  3. The additions and overdraft charge is for a service which they provide and as such is not a penalty, so unfortunately you cant get that back.
  4. They may be the monthly charge for having an overdraft and as such are a service and cant be reclaimed. Dont forget to do the interest on the DDs etc. Vampiress has a spread sheet about it from the library section.

  7. Now just spent two hours reading through this thread and my you dont half miss alot with not coming on for a few days. Dont forget we are all entitled to our own opinions. I would defend anyone for having their opinions even if I dont believe in those opinions.
  8. DK has given money to the site and is prepared to stick around to help others, which is another form of payment. It is only suggested a 5% donation but more importantly it is the help he can give to others. I have been on here awhile with several claims going through and more to come. What I do see is that new people join the site and seem to ask silly questions straight away, but I remember when I first joined it was quite difficult to navigate but I spent the time getting to know the site first before doing anything else. This is invaluable. The mods and site helpers are great plus alot of regular users who offer their advice and it does create an excellent forum in which to claim back these unlawful charges. DK has raised points about the level of help and it was just a thought but would it be possible to have a duty moderator/helper whos job was to check all posts for questions thus avoiding some slipping through. Whether the amount of posts would allow this? It is only a suggestion.
  9. Thanks at least it answers a question.... GEOs of the big banks are on at least £15,000 per day so that idea is a non starter. And if they can avoid the the answers in a commons select committee I am sure a normal court of law would hold no worries for them.
  10. This may be a stupid question or been covered elsewhere. Would it be possible to call a Chief Executive of a bank as a witness? Thus getting them on oath to give a full disclosure of the true costs, how much profit etc
  11. It might be worthwhile emailing Keith Jeremiah at barclays now and just asking if they are prepared to settle before it gets to court. I have read of others who have done this and Barclays have settled in full. This is what I intend to do.

I am waiting with baited breath for their defence so as to email them and hoefully cut a deal. Would be interested to know what you put in your email. Once again congratulations on getting back your money.
  13. They put in that they wished to defend right on the 14th day, surprise surprise!!! Then got the defence on Saturday with two weeks still to run. it is now in London and the famour Keith Jeremiah dealing with it. So his department must be dealing with all claims against the Barclays group. One thing that appears to be strange is the fact that they have refunded me the difference between £12 and £20 on all their charges and credited this to my Barclaycard account even though I had not accepted it. No mention of this in their defence though. They have also said they have identified me and put the account number in but this is not my account number??? Now have to do the AQ and get that back before 2 August.
  14. It seems to take such along time for you to finally get a court date, justice is slow. I am still waiting for the defence to be submitted, so might get my money back before Xmas.

  16. I dont agree that you should forget about the interest the banks have taken off you. They have illegally charged you in the first instance and by only claiming back the charges plus the 8% is not a fair reflection of how much you are out of pocket. I did my interst calculations myself with Excel. I did it by the number of months and found out the banks monthly interest rate (monthly) and times it by the number of months since the charge. So for example if you were charged £20 in July 2000 then times that by 1.22% (my banks monthly interest charge) times 60. 20 x 1.22% = .244 x 60 = £14.64. This is a very simple way of doing it and does not include times when you are not overdrawn but it is a good basis to start with.

I have filed mine in just my name although it is a joint accoint and I also included my own account in the total amount with the interest, I am waiting to see their defence but may have made a mistake I will wait and see. The principle is still the same though. I am sure it will be settled before it gets to court.

I am in the same boat to a degree, I have claimed on joint account in just my name and I am hoping that when it is settled the payment will be made to me .... my ex does know about it and I am hoping to be able to pay her a smaller percentage as per the house being split. If and when you get it to the court stage do it just in your name.
  19. When I sent my LBA stating the amount they came back with a different amount and on checking the amount they had said was correct. So doing a good estimate might get them to come back to you with the exact amount. its worth a try. They will then offer a refund of the difference between their charges and £12 and when I phoned to say I was taking it to court they would not increase their offer. So its off to court. Good luck

The charges that Northern Rock or any other bank makes are in breach of contract for exceeding an overdraft, and they could only charge for Liquidated Damages (which are what it cost them for your degression) and it is quite simply a penalty charge. If they charged for liquidated damages then they would not be the same because different customers would warrant different amounts of time being spent on a case by case basis. This is set in case law going back to the 1890's.
  21. Was given advice to look at the National Debt website which is a fantastic site. Spoken to Barclaycard again and they are saying that they are trying to reinstate the insurance and will get back to me. The debt collection agency that bought the debt from Barclaycard are a typical b*******s that wont listen.
  22. I am in the same boat as you and just got back that Barclays are defending the claim and off to do even more thorugh work on preparing a case. No doubt Barclays will wait till the last minute to submit their defence. Although their acknowldegement came through in less than a week. Good luck with your case and will be keeping a close eye on events.

Finally put the Moneyclaim in against Barclaycard and checked my figures and they were as per the letter from Barclaycard, so at least I know it is the right amount I am claiming back now plus the interest and the 8% totaling over £600. I am not registering the claim no etc on the site because I believe Barclays are stopping members from posting their successes against them and they must be doing a Tomlin Order to do this. As I cant be identified from what I have put on the site so far I am hoping I cant still report my victory.
  24. Got Letter from Barclaycard this morning offering me £112 of a total of £728 of which £288 was the interest. I had gone through all the statements and added it up to £440 but he stated that they have only charged me £400. Interesting that they seem to have this information to hand despite them claiming that all statements prior to May 2004 have been microfiched!! So can a DPA just request the amount a person has been charged? Done the request for repayment and LBA and the moneyclaim can now go in but do I write back rejecting this offer first or just continue.
  25. Thanks for that .... I have received a letter from Barclays this morning stating that my Insurance Policy has been cancelled on 7 Feb 2006 ..... First time I have been informed of that and now no further payments will be made.. I am off to see the CAB this morning and I shall let you know how I get on.
