  1. I had been with Natwest for 22 years and had a black account with the Gold Advantage Charge card. I was advised to become a company as I would be delivering a service through several agencies. Unfortunately, due to exceptional circumstances and include a bad personal relationship left me in debt and I am about £8 -9k in mortgage arrears on a house I rent out and a personal overdraft that was £12k. In 6 months that OD was cleared and both business and personal accounts were in the black. The difficulty in meeting the mortgage department for an arrangement to be put in place was mainly because this period was over the summer, they would meet with me after 5pm and if I called at 4.45 they would not deal with me. I sent in 2 income/expenditure spreadsheets but they clearly didnt see them but I managed to set up a DD for the mortgage online and I met the deadline. That evening all three of my accounts were closed. I called the callcentre and they said they didnt have me on record. I tried to log a complaint and they were too busy on the Friday but promised they would be in touch the next day. They never did. As a prelude they stopped my access to online banking even though there was no way of spending money or transferring out into other accounts so it made knowing where I was financially and who had paid me and hadnt. The worst thing is that I couldnt operate, I need supplies, sundries and I was without any money to buy food or even some milk. I told Natwest this but they told me all my funds were transferred into the mortgage. It took a further 3 months to work out what had happened and the cause was not offered to me by the bank whose level of investigation was looking at the screen in front of them whilst on the phone. They hadnt cancelled the previous direct debit so every month the original arrangement would draw funds then the older previously arranged dd would be rejected. This was recorded as a default. I tried to make it clear to them there was an arrangement in place, it utilised a payment system set up and approved by the bank and it was their job to find out where the money was disappearing to every month for three months instead they left it to me. I complained about being oushed further into hardship by continued charges I had no way of keeping track of as the online facility had been taken away four months before they closed me down, failed to log 6 out of 8 attempts to complain and didnt care that I had not a penny for two weeks. They tried to issue a repossesion order and I wrote in to the lawyer to say that was illegal as the account was under dispute. In the meantime, I asked for SAR to get all the account information and after three months all I have is mortgage account copies. The lawyers are now calling me and I am sure its about instructing me to pay the arrears within the week or they would issue a repossession order on the house. They cancelled the direct debit that existed so I was conscious to keep puttting funds in every month but trying to function without a bank account lost me more money and irretrievably lost more clients. I am expecting a lump sum of money that will clear the arrears but the knock on effect meant that I was late paying my suppliers and one has taken a county court judgement out against me and bankruptcy is where I am at if I dont have some means of a reprieve. Yes, they said that if i didnt have an arrangement in place my account woud be closed and they talked about recovery. Sounded to me it was going to get better! The arrears werent as much as my overdraft which i cleared in less than 6 months and they had said the the charge card was a different legal entity and when I called the credit card company customer services before they closed my accounts they said that there wasnt any money owed and that it would be fully operational once the mortgage arrangement was in place. That wasn't true and I also lost my 36,000 reward points as I had no online access and frankly more serious things to worry about. i cant really afford a litigation lawyer at the moment and have little faith in the FSA from what I am reading. The banks replies to my complaints are to issues that weren't raised and they have not taken notice of my plea to allow me access to funds I had to eat and drink. I was not notified clearly that every account would be closed down and as far as I am concerned there was an arrangement in place that obviously isnt integrated into the RBS network as they couldn't see that the money had been taken from the holding account and HSBC provided a fast pay reference number. You cannot open another bank account if you have mortgage arrears is what every other bank told me but once I called the Business Debtline they advised me to walk into a bank and ask to open an account. Why didnt the other banks suggest this to me? A week after submitting an application form for a Cashminder account with the coop was i able to restart rebuiding what Natwest pulled down.
  2. A few months ago a male, who is a live in employee at a property opposite my girlfriends house aggressively threatend to smash my face in and knock my teeth out, when I asked a delivery man to move his van that was blocking the driveway, the delivery man moved his van and drove away but the other man made more threat and demanded I fight him in the street and telling me what he will do to me, so I called the Police. Police never came out because they said I was safe inside my girlfriend house. The Police investigated but the male employee who made the threats denied it, the delivery man was traced and also said he didn't see or hear anything, but he had already moved his van and drove away before the threats wre made. Since this occurred the male employee is always outside in the street when I visit or stay at my girlfriends house,, always staring at me and now always parks his van outside my girlfriend house very close to the drive but not blocking it, he never parked there before.
  3. HI everyone my first post on this site as i am in a bit of a pickle around 2 years ago at my gym ( which also happens to be a hotel & restaurant ) company called "millennium door and event security randomly turned up and decided to start slapping tickets on everyones cars ( gym users , hotel stayers & restaurant eaters all included ) as you can imagine there was quite the uproar with many complaints going to the hotel manager about this whom seemingly was unaware what exactly was going on ,but someone within the hotel had agreed that millennium could start ticketing peoples cars under the pretence that they were " managing the car park " i imagine of course the hotel would receive a percentage of any " charges recovered " i avoided the whole thing for a while although i will admit things like this make my blood boil as this business model is created to inflict misery on innocent people and to generate pure profits for the robbers that own these companies i cannot believe that in 2017 companies like this are still allowed to get away with slapping tickets on peoples cars on land they have absolutely no affiliation with anyway around a year ago i damaged some ligaments in my leg , i still attended my gym as there was a good physiotherapist there and i liked to use the pool facility however for around 5-6 months i was unable to walk distances and therefore i would use the disabled spaces provided by the hotel this is where the problems began everytime i would return from using the facilitys i would find a "ticket" on my windscreen i must have collected around 20 of them in 6 months however as i pay a monthly fee for my gym i believed i was more than entitled to use the private disabled parking space provided by the hotel and simply ignored the nonsense tickets i can remember even querying this with the gym manager who said the rules do not apply to patrons and members ( the sign millennium door and event security had put up even mentions this ) i kept throwing the tickets away and thought nothing more of it , until i started receiving mountains of letters from "max recovery" and "goldstones solicitors" more con artists i ignored all these swell thinking it was all huffing and puffing trying to bully money out of me next thing i am being served county court papers from some business centre in Nottingham ( 200 miles from where i live ) first i received one claim stating i owe £400 - this was the first one and i actually went to court with expecting somebody to see sense and throw it in the bin gladstone rocked up with 3 solicitors and had carefully analysed every single defence point i had I'm not joking they must have spent more time on this than the OJ simpson trail myself and the magistrate had lost all interest by the end and the court awarded them the full amount minus a little bit of interest they were trying to claim i ended up paying these ba*stards £374 in full they were not prepared to negotiate a payment plan of any type then a few months later i receive one stating i owe another £350 - by this point i had enough and just threw it in the bin ( i know stupid ) the judgement defaulted and they yet again get the result they so desperately wanted along with a CCJ which has now been handed to DCBL aka don't pay we will take it away i also have another case with them waiting to go to court for another £400 - but i have been clever in dragging this one out for along as i possible can by switching addresses and saying i am out of the country for 5 months but i have no doubt that gladstone will be after this one like a dog after a bone too anyway its the defaulted one they have a cci for i am most concerned about at the moment because i live with my parents and where as if i was on my own i simply wouldnt even acknowledge they're existence and would potentially consider an acceptable level of force to remove them from my property ( yes i feel that strongly about it ) my mother is old and would get frightened easily if 2 burly debt collection attack dogs and a camera crew turned up at the door one day i am aware there is no where else to really turn now I have accepted i will have to pay the criminals £350 and be thankful for it however like most ordinary people who don't con others on a daily basis i don't actually have a spare £350 just laying around to pay them i am insolvent and live on very little i am going to ring DCBL tomorrow to see if i can pay £50 a month I'm already anticipating they will politely decline this and i notice there is no way to contact them via email ( meaning no paper trail of attempted negotiations for court ) so assuming this will probably end up in high court a few questions 1) could a £350 debt even incur a high court writ and if not does it just go back to county court what sanctions do they take 2) i am aware you can ask the court to set aside the judgement or set up a payment plan however they want £50 minimum to do either of these extremely difficult tasks and seeing as the debt is £350 I'm not sure its really worth it to add another 50 on 3) is it worth speaking to citizens advice or will they just give me barrel answers 4) the outstanding judgement thats waiting to go to court could anyone help me on here with a defence ? because obviously my last one didnt work very well sorry i know the post is long but this is literally so frustrating if i had actually incurred a debt with someone for a service or goods they had provided i would of paid up straight away however these "debts" have seemingly appeared out of thin air i still after all thisl fail to see the damage I've actually caused to warrant nearly £1000 pounds worth of parking charges all i did was park at my gym thanks to anyone that takes the time to respond
  4. Hi I am in a bit of a mess and would like some help if possible. I have a very old loan of around £7000 which a ccj was gotten on some time ago. Due to other issues I had forgotten about it until recently. Unfortunately the solicitors are now looking to take enforcement action. I know I need to pay this off, but money has been tight. I realise I need to start paying something however I currently have mortgage arrears, water arrears and other current bills to pay. Additionally I have been signed off work for weeks now with stress. I could afford £10 a month for now, do you think this would work until I can get my health and other bills sorted. I don't want to ring them to discuss it so would be looking to write to them. any help appreciated with the amount or what to write.
  5. I set up DD with DVLA 2015. DVLA confirmed DD was set up and supplied a letter saying so. Thinking my car was taxed, and having comfort DVLA would take payments as needed, DVLA has not requested/taken payment. Car was not, therefore, taxed. I discovered this with a lovely man put a wheel clamp on my car, with £260 release fee (£160 later refunded once taxed) but then 2 weeks later, letter from DVLA with fine of £216. Replied to DVLA fine letter saying it's their fault. The DD letter from DVLA in 2015 says exactly 'you do not have to do anything'. I am fuming.
  6. Hi all, Long story, which I will try to keep short for you! I purchased a Humax Freeview recorder for £199 in Jan 2016 on my debit card. Over time it developed lots of faults, such as random crashes, missed programs, freezing and even not turning on. After researching the product online, I decided to take it for a refund - Lots of similar stories from other users. This was within a year of purchasing it. The girl on the till wouldn't refund to my debit card as the card I used to purchase it had been reported lost/stolen. I was made to take a refund onto a gift card, which I reluctantly accepted, thinking I'd buy another freeview box from them anyway. After reviewing the options, I decided on a £400 TV instead. Bought the TV and the picture quality was awful, with vertical banding (dark black lines) particularly on one side of the screen and generally poor quality image quality when compared to the 10 year old TV it was replacing! I took this TV back and swapped for another of the same - this one also produced a poor quality image, I got in touch with Argos via their live chat feature on their website today. The girl I was chatting to called the store that I got the TV from (FastTrack) originally and she came back saying they would refund £200 cash and £200 to my new debit card as long as I could provide the long card number and expiry date. I printed the chat transcript, called my bank to get these details and took the card number, the transcript and all my receipts into the store for my refund. They denied ever saying this to the girl at the customer service centre and said that they cannot refund to my card without the card, which I explained was impossible as it was reported lost/stolen! They wouldn't do it with a printed bank statement showing the original transaction either. They also said the store has final say on the matter and gave me an 0345 number for head office, which I called tonight only to be told I have to email head office as they were "only customer service, so we don't have the authority to override the store's decision". No phone number for head office apparently?! Has this happened to anyone here and where do I stand? I don't want to keep buying "blind" at Argos and would prefer to take my money elsewhere - somewhere I can actually see the TV in action before purchasing. Thanks very much in advance for any advice you're able to give before I write to Argos Head Office tomorrow Looking at their returns and refunds policy suggests the following can be used as a proof of purchase. All of which I can produce. WHAT COUNTS AS PROOF OF PURCHASE? Any of these: Till/kiosk receipt confirmation email e-receipt your order number If you can’t find one of the above, don’t worry. We should be able to sort everything out if you have: your card/bank statement the email address used to buy your item Hmm. Surely, as I can provide all the above (bar the stolen/lost payment card) proves I am the person who purchased the Freeview box to start with, so why are they not prepared to refund me?
  7. I have a clear cut situation.... My original phone contract was on orange but after the merge of orange/T-Mobile which is now known as EE.....I was upgraded onto EE. Due to an internal error on their end (which they have admitted to the ombudsman) the original orange account did not get closed which resulted in the company automatically billing me twice (no money was ever attempted to be taken for the original account after upgrade) which resulted in missed payment/default put on my credit file. The kicker...... How I came to find out that this error occurred was when I was speaking with a mortgage adviser who recommended I check my reports before going ahead with application. To keep it short, the company ignored my "recorded delivery" letter and by the time the ombudsman was able to get involved (2 months after letter) I had to sign a years tenancy agreement wasting another year as I could not apply for a mortgage with a default, not to mention paying more for a house next year. I was constantly being hassled by dept collectors throughout this whole ordeal and taking into fact what this error has cost me....should I take this to court to get some form of compensation or take very small fee being offered by the company? Company has confirmed it was their error. Any advice is greatly appreciated.
  8. Hello. My Father in law has taken early retirement and is part of a large social circle of friends. His friends travel often and would like to pay him to be their driver to take them to and from the various airports they fly from. Please can I ask if there will be any insurance issues with this arrangement?
  9. Hi all. I'm hoping some of you caggers will be able to relate to my experience and hopefully provide some advice. I've received notification from DWP that I owe about £500 in overpayment of tax credits. A brief overview of the issue: We were claiming £53 per week while I was working. My wife was at home looking after our disabled daughter. I ended my employment some time in April of this year, and attempted to apply for JSA. I was advised that my wife would be better applying for ESA and having me included on the application, which she did. We informed DWP that I was no longer working, but they continued to pay the tax credits into our account. It was a good job they did because two months, and then three months later we still had not received any of the ESA or other benefits we had applied for. We basically lived on family handouts for months, and relied on the good will of our housing association as we began to fall behind on rent payments. Our arrears on council tax and also TV license all mounted up. Thankfully in June I returned to work and the tax credits payments stopped. Now I have received a demand for payment in full or they'll take it out of my wages. I've explained that their mistake in continuing to pay us was all we had to live on due to receiving no other benefits, but they aren't interested. I'm not denying we spent tax credits and I'm more than willing to make affordable payments back. However, what I do mind is the fact that they want their overpayment of tax credits back but that was just a fraction of the entitlements we were never paid. We struggled like hell as a family and now we're trying to get back on our feet and paying our way, they are forcing more hardship on us. I just want fairness and a level playing field. Any help or advice will be truly welcomed. Craig
  10. Hello everyone - I'm looking for some recommendations following a problem with an EE contract and phone. This is the current situation: My partner has a monthly contract with EE. Her phone stopped working so she took it in for repair under warranty. When it came back it was reported to be unrepairable due to water damage, even though it has been nowhere near water. She asked if she could buy a replacement phone to use with the existing monthly contract and was told by the guy in the EE shop that there was no way to do this because EE only sold phones for PAYG purposes not for monthly contracts. She was advised that the only way to solve the problem was to take out a second monthly contract to run concurrently with the first one, and let the first contract run out in due course. The second contract would come with a new phone. She felt pressured into doing this because she needed a working phone that day. My questions: Is it really not possible to buy a replacement phone from EE for a monthly contract? To be clear, she wasn't expecting a freebie and was willing to pay for the new phone. Even if for some reason it isn't possible to buy a replacement phone for a monthly contract, surely she could buy a PAYG phone from them and just transfer the 'monthly' SIM card? Is it usual practice for EE staff to advise customers to take out concurrent contracts? Isn't this mis-selling? Can we cancel the contract under the terms of the cooling off period? Thanks in advance
  11. http://www.bbc.co.uk/news/world-us-canada-38164590 I probably would have ... But I hope I would have had the kokum to pull my hoody up...
  12. I purchased a used car last week on Monday and realized the car doesn't hold coolant whilst parked on my drive. After contacting the car dealer he offered to topup the coolant which I said I did and didn't work, none was left on the expansion tank after a couple days. Yesterday I sent the letters to reject the car and arranged a transport to take the car tomorrow but the car dealer has told me today he won't take the car back and he won't be responsible for any damages on the car on his site. What can I do..!
  13. I'm assuming there is a precedent to this. I have a debt to the Council for back Council Tax which I have been paying back as and when I can afford it. Today Bristow and Sutor sent an enforcement agent (who told them he was a bailiff) while I was out and luckily they did not let him in. Nothing, apart from a few items such as my bed and an old stereo which is worth pretty much nothing, on these premises belongs to me as I am just a lodger here and the room is furnished by the landlords. I have never denied that I owe something but the amount is in dispute I have told B&S this previously but they have ignored all my letters. The bloke cleared off when it became clear he wasn't being allowed in but I suspect he will be back. Apparently he was eyeing up their car and I would obviously hate for them to become involved when it is nothing of their doing. Do these people have any claim to anything on the premises and where do we stand if they return in the future? I have spoken to the Council but they say it's out of their hands now although I suspect they could do something about it if they wanted to. Thanks in advance for any help and advice
  14. hi i have had bayv for about 3 years now i rung them the other day to ask to return some furniture i have as i am moving and i dont need it at my new house, i just assmed because i had been paying it off for so long there would be no problems, well i was wrong they have refused to take them back because a fault i had reported to them and they were currenty trying to order the parts (i have been waiting for them to fix this for nearly a month) had not ben sorted and said they could not take them back unless they were in the condition they were sent in i am now stuck as i move in a few days and i literaly can not take them with me does anyone no what i can do thank you
  15. Hi Everyone , i was hoping for some advice , after looking through documentation it seems i was REALLY naive when i took out the credit for my car , i had finance on 10.12.2014 for a renault megane 2007 1.9 DCI To cut it short they charged me £2,350 for the car and the loan amount by credit for cars was £5500 !! i was paying £150 a month , ive paid £2,300 off it , but with all the numerous problems ive had to pay for with the car from the start i stopped paying last month last payment i made was on 17th june and i had to pay via "shopper@worldpay.com a Guy from avelo emailed me 10th june saying i needed to contact them urgently to discuss arrears (he was a negotiations case handler) i gave him a email back and told them when id make a payment he replied saying "sorry our systems have not been updated and could i ask how you will be making a payment ? and can we have your current phone number" i didnt give him my number but id updated them with my new address and he replied back "thank you ive updated our systems and "are you willing to continue paying £175 per month starting from next month?" i never replied then today i had a different person who was "Trainee Case Handler" asking me to contact the office to discuss arrears (the same like before) The reason i am not making payments is because i cannot afford to , the advice im looking for is Can they take the car away from me ? (on the documents i signed it stated that they could not take the goods if payments totalling £1997 have been made then they may not take the goods back against my wishes unless we get a court order) this is the Credit4Cars agreement i signed 2 years ago , also i have noticed that they charged me £375 for a "Stronghold Protector payment assurance system" they said they can disable my car with it as they reckon a device has been attached , the reason why i say they reckon because when i was late with a payment with C4C they threatened me they were going to disable it , i was not in a good way then and snapped back and replied "be my guest as i dont care" (they did this 3 times to me but never disabled it and also when i asked a mechanic to look for it he said he couldnt see anything , when i chose the car the people at trade center where i bought the car said because i have a tracking device my insurance would go down now when i queried with them what make it was for my insurance they would not tell me so i was paying a LOT more than i should have for my insurance , sorry to have gone on and on its just that the cars wheel bearing has gone and it will cost me £200 tomorrow and if they are going to take back the vehicle then i wont get it fixed , thanks for your time any advice appreciated
  16. Cutting a long story very short, bought a car in May 2016 for a few hundred pounds, have received a letter from Loans 2go saying vehicle was subject to security by the owner previous to the one we bought from and to contact L2Go. Called them this morning and asked to see copy of BOS and authorisation over the vehicle, they said they would release their clam for over three times what we bought the vehicle for. :-x the amount requested is laughably high, the vehicle would be worth maybe £200 at auction, the person on the other end of the line said we have 10 days to respond Obviously courts are closed for the weekend. Advice please Have reported the matter to the police as a pontential fraud
  17. Hi All Summary: - I've had an agreement set up for 12 months with no issues from a debt. - Visited on 3rd August 2016 while on holiday by a HCEO, no 7 day warning in writing. Asked confidential questions to my neighbour - Visited again last Friday 12th at 06:45 am, again no 7 day warning in writing - He showed no ID, I let him in to stop any embarrassment and to genuinely sort out some confusion as a payment plan has been in place for over 12 months with no issues. - Outstanding amount before entry was £358 (oringal writ amount £2305.56), he demanded £1483.11 - Gave me no opportunity to speak with anybody from the claimants office - Served a writ - I didn't read it properly as I was in a panic with my daughter in the house - I had 1 option to pay in full, without hesitation and with no inventory made he grabs my car keys - We panic and pay the full amount £1483.11 with a credit card He leaves, leaving a trail of utter despair and emotional distress. I called the relevant parties at 09:00 the same day, the HCEO office decides to refund me £970 within 1 hour (when I mentioned the writ below) - Saying 'we dropped the ball' (the claimant and HCEO had no communication or understanding of my debt and the actual correct figures owed) From researching the past 3 days: - The writ was dated 28th May 2015 (expired) I never checked it. I've called the court who issued it and they confirmed it expired and was never renewed. - The actual HCEO who attended seemingly has no certificate according to the register I have made a formal complaint in writing but wanted to know if there is any consequence for a HCEO enforcing an expired writ? Also when a HCEO has no certificate? ...Can I take action? Appreciate any guidance. Thanks, garynansome
  18. Hi This is my first post so please bare with me. My wife was issued a Private parking ticket for Payment not made in accordance with terms displayed on signage by CIVIL ENFORCEMENT LTD at The Parade Firmley High street GU167HY so I appealed but I got refused and in few weeks I forgot about it, as I got busy with my work and young baby. Few weeks ago a debt collection letter came through my door asking for £200 double the amount of actual ticket so I replied but there response just got worse and now I have letter from their solicitors asking for £236 or they obtain a County court Judgement. Here are my details:- PCN issued- 17/08/15 on the PCN it reads vechle parked from 1500.10 hrs to 1625:42 hrs , the actual ticket reads 1513 hrs to 1713 hrs they have a 10 mins window to obtain ticket. £60 for 3 mins or after 14 days £100 for 3 min. I have the actual ticket and all the letter we exchanged with different parties. My defence:- 1) Discrimination against my wife as she was with our 2 months old baby, she was willing to pay parking charges and did paid but was penalised for being few minutes late just because she was not fast enough to handle her young baby. 2) The amount charged was unfair and is not the true representation of the cost incurred by the owner or company running the business. 3) I was not provided with a case or reference number which would have allowed me to appeal to BPA after Civil Enforcement Ltd. Shall I defend my case or just pay and end this matter, which I was thinking about but I just feel that I have been used to extract money , to me its unethical and my inner feeling wound not allow to give in to these cowboys. Please help me to defend my case I would happily donate the parking fee amount to this forum if we can beat these cowboys.
  19. So, long story short, we caught the Water bottle provider (for office water) filling his pockets with mints from the meeting room. He was only supposed to, and trusted with, being in there to change the water bottles over. we dont want this little thief in the building any longer we called to terminate the water contract - they have stated a) they dont give two hoots about their staff and b) they wont cancel the water order, will, come to premises and take the goods and continue to bill us c) "bring it on, we have lawyers" No apology, nothing. here is the agreement enclosed that we signed, yes we can give three months notice as its dated 2014. what rights do I have - without court, bearing in mind its a civil agreement not a criminal one - yet my issue is technically criminal (ok its only mints but the principle is there). we threatend the fact we may call the police about this and for them to just take their stuff and go - but he proceeded to take that as blackmail! We just dont want them in the building ever again nor do we want to pay them a penny more! They are also member sof: http://safecontractor.com/ and http://bwca.org.uk/
  20. Hi there. My car payment was missed twice. This is down to a change in bank accounts and carelessness on my part. 4 days after the second payment was missed, a guy from Ceatta Ltd attended my house and attempted to collect car, which was not at the property at the time as my Mrs was out in it. I rang Motonovo and tried to pay the arrears of £850 but they have refused and claimed that the finance agreement has been terminated. I have received no notice of this whatsoever, and the only letters I have received are "notice of default sums". I am aware that those are neither here nor there with regards to the law and are made to look like default notices. The day after the repo guy turned up, a letter came through which was "notice of sum of arrears". This letter states that I should ring them immediately to arrange to bring my payments up to date. However, they won't accept anything but the car! If they take the car, I can't work. I will also owe them around 12 grand as the amount owed is 22k and I can't imagine them getting more than around 10k for the car at auction. My question is can this be done?? We received no notice of termination at all and they are outright refusing to accept payment unless it's the full amount which is around 22k. I have lodged a complaint with ombudsman which could take weeks. I understand that the repo guy isn't a bailiff and has no power to take from private property but motonovo are saying that if we don't allow them to take the car, they will report it stolen. This will greatly affect mine and my wife's job if it goes to police. Can this even be done seeing as it's our name on the log book? This is a hire purchase agreement not a loan. help!
  21. Bailiffs from 'Can't Pay We'll Take It Away' throw car park firm out of Huddersfield site for not paying its bills A national car park firm has been dramatically evicted from its Huddersfield site by bailiffs seen on television’s ‘Can’t Pay We’ll Take It Away’ show. Euro Car Parks was abruptly turfed out of its Lord Street site and the entrance chained over. It has now been claimed that the huge international firm, notorious for giving shoppers parking tickets, has itself failed to pay its bills. The Examiner understands it has not paid the past three months rent on the site, which was purchased by a private landlord recently for more than £700,000. The Examiner has asked Euro Car Parks for a comment but it has so far not responded. This morning a new firm, Simple Intelligent Parking, was busy installing its equipment and signs at the popular town centre car park. A spokesman said the landlord had become tired of waiting for payment and had recruited bailiffs from DCBL Ltd, who feature on the Channel 5 TV show, Can’t Pay We’ll Take It Away, to come and reclaim the site. He said he had assisted in dealing with the confused and upset employees of Euro Car Parks and customers, whose cars were locked in. And he revealed plans to improve the car park with a new surface and better markings were underway. Link
  22. Hello, I wondered if anyone knows how long MET and euro car parks have to take you to court once all letters have been ignored by the motorist? I received a euro car parks ticket for an incident on 5/9/15 when I had sat in the car for 10 mins or so as I was not feeling well (I have a medical condition). My ticket was for staying longer than than the hour's ticket I paid for by that 10 minutes. I ignored all the letters, the last being on 31/12/15 from their debt company giving me a' last chance to pay to avoid court proceedings'. I also received a MET ticket for an incident on 12/9/15 when I had 'overstayed' at a large McDonald's I spoke to the manager saying I was in the restaurant the entire time giving them business as can be proven by their CCTV. i was not a driver using the car park to wait for airport passengers as others are doing there. He agreed to cancel the ticket but I carried on getting letters. Last letter was a final reminder on 3/12/15.My friend had also driven and out at the same time but she did not get a ticket. Am i safe to assume any time limit is over for the car park companies as it has been over 6 months since both incidents? Thank you in advance.
  23. I have seen this question come up on several forums. The bailiff can enforce and take control of goods belonging to anyone on the liability order. The council tax regulation state that a summons for a liability hearing may be addressed to two or more joint taxpayers in joint names. The TCE permits enforcement of more than one individual on a single enforcement power. So it is a matter of looking to see who the summons is addressed to, or alternatively whose name the bill is in. 24. A motor vehicle has always been a most attractive item for a bailiff/enforcement agent to seize and in particular; because of its value and the fact that in many cases, the vehicle is located on the debtors driveway thereby easing the removal process. In 2014 significant changes were made to bailiff enforcement under the Taking Control of Goods Regulations 2013 but unfortunately with motor vehicles, the regulations may result in reduced protection for many people and in particular, business debtors. A short while ago I wrote a new STICKY for the forum entitled Bailiff enforcement: A Simple Guide to the Taking Control of Goods Regulations 2013. To ensure that the forum does not get clogged up with too many stickies I included with that STICKY a separate Guidance regarding bailiff enforcement and motor vehicle. Given the importance of this subject I thought that it may be useful to post a copy of the guidance (on motor vehicles) on the main forum as well (see copy in the next post). A link to the Guidance is here: http://www.consumeractiongroup.co.uk/forum/showthread.php?453292-Bailiff-enforcement-A-Simple-Guide-to-the-Taking-Control-of-Goods-Regulations&p=4800997&viewfull=1#post4800997
  25. Hi, new member here I had a big issue with Lloyds due to a number of transactions that I didnt recognise. Lloyds however didnt do anything to resolve the problem therefore I submitted my case to the Financial Ombudsman last week. I wanted to ask how long did it take you before they acknowledged and logged your case? Its been 5 days now, and the 2 representatives I spoke to seem to given me 2 different answers. One of which saying logging your complaint takes 48 hours, while the other told me itll take up to 2 weeks. On average how long has it taken the ombudsman to log your case.
