Hiya You will have to hand it in at the court on a written document which is what i did, the courts dont like using a PO address, i used the same address as you have to serve them, they acknowledged it on the 26th of june got a letter from the court saying this the next day BUT IT ALSO SAID THEY WERE PLANNING TO DEFEND THE CLAIM HA HA .!!!. Went to the bank today after buying a desperately need hedge trimmer as garden is like a jungle, and checked my balance today 29-6-06 so as not to go over overdraft when buying food for weekend, and did a YES YES YES outside the bank They have paid me all of the claim, in two payments marked as Cash. and i still have an account with the overdraft facility. So i am more than happy. SO DONT YOU DARE BOTTLE OUT KEEP GOING. iM ON TO THE NEXT LOT NOW.

Hi there nearly at the end with Halifax she says rubbing her hands together, now turning my attention to Capital One, who have supassed all expectations with the DPA, I have every single peice of information they hold on me, NO Joke, seriously i got my £10 worth. not only did i get what i asked for but all my other credit in fo they have too. Which is interesting to say the least, good job i am clued up or i might be thinkin it was done to baffle me. So bottom line i am going to ask them, to take off all the charges reducing my account by nearlly half, then i am going to settle the account in full if and i mean only IF they remove the default and re-instate my account. If the answer is no then i will ask for a reduced settlement figure lol. So this will be interesting. Will keep you posted guys.

OK here is a suggestion, submit a financial statement to them a break down of income and outgoings, making sure you don't leave yourself short, get the interest fixed too if you no longer want to keep the card. Local CBA can help there, if you can't get them to agree to fixing the account so no more interest is added. They can't bully you this way, you can only afford to pay what you can, afterall they took the risk of lending you the money, Unsecured lol.....let them take the strain.

Hiya, court papers have been filed at the court just waiting to hear now, in the mean time after the 14 days of the LBA This Sat i got an offer from Halifax for £285 as a gesture of goodwill..... Well whilst that is nice i think they should have added another 0 to be anywhere near my amount owed to me by them. So will say ok but not as full and final settlement. as i intend to uphold the claim i have since filed, do you think this sounds ok....?

  8. This is what really narks me about Halifax: In the good old days they sent me a letter snottily informing me that they were going to deprive me of £30-£39 for a bounced item. Then they persuaded me to switch to paperless banking via emails. And et voila, I've reduced their costs and I get the same snotty letter charging me the same amount despite them not having to fork out for a printer, paper and a stamp. Have to say that is a very good point you have raised there, Im now thinking, i should revert back to Mr postie, to get my monies worth, from the bank that offers a little extra, i think they meant to say .....They take a WHOPPIN XTRA, that way i will not have to fork out for copies at any time.

Hi Everyone, Firstly thanks for all the encouragement & support through this, I am on my 12th day of LBA being hand delivered, posted and recorded so no worries about them recieving the LBA. 14 Days are up Saturday. So Monday its off to the court to hand in my court papers. In the last twelve days ive heard nothing from the Halifax, in a way im glad because i don't have to read a petty offer letter from them and get more annoyed. Since starting this i am in the process of having one ccj removed, via Capital One bank credit card. I applied myself. I used the futher information that i was unaware of at the time, I have also sent out other DPA's which i will list on here over the weekend, so you can see how far i get with them all. Those included will be Egg, MBNA, Citi Financial, Benificial, (yeah right).!! and first direct. Capital one. Dread to think of the grand total.
  12. Almost forgot, when you go on some webb sites they have COOKIES which pull out information from your hard drive Information about YOU. so always logg off and delete that COOKIE.!!:o
  13. Hi, Have read the above Poor you ghastly thing to happen. Do you or did you ever use a computer at work for online banking, it is possible to access sites logged in if you go back on the history sometimes. Shocking i know but possible. I discovered this when my friend was checking on his wife, he got on to all her dating sites and read all the mail from guys, just by going back on the history. Hence no longer married to her. It also made me aware what is possible on a pc so i always clear my history and cache and temp internet files. before i let anyone on my pc. I am on old dial up, because i shop a lot on the net etc, it is supposed to be less easy to hack than broadband so i hear. This is just an opinion, of mine above, but worth thinking about. It could well be someone you know. I am inclined to think it is 80% likely too, that it is someone you know. A previous partner?????? One other tip i never ever shred anything or throw it away, i burn all personal papers. And i keep all paperwork out of prying eyes. Sad world we live in sometimes.
  14. Glad to be of help, i always read the small print now, Most small print normally contradicts itself in one way or another so scan over, you might find that vital point. Sounds to me like you will get some help with costs if not all of it, any way it will be the Halifax GIVING that little XTRA help in other words they will end up footing the bill for costs, they can easily afford it on their profit margin.

Hi Pete, not sure if this will work, but those on benefits show a copy of this to the court and they pay the cost, their is also a low income form you can fill out if your income is £15,050 gross per year, if you show the court also that the cost of the court fee would endure hardship you can apply for a fee exemption/or remission. Ask your court for an EX160A form. This could possibly be another way of helping us all on this forum. Give it a shot Pete, it gets you to fill in out goings and income, if your case looks favourable even better. After all it is only a mug that backs a loser. And i know my local court aren't Mugs.   17. Firstly they know these charges are unlawful, you need to do a few things here to get the debt collectors off your back. Write to them and tell them you dispute the actual amount owed and you are pursuing the repayment of unlawful charges, and that you are going to write to the court to set judgement aside. You can set judgement aside for serveral reason's, Include this copy of the letter to the court in with the debt collectors letter, One reason is you accepted the full amount in the begining, and you have new information that you didnt have that you are now disputing some of the debt. In other words you were not aware that the charges applied to your account were unlawful and that you could claim these back. Remember to keep copies of letters too. I was in the same position Saturday and i spat venom down the phone to those nasty debt collectors because i now know about this site and the unlawful charges. I googled removal of ccjs and found out how to ask for judgement to be set aside. My letters went off this morning. Hope this is helpful.
  18. Have not sent DPA yet to these guys, but had an accident whilst i had my account running, lucky i had PPP with it. Yes they paid out a yrs worth. But my balance remains the same, in excess of 12 k I am not back at work. Due to my accident. But wait till i hit them with the DPA charges. I am sure my balance will drop considerably. They have been good though not registered any ccjs as of yet.

Way to go....i had a letter from egg solicitor, i posted the DPA to him asked if he would pass it on to his client, as i had no luck with them responding to my letters in the past, have not heard a thing yet hehe.!! I also pointed out i had PPP with them and that they had failed to pay out after an accident i had whilst on holiday. So i have given them plenty to think about. Once you get a result, i would be inclined to ask for a lower repayment one you can afford, with capped amount owing and the ccj set aside. And all defaults to be removed. If they go along with this your credit history will improve as you will have a record of steady reguler payments and thats what credit companies look for. Long winded i know but should work in your favour at the end of it.
  20. Hello there, I think they have come up with this to scare monger you, or for you to back down, personally i would keep to your time table and send them the LBA. I would also send a seperate letter enclosing a copy of the above, pointing out you note the contents of their letter, and if they wish can argue their point in court. Bluff plays a big part in this world, no one has ever said it's a one way street. As i said send your LBA in one letter and post the above in a seperate letter, as the Halifax have a way of addressing only one issue at a time. Fustrating i know. The above comments are my opinion, what you decide to do is up to you, but you have come this far, the road ahead always seems to take longer getting there than it does to arrive home. Good luck we are all supporting each other here as we are all in the same boat.
  21. HI Yes i agree with Bookworm, keeping everything in writing is the best possible way to keep logs of everything should you need this later in court. It is much harder to prove who said what over the phone, and they cant deny any thing in written correspondance. Where as they could lie about phone conversations. We all know they tell porkies thats why were here on this site. Keep up the good work and the courage to go the full mile with them, i don't know if you have noticed but the Halifax have the highest number of us on this site, Always getting that little XTRA ha ha.

Hi Mr Beale, I see you too have recieved letters from CaryAnn McEwan, judging by my response from her as well as yours, i have come to the conclusion, She can not understand the basic meaning of the English language. It is my asumption that she has roughly 5 standard letters on her Pc and it's pot luck which one you recieve. Maybe she has been employed as a deCoy.!!!!

  25. I took my DPA letter into the branch, without any dosh......or cheque enclosed. I got a letter back within 4 days telling me they would require £5 for the statements, I could either send them a cheque or give them permission to debit my account, As i was hard up due to nearly £200 worth of charges at the time i gave them a date when they could take the fiver a week later, it was 8 days later i thought i had been mass mailed by some freak...thousands of letters dropped through the letter box containing all my last 6 yrs statements. I filed them and highlighted all the relevant charges in one colour and interest in another, then added it up worked out my 8% and sent the next letter off the next day requesting payment. Now im getting the go slow and act dim from the Halifax. I am assuming now the Xtra at the Halifax means Xtra delay xtra charges and xtra stupid.
