  2. Er.........the only time I used it was on MoneyClaim; its what I entered in the Particulars of Claim field........... Both my claims were settled within 8 days of issue!
  3. Hi Mandi, This is what i used........... Claimant has account 0572/xxxxxxxx with Defendant from xx/xx/2003 conducted on their standard terms and conditions. Claimant is claiming the return of £xxxx.xx taken by Defendant in charges from xx/xx/2003 to xx/xx/2006. The Defendant's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. They are also invalid under the Unfair Contracts Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999.Para.8 and sch.2.1.e. In the event that the charges are not a penalty they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. Defendant has declined justification of charges despite repeated requests. The Claimant claims interest under Section 69 of the County Courts Act 1984 at a rate of 8% a year from xx/xx/2003 to 12/07/2006 of £xxx.xx and also interest at same rate up to the date of judgment or earlier payment at a daily rate of £x.xx Good luck ! Tazz PS Just reading your posts again - you have sent the prelim letter; the next letter you need to send is the LBA, then you need the above for Money Claim..........

  5. bathgatebuyer - you will win! I went through all the emotions (thinking I would be the test case etc) but they paid up. Have checked my account tonight and the court costs have been refunded - as expected.......... Rest in by Monday - just as they confirmed on the phone. Follow the procedures here - you will win ! Think of it as a savings plan - now is the time to cash in !!! Tazz PS Let me know if you are in bathgate; there is an easy way to get round the Scottish court rules..............
  6. Ting Tong - my second claim was issued last Friday and they have just confirmed by phone it will be in my account no later than Monday 21st. So, hopefully, you will have your cash by the end of the month! (Remember the 28th is a bank holiday.........)
  7. I started a second claim last Friday as I wanted to keep my first claim under the £5000 level and keep the Moneyclaim costs down as well. My claim was acknowledged on Monday 14th and I have just phoned them to find out the position as my account is being closed early next week. They are currently working on it and it will be entered tomorrow; funds will be in my account no later than Monday 21st. So if you made a claim around the same time - start checking your account!!!!!
  8. kevcr - I claimed on a joint account and just put the claim in my name. As for the account number, I put it in the details of claim section and used it as the reference on the claim. Good luck !
  9. Well, just had a phone call back from them.........very prompt! Would you believe it, there is a letter in the post to me, requesting some ID from me before they can issue the statements. What a coincendence, eh! In the space of 15 minutes, they have gone from having no record of my request, to having sent a letter out to me "which maybe waiting for you when you return home". Aargghh:x
  10. I have just phoned Endeavour and they have no record of my enquiry and have not requested my statements. Funny thing is, when I mentioned the letter was sent by Special Delivery, they found it within about 10 seconds. They do not charge for statements so I look forward to the return of my £10 ! They are getting back to me with a date as to when I can expect the statements.

  13. Well good luck nursiepoos - I received notification of their intention to defend on Wednesday 19th July, and the money started to go in on Thursday 20th July. Remember - it can appear at any time of day............. Tazz
  14. Thanks ! The claim was submited early on the Wednesday morning, and was issued by Money Claim on the same day. It was acknowledged by Nationwide the following Monday, their notice to defend was 2 days later, then on the Thursday the first batch went in with the remainder on the Friday morning. Total time from hitting the submit button on the claim to the funds in the account = 8 days!
  15. Its a bit after the event - but I won ! The money was paid into my account in two batches; interest and costs on July 20th and the remainder on Friday July 21st. Total £4798.29 !! Thanks to everyone for all their help on this site. All I did was follow the step by step instructions here, and go through all the emotions as well......... I was overjoyed when I found out - but not half as surprised as Mrs Tazz ! All those evenings logged on were not wasted............ Good luck to everyone making their own claim. Tazz
  16. If you have severed your claim, is it necessary to go back to the prelim stage for the rest or can you just go for the LBA ? Looks like good old Nationwide have been making a few refunds this week.........

  18. Help ! I am just about to submit my moneyclaim on line but have a question regarding the interest. My claim is under £5000, but adding the 8% interest on would take it over. Is it only the initial claim that must be under the £5000 mark to avoid being liable for costs or is the interest included as well??? Tazz

  20. Letter received from Nationwide this morning........... We are aware there has been a lot of speculation about fees and charges in the media and that the Office of Fair Trading has issued a directive regarding credit cards. Really ? :o We hope that you will feel that you can abide by the terms and conditions of the account but if you cannot, then regrettably it may be appropriate for you to consider alternative banking arrangements. So its okay to keep charging me each month, but once I question the charges...................... .........I am unable to refund any charges on your account. LBA getting sent this weekend - a couple of days ahead of schedule !
  21. I sent my prelim letter to Nationwide on June 13th by Special Delivery and plan to follow it up next week with the LBA. However, I have heard nothing in response to my letter - is that unusual ? I was expecting at least an acknowledgement of my prelim letter..............
  22. Well the statements arrived today, Special Delivery, 21 days after I posted my DPA request. Off to do some adding up..................
  23. Hi, I sent my DPA request three weeks ago - but still no statements. I realise they still have time to send them; I was wondering how long other people are finding it takes Nationwide to send out the statements ? Tazz
