  1. I sent the statue barred letter to Capquest and their reply to it was to contact Resolvecall as it's now managed by them so should I sent another copy to Resolvecall
  2. Had a reply from Capquest saying that the debt is being managed by Resolvecall and to contact them. Should I send the statue barred letter to them?
  3. Resolvecall. Only a card with a reference number. Nothing else at all. no letters sent saying someone would call at house.
  4. Evening good people. it looks like my SB letter has had no effect. I have just arrived home from work to an envelope marked Private & Confidential and inside it a card from resolvecall for my URGENT attention saying they have called today at 1pm and for me to contact their head office. What is the next stage here because the SB letter I have sent clearly hasn't had any effect

  6. I received another letter from capquest today, the same wording as the first one telling me that resolvecall will now be managing my account etc but this is for £319 Shop Direct. I have no idea what is going on. My question @dx100uk should I just send another SB letter to them for this? x
  7. I have not paid anything in the last six years and I do not have any paperwork regarding this. I moved house about 9 years ago so if I had paperwork it has either been lost or trashed. There is an account number on the letter from resolvecall that I received today though but it is not the same as my account number with Santander now
  8. I have today received a letter from resolvecall giving me 7 days to get in touch with them and if I don't then they will arrange to visit me at my home (in line with covid restrictions). I am thinking I might ring Santander and ask them if I do actually owe this money. Looking back through that old thread of mine on here, this has been going on for over 20 years It is not going away. Or would it be worth me going to CAB and asking them to look into it? Calling at my house is not going to end well I'm thinking if I phoned Santander and asked them to look into it and tell me yes or no this is my debt. If it is my debt then do I arrange to pay it through Santander or the dca? I know what you're saying about dca's being **** (and I wouldn't argue with that right now) but this just all feels very horrible and stressful Actually, reading @dx100uk signature I will not pay these people even if I DO owe the money. That said, if I do owe this money how would I go about paying it? DCA's view debtors as suckers, marks and mugs NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type and they are NOT and can NEVER be BAILIFFS. even if a debt has been to court.. If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight.
  9. No DCA are NOT BAILIFFS and have ZERO legal powers on ANY debt - no matter what its type. if resolvecall do appear at your door film them on your phone DO NOT ENGAGE tell them to leave your property and never return else you'll call police 101
  10. I have been receiving text messages from Capquest for a while now and I just thought it was a scam. I received a letter a few weeks ago stating I had a debt with Shop Direct which I don't recognise, I have never had a catalogue or had anything from very ect.. I received a letter from Resolvecall stating they are acting on Capquest behalf, they have also stated that I have 7 days to contact them or "Capquest will instruct them to arrange a visit to your property". The letter is dated 20th I only received it this morning.
  11. Evening good people, Yesterday I received a letter from capquest saying "We are writing in relation to your SANTANDER account, with which the balance of £1327.20 remains outstanding. We note that you have yet to contact us to discuss a suitable repayment option for your account. Your account will now be managed by resolvecall, a debt collection agency who work on behalf of capquest and are also authorised and regulated by the Financial Conduct Authority." It goes on to say that they specialise in visiting customers' properties etc. I also received a text message from resolvecall yesterday at 11.52am saying "Your account has been passed to us for a home visit. To prevent please visit www.myresolvecall.co.uk/?id=G9Kfpn. Thank you." I don't know what to do. I am a customer of Santander already and have an overdraft with them and have always found them to be very helpful when I have needed help. Would they not surely have mentioned this debt to me before now? I don't know (I don't remember) what this debt is or when it is from or what I should do next. I have read reviews about resolvecall being aggressive and abusive and not very helpful at all and I do not want people like that turning up at my front door. I have had ongoing issues with my brain since 2007 (2 brain haemorrhages, five brain surgeries, chronic daily migraine sufferer) and I just don't want the hassle of people turning up at my door. Should I get in touch with these resolvecall people by telephone? Or capquest? If I genuinely do owe this money, I am not trying to get out of paying it, I just have no recollection of it at all and I do not have £1327.20 to hand to just pay it off. Help x

Resolve Call & A Statue Barred Debt! - Debt Collection Agencies - Consumer Action Group I have just had exactly the same situation occur, I got home on friday to my wife telling me a man with a ID badge on a string around his neck banged on our front door and after she told him I was not home and closed the door, he proceeded to write a paper out and post through our front door,, I had a letter from a debt company about 2 weeks ago telling me they have either passed on the debt or have instructed resolve? I cant remeber the company as I threw it straight in the bin, I am sure they are referring to a debt from 2006 which has well gone past any kind of hope they can expect to get anything from myself ,, could anyone please direct me in the direction of which letter i send them , ie statuary barred ,, also when i do the letter should i put my name on it or just the ref number and also do i sign it or just leave it, I really am pretty disgusted these people (who seemed to be bully boy according to my wife) have the cheek to visit me for a debt from 16 years ago,, well 10 years stature barred,, Any advise most welcome thank you ! Just to add after reading another post I remember the original debt was for a credit card from american express that capquest had obtained, I never had any kind of CC and no communication with anyone for 16 years ,, any letters which have come to me have gone straight into the bin, I guess i should send a letter and get it finished with ,,

This will incur a fee, of which will be added to your balance and become repayable by you. This is a serious matter that requires your immediate attention. If Resolvecall are unsuccessful in reconnecting you to us, we may consider escalating your case for litigation. This would involve a firm of Solicitors being instructed to issue proceedings against you in the County Court to obtain a County Court Judgment (CCJ).   15. Hi Been recieving texts & emails regarding an old piggybank payday loan debt, latest one threatening resolvecall agents visiting address. IS 1st step to request CCA?
  16. Sent CCA off today tracked. We had 3 calls on our home phone from Resolvecall today and wanted to ask if anyone knows how they got our number as we mainly use mobiles and very few people even have our number. I cannot believe they are allowed to trade as this is not right.
  17. My wife has received a demand for monies owed by a company called Capquest. They state that she owes £3476.00p on the 20/10/22. The letter also states the debt is being handled by Resolvecall and managed by them. Resolvecall sent an early payment offer of £2085.84p on the 31/10/22. And the Capquest sent another demand for £5596.76p on the 9/11/22. In the meantime I sent both companies a request under the Consumer credit act which was ignored as they stated it is online fake news? So I then applied for a SAR to both companies. Resolvecall replied stating it was being referred back to Capquest as they held the original debt. Capquest in return replied today asking for full details of Full Name 1st Line of of current address Postcode Date of Birth Last address provided to the credit card company. The first 3 questions were already supplied as they addressed the letter to the above. I am reluctant to provide any such information and refuse to sign anything. Has anyone had dealings with these companies as another name of Arrow Global has appeared as well. And do we have to give anymore information as we requested the SAR. Thank you.
  18. urm interesting... i hope none of your debt is being paid to a DCA? interesting they wrote aug 2019 offering a 25% settlement...worthy of note going fwd. forget stupid quotes/use of this fake 'maturity date' issue, it's not debatable, and is set in stone, but often used as a bargaining chip by eurdio because they know the mug has no idea. it is MOST CERTAINLY NOT!! dictated in relation to defering or not! consulting with any 'manager' at eurdio is a commom LIE!! a telephone conv is NOT admittance!! p60 and statements are another read herring used to coherse mugs into agreeing a payment plan. again, as i indicated earlier, there was nothing to stop you defering again once threshold was not exceeded, shame they used the 'rollback' scam to gain payment. lucky you physically made no payment? NOSIA are simply a legal requirement they must send if they consider themselves the creditor. noted this was not for all 4 loans only 2 of 4 in this claim. capquest/drydens and even Erudio are simply members of the Arrows Goup of companies, the real name for the parent company that did the gov't deal in late 2013 regarding all remaining unsold mortgage style SLC loans not already sold on. resolvecall are simply a DCA doorstepper company that other DCA's use to scam payments by threatening and sometimes actually attending addresses chasing debt. as like ANY DCA. they ARE NOT BAILIFFS and have ZERO legal powers on ANY DEBT, no matter WHAT it's type. ................ let things run. pull my chain near defence filing date if nothing more pops up. dx
  19. Hi, I won't file anything until the advice here is that it is good to go. I do have other debt, but thankfully I am managing this far better! Happy to clarify some detail. Graduated in 2001, deferred with SLC and when this was sold to Erudio, I continued to defer using Erudio forms. In Aug 2019 Erudio wrote to me with a settlement offer, asking for a single payment of £3425 instead of the £12337 owed. I had no means to take up this offer. This letter told me that the maturity date of my loans was May 2025, my age-related cancellation date was Aug 2025. The letter told me that "every time you defer, your maturity date is delayed by a period equal to your deferment date". (I later queried my dates in the call with Erudio in May 2020, and I was given wildly different dates, many, many years later) In Feb 2020, I took on more hours at work which put me just over the threshold to make repayments. My deferment period was to end in June 2020, so no payments were requested within this period. In late May/early June 2020 (I do not have the exact date), I had the conversation with Erudio as described in my first previous post (month corrected here). I explained my situation, that the hours were a temporary increase until Nov 2020. I was told, following the Erudio worker consulting with a manager, I would have to begin to make repayments as my telephone conversation counted as a disclosure. Frustratingly, they told me that had I sent in my P.60 from year 2019 - 2020 they would have accepted this, but I note their guidance stated that if the P.60 was more than a month old, wage slips had to be provided, hence me just not doing this. I cried (!) and told them I could not afford the £206.52 they were asking for a month, and they suggested that I make half payments, beginning end June 2020 of £103 per month, accrue arrears for the remainder. I was told I could accrue 3 months max of arrears and then could in Nov apply for "roll back process" to defer again and claim the money I had paid back. I was told I would lose contractual rights if I had anything over 4 months of arrears, I would not be entitled to age-related write off. Feeling pressured, with no other option, I set up the direct debit for the £103.26 with them. Nothing came in writing to confirm what I had agreed. I came on CAG and thought I understood that as Eurdio were a DCA, they could not enforce anything. My husband was about to lose his job because of COVID I stopped the first payment before it was taken. I cancelled the direct debits to Erudio. By end July, I was being chased for the arrears. I now note that I have two Notice of Sums in Arrears from July 2020 relating to two loans (no idea why I don't have 4 Notices, as I had 4 loans, maybe I chucked them?) stating the arrears were £110.04 and £111.56. Either way, this is more than the original repayment they were actually asking for. Chasing the debt was a task was later passed to Capquest, Resolvecall and then Drydens. I merrily buried my head in the sand after that. Meanwhile, my temporary hours were extended time and time again (with no real certainty and confirmation at very short notice, sometimes leading to incorrect pay). My full-time hours are now permanent, I earn over the repayment threshold however, as many families who suffered financially due to COVID we are playing catch up and there is no spare cash at the end of the month. To confirm, I have not paid a penny in repayments. Nor have I made any contact with Erudio since May/June 2020. Does this help fill in some gaps? Do I have anything to cling to? RC710
  20. Hello. I wonder if anyone can offer some advice? I took out 4 student loans between 1997 and 2000. They were sold to Erudio to manage in 2013 I believe. I have never paid anything back and deferred every year prior to April 2020 due to working part time, earning under the threshold. In Feb 2020 I took on additional hours at work on a temporary basis to cover maternity leave. I called Erudio to discuss this temporary arrangement and my phone call counted as a “disclosure”. I subsequently defaulted because my husband had lost his job due to COVID and I could not make the repayments. I have made no further contact with Erudio since this call in around April 2020. I have since remained working full time, earning above the threshold but our financial situation has not improved. Erudio have since used Resolvecall to try to recover the money from me. Once they called at my house but, thankfully, I was not in. They are now using Drydens and I have received a County Court Claim form for the full amount outstanding, plus court fees and legal representative's costs. Under particulars of claim I notice that the agreement numbers are missing. I have not checked that Erudio/Drydens have signed copies of the original agreements. Could they be bluffing? If they have them, am I liable for the full amount? I have been through the County Court claim process years ago in relation to a matter for my husband. I will need to refresh my memory but would be grateful for some support from CAG Thank you RC710
  21. resolvecall are as you know a powerless dca. if they ever do appear, film them, tell them to leave your property and not to return or you will call police 101 do not engage.
  22. So yep I was probably stupid not launching the court action back when told, as time went on it was out of my mind. That aside, I recently got told by arrow that they are using resolvecall and then resolvecall sent at letter saying if I don’t reply in 7 days someone will come round to try to collect the debt, this is the first contact since they received my letter February 2021 stating that the debt was barred even though payments were made. I am wondering if they are just trying it now? It’s been over 1.5 years since my last contact and if they could legally enforce they would have by now, surely.

  24. Hi Consumer Action Group. Looking for some advice regarding my wifes old student loans. She took out three student loans in 1996/97/98. she has never earned the threshold for repayment. she deferred her repayments for a few years maybe till 2005ish, then she stopped. There has certainly been no contact from her in the last ten years for certain. She continues to get 'notice of sums in arrears' which go to her mothers house where she lived as a student. All was quiet until the beginning of this year when she had a letter from capquest saying they were instructing Resolvecall. Sure enough Resolvecall wrote saying we're sending someone 'to make a personal visit to your home', which they did and we're told she no longer lives there. Three months later another threat letter from Resolvecall about a 'personal visit', that was 5 months ago. I think it time to try and nip this up once and for all. My feeling is to send a SB letter but I'm just so confused of the new rules regarding 'cause of action', I have no idea if she has ever been defaulted. So is SB letter way to go? who do i send it to? and when does the 6yrs run from with regard 'cause of action'? sry for the long post and look forward to hearing your wisdom!
  25. Hello, Just like some advice on what to do. I'm getting letters, calls and apparent visits from a company called Resolvecall for a debt that has been statute barred since August 2016. It is one of these debts that has been passed from company to company. Many thanks, M
