  1. I'm not completely certain but if you go down the Income from Rents road it maybe totally disregarded - check with your benefits department.or CAB if you prefer.
  2. Oooooh, I've entered 27.9% as the cash annual rate. Account is still running and up-to-date.
  3. My council additionally apply this to carers allowance, the disability premium of approx £14 (is it 13.80?) on esa and households with a child under 6. Low-rate dla also means you qualify - but is this true all over the country?
  4. Extended payment period is still awarded nationally - it just gets a bit sticky if you jsa/is stopped the first week in April for council tax - but only sticky for that one week. You have to have been on a passported benefit (esa, jsa(ib) or IS) for 6 months without a break to qualify. As to how long it will take to process a claim - how busy is your local council who action this? Write to them (if you haven't already done so in response to a letter stating your HB is suspended) and provide either a letter from your employer or whatever payslips you have to hand.
  5. Not sure how to advise about this. Getting someone else takes care of the bedroom criteria and you could then state she is a non-dependant but then her wages would need to be taken into account for HB/CT purposes. Alternatively you could provide proof that you have 'income from rents' in which case you would incur the 14% bedroom criteria loss but if she is paying half the rent would this make more sense economically. You would also still be entitled to the single person discount (25%) for council tax I believe but check with your council tax department - all changed since 1 April...........................
  6. Under regulations domestic violence cases have to be treated sympathetically. Your daughter can ask for benefit to be paid on the DV address as long as she has an intention to return. Benefit can then be paid for up to 52 weeks. I get the impression that your daughter has returned - am I right? In which case she should inform her council that she moved out due to DV and advise of the date she left and returned and ask for benefit to be paid on that basis. If she has not returned and some time in the next year decides to accept a tenancy elsewhere she must inform the council who will pay HB for a miximum of 4 weeks once she advises she has no intention to return. It may also be prudent to ask that she can be removed as the liable person for council tax - just to be on the safe side. If you arn't living there you can't be responsible for council tax - simple.

Your local council will probably suspend your benefit due to the fact the esa has stopped and I suggest you contact them explaining that you are going to appeal and ask for your HB to be paid on nil income at present. Provide a bank statement showing you have no current income. Can the citizens advice bureau help - they do a lot of these appeals as does Age Concern - and you don't have to be elderly. Can you get a crisis loan I wonder..............
  8. I have some old charges going back to the 1990s and the interest rate then was 1.53 monthly. If I enter 25.9 (which is what they could charge me on their website) with compound interest the result is truly staggering (almost 1200.00 in extra interest). People, can I justify this on the grounds that it is compensation for being deprived of this capital to invest at my choice and also the fact that interest on the interest would have increased my outstanding debt to halifax which I only settled last year. And the so-and-sos had entered a default on my account which is not due to 'drop off' till October this year - even after I reached an arrangement to settle the debt and made the last payment last autumn. Default is due to disappear 6 years after they defaulted my account originally so having an adverse effect on my credit rating. What a difference that interest rate would make to my finances. any thoughts gratefully received.
  9. Here I go again - compound interest and charges going back almost 3 years. Have been missing from this site for quite some time - it's good to be back. Prelim going off tomorrow.
  10. Having been away for some years I'm back to claim my charges from the remaining credit cards, secured loan etc who have MY money - and I want it back. Site has changed quite a lot (so glad it's still going) and I could do with reading up before I do something silly. Going to claim compound interest again and have found the template but so far have been unable to find a step-by-step guide about how to proceed. Can any one advise?

I send off my SAR and some of the information arrived yesterday - but in a royal mail plastic bag appologising that some of the information may be missing and I can let them know and they will search for it. Original emvelope not of very good quality. I'll say some is missing -over half of the statements and god knows what correspondance Creation sent and has failed to arrive. My query now is whether to send them (Creation) strong letter advising that my identity is at risk due to their not sending it adequately packaged (packaging came to over £1.50) and I want information sent again in stronger package and will let the fact this has happened to me be known by the ombudsman. I don't think this is over the top - any thoughts gragefully received.
  13. I have credit card charges going back to 1996 - am I out of time then even theough they were called late payment charges as I was just about to send LBA and they have told me I am out of time because of Limitation Act - was going to use S32 for this very reason
  14. Well, it was my fault. Seems because I filed a wasted costs order the warrant was recalled and the whole of the claim was then dismissed - in error. I am going back tomorrow to submit a request for the warrant to be reissued and court employee informed me last week that it won't cost me anything as I am not asking the baliffs to go to a different address. I do feel a ..... silly billy. Still it will be userul for the summer.

  17. Shall I start saving now in the hopes that I will turn up? When are we thinking of as I am going to be in London (in theory) first week in August and Cropredy folk festival approx 9th August for that weekend (assuming I have some wins between now and then finances being 'orrible as usual).
  18. OFT can only make recommendations - this £12 is just a guideline. Carry on with whatever letter (prelim or LBA) and ignore what they say. The fact that you signed an agreement saying you would agree to their T & Cs does not make the charge lawful IMO otherwise what is the point in this site and any others. When you sent your letter you did state the amount of compound interest didn't you as this is necessary for when you file at court. I woud ignore what they say about the FSA - what does that have to do with the price of fish? If their intention was to put you off and it worked just think of the money they would save!!!!!!!!!!!!!!! Keep going and keep posting - good luck
  19. Silly me - I do feel embarrassed. Shouldn't have filed for wasted costs - can only do this when defence has been submitted. I won by default so wasted costs not applicable and they even sent a solicitor along to make sure I didn't get anything. Definately going to get court book from this site when I get paid. Still heard nothing from the baliffs and am wondering what is going on. Will check with my court to see if they can advise as I phoned london court and just got automated system. Very Frustrating.....................
  20. I have just heard from Birmingham court - I have till 30 November to submit amended POC or it will be struck out. Seems very reasonable to me - unless bank in question ask for it to be struck out in advance.
  21. Who it was sold onto dosn't matter in my opinion - you are claiming back the charges from the company who applied them.
  22. Sorry - I meant not the interest they have changed you at the end of each month (it's only pennies). If you go for compound YOU MUST mention this in every letter. If you go for statutory only enter that when you file at court as statutory only starts from the date it is deemed to be served on the defendant.
