  2. Hi woodentop, have read through this and it is the same one I used for all 3 CCI claims to Cap One. Looks good to me You must have a big claim here for a court fee of £250
  3. Icy, Cap One seem to be removing defaults, I have had mine removed plus the late markers on my credit file, also got my O/Hs removed. As UK says keep your claim intact, do not accept the money until you have confirmation that they will remove the default. When you get your offer letter hopefully it will also say they will remove the default, you will then receive a letter from the credit file amendment team confirming that they have done this with Call Credit, Experian and Equifax. Not long now
  4. Have now received their 11 point defence. Looks the same as a few I have seen posted up, have also now received the AQ which has to be in by 6 August, so will now start to prepare this. As of yet no offer, I have read on quite a few threads that you may get an offer of 65% - we will see.

    Hi DS, strange directions from the Judge, perhaps he dealt with your paperwork after a liquid lunch . Will be interesting to see what response you get from the court once they have received your letter, I would definately write in as well. Have now received my defence, same as yours, except for No. 7 where they make no mention of interest. Have now also received allocation questionnaire, so will now start to prepare that. As of yet no offer. Will be watching

  8. lynne, I got the same letter about the court date at Southend Court, I have not informed them that my claim is concluded yet as I am still trying to get the Allocation Questionnaire fee, if I find out anything I'll post up on your thread.
  9. You have no worries with Cap One ICY, your claim will be done and dusted within the next 28 days, once it is served that is. Keep the faith lol

  11. Totally out of order Icy but you know better - you will find Cap One a stroll in the park compared to your dealings with Abbey, which I am watching closely. Are you claiming statutory or CCI? Also, you will get your default removed, got mine and my O/Hs removed, also the late markers on my credit reference entry.
  12. Hi sowerby, I have not stopped the claim yet but have had notice from Southend Court that the Allocation and Case Management Conference will take place on 13 September, which I should attend. Will now write another letter to legal dept about my allocation questionnaire fee. I really do not think I will get any more money out of them though, also not sure what the above is, seems tome that there are alot of cases all on the same day/time.

  14. Hi louis, thanks for answering, I have a feeling I will need your help soon. Not worried about doing AQ, have done one for my cap one claim. Must start doing some more reading on Abbey claims though, are they paying out any quicker these days?
  15. Did you ring the court, just wondered what they said, I would have thought if you were awarded judgement then you would get the full payout. Keep us informed.
  16. Hi Sowerby, saw your posting on another thread and thought I would pay a visit. As Paintball says, read my thread, my claim seems to be going on for ever, the long and short of it is that 2 months after my rejection of their offer they have finally made a GOGW of £200, my claim is still short so have to now decide whether to call it a day or carry on. They are not easy to deal with as they are extremely difficult to contact, they promise you replies but you receive nothing - so be prepared to be patient. I will keep an eye on your thread now, if I can be of any help give me a shout.
  17. rockinrodders, stick to your guns about the default, do not accept any money and if they send a cheque return it, tell them the default is linked to your claim and you will only stop the claim when they have done so, make sure you get everything in writing. They will remove it, I got mine removed plus the late markers on my credit file, my hubby also got his removed. As for your offer letter, I am afraid it is the same one I got. Two months after I refused their offer I did eventually manage to get them to enter into a dialogue, at the moment they have offered another £200 as a GOGW.
  18. Just to update, the case went to court, the judge decided that the first year's subscription had to be paid plus the court costs but threw out the claim for the second year. The Judge also reprimanded the claimant for the way he has chased the debt, going against the OFT debt collection guidelines, which we had added to the court bundle, apparently he has been told of this on a number of occasions. We are now going to complain to the OFT - on the Judge's recommendation that we were fully entitled to do this. The debt has now been paid in full, the court has been informed by my friend that it has been paid, they have made a note but apparently cannot update the file until the claimant informs them.
  19. Defence received, haven't seen it yet as I am waiting for my brother to send me a copy, sounds like it's about 3 pages, not sure if this is the norm, will update when I receive it. His local court is Romford, does anyone know if they are using the draft order?
  20. Thanks sonja, paintball. Cheque received, minus the £100 for the Allocation Questionnaire. As I have already said they have informed me that the £200 GOGW received more than compensates me for the AQ fee, now, have to think what to do next, do I call it a day or push on. Any comments?
  21. Hi KMS - don't panic - take dpick's advice and first thing Monday morning ring the court, they have awarded judgement by default back in June, Cap One cannot work to their timetable, they must abide by the court's, at least that's the way I see it.

    Icy, that e-mail is brilliant, have been following your thread for a while as I am currently working on a bank claim against Abbey for my brother, have filed N1, Abbey have filed acknowledgement of service so am really just waiting for copy of their defence. Hope this works for you, will be watching closely.
