  1. Help/advice required please. Some years ago, i had a credit card with Sainsburys which fell into arrears and a notice of default was served. I then received notification of the transfer to Robinson way who took an aggressive approach. In september 2007 I wrote, asking for a copy of the credit agreement, enclosing my £1.00 payment and 14 days later received a reply stating that this could not be traced and returning my £1.00 In 2008 I received a number of harrassing and threatening calls at my place of work which stopped when I referred the matter to trading standards. On the 1st of July 2012, I received a copy of a document which alleges to be my credit agreement (which i had been advised in 2007 could not be found) and one week later a summons, via the Northampton County Court, in respect of the alleged debt (now over £7k with interest and costs). How should i deal with this matter? Does the failure to provide a CCA within the required time make the debt unenforceable and what steps should i take re the summons? thank you for reading this, hopefully you can help. Regards
  2. Hi Had a Barclays account which was taken over by ME III Ltd, Mortimer Clarke. The month they took over they automatically defaulted the account and sent an application to Northampton BCCC. I requested via a cpr 34.14 to Mortimer Clarke/ ME iii Ltd but they did not respond within the 10 day indow given to them. As I have no paperwork for this debt I had to pay the court £210 to defend and request that they write this matter off. Today received a letter from the court stating the court orders that the claim and counterclaim is stayed until Aug 10 2012 to enable parties to attempt settlement. Either tha claimant must notify the court that the whole of the claim has been settled or claimant/defendant must write to the court requesting an extension of the period of stay or all parties must file a completed allocation questionaire at the court. I have already sent in an allocation questionaire, form n150 and paid the £210 fee when I responded to the first enquiry. Can anyone help? @andylglover Cheers
  3. I would like to alert anybody that may be considering buying double glazing units, because dialling ABLE GLAZE LTD could be a very costly experience. ABLE GLAZE LTD are an Essex based company who carry out Double Glazing Repairs and also Door and Window locks repairs. They advertise their business NATION WIDE in the THOMSON LOCAL DIRECTORY. I contacted ABLE GLAZE LTD and asked for a quotation they then phoned their North West agent from their Essex headquarters, who came to measure up. My wife accepted their quotation of £520.00 PLUS vat = £624.00 and gave them an order for 10 doubleglazed units. Four small and six medium units. ABLE GLASS LTD then phoned their North West agent to order the glass. Coming home from my work that day I noticed that my wife had left a note with the quote saying that she had ordered the units. I was not comfortable with the price and phoned ABLE GLAZE LTD, you can guess how the conversation went, which included a promise to put ABLE GLAZE on this Consumer Forum. After half an hour a 10% discount was offered, at 45mins a superior employee offered a15% discount, that was their final offer or I could cancel the order, but that would have cost me £312.00 lost deposit. Throughout the conversation I repeatedly asked for the name of the company that was actually making my units, and they consistently refused, but having taken much of their time over the phone they eventually gave me the companies name. I phoned the Glass Company that was making the units and curiously asked for a quotation for 10 double glazed units - they quoted £181 plus VAT =£ 217.00. Unbelievable! I was speechless. the local glass company in the north west sold my order to ABLE GLAZE LTD who are based in Essex for £217.00 vat included. ABLEGLAZE LTD, who have made nothing, wanted to charge me £620.00 including vat. That would leave a difference of £407.00 I would have been paying, if it wasn’t for challenging ABLE GLAZE’S original cost , just because they made a phone call. ABLE GLAZE LTD who advertise their services in the THOMSON LOCAL DIRECTORY gave me the impression that they are riding off the back of the NATIONS local GLAZING COMPANIES, and it looks like from our experience that they are using them as CASH COWS . I hope that this post will save somebody hundreds of pounds by making them aware of ABLE GLAZE LTD, who will be advertising in your THOMSONLOCAL and using one of your local glaziers that you could actually phone yourself. So the choice is yours , will it be ABLE GLAZE LTD you phone, maybe you would like to receive one of their quotes, like we did, or one of the many others glazing firms in your area, to compare them first?

I was at the university yesterday, I used to work there, I remember another company doing the the tickets before, and there was no pay and display then, so I also advised students not to back down, and just ignore! That was always successful, never know any to be taken to court, as I explained reasons from here, also why should they pay for parking when paying for accommodation and even the workers having to pay. My partner and I had a joint back account which went over the credit limit some nearly 6 yrs ago It was defaulted in 2009 We both received a similar letter to some on here Original joint debt was £1069 But both had letters for 299 plus costs £364.99 each Have already done AOC online but need my defence in by Monday 9th July As this was a joint debt and clearly not a Credit Agreement as stated on both claims form and not for the correct balance What should my defence say?   7. Hiya Ladies and Gents, A few years back I had a CC with MBNA which I disputed due to them being unable to provide an enforcable credit agreement. They pursued me for the outstanding balance for a while and eventually passed it over to a company called Optima (i think) who harrassed me for a few months and then gave up after offering a settlement figure of approx 10% of the balance which i declined. I haven't heard a peep from them since. This was 3 years ago but last week I got a letter from MBNA stating that they transferred the right to collect this account to a company called MFS Portfolio Ltd. Just wondering if anyones had any dealings with this company and what to expect now. Thanks in advance for any advice. Travis
  8. Hi All, Just remembered about a car I had around 10 years ago and thought I would try and find who I had the credit with. Rang bank and asked them for payments made for a specific month and turns out it was College Credit. Had a quick scour on data controller register but didn't come back with anything, anyone know anything about them? Are they a dormant company? I just want to send them an SAR and double check whether I had PPI, have a feeling I'm too late with this one though.
  9. hi all id be really greatfull if i could have some advice i used to take out loans with a firm called morses door step collection sort of loan i had a few of thease 1 after the other(very tempting when an agent says do i want 500 quid now your loan is paid up) i was told id paid up by the agent and not long after met a wonderfull woman and couple of months later i moved in with her 50 miles away from my home and lost contact with the agent... then about 18 mths ago i got a letter from a company called robinsonway ltd saying i owed £2711 i thought it was a joke an ignored it then got a letter saying if i paid 10% the debt would be cleared ignored also, then in jam 2012 i got a claim form from northamton county court stateing they (robinsons) want to take me to court, i went on the .gov website and gave a defence that i never had such a loan and maybe someone took it out on my behalf blah blah and asked them to prove with documents that i owed this money as of today i have not heard anything more on this matter rang the northamton court and they said my defence was sent to them and they have put my case on hold permatly.and they will have to pay to reopen the case, i know i never borrowed this amount but i am worried about all the intrst they are charging as follows amount claimed=£2711.91 court fee=£75.00 solicitors costs=£80 total amount=£2866.91 plus it says in the court papers they are charging me 8% per year and a daily rate of 0.48 and costs #] would it be wise for me to call robinsons to see if they are still persueing this or should i just wait for a bailiff to knock im just worried that they will do this and take my belongings car ect as i have read so many horrer storys thanks for looking jason ...

  12. I've been going through the DCA's as they have popped up and with CCA requests etc they have pretty much all given up. A while ago I dumped our land line number when we swapped from BT to Virgin and did the same with the mobile so it's been peaceful! Just keeping an eye on my credit file (via deal from bank with travel/mobile insurance for a good price BTW) and it's just a case of watching them drop into the SB abyss over the next few months, lord know I tried to get this sorted with the original creditors but that was like pushing water uphill so I have no issues with the situation. However on a pretty new mobile number (couple of years old) I just got a txt from Debt Managment Ltd, I'm not going to call just wondered if they are chasing and got my number or are they just one of the PPI ambulance chasers?
  13. Hi All I have recently received a Parking Charge Notice from Vehicle Control Services Ltd for parking on the approach roads to Doncaster Airport. It's their usual £80 charge going up to £120 if I don't play ball. I have ready many posts on here about this company and others. Most of these posts relate to parking in car parks so my situation is slightly different. In brief: I live adjacent to the airport and some time over the last year (I think) VCS has put up signs that basically say no parking on double yellow lines or roadways. There are a small number of areas on the airport approach road network that are not covered by double yellows and my car was parked on one of these, as their own photograph shows. Living next to the airport I have travelled along these roads many times over the last year and unless you stop your car to read the signs as posted it's impossible to read the text. Hence I have never noticed the warnings given. Many other local people I have spoken to have also not noticed the signage. maybe this is because the warning signs at the entrances to the site are situated on corners so the drivers attention will be focused elsewhere? I have read the advice on here about ignoring but ultimately I did write to both VCS, The Airport Director and my local MP. The MP has an office on the airport site so I've asked her if she's ever noticed the signage that is right outside her door. I've pointed out that I've not noticed the signage as it's impossible to read, without stopping, which ironically is the very thing that they are trying to prevent. I've also pointed out that a claim for trespass will have to show that I damaged the property (which I didn't) and that I don't believe that I was ever in a contract with anyone in the first place hence no charges are applicable. I've also said that their charges are not a fair estimation of their loss as they have suffered no financial loss and are therefore penalty charges which are unenforceable. Whilst considering my reply I came across the case in Stockport where the motorist won his case due to the car park signage and also now it seems from the Ibbotson case in S****horpe that VCS have no authority to prosecute in the first place. At the moment I have heard nothing back from either VCS, the airport or my MP so I'm sitting tight waiting to see what happens. I know that many of you will feel I have wasted my time writing in the first place but felt that if this does go all the way that I would be in a better position if I had at least attempted to put my side of the argument. Could anyone please advise what they think is likely to happen next from VCS....... i.e. what series of letters I'm likely to get. Having stated my case I plan to ignore if they continue to peruse. Fortunately I am in the position of being able to afford the cost of the County Court process if the worst comes to the worst and I have to pay, so am looking forward to possibly a new experience in life. Just as an aside my son in law ignored a parking charge notice from another company here in Doncaster. The company submitted a claim in Northampton County Court which they won because he never received any paperwork telling him about the court case. As he didn't show up in court he lost by default. Can anyone comment on both the lack of paperwork received and the fact that the court was a 2 hour drive away from where he lives and where the parking notice was issued. He ultimately paid because he became scared but could he have done anything else at this stage? Many thanks for reading this far and any help would be greatfully appreciated. Kind regards Rich
  14. Hi all, I received a letter from the county court saying the hmrc was seeking a ccj against my limited company for corporation tax. I owe 19k in total. This has risen over a few years. It started in 2001 when I was out of work for 12 weeks. I foolishly used my tax money thinking I could pay it back. I have chased this ever since and it’s got to this. I honestly don’t know what to do next. I am a one man contractor limited company with no assets. I have been paying the minimum PAYE to get my Ni stamp and taking the rest out in dividends. Now I am scared that if I go into liquidation they can chase me personally. I have tried to catch it up over the years but I would have to re pay it over 2 1/2 to 3 years to make it feasible and something I can realistically pay off. But they won’t have that at all I wouldn’t imagine. I hear of people going into liquidation and I have avoided this for 11 years. I am scared of that because it’s a massive unknown for me. I don’t have the cash to do it voluntary and I need to carry on working after it. I don’t suppose you can be a director of two limited companies whilst one of them is going through insolvency. And what happens with being able to operate as a limited company after insolvency. The other thing I am scared of is them chasing me personally for the cash. Someone who I know has said they could pursue me if they feel the company has been run badly but this is unlikely for the amount owed. Knowing my luck though they will. Has anybody been through this? If so is there anything I can do? What do I do with the pending ccj? And what happens with insolvency and the implications? I honestly don’t know what to do and I have avoided all this for 11 years now.
  15. Not sure if this is really anything to do with Santander - however:- My son has an account with Nationwide and found a payment of £20 made payable to Santander Cards Ltd on his bank statement. He queried this with Nationwide and was told it was not their problem and that he should contact Santander. He rang the phone number which appeared next to the payment on the statement but this showed as "number unobtainable". He again contacted NW and they said they would look into this. They mentioned that it was GE finance. My son has never had any form of credit (he is only 18 and a student with no income as such). As a result of them taking off this payment he has been landed with bank charges of over £45 which is a lot of money to find when you have no income. Any comments would be appreciated.
  16. Hi Good People, I've been a lurker for some time, but thought I would ask for assistance if you would be so kind. A few years ago I signed a personal guarantee to the sum of £30K for an overdraft with the RBS. Last year through the difficult economic times, sadly we had a winding up petition served & the company was placed into liquidation. The Ltd. Co. at that time had a positive balance, but because the bank didn't act quickly after the petition was published in the Gazette, many standing orders, & direct debits, wages etc came out of the account. After this, despite me phoning them & informing them that a petiton had been served (& by this time granted) it still took at least 3 weeks before they froze the account, by which time the account was left minus £20K, which the RBS Solicitors are now looking to recover via the PG. I have wrote to them explaining the above & await their reply. Some other info, I was the largest creditor (c £150K, followed by HMRC c £50K) I look forward to the replies. Many thanks MGA

I recently was asked to get an experian credit report for my mortgage the report came back with a decent 745 but a few things got brought up on it which has meant my mortgage being denied. They are as follows ; Aktiv Kapital account updated to:9/10/2011 Account type : Bank Started 13/07/2000 Default Date 11/01/2007 Balance £832 And Aktiv Kapital account updated to : 26/04/2009 Account type : Credit card / store card Started 05/06/2004 Default 23/06/2007 Balance : £352 Can any let me know how to remove these defaults so can carry on with mortgage ?? I don't even know what they are for or connected to but have read that Aktiv Kapital regularly try it on. Any help will be much appreciated. Thanks
  18. guys i received a similar letter from civil enforcement ltd few montha ago.. after reading few forums ive decided to ignore them... after the final reminder I've received a letter today saying that they are intended to take the matter to Northampton County Court. It is not from Newlyn. i wish i cud attach the letter here... Anyway the letter still looks fake to me as the County Courts Act (section 69) looks like scanned and pasted into the letter. They say they will seize my vehicle/good, and many other things they can possibly do. What shall I do? Do I continue to ignore them? It just bugging me. Please do reply
  19. I need to know if bankruptcy is for me and wil try and keep to the facts rather than waffle on.......... 1. I have a total debt of approx £72,000 the breakdown is: mortgage shortfall debt of approx £60,000 Four x Credit cards debts of £500,£2300,£2900 and £5200 (I have been making token payments to each one for about one year) Past utility bills of approx £700 (I pay them a monthly instalements) One court fine of £300 ( i currently pay this in affordable instalements) 2.My personal situation is, I have no savings,no assets and in rented accomodation. All i have is a car worth approx £4000..... 3.My work situation is I formed a LTD company approx 8 months ago and I am the sole director. (the company is running at a loss at present, well i guess so, even though end of year accounts have not been done yet!)-Basically, i am working for no wage! The company has no debt-I rent the machinary and the premises.... 4.Shameful to say but I have attempted 2 over-doses because of all this debt (as i knew the mortgage shortfall was in the pipeline and i would be made homeless!) and am currently under phsychiatry programme and improving every day and creating my LTD company is a road to a brighter future.........and i sign of my recovery...... I just do not want this debt to dictate my life any more and i need to take the reigns and see what my options are...... Ok, i think i have stated all the facts and i hope they are clear....my questions are now: 1.Life after bankruptcy-how long does it take to be discharged and will i have to declare i have been BR? Will that prevent me from obtaining a mortgage or credit in the future? will it mean my credit file is "clean" after 6 years? 2.During BR, will i still be able to have a basic bank account? how will i be able to rent a property etc? will it not show on a credit check? 3.I suspect the mortgage company will force me into BR but they will not gain anything as i have no money or assets! will i have to pay? 4.If the mortgage company leave me alone for the time being when they realise i have nothing-would it be advisable to try and offer full & final settlements on the other debts to avoid BR myself? (although i do not have money to do it myself) 5.My main worry is my LTD company and the effects of personal BR-how can i keep my company during the BR period? can i make an accountant a director until i am discharged and then be director after i am discharged? Sorry for all the questions but i am just in so much turmoil as to what to do, do i enter into a DMP? BR? F&F offers? Should i avoid BR to avoid the shame and stigma and seek alternative options so that i am not "restricted" during and after BR, I am just so confused..........Any advice is greatly appreciated!
  20. Hi, I posted this on the wrong forum a few days back: "Any advice trying to remove a default from a 3 mobile account? It is for £81 (defaulted in 2007) and is now settled as per my credit file but, it constantly lets me down when applying for credit. I have seen the 2 letters here now, do i send them both to 3 Hutchison? Would it be best to try a sympathetic approach first asking if the would remove the default from my file as it is only a small amount or go straight in with the 2 template letters?" Following advice from what I have found, I sent a letter asking 3 to remove the default from my accout as I am having problems when applying for credit. Here is the response they emailed to me: I've received your query regarding a default on your credit file reported by us. I understand that you no longer have an account with us and that you settled this account in full in 2008. However, this does not mean that the account should have been removed from your credit file at this time. When you entered into the agreement with us, you accepted that the way this account was managed would be reported to the credit reference agencies. You defaulted on your payments in 2007 and we reported this to them. When you settled the balance in 2008 we reported that the default was satisfied and we were not required to do anything more than this. I'm sorry this is causing problems with your credit file but we cannot remove the entry for you. My understanding is that a default on any credit agreement will remain on your credit file for six years but if you want further information on this I'd suggest that you contact the credit reference agencies. I must make it clear that we are not breaching the Data Protection Act in anyway, irrespective of the fact that your account has now been closed. We are obligated to provide the credit reference agencies with correct information on how an account has been managed and I can only reiterate that we will not be making any changes to your credit file, in relation to your request. I'm sorry I couldn't be of further assistance but if you wish to discuss this matter further, you can call me at the Executive Office on 08433 733330 (5p/min from a BT landline, other networks may vary). Our business hours are Monday to Friday, 9am until 6.30pm. The bit where it says My understanding is that a default on any credit agreement will remain on your credit file for six years is a bit confusing. Am I right in saying that you do not enter a credit agreement with a mobile contract? I entered this contract in 2006 from carphone warehouse. Please can someone advise me what my next steps could be?
  21. Hi, I've recently had late payment charges on 2 LTSB credit cards. This pushed one of the cards over the limit incurring another £12 on top of that. When I made the next payment I did not include the late payment charges they'd added on to the minimum payments, so they added further charges. These cards were originally an accucard and an Easy card both of which LTSB bought out. I have noticed that the interest rates have crept up to much higher than when the cards were taken out also and when I received the last replacement card it stated "for details of the interest rate please refer to your original agreement. I'm therefore thinking it's time to challenge them for agreements. I've been reading up on the latest CCA info as I'm a bit rusty and things have moved on since I last did this. I'd really appreciate any advice, because it looks a bit confusing nowadays. Adding late payment charges onto the minimum payment really annoys me. How do they expect someone who has struggled to make the basic payment be able to pay all their add ons? Does anyone know please whether adding late payment charges onto minimum payments has been successfully challenged? I'm thinking of sending a standard CCA request letter with an added bit challenging the charges. Any further suggestions would be appreciated.
  22. Weve had a telephone call from Blackhorse today to say we can cancel our PPI but our repayments on the loan wont go down due to a previous claim we made. Is this correct??? Hadituptohere
  23. Its a long first post, but please bear with me...desperate? In 2001 i had a major epileptic seizure while at work, i have never had a seizure before and was taken to hospital.(where i spent the next 4 days) Over the next 6/12 months i was having quite a lot of tests done to see what brought on this seizure. In 2002 my wife and i bought our ex-council property,when we took out this mortgage we took out PPI i disclosed my illness which hadnt stopped me from working, and the seizures were now only partial and unfrequent there was no pattern to them at all. I was perhaps having maybe 1 or 2 every 3/4 months. When the PPI was taken out as i said i disclosed the illness, it was a fixed term of 3 yrs and they contacted the hospital and my GP for eveidence. However in late 2002 i was eventually diagnosed with a ''cerebral brain tumour of the right temperal lobe which was causing the seizures'' The insurers were made aware of this i think at the time i was paying around £62 per month PPI. In June 05 i had a call from my insurers they said my fixed term was now ending and did i want to contuine it, also had my condition chnaged at all. I said yes i did want to contuine it, and yes my condition had got worse. The reply was ..well as you havent claimed against this policy before there is no need for any further medical eveidence. But my premium was now going to be £65 per month, thats ok i said. My seizures were now getting very frequent and i was having 2/3 per week i was taken back into hospital for tests. Where lucky enough they caught this one on VT test and it showed that i was blacking out but having only partial complex seizures (not full ones). I was advised by the hospital to stop working and they would go for removal of the tumour (i was having regular MRI scans that showed the tumor was not growing , not cancerous, but was sitting on a part of the brain that was giving me seizures) and the removal of it was the best option, it was in a good position to be removed. Because my mortgage was taken out after 1995 i would have to wait 28 weeks before i got any help from the DSS. I wasnt unduly worried as i had the PPI...But they neglected to pay out!!! Their get-out-clause was A) It was a pre existing medical condition. B) it was a new policy? It wasnt a new policy i had just carried on the old one, and they knew of my medical history ...so what were they covering me for and why was it a higher premium? I went thru the Financial Ombdsmen/LLoyds back and fourth went the letters and then they changed the reason they were not paying out to: ''they didnt ask me to go for a medical i wasnt covered for the only thing that was wrong with me''?? Where can i go from here as to trying to get redress from either the insurers or brokers (was the policy mis-sold)? Anyway late 05 the mortgage company try to reposess and take us to court, the judge awards them 28 days? I borrow some money and employ a barrister who takes it back to court and this time we get a good judge who sees we have done all we can to resolve things and allows 3 months to sell the property, which we do in a week and are now in rented accomodation. We have a 17 old at college and a 13 yr old at school. When we were in court on the second time the mortgage company sought reposseion or £146k settlement. That was the figure they asked for. When we get the last statement after the sale we see they mortgage company have taken £156k, They say £8k on early settlement figure £2k on fee's. IMO an early settlement is the same as penalt clause in this situation (ie we were forced to sell) and therfore a penalty clause is NOT ENFORCEABLE in a court of law. I have now asked the barrister to look into this, he said the Penalty clause is NOT ENFORCEABLE IN A COURT OF LAW, but they are trying to get round it by saying it was an Early settlement figure, which they would be intitled to ''if i moved mortgage companys to find a better rate'' for example. Does anyone know of a case like this? What was the outcome? ANY help would really be appreciated, although we could really do with the money i would rather the barrister had in fees, than let the mortgage company have it!!! Thanks for taken the time to read this long post...appreciate it! well second like an idiot i posted in the wrong forum i posted under ''general consumer issues'' insted of looking at the site properly, so appologies to the MODS and other users of this board. please have a look in the general forum under ''repsosesion/PPI/early settlement'' I would really appreciate it if someone could take a look at for me or if the MODS could possibly move it to this forum. I never knew so many people had probs with gmac/eversheds llp (solictors) Thanks again all and i will update if i get some news from the barrister Three threads merged
