  2. Hi Gary and all I don't live anywhere near the court can I post the AQ or do you have to hand deliver it? Thanks
  3. Thats great Thanks so much for your help.
  4. Hi Gary Thanks for that I don't mind losing those few weeks, but was worried it would affect my claim. Do I submit a new spreadsheet with the new date of 12 February and do I have to answer to the Point 9 on the questionnaire. Am a bit worried about it. Thanks
  5. Thats great thanks for that Michael Do you have any advice on Point 9 please? Also she has a joint account with her husband can just one of them go? Thanks
  6. Could anyone help me on the following points please: I am reclaiming on behalf of my sister, she will not go to the court so in section d on the allocation questionnaire do I put myself down as a witness and can I go to court without her. Or is there anywhere I can explain this? Also point 9 in Lloyds TSB defense states: Claim is based on charges levied on their account prior to six years from the date of issue of their claim, that is 12 February 2001, this part of the claim is statute barred by Section 5 of the Limitation Act 1980. The defendant is unable to verify the amount claimed prior to the 12 February 2001 as the Statement Of Claim does not show how the amount claimed is arrived at. The 12 February is when I submitted my claim with MCOL but the first letter to them was 21 November 2006 so I have requested from 21 November 2001. How can they put this and how do I respond to it. Any advice please
  7. Thanks for that I think I will ring moneyclaim customer service desk and ask if I can add it as I only submitted it yesterday and it will not go until 10am this morning. Worth a try:)
  8. I have already submitted how can I ask for a cheque anyone?
  9. Hi I have just submitted my claim against Lloyds through Moneyclaim online. Somewhere on here I read that you could ask them to pay by cheque as my account is still overdrawn so I don't want it to go into there. I was expecting somewhere on the claim for me to put this but there wasn't anyone know how/where I do that. Thanks
  10. I received a letter from Lloyds saying they would send me a cheque in the next couple of days for half the amount (£750). Now I still intend to go to court for the rest and am in the process of doing that. Do I just deduct the £750 from my claim? Also do I write to them and say thanks for the cheque but am still going to court? Any advice
  11. Thanks ok I'll be kind and give them an extra week thanks for your replies
  12. Hi There I have just sent my third letter to Lloyds as they had not replied to my second. Today though I have received a reply to my second letter (just saying get lost really) anyway it was within the time frame and from the Customer Service Recovery Centre in Hampshire. I wrote to the main London address. My questions are: should I now send a copy to the Recovery Centre in Hampshire AND should we be allowing more time for the holiday period. Many thanks and Happy christmas
  13. He was buying from my account (mostly mobile phones) and sending them a fake paypal email telling them the money was in the account. Like I said he was giving a name and address of where to send the goods. I was getting emails from people saying but you've paid me through Paypal why do you now not want me to send the goods.
  14. The password was left unchanged until I changed it as soon as I realised what was going on. The thing is it was a Saturday night when I logged on and realised what was going on, now I normally only log on during the week and if i hadn't have done all of these people would have sent the goods and been out of pocket. Seems to me Ebay didn't act for so long they did nothing to protect me or the sellers. I thought they would have a duty of care or something. Just don't seem right :-|
  15. True thanks for that Buzby was just so angry I guess but your right its their ball and playpark. I'll just have to get over it.
  16. Hi Buzby I emailed them through their help pages in their Security centre. It took 3 days for them to close my account and they have still done nothing. I don't know how I got hacked I always ignore emails from them that has a link. Do you know of anyone higher I can report them to. Someone suggested Watchdog as I have kept all the emails and screendumps etc.
  17. Hi Popynurse I have done exactly what you ahve done and no response
  18. Hi Am new so hi to all. On Sunday 22 October I logged on to my computer to find 78 invoices from Ebay, someone had stolen my Ebay account and ordered over £9000 worth of products. I was really distressed and rang the police who told me Ebay had to contact them. I emailed Ebay and got no reply. As I began investigating what was happening I discovered that they also had access to my email account and were sending emails from my screen name to the seller. I emailed Ebay again and received no reply. I then began to email the sellers telling them what had happened. I received emails telling me the goods would be shipped to: the name and address were there. The sellers had received an email from Paypal telling them they had been paid. I was by now frantically emailing Ebay and contacted each seller seperately to tell them not to send the goods. I took two days off from work and emailed each seller telling them to not send the goods, the Paypal email was false and to report the matter to Ebay and the police. Some people could not believe it and were actually emailing me back telling me they had been paid. Some were sympathetic but could not believe Ebay were not doing anything about it. Some had left really nasty feedback so underneath the feedback I explained what had happened and advised everyone not to send the goods. On 25 October after three days of emailing Ebay and receiving no reply my account was suspended and I have still not had a reply to any of my emails. Had I not gone to the extreme lengths I did a lot of sellers would have lost a lot of money. I have done everything possible to help all 78 sellers and protect them from losing money. I had to do what Ebay should have done to protect the sellers they have done nothing and have not even bothered to reply to me. This shows the site is practically operating on its own as Ebay are not intervening when something goes wrong. I am still suspended from Ebay the crook got away with it when I had a name and address and Ebay have still not replied to me. I was really stressed and some of the nasty emails I go from sellers was unbelievable when I was helping them. Is there anyone else I can report them to. Thanks please help.
  19. Hi This is my first post so please be gentle if I do something wrong. I am also about to make another post about Ebay so help there would be appreciated (not much going right at the minute). In March I purchased a sofa from Harveys buy now pay December, I also purchased accidental insurance for 5 years at a cost of £150. On July 25th I rang to make a claim on it as my husband had scratched down the side when moving it. On 28 July I received a phone call for the technician to visit. On the day I got a phone call saying the van had broken down and the next available appointment was 14 August I agreed to this and took the day off work. On 14 August when it got late in the day I rang and asked where he was and was told he had been and I was not in. I told the girl I had been in all day and no one had called after several more phone calls she said he had gone to the wrong house and he was on his way. He came and took the photos and said he would be in touch. After two weeks of not hearing anything I rang again and was told the emails were lost, then another phone call that they had gone to the wrong address. Two weeks later I received a call saying the technician would be in touch. After five days of not hearing anything I rang again and was told the technician was sending to head office for a colour pigment that was 29 September. After two more weeks I rang and was told the technician would have to come and take a swatch. After another week I rang again and was told someone would get back to me no one has yet rang back. The phone calls have been to both head office and the local technician. I wrote on 23 October to both Harveys and Multimaster and today I got a letter from Multimaster saying they will look into it and get back to me within 28 days. I just don't want anything else to do with them but don't know where I stand on paying in December. Can anyone help please.
