  1. This has all turned sour, the garage attempted to fix the fuel light however in the process messed up the fuel sender unit which we discovered when the car was leaking diesel. We then took it to a local trusted garage who sorted out the leak for free but informed us of various other problems ie 1) non existant rear suspention 2) bent stub axle or knackered bearings on the driver side rear wheel 3) fuel sender unit had been sealed with bathroom sealant and had holes drilled into it 4) Needed valet on back seat where fuel had leaked through 5) original fuel light problem. They had the car for almost 3 weeks and fixed most of the problems, but today they informed me they aren't prepared to fix the wheel or valet the back seat. I now plan to take legal action to force a refund as the car is unfit for purpose and they took an unreasonable time fixing it, i also plan to claim back any fuel used going to the garage, taxi fares used for getting to work when car was getting fixed, and damages as its actually the girlfriends car who is 7 months pregnant and this has caused loads of worry and stress. I plan to get the AA out to do a report on the car and will also be looking to retrieve this fee. Does this all sound feasible and does any one have any advise...luke
  2. Hi mate, don't worry i had exactly the same with DG, i got the court date before they paid up. I'd imagine you be getting a letter within the week with an offer, or at worst at least now you have a date that they'll settle buy.
  3. Thanks very much for having a look at the thread and for the advise Sparkie, i think i'll go down the n255 route first then and see what happens from there.
  4. Thanks kelly and wobbles, would i be right in not claiming for damages as in my details of claim it says it's up to the courts discretion?
  5. Hi, just wondered if any one could clear up a couple of questions for me as i'm filling in my N1 form for non compliance under the data protection act. I still haven't recieved all my statements yet and i've been far to lineant already. 1) i'm unsure what to fill in in the "value" bit of the form 2) not sure if this is a breach of my human rights 3) i'm not sure what to fill in on the amount claimed bit at the end, i assume i'm not claiming anything. Any help especially from anyone whos gone through this would be much appreciated
  6. Hi mate, i'm in the same situation, i've even complained to the Information Commisioners Office who basically told that HSBC are telling the truth and my case was closed. I don't believe this for one minute though, however i don't know what to do about it.
  7. Hopefully your right Bong, i guess the only other option is to estimate the charges from the six years worth of statements already recieved, however this seems abit dodgy to me.
  8. Hi i had a letter today from the ICO saying my complaint against HSBC only providing 6 years worth of statements had been closed because " I am aware thet HSBC operate a strict six year retention policy and so it is my view that they have complied with you subject access request already." Gutted, looks like the ICO is siding with the banks on this one
  9. The problem is trying to get it from them though, when the ba$&*rds deny having it.
  10. I had the same problem with HSBC, they claim to only hold info for 6 years
  11. Hi mate, i had the same thing with HSBC. I waited till they agreed to pay out then sent them another letter basically saying, i would be prepared to claim again for the new charges, but felt it would be easier and cheaper for us both if they added it on to the amount they were going to pay out, which they did.
  12. Thanks alot, i will have a good look at them
  13. Hi, it looks like i'll be going down this route soon with Nationwide. Is there any links as how to file a non compliance claim, as i'm not sure how to proceed with this one...luke

I also included I.D with my SAR request, hopefully they'll have no reason to delay, however i won't hold my breath just yet.

Hi alison, i couldn't agree more with Cornucopia, £10 is the max you have to pay for all the info they hold on you, don't let them take the p##s. Just follow the step by step guide, use the template letters and ask advice when needed and you'll get your money back. I personally won't communicate with any bank or credit card company over the phone in regards to this issue, i want everything in writting.

Hi i'm a bit confused about interest, if i've got this right you claim contractural interest at the start, but do you then claim another 8 % once you do the mcol claim.
  19. Hi Rosie, thanks for the reply the car is a y reg(2001) and has done 116,000 miles and cost £2050. It's in really good nick apart from the listed faults. I rang up the garage today and left a message saying the car should be working properly when driven of the show court as these problems certainly weren't brought to light. If they refuse to put it right i plan to get it fixed else where and forward them the bill, i will persue through the small claims if necessary.
  20. I recently bought a car from a used car garage, the fuel light was on when we bought the car so we assumed it was because it was low on fuel, however once we filled it up the light stayed on. I've rung the garage who informed me this isn't covered in the warrenty, i'm sure i'm covered on this because of some kind of consumer rights act, however i would appreciate any advice.
