  1. Hi recently SAR Barclays and have received a list of documents from them, can someone give me an idea as to what they should have sent me. They have sent me a print out of statements which point out telephone calls made to house and late payment charges going back 6 years dont seem to see any T&Cs included. I know I have had an account longer than that, is this all that they are required to send me, any help would be appreciated.
  2. I made a standard CCA application of Santander in respect of a current account, originally with Alliance Leicester following an online application in 2006. I got a fairly prompt response returning my £1.00 and making the following comment: " ... we have now completed a search of our systems and can confirm that this account was not regulated by the Consumer Credit Act and therefore does not have a credit agreement. ... " As a further check I then made an SAR for everything relevant. After an inordinate delay Santander sent me maybe a dozen pages of copy statements saying that that was all they were obliged to provide. I spent an interesting two or three months arguing with them, being told that that really was all required, that they hadn't had my application, that they had had my applicatin but I needed to repeat it and enclose anoher £10, that I hadn't included a cheque, and more such nonsense so I made a complaint to the Information Commissioner as I'd already threatenend. This eventually produced a thick wad of stuff and a letter saying that as a matter of goodwill they were making this so-called second supply available to me free of charge! Clearly I then searched the bundle very carefully and there is indeed no sign of any agreement although copies of both my original CCA request and the bank's response are included. I've earlier told Santander that we're in dispute - this is mainly around unreasonable charges (such as £140 for exceeding the agreed OD by around £3) but also issues around their management of the account and ignoring letters, instructions and the like - but although they initially paid no attention to that, bringing in their own tame debt collectors (Moorcroft) and flooding me with letters demanding full repayment of an inappropriate sum, at least they've now quietened down. Is there any validity whatever in the claim that such an account would not have been regulated as they claim? And presumably with a copy of the agreement they are, at least for the moment, stuffed both as regards enforcement and negative reporting. Thanks.
  3. My OH had a unsecured loan with A & L in 1995 in which she settled early but recalls that in order for her loan being successful ppi was added. It wasn't a large loan but nevertheless she paid monthly ppi premiums for about 3 years. The problem being is that she cannot locate the original agreement details but does have a couple of letters in relation to early settlement and rebate figures with loan account number and old address details. So she sent off the usual SAR letter to Santander and has now received the attached response. Has anyone received one of the same or is it the usual Santander reply letter ? Cheers

  5. Dear all, The Friday before last (4/7/2014) I went to make a debit card payment for dinner with clients and the transaction declined. I checked my account on my phone (Barlcays App) and my two barclays personal accounts (current and premier) 4 savings accounts and 2 business accounts were collectively showing to be overdrawn by £5,000,000. On 7/7/2014 all available funds in the account were sent to reconcile to Coventry OPS 05 ADV. I logged a formal complaint on (4/7/2014) and after countless calls to customer service advisors who gave excuses ranging from a technical error to an account review and no resolution I sent an email to senior executive at Barclays. Later that day I was contacted by a member of the Barclays customer relations team at their Head Office in Canary which was on Thursday of last week (10/7/14) however he has not been of much help at all, he has not provided any clarity as to what is going on or any time frames as to when I can expect to have my funds released. I have gained an understanding myself and believe it is a Suspicious Activity Report (SAR) that has been filed to the National Crime Agency (NCA) or similar however I have nothing to hide and although its been a good year for business everything is above board and I do not understand why they can't simply ask me for clarity... This freeze on my accounts/blocking of funds is causing serious problems for me and those dependant on me/my business. I was wondering if anyone has experienced a similar situation and if so when the issue was resolved and if there is anything I can do to speed up the process or any other information that might be helpful. It's so frustrating being in the dark and having hard earned money taken away from you with no explanation ! Thanks.
  6. Hello, Just wondering whether Swinton Insurance would have records of myself contacting them in 2007, 2008, 2009 & 2010 - both by telephone and letter. As this is such a long time ago, I am not sure whether it is worth me making a Subject Access Request with them. Hi Just after some opinion I had a HBOS current account that has been with Wescot and has now been sold to 1st Credit Arranged payments were being made on it until about Jan 2012 In my many correspondence with Wescot , amongst other things they claim that there was never an OD facility on this account but when you consider that for most of it's life there were periodic debit balances of over £100 and no charges that is easily shown to be a lie. Anyway it was sold to 1st Credit so I wrote asking for the statements etc that they should have been sending me. They have come back with statements from opening until Sept 2011 . The odd thing is the final statement says 25th August 11 balance -716.10 12th Sept closing balance £00 but nothing to show where that money went The summary sheet also shows closing balance 00 and £444 of fees paid Since that date a further 6 monthly payments of £1 have been made which reflects in the balance The account number in question is definitely a current account with cheque book etc but the final pages refer to it as being a cardcash account. Now I did also have one of those but a different number. Has anyone any thoughts In summary they are chasing me for £710.10 but the statements show a balance of £0. The statements refer to it as a current account but the sheets relating to charges etc refer to it as a cardcash It seems to me that they have no idea what is what
  9. Hi All, My dad has today received his SAR response from Barclays of which I am going through for him. Your help will be greatly appreciated in answering my queries. 1. On the Prequal PPI under BID policies my dad has one for First Plus, does my dad complain to Barclays about this? 2. On the retail account details it lists Barclay loans plus the First plus loan mentioned above and 2 monument visas. My dad had 6 loans with Barclays some with PPI. The Barclay loans show a "Y" or "N" under the account PPI Flag section, but the monument visas and first plus loan show "I" under PPI flag. What does the "I" stand for? 3. If my dad did have PPI on the monument visa which was sold to him in branch at Barclays, does that mean he complains to them and not monument? Thanks in advance
  10. Good Afternoon, Apologies if this is in the wrong forum. I'm about to send off a SAR with regards to a problem with AMEX and Allied International and a breach of DPA, amongst other issues. Allied International are purporting to be representing AMEX as an agent and as such are effectively working on behalf of AMEX. With this in mind, will a SAR sent to AMEX be enough to gain access to Allied International actions taken on behalf of AMEX? Thanks in advance.

    Apex and Egg

    I had an egg loan sold to Apex credit. I sent them CCA request 3 years ago and they replied with a CCA. However I have never paid them and they have never chased me. I am trying to sort out finances at the moment but am wary of phoning them after all this time. Does anyone know why they have not been in contact ?

Hi can anyone help me, I have sent a SAR request to HSBC, I used the following address: HSBC Bank Plc Service Quality Team Arlington Business Centre Millshaw Park Lane Leeds LS11 0PP I sent the letter Signed for delivery with Royal Mail. My problem is when I track the letter on royal Mail it says that they (RM) have the letter, does that mean that no-one signed for the letter at the address and it is sitting in the Post Office. Is there another address I should be sending the request to, how long will I be expected to wait for the information? Grateful for any help!
  13. Hi I wonder if anyone can help. I have various CCJ's which are being paid and a recent check on my credit file shows that all my previous old defaults/CCJ's have disappeared since it was more than 6 years since they were applied. One particular one is a credit card from Halifax which is for £5.5k. It was only ever defaulted and I am now starting again to receive letters for settlement. Over the years this has probably been passed on and I recently received a letter from Marlin who were appointment by Cabot Financial. I ignored this and they have now passed it onto Reston’s who are threating court action. One thing to note here is around this time in 2009 I did contact the CCCS to start a debt management plan and only ever made 1 payment to them. I am unsure who the CCCS actually sent the money to but I am guessing they split it over all my creditors by apportionment. My question is because this payment was made, is there any point writing to Reston’s saying the debt is statute barred? Would I be wasting my time as they will have a record already of the last payment being 5 years ago? I am tempted to just ignore the Reston’s letter but I have a feeling they will go for a CCJ. Any advice would be most welcome. Thanks

  15. DX suggested I create separate threads for two PPI claims - this is the first for Blackhorse. I received a response to my SAR within a week of sending the SAR. I can't really work out what I'm seeing in the documents PDF attached. I've tried to be very careful to remove all identifying stuff from the documents before uploading. It seems I took out a HP Agreement for a car and PPI was added and that I paid this for 9 months and then the HP agreement was converted into a standard loan with Blackhorse / Lloyds. I'd be grateful if anyone who understands these agreements can take a look - there are some alarming figures. For example, the original price of the car was £14995. I paid a deposit of £4100 and with PPI, charges for credit etc the price was back up over £20k I'm not even sure this loan was properly constructed. It's all paid off now but I want to make sure if there is anything I should be claiming, in addition to the PPI in the first 9 months that I'm not missing something. The statements in the attached PDF do not show the first payments but they were made. I think I seem to have paid 62 payments instead of 60. Any advice would be gratefully received.
  16. i have a debt from welcome that was sold off to lowell and got a few grand outstanding on there. welcome were absolute dicks to be so in no rush to pay it off now ym default has dropped off. so instead of the £200+ a month i was paying them im paying about £25 to lowell at the moment.
  17. Hello, I sent SAR request to Lloyds giving them all detail that I think they would need and I notified them in SAR request about recent name change, attaching copy of my deed poll. They wrote back to me saying that I need to send them an original of my deed poll (I changed name back in January) and returned all documents I sent to them with my SAR request, yet they haven't returned the cheque. What do I do now? I don't feel like sending them originals and from all the info I already provided they should comply with the request.
  18. Hi all, As suggested by other members of here I am trying to get a default removed if possible that Next has set on me back in 2012, even though at first they denied it. I have tried all the begging letters without success and I'm hoping that from the contained SAR info that something is a miss. I have noticed that the debt collection department letter and the signed credit agreement letter are for different address's, this change anything? Also as you can see I haven't signed anything and NExt state that they're not obliged to provide a copy either?!?! Any advice and help as what to do next would muchly appreciated Thanks in advance
  19. Hi hope someone can help. I had a CPP for the above in which I have been successful in reclaiming. The only thing is I have today received a statement and Barclaycard have deducted protection amount owed from balance, Tax amount and also the simple interest amount ? The card was suspended a couple of years ago (due to another barclaycard account that I had problems with) and I always make the regular minimum monthly payments that are due on this account. I have had no contact from them regarding what they have done or any further contact from Card Protection Plan Limited. Is this correct what they have done as I thought that any interest less tax should have been returned to me and not applied to the account ? Its not a large amount but its the principle of the matter that concerns me. Apologies if I have posted under wrong section.
  20. Firstplus has returned our SAR letter together with the cheque and proof of address we sent. Their cov letter is asking my husband to provide authorisation to disclose information relating to me. It also says they will respond "....in any event within 40 days." Can I send them a fresh 'joint' SAR? With both our signatures and copies of our proof of addresses etc with a fresh £10/- cheque?
  21. Hi, Can I get some advise here please? Paypal have been messing me around for a while and placing random hold on money that I receive from ebay sales without ever giving any reason. So I have sent them a SAR request which they firstly said they don't need to honor as they have no UK based operations - now they are saying they will provide all the information on me however will not disclose any internal notes about me and in particular they will withhold the "judgement" on why money was help due to that information being confidential. Is this right or as they having me on? Thanks Scott
  22. overdraft: Account opened: July 1997 Last payment: September 2010 Current balance: £2000 Status: Gone away credit card: Account opened: July 1997 Last payment: August 2010 Date defaulted: Feb 2011 Current balance: £6000 I have an overdraft and crdit card with HSBC, it was a young savers account and converted to student account and then joint account over the years. I think that opening date of 97 was the student account but Im pretty sure the same account number existed since the 80's. I lost my job and used the overdraft to make a mortgage payment, my credit cars which was high was also run up further while i looked for work, then when I did find work I found my monthly salary wasnt enough to get me back to £0 on the overdraft and things spiralled. I opened a new bank account and then wrote to HSBC explaining my difficult situation and basically have heard very little since, especially on the overdraft. I also have a credit card that I sent the CCA and SAR letters and did eventually get a large box from the SAR request, but they admitted that they held no agreements to satisfy the CCA request. They attempted to open a case in he bulk Northampton court but it was thrown out when they failed to provide the evidence required in time. I have had the usual letters from Metropolian and DG Solicitors but I am unsure of what to do if anything. I have been saving with the aim of making full and final settlements to all of my debts but I owe close to £40,000 in total and Im not sure how I should prioritise.
  23. I have an old catalogue debt that I am planning to SAR but there is a discrepancy between the balance at default and the balance that was passed to debt collection agency. I have it in writing from the collection agency that this is not something they have done, they have not added any interest etc on to my account and I have all the statements from them which clearly show this. So I was wondering if I should edit the SAR letter slightly to ask what the difference with the balances is? Or will that be evident in what they send for the SAR anyway? My current balance is less than this difference so if I can find out what this is and claim it back it will be one debt cleared!

  25. Hi friends, I had taken out a £15k loan with Lombard Direct back in 1997 (fully paid off). I have been saving all my bank (Barclays) statements. Wanted to know if PPI was charged on this loan and had sent an SAR on the 21st of January 2014. Its the 6th of March and the 40 days period has clearly expired. I also know that the £10/- cheque I sent with the SAR has not been en-cashed. I am planning to give them a couple more days before I post the LBA (DPA non-compliance letter found in the templates section of the forum). My questions : 1. I hope this was the right address to send the letter to : Lombard Direct Loans 1 Hardman Boulevard Manchester M3 3AQ 2. I also hope its still Lombard Direct Loans that we should write to and that its not been taken over by any other company. 3. I have moved 3 times since 1997, should I provide them proof of my new address together with my LBA so that they do not get a chance to breach the time limit? Thanks Autumn
