Hi there, ok the latest is that Barclaycard have now taken back the £77 that they had given me back on my account (id sent a letter saying that i reject their offer if it as i final settlement but would accept as a partial payment) and their 10 days is up! Time for MCOL, any ideas of help?? Thankyou-Craig

    Hi all, just a quick update: Hsbc/DG has until March 20th to lodge a defence, i just thought it was a bit odd that only yesterday (6 days before the deadline) my brother recieved another offer from hsbc, not DG, for around 70% of what we are claiming! They offered exactly the same after our first letter many weeks ago, i just find it odd that it is now in the hands of their solicitors (DG) and yet they make this offer!! Any ideas people?   5. Thankyou gizmo, just one more final question- It is ok to go ahead and send the N1 once iv filled it in even though iv previously sent Citi two different amounts in two different letters?

Hi again, BAD news im afraid!- I sent the first letter to Halifax requesting the info on my girlfriends mum's charges on 24th of Feb along with her cheque but i found out today, quite unbelievably, that the cheque bounced!!! Her fault, not mine!! Can you please help me out as to what to do now? Im willing to send them a cheque, would this be ok? Does their 40days start again from when they recieve my cheque? do i have to send another subject access request? Please help me when you can....

Hi everyone, just to update you- Barclaycard offered me a pathetic £77 instead of the £323.69 (including 8% interest which i now realise that i should'nt really add until it gets to court!!), i sent the letter from the archive saying i refuse their offer as a settlement but will accept it as a part payment but if they do not pay up before the given deadline then i will take them to court! Now, i sent this letter on %th March but i notice from my statement that they took the £77 off my balance on 22 Feb!!!!!!! Can anyone please help me with what to do now? Many, many thanks-Craig:x
  10. Hi Gizmo, yes i have my statements to hand! The mistake iv made is iv sent Citi cards two different letters: the first letter asking for the refund of charges plus the 8% interest, the second letter (LBA) for the refund of charges but this time iv included charges that they refunded a few weeks after they were originally applied(dont ask me why!!Doh!!) so where do i go from here? Do i go straight to MCOL or go for this N1 form that you mention? I really do appreciate the help you give!! Many, many thanks-Craig

Just one more question iv been DIEING to find out- Apparently the OFT are going to say shortly that the maximum a bank can charge will be the same £12 as the credit card companies, in your opinion do you think that this will make a difference with how the banks defend? ie-will they be able to offer the difference between the charge and £12 and get away with it?? Hi there, ok the latest with the Lloyds tsb credit card claim i have is that i worked out what they owed me ,£140 in charges, and added the 8% interest, £35.85, (should i have done that?) and sent them my first letter on Feb 22nd, today i recieved their reply saying that allthough the OFT has made the decision regarding £12, which they now apply, the OFT didn't mention anything about past charges!! Please can you tell me do i just send the standard second letter or do i have to modify it slightly? Also, have i messed up by claiming the 8% interest? Please help me if you can, all the best-Craig
  13. Hi there,im not familiar with the N1 form, is that the one you fill out at your local court? How is it easier to use? Just to clarify- I sent citi one letter asking for x amount of charges plus the 8% interest then in my second letter, for some reason, iv asked them for a larger amount, the reason that it is a larger amount is because iv stupidly included charges that they refunded at the time(when i rang to complain at the time of those particular charges), do you see my problem? Thankyou for your help!!

  17. Thanks matey, iv done it but haven't sent it yet!! However, do you think i should do an estimated guess of what they owe me as i believe that the majority of my charges were charges during the statement periods that they have given me!! Let me know what you think as i have no idea how to calculate it..... can anyone please, please help me?? On January 15th this year i sent a subject acces request to Sony card/Mbna, they sent me statements of October 2000 to October 2003. i sent them a letter from the templates library telling them this and asking for the statements from October 2003 to present day. They then sent me statements from March 2006 to present day which leaves a big gap between November 2003 and February 2006, i sent them yet another letter threatening court action unless they sent me the remaining statements. I recently recieved a letter saying that they are unable to provide me with a list of transactions on my account from December 2003 to November 2004 as they do not have this information. e letter says " Your account has been dormant or has had a zero balance this would mean that no statements or transactional information would be available." Now this morning i rang a very helpful Mbna operator who tells me that there are these statements that they haven't sent me: December 2004, Jan, Feb, March. April, May 2005 and Jan, Feb and March 2006!! What on earth should i do now? Please help me if you can-Craig :-|

Hi there, 40 days ago i asked MBNA (sony card) for my info and i filled out their form and included the £10 cheque that they asked for and today i recieved only the statements from oct 2000 to oct 2003 but my account ran until last month!!     ***WON!!!*** Ok you all, i want to thank the following BRILLIANT helpers: nettyg,castlebest,anney63,gary H and most of all: LATERALUS!!!! You were all so helpfull and i cant believe it is true!!!- I WON!!! Yep, i had a nice little £1658 go into my account on Monday and you know what is the sweetest thing of all is?- It appeared on my bank account as 'refunded charges'!!! After all the sh*t they gave me about them being in the right eh?? Pah!! Thankyou ALL of you!! There will be a nice little contribution on it's way....... Craigten xxx:D :o :-D

    Hi there, can anyone please help me? Iv taken HSBC through the MCOL for my brother and recieved 3 pages of papers from the courts: the first one is a 'notice of issue' which says my brothers name and address and the relevant details but says it is in Northampton court (i live in north wales so is no good to me!) and it explains what the defendant may do! The second paper says 'Notice that Acknowledgment of service has been filed' and that 'The defendant now has 28 days from the date of service of the claim form to file a defence' and the third, more confusing, form says it is a 'Response Pack' with DG solicitors name and address on it and the box 'i intend to defend all of the claim' has an x in it!! Does that mean it is a defence? If so, shouldn't there be an AQ for my brother to fill in??? PLEEEEEASE try and help me? All the best-C:?

Hi people, just to let you know that iv sent my first letter to barclaycard and iv recieved a reply from our carl nuttall offering me the difference from their charges (£25 a time) and the £12 maximum fine by the oft which came to a measly £77!! Now, do i just send my standard second letter not even mentioning their offer (which id prefer) or do i have to mention it? Please please help me if you can, all the best!!
  24. HELP!!!! Can someone please help me?? Im just about to take citi to MCOL when i noticed that in my very first letter after id worked out what they owe me i asked for £395 plus £119 interest, then in my second letter i had changed it to £570 with £193 interest, i think in my second letter iv included the charges that they then refunded me at that time!! What do i put in the particulars of claim now??? Do i go for the original amount that doesn't include the charges they later refunded me when i rang them to complain or do i go for the full amount irrespective if they refunded them or not?PLEEEASE help me people????
