read the ticket until after I'd driven off but I believe my wheel was actually passed the end of the lines. There are no bay markings. I would like advice as to my next course of action. Should I write to them and ask them to prove it first and send me proof that they work on behalf of the land owner? Ticket (all details correct) and 'evidence photo' attached but censored in case they are watching. Many thanks for looking! EDIT: Forgot to mention, my car is leased so cannot risk a Notice to Owner.
  10. I was in dispute with Private Parking Company about a PCN. The last I heard from them was in February after a Letter Before County Court Claim was sent on 31 December 2014. I was away during August this year upon return from Holidays received a Judgement for Claimant (in default) which the Parking Company had filed during my absence and thus I could not file my defence within the 14 days statutory period. I can apply to get the Judgement set aside but there is a filing fee of £155. My first question is if I do so and get the subsequent judgement of the case by the Court in my favour can I claim back the application fee for setting the initial judgement aside? If not, there would be little point as the fee and the claim they won are similar amounts and I will end up out of pocket in any case. I intend to write to the site owner and complain about the underhand tactics of this firm that they employ but am not sure if they can force the Claimant to to withdraw their clam at this late stage and thus avoid any further costs? Is there a procedure for withdrawing a claim once a judgement (in default) has been issued by the Court?

Hi all Wondering if anybody has had any dealings with 'Private Parking Appeals Limited' I bumped into them via Parking Cowboys when intially researching my response to a PCN/NTK (as explained in my thread 'Owner/Driver left the site'). I 'knee jerked' somewhat and paid £18 to them to take the appeal process on as promised on their website and make the whole thing 'go away' That was on 22nd Aug. I've not had any response. Even after sending several emails inc via their website and a couple of phone calls to the message service. Are they legit?.... or more [problematic] on the make? Cheers
  12. Hello I was wondering if anyone could give me any advice. A few weeks ago I parked at Brockholes Preston and it was one of them number plate recognition places where you type your registration number in to pay on leaving. I made a bit of a hash of the first attempt so I cleared it and typed it in again. The parking charge came to £2, we paid this and left. Last week I received a non payment of parking letter from the private parking company (Park with Ease) saying that I owe them £50, or £25 if it is paid within two weeks. I have since contacted them, I stated that we had paid for our stay on that particular day and that we should not have a 'non payment parking charge'. They have replied, they state that we had not typed our full vehicle registration into the machine which resulted in us only paying £2 instead of £2.35. The thing is I was at the same place two days earlier, we had no problems and paid £2.70 for our stay. Do I have a leg to stand on by not paying this charge? Is there any avenue I can go down? My case doesn't seem to come under anything POPLA deal with, or what I've read about other independent agencies either. Legal thieves!
  13. hello I was given a parking ticket from a company called TESGB 2 weeks ago, the fine was issued to the wrong number plate (confused x by k). In the first place the fine was unfair as i parked my car at the bank's car park and before taking my child to the toilet (there were no toilet facilites onsite) nobody made me aware that i could not leave the premises but even then there has to be an exception to the rule as the bank does not provide facilites. My husband suggested i should write to them to clarify the issue and informed them that PCN was invalid, then i received an email advisiing me that they were going to re-issue the PCN to the correct car and I have now received a letter informing me that my appeal has been rejected and that i have to pay. could anyone kindly provide advice on this?
  14. Hello all, as a newbie to the forum please bear with me. Here's the situation. In march 2015 I was issued with a parking ticket for parking outside the gates to my apartment complex. The reason I parked outside and not inside the gates in my private space was that the electronic gates were broken and it was nearly midnight. I parked in of the two visitor bays and went to move my car back in in the morning, by which time a ticket had been submitted and the gates were fixed. I appealed to the company but they told me my appeal arrived too late and that the matter would have to be passed on. Currently my fine is with a debt recovery firm who are now demanding 160.00 or I face court action. I spoke with the debt recovery firm but they told me the best they can do is take a reduction in the fine. I feel really aggrieved by this even though I know I am not without blame for appealing a little too late ( a few days ) but I am so annoyed that it was because of the broken electronic gates ( which are always breaking down ) that I must now face court action or a large fine . If there is any advice anyone can offer me I would be very grateful. Kind regards.
  15. Please could I seek some advice, my wife was visiting friends today who live in a private block of flats. The flats have parking for residents, and a number of specific visitors spaces allocated. My wife parked in one of these visitor spaces and when returning to the car, after around an hour, found a ticket attached to the windscreen with a fine for £100 (£60 if paid within 14 days). While our friends have a parking permit for both cars, they were unaware that visitors needed a permit on display, and have lived there for many years. We're seeking advice from another neighbour, and a friend who also lives in the flats to see if they were under the same understanding (or lack of). The signage in the car park does say private property, permit holders only and spaces only for residents or visitors. What I would like advice on is whether, if residents are unaware that visitors need permits on display, and for years all have had visitors using the visitors spaces without fines, whether the fine is enforceable? Does the parking company (or owners of the flats) need to make a certain amount of effort to make the residents aware of the rules regarding visitors / how to obtain visitor permits? thanks in advance, David
  16. Hi, I work for a housing association and we have a car that has been dumped in one of our car parks for over 6 weeks. We do not believe the car is owned by a tenant and it is SORNed. The land is owned and maintained by ourselves however we have been unable to identify the owner of the car. Can anyone advise what we could do to get this moved?
  17. Hi Guys, Hope someone can help me with this one. CAB were not much use. I purchased a used Heat Press from a guy in Scotland (i am in England). I asked the questions i needed answering , does the thing do what it's supposed to do. He emailed saying yes it was in perfect worker order. I bought it, it arrived next day, plugged it in and......no heat. I informed the guy straight away and he said he would sort it. I said a repair (at his cost) was exceptable or a refund. He then contacted the manufacturer and emailed a mail saying it was "all sorted" with the company to send it to them and he would cover the cost. Luckily, i didn't send it. I emailed the company and asked what the guy had "sorted" with them and they said just the £25 shipping charge to collect from me and drop to them ! I emailed the guy back and said this wasn't exceptable to me and could i have a refund or repair. No, he decided to claim off the courier despite not having purchased additional insurance. They said no and offered standard £20 compensation which he then said he had paid into my paypal account - he never did. I again said this was unacceptable and would accept a repair (at his cost) or a refund. A lot more waffle went under the bridge but the crux of it is , he won't refund or repair. How do i stand on this ? I made sure i asked the questions BEFORE i bought it. Surely i can't be held responsible for the damage when the item never worked at all. Any help appreciated as i want to file a small claim if i have the right to Cheers
  18. Hi everyone, I'm not sure if this is the right place for my question, if it isn't if anybody knows where I'm best asking I'd really appreciate it. I've already rang citizen's advice who put me through to Shelter but every time I call there are no advisers available and no waiting to get through to someone. As basically as I can put this; I'm 21 and inexperienced in renting, I have an almost 2 year old. I viewed a private property to rent on the 12th May, paid 150 plus 30 VAT to "secure the house" and for admin fees (Entwistle Green originally wanted 260 but we talked them down). I was due to move in a week later, the day before I was due to move in Entwistle Green rang me to say they have to move the move in date to the 28th because the landlord has had to order a part for the boiler. When we went to view the house there was nothing really too bad about it except previous tenants small graffiti on the front of the house and missing garden fence panels which the lady said would be sorted before we moved in. We finally got the keys at 6pm on the 28th May, excited to get all our furniture in and live there until we got into the proprrty. The kitchen had been trashed, the house was a mess, only half a boiler was there and there was no gas supply. We have already paid deposit and 1 months rent in advance, and its now the 5th and we still can't live in the house, the whole thing has been a nightmare. I was wondering if I have to pay rent for the time that there is no gas supply and I can't live in the house with my son. by no gas supply I mean after us viewing the house there was a break in with no forced entry according to the gas contractor where the boiler was ripped off the wall, the kitchen damaged and the gas metre pulled off the wall outside in the side place. National grid won't fit a metre because the gas box is damaged, we've had a nightmare trying to get the landlord to replace the box, which he's finally told me that it will be delivered on Tuesday 10th and then it could take up to 11 days after that for national grid to come back out and a gas metre. Do I have to pay rent when I can't live there with my baby?

Hello all, its been a while since I had to come on this forum but I feel I need to come and ask you guys for some help once again I don't really know where to start as I could write pages and pages on this issue but I will keep it as short and sweet as possible, here goes.... I am a member on a certain car forum and a member had a car up for sale which I purchased, however the car did not arrive as was promised and did not have the refurbished alloy wheels stated in the original sale thread along with other smaller items. on delivery of the car he stated he had 3 wheels on another car that he would refurb and deliver to me and if I supplied him with an alloy off my car ( I have another one of these particular cars ) he would do that also... meaning that I would now have the full set of refurbished alloys that I should have had from day 1 ( putting 1 wheel back on my car )..... lost yet ??? Short version is I am 4 refurbished wheels short as per advertised on original sales advert with no sign of getting them back as for the past six months I have had nothing but excuses and being ignored. I am thinking of taking this guy to a small claims court as not only was my purchase not what it should have been... I have pretty much had one of my wheels "stolen"...... just wondering what your thoughts are...... I could go a lot further into detail but it may be even more confusing for you all but the more questions you ask then the clearer im sure it will become . Regards
  21. hello peeps, this is my first post - hello! I have a question: I drove my wife to a specialist doctor in London. 5 weeks after her consultation, we had a letter with an invoice for £290. The initial consultation lasted about 25 minutes. At no time was it explained to us that the initial consultation would be chargeable - so , of course, there was no mention of the price of the talk. We would not have driven to London if we had been informed of the price. Now the invoice has been followed by demanding emails and a call from a medical debtor agency - not answered by me . Since there was no prior information on the cost of the first visit, can anyone tell me what our legal rights are? An offer of £50 for goodwill has been rejected so far. Thanx!
  22. This morning when I was leaving the car park of an industrial estate the gates weren't secured and the wind caught them and swung them into the side of my car. There is a fair amount of damage to the bodywork. Does anyone know whether the owners would be liable? There is CC TV evidence.
  23. Dear all, on the date of January 21st, 2015 i visited a friend in London to which i had to park my car within the car park provided. I could see that signs were posted stating permit holders only. I had parked my car and proceeded to go inside to my friends room to obtain a visitor pass however once i cam downstairs i had a parking ticket on my car. I was furious as i was only gone a short while to obtain what was required to park my vehicle there in the first place. The date today is 15/04/2015 and i have just received a 'Parking charge notice' from a company called TNC parking services stating i owe £100 for this 'offence'. I have pictures of my car with the ticket on it and with a visitor pass. The letter i have received from TNC parking services states they are acting on behalf of their client P4Parking uk ltd. it also clearly states all parking charges are placed on hold upon receipt of an appeal. Furthermore TNC do not accept appeals as they did not issue the PCN and that all appeals should be made in writing directly to P4Parking within 28 days of this letter. If the appeal is unsuccessful then i would be provided with the contact details of the Independent appeals service (POPLA) with a unique 10 digit verification code reference. Could someone please advise me on this situation as i feel i have not done anything wrong and should not pay £100 for this unfair ticket. Thank you all for reading this post! Kav

Hi, We rented a property during 2013 for £695 per month, in the contract it stated about the renewal and the increases would be 3% making it £715 for the second year etc. Anyway. the landlord at the expiry of the first year term decided not to issue us a tenancy agreement via the letting agent but instead use one of the templates purchased from Staples. This year he has decided to go back using the agent and now wants £750.00 per month. 1st Year £695 2nd Year £715 3rd Year £736 (Landlord now wanting £750) so my question is this, the first agreement was a fully detailed contract which stated the 3% increase per renewal. the second contract was so basic it was just a 1 A4 Page with no mention of the 3% now i suspect the new contract from the agent will again contain the 3% increase. so basically by the landlord not giving us a new contract last time which is the one issued by the agent, Can he now put up the rent to what ever he wants?
  25. Hi all, Bit of a weird one but I am sure you guys can offer some solid advice. I was leaving a private car park of a retail shop, as I was leaving I went through what only can be described as a crater. The crater was taking up a full parking space and was filled with water. I've driven through it, ripped and scuffed all the underside of the car and cracked the bumper in a few places. It's nothing massive but still annoying and was wondering where I stand in regarding claims etc. It'll probably cost £200 (guesstimate) to get fixed. I was thinking of finding out the land owner and contacting them, then going from there really. Do I have any legal grounds or am I knackered? Cheers.
