  1. Hi, I received a claim form from HPH2 for a Barclaycard debt of 2002 for £7476. I sent MKDD two CCA requests but no reply and now the HPH2 has issued the claim. I have two questions which I hope you guys could help me with. 1. Can the HPH2 enforce a credit card agreement which was taken out in 2002? 2. They are claiming interest, if they are successful, then is the interest COMPOUND, or Simple? Thanks
  2. Hi Just received 2nd county court Claim form, within 2 days of each other, have another thread running for first one. Its from County Court Business Centre Northampton from the above claimants for an old Barclaycard debt that goes back to early 90's that was passed to MKDP and then Hoist Portfolio Holdings 2 Ltd, the debt collectors managing it are Robinson Way. The claim was issued on 04/03 The POC is as follows: The Claim is for the sum of £4710 in respect of monies owing under an Agreement with the account no. XXXXXXXXXXXXXXXX pursuant to The consumer credit Act 1974 (CCA). The debt was legally assigned by MKDP LLP (Ex Barclaycard) to the Claimant and notice has been served. The Defendant has failed to make contractual payments under the terms of the Agreement. A default notice has been served upon the Defendant pursuant to s.87(1) CCA. The Claimant claims 1. The sum of £4710 2. Interest pursuant to s69 of the County court Act 1984 at a rate of 8.00percent from the 24/06/10 to the date hereof 2076 is the sum of £2143 3. Future interest accruing at the daily rate of £1 .03 4. Costs Total Claim over £7363 I sent barclaycard a CCA Request few years back but only ever received their T&C. I have gone on mcol and done a AOS with defend all. I have also sent CPR31.14 to Cohen and CCA to hoist. Any further advice much appreciated, i assume i need to file a defence with 28 days is there any advice / links on best way to word it ?
  3. I have received a letter from Barclaycard asking me to confirm my details in respect of something to do with my former SkyCard payment break plan. I rang the number and was taken through to the complaints team who asked me to fill out the form and return it. Has there been something in the news about this that I have missed as its all come a little out of the blue? I did have a SkyCard but that went away with all my other debts when I was declared bankrupt in April 2011 (i was discharged in October 2011), and I dont remember having any cover but then again maybe I did. I'm assuming they're contacting me in regards to potential compensation or something. On a related note, a couple of years back I was contacted by Natwest who informed me that I was entitled to compensation for missold PPI, in total they sent me just over £4500. Due to the bankruptcy I of course informed the Insolvency service and they thanked me and told me they would deal with it. Jump forward two years and I recently discovered that the money is still sat in an account in my name but has a no transcation marker on it. I once again contacted the insolvency office and they gave me the same speech as in 2014. Having checked back with the bank however the money is still sat there and seemingly the INsolvency service arent that bothered about taking it. So where do I stand in regards to the money, Is there a period after which I would be able to access it or will it always be theirs regardless of their inaction?
  4. Hi all, Have what I think a slightly odd situation with Barclays at the moment, appreciate anyone's thoughts. Years back I got into a dispute with Barclaycard, that ended with me being issued with a Default in December 2010. They then sold on the account to MKDP not long after, who hounded me for years, took me to court, but I saw them off. I recently checked my credit report and noticed that this same account had had all this time 2 defaults registered against my name, by both Barclays and MKDP. MKDP registered their default 30 days after Barclays, who did theirs 7 months after the Default Notice, so there was obviously an overlap of some kind. Naturally I complained to the credit ref agencies who said they could do nothing, so I complained directly to Barclays. They upheld my complaint, but their response still puzzles me. I'll quote:- '...I have been unable to locate any record of a formal demand being issued to you. In view of this we can arrange for the default to be fully removed, however we would have to replace the default data. As your account has been in arrears since that time, this is what would be reported. The default will be removed 6 years from the date it was registered, however if we remove this the account would remain on your credit file 6 years from the date it was settled. This could mean that it would impact you for longer.' Are they saying that yes, we messed up but ironically if we sort it out you will be even worse off? if the default is removed how can that make things worse? when would the 'settled' date be, when it was sold on to MKDP? bit confused by this one. Barclays have offered to change the date to match the (later) date of MKDP so only one default should show (not even sure if that would work). Any thoughts welcome. I'll decide if I should just let it run its course, or choose to pursue further. Thanks in advance.

Hi all, I used to frequent these forums years ago and was successful in getting money back from Nationwide who promptly closed my account (like they used to, dont know if it is still common practice) and helped others do the same. Around that time (2007) I sent a PPI request to B'Card, and they rejected my claim saying that I was not mis-sold PPI. Yesterday I received a letter acknowledging that they said that I wasn't missold PPI, but now saying that they have reviewed my case and agree that I was missold PPI. It says they will provide a refund, and they offer a refund of the premiums paid, as well as interest on the premiums paid, plus 8% statutory interest as compensation. They say they are unable to calculate because they cannot find any record of the premiums paid, so have worked it out as an average. They say that my PPI policy started on August 2000 and ended April 2001, and no ppi premiums were received after this date. (probably because I stopped paying - oops!) They have worked out that the total payable back to me is £210.67, based on £103 paid in premiums. I have several questions. 1) If I can't find my original documents (I've not even looked yet), can I send another SAR to get my statements and work out the correct amount myself? 2) When can I claim interest until? If they made a mistake in 2007, when they should have originally paid out, can I claim interest back until today? Or until 2007, when they originally said no? 4) Is it worth contacting a PPI claims company to look into this? 3) Should I just accept what they are offering and be done with it? (incidentally, it is £10 less than what I still owe on the account) Any help would be GREATLY appreciated! Many Thanks

Hi, Been struggling financially the last few months after being made redundant from my job and I am unable to make the minimum payment on my barclaycard credit card (balance 12,000) as the salary in my new position is considerably less than before. I contacted barclaycard in writing as soon as i got into difficulty and arranged an alternative monthly payment of £30 per month. They reluctantly agreed to this and agreed that any interest and charges would be frozen but as the new payment was not enough the account would eventually go into default. I received a default notice for this account last week and when i checked my account I noticed that they have started adding interest and missed payment charges again. I've just written to them again asking them to stop the interest and charges and am waiting on their reply. I was just wanting a bit of advice on what my next steps should be. Do I just continue to pay the £30 per month and wait and see what happens? I haven't CCA'd them or sent an SAR request. Any advice gratefully received. kind regards

Costs Total Claim over £6800 I sent barclaycard a CCA request few years back but only ever received their T&C and what looks to be a badly photo copied application form ! Any help or guidance on what to do next, and what forms i need to send to who would be well appreciated.

No, not heard from them since Feb 2012, they did write in 2011 assigning MKDP LLP Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? No Why did you cease payments? Business went bust, leaving me with £70k worth of personal card, loan and HMRC debt, I’ve never recovered from it, finished therapy less than a year ago, I’d struggle to pay them all £50 a month combined at the moment. What was the date of your last payment? Nov 2009 – Account defaulted 29 July 2010 Was there a dispute with the original creditor that remains unresolved? I paid Moment Networks £5k to handle all debts, as advised by the administrator of the business (who was wound up themselves) and Moment was wound up as well, turns out it was a con and this company also went bust. Barclays don’t recognise them and this left all the debts with me and a lot of grief from the business side as well. Did you communicate any financial problems to the original creditor and make any attempt to enter into debt management? I never made a plan with Barclays, I communicated that Momentum Networks was taking over the account, but obviously that fell through, I then disputed ownership. All my debts are in the sixth year, is it correct they're removed from my credit file as well? Obviously getting a county court judgement now would not be helpful either. Looking for a way to defend myself and to progress, would love to finally clear my name up. Today I received the following claim, I'm looking for guidance on how to move forward. I had 8 debts,, some of which are now settled (not by me), three remain and this is one of them.
  10. Hi all, I am writing a SAR letter to Barclaycard as the first step towards reclaiming over limit and late payment charges. I've spent a couple of weeks reading various threads here that have been very helpful. I am trying to find the best address to send my SAR but am confused by conflicting information, some of which may or may not be out of date. London? Northampton? Knutsford? If someone could point me in the right direction I'd be most grateful - I don't want to stumble at the first hurdle! Thanks, John.

Hi, I sent out a CCA request to DLC, who were collecting for an old Egg debt; I have been paying £1 token payments to them every since the account defaulted over 6 years ago, and due to having moved house a couple of times since, have completely lost track of what has happened with this as the standing orders were set up to come out automatically. Last week I received a response to my request from DLC stating "we returned the account to Egg in July 2010, who have since ceased to trade. We assume that your account has been acquired by a third party company and we suggest you contact them". I have no idea who to contact about this now! Any advise as to what I should do next? If Egg have ceased to trade, then where has my £1 a month been going?!! Many thanks AM
  12. Hi All I had a DRO which I was discharged from in 2011. I had a barclaycard debt as part of this. So for the last six years, barclaycard have been reporting a default every month on my credit report incorrectly, negatively impacting me. I asked them numerous times 2011-2012 to sort it. They never did and I just could not be bothered to chase. I am now sending a final formal complaint before I go to the FOS. Would you say I could request some compensation too for the fact they have left it this long, it has negatively impacted me for years and they ignored me? Not sure if thats a basis for it..
  13. Hi all, I filled Barclaycards online PPI claim form in regarding an Egg card paid off a couple of years ago. One week later (yesterday) I receive a letter from them acknowledging my claim form and outlining what will now happen. They say they will contact me by 10th March with an update and have also sent a form for me to send back submitting my bank details for any repayment of PPI. So not bad from them! However, I only asked them to research the Egg card but in the letter they say they have found two further card numbers "linked" to the Egg card and will investigate them too. Im not sure what this means. I had other credit cards around that time but they were separate cards from other card providers. They were not "linked" to the Egg card in any way. Could it simply be that they are now responsible for other cards I may have had by way of buying other companies as they did with Egg? Thanks all.
  14. I have tried searching on this thread to see if someone else has posted this query before but have not been able to find anything. So apologies if this issue has been raised before. I recently made a complaint for the mis selling of PPI on my mothers Barclaycard which she had between 1998-2011. Now barclays has written to us with a final decision letter stating they are upholding the complaint and have offered £768.41 as a refund. I know that this is nowhere near enough the money my mother is entitled to as in the early 00s she was using the credit card like nobody's business and did actually run into a lot of debt because of this, but thankfully that has been payed off. On the final decision letter barclays have stated that they have been unable to accurately calculate the refund because their investigation has been unable to find any record of the premiums she paid. So they have used an average value for the premiums paid based on someone who was sold a comparable policy. They have said they are happy to to recalculate the refund if she is unhappy with it. How would I go about proving that this refund a lot less that what my mother is owed. I have read up on SARs is it true the banks can only go back 6 years for any statements? My mother herself has not kept any statements for the card. How can I go about disputing this offer if i have no proof of the payments made? Also I didn't get a chance to read the final response letter from Barclays until a week later but by then they already put the money into my mums account, does this mean that barclays see this as acceptance of the refund and the case has been closed? Any help regarding this would be much appreciated! Thank you.

Hi there I took out a Barclaycard in 2006 I got into difficulty in 2013 after my mothers death and the account was passed to link financial- I thought they were a subdivision of Barclays so I set up a payment arrangement of £5 per week I was receiving letters from both of them at one stage so was confused who was dealing with the account. I was given new bank details to pay link direct so did so accordingly (mistake I now fear) I understood that I received a default from Barclaycard but on checking my credit file i have been quite surprised The Barclays information shows the account was opened 18/8/2006 and settled in June 2014 for £5601 with no default There is then separate information by link with a different account number (which I use as reference ony standing order) Account opened on 18/8/2006 which is not the case and they have recorded the default on June 2014 £5591 there is no further payment history shown to date just an outstanding balance of £5176 and the terms show 0 I did not start paying link directly until mid August despite them lodging a default in June Are they able to lodge a default when I have not entered into a credit agreeing with them other than to stupidly pay them directly (I didn't want to get into any more trouble) Does this look to potential lenders as two separate agreements given the different account numbers? And does this hinder my credit further? With them not showing any payment history does this mean that if I stop paying them that they will be unable to show a further default or enforce the debt? Please advise me of where I stand.... ..I do not want to impactt credit file further as I am strong desperately to negotiate full and final settlement s with all of my lenders to improve my credit rating Many thanks in advance
  16. Hi I just wanted to ask if anyone has used the PPI claim complaints page offered by Barclaycard to make a PPI claim? They have an online form and an option to print out a large PDF form to fill and send. To me there seems to be a large number of questions they are asking including employment status at the time etc, which I can not see the relevance of. If anyone has used this I would appreciate it if you can let me know of your experience,
  17. Hi Everyone, I've tried reading as much on here as possible however I'm now at a point whereby asking might be a clearer way forward. Debt - £2583.32 Creditor - Barclaycard I've had a letter through from Kearns Solicitors informing me that I have to pay the outstanding debt of £2583.32 is required in full otherwise I'll be taken to court in 14 days. I contacted them stating that I was unable to make any form of payment and that I had sent a financial statment to both IDR and Link whilst making an offer of £1pw. I was told that Kearns could either enter into a 12 month payment plan for the full amount of the debt or take full payment now. I said that this wasn't possible in which they said I would receive a summons in 14 days time. To cut a very long story short (as possible) I had to give up work to care for my disabled daughter whom is ventilated 24/7 and requires 2/1 care 24/7 in July 2013. On doing so it meant I was unable to pay my creditors and I also lost my house. As soon as I gave up work I started contacting my creditors informing them of my situation. Whilst most couldn't do anything until I actually defaulted, I was able to deal with all easily enough however this could only be done when my partner was present or the limited nurse cover we have was. Unfortunately I've lost track of who I've dealt with however I did forward a letter to both Link & then IDR along with a financial statement making an offer. I believe I spoke with Link however I can't be sure I spoke with IDR. Apologies if I've given any information not required however I thought some circumstances might be helpful. Any help/guidance would be greatly received. TIA
  18. I have had visa card for decades with largish credit limit of around £7000, very light usage, and always paid in full before pbd. The latest Card was issued in 2010 and I did not use it for any purchases but kept it for emergencies only, and was due for renewal at the end of July 2014. However, sometime in Feb 2014 they sent this surprise automatically generated note; “Would you like to keep your Barclaycard account open? We've noticed you haven't used your Barclaycard Classic card for a while and thought your account may longer be needed. That is why on 9 April 2014 we'll close your Barclaycard Classic account for you. This means any credit cards associated with this account will be cancelled unless you tell us otherwise. Don't worry, the other Barclaycard accounts you hold with us won't be affected.” The letter was sent by normal post, dated just “February 2014” and I ignored it because it looked like junk mail. When I found out in July that the card had been cancelled, BC at first verbally said they couldn't reopen the card with original credit limit because I did not appear on the electoral register, then in their final response they changed their story and said that they had issued a notice ending the agreement under the terms and conditions, and that my creditworthiness was not an issue. The FOS just lied about the whole thing in their non-investigation whitewash which I didn't accept. My new visa card has a mighty credit limit of £260! What are the legal viewpoints, breach of contract because no valid termination notice or something else, unfair relationship?

  20. ************************Hi need help urgently***************.... on 11th august 2015 around 2330 at night i received a text messages from barclaycrad to confirm some transaction my card, there were transaction that i had used on 10th and 11th to which i replied Yes( HOW WRONG WAS I) I was at home with my mother and a friend of my mother, i than received further emails and messages from barclaycard that my credit card was used for £3500 on virgngames.com (gambling site) also £280 was taken from my paypal account. i called barclaycard and reported it straight away it was around 0130 in the morning 3 minutes before the last transactions that was done on my account, barclaycard blocked, issued me a new card and sent me a dispute form to fill out and send it back. i did and got a full refund within 10 days, and from paypal. however barclaycard fraud team have now contacted me again few weeks ago and asking me to fill out another form which stated FRAUD DECLARATION FORM to fill and send it back, again i did and they wanted bank statement, prove of my passport payslip basically everything... .. i done that and it proved that i do not gamble. however barclaycard spokesmen was so rude and aggressive and was trying to pin it on me, saying all my details like mother middle name, IP address, Email verification and all my details matches and if i was drunk and did not know that i did it, REALLY!!!!! he called me and said if i was sure that i want to go ahead with this case, i said yes and he stated i would get a decision within 5days through he post, 8 days went pass nothing, i than get a call saying he and a senior investigation team want to come and see me face to face and speak to me and make sure there arent any misunderstanding, i have no problem and said sure lets meet, but i am worried of what might happen i have reported it to action fraud, spoken to Citizen advice bureau, spoken to police and not sure what to do, they are calling me after 3 months after initial fraud and trying to pin this on me now!!!! help what do i do, any advice about why the meeting as they are coming from north of england and i live in south of england and why the meeting?? they have treated me really bad as if i am the suspect!!!:-x:-x:x:|

And i do bank with Barclays Just had a new credit search on my credit file that i did not ask or authorise Exquifax say it is a credit broker company I realise this is probably a "Soft search" but who are these people, and more to the point why are they doing credit checks?? If this has anything to do with that Clearscore then i shall not be happy
  23. Whilst i have a little experience with reclaiming charges etc this was some 7 yrs ago so i just wanted to make sure i follow the correct procedure for this one. Old Barclaycard debt with current balance of £696 against £500 limit, BC wrote yrs ago closing the account for no apparent reason. A/C opened march 2008 and no activity since at least 2009. PING PONGED with various DCA's for a good few yrs, latest was with MKDP LLP until letter recd from both MKDP LLP and Robbers way regarding account being re assigned to HPH2 LTD and Robbers way will be collecting on their behalf, both the MKDP and RobbersWay letters came in the same envelope. Checked noddle and default regd by MKDP on 17/9/2014, account reassigned 21/9/2015 to HPH2. I have no statements. Some of the balance will definately be charges, late fees etc so i know i can work with this, just wanted to check where to start, is it CCA or full SAR? Many thanks in advance guys
  24. I've recently started to receive letters from Lowell and today, out of the blue, a phishing letter from Robinson Way. I've plumped for a free Noddle file and can see Mkdp and Lowell. Lowell have mentioned a Barclaycard and their balance reflects what is in my file. I presume Robinson Way will follow the phishing letter with demands for payment. I presume both relate to old Barclaycards. The default dates show mid 2010 however I was thinking the dates would have been 2009. Is there a chance the default dates are wrong? How do I go about moving this forward? One account was opened in 1994, one in 2003. I'm confused about what I should be asking for having read different things about a CCA pre 2007. There will be charges no doubt, not sure about PPI. I need to engage with Lowell now as they've been persistent , but will wait for Robinson Way to say exactly what it is they are chasing. The Lowell account is a card account that was sold to Barclaycard , maybe an egg card. When would a true default date be?
  25. Hello Caggers, I have gained immensely from the advice on this forum...thanks for that everyone. I need help in removing a DN from my credit file please. The entry was made in Aug 2010 by Barclaycard for #492. I have emailed CEO using one of the sample letters on here and got a response from a lady called Judith Hayes. She has promised to send statements and records. She also mentioned that some of the charges are made up of PPI, Penalties and Interest charges. This is a cummulative total of the charges vs credit limit Credit Limit vs Balance History 2009 2010 2011 Jan -61 -232 Feb -94 -232 Mar -128 -232 Apr -163 -232 May -200 -232 Jun -226 -232 Jul -229 -232 Aug - 232 -232 Sep -232 -232 Oct -13 -232 -232 Nov 30 -232 -232 Dec -28 -232 -232 Ideas and suggestions all welcome.
