  1. Sent off prelim letter with compound interest spreadsheet and VERY quickly they responded with a cheque for £276 with usual blurb about being in line with OFT ruling and fees reduced to £12. Do I now sent LBA mentioning Limitations Act as I am claiming fees from 2010 to 2012 and whatever I can find that seems relevant (already pointed to a very successful case which I will take time to re-read). Do I also accept cheque as a part-payment or not? When doing my POI (eventually) do I just leave the spreadsheet as it is currently showing but put that I have already received the amount above - my reasoning is that they will still owe me the interest on amount received and this is now almost £800 with interest added. They do appear to have given me some interest as total fees only came to £168.
  2. Wow - loved the Shelley thread. Not filing tomorrow - I did finally locate N1 info on this site - but will get Christmas over and then settle down to go to court - restitution interest rate will apply and the limitations act should go POC just in case - claiming back from 2007 up to 2012 so getting it right at this stage is paramount. I had also completely forgotten about the daily rate when filing at court. Thank you so much.
  3. Last I managed to fine the 'Particulars of claim' without any problem but sadly not today - shame I didn't write down where it was. Can anyone give me a link please and am I right in assuming my smalls claim court will still be open tomorrow?
  4. Spoke to society their line is that as the policy was sold to us both at that time they need confirmation of his new address/residency as he may be entitled to 50%. Luckily we are on civil terms (after meeting at a family funeral) I have sent the sheet for him to complete and send back to BS - lets see what happens between now and christmas. If he sends it back after the 8 weeks are up I will just need to fill in a questionnaire again.
  5. No response to my LBA sent 3 weeks ago so going to file at court. Can someone point me in the direction of any tutorial about filing using mcol and any 'arguments' I can use in my claim - do I have to pay upfront or when it is assigned to a local court?

My solicitor did get him to sign the house over to me (being in America he didn't bother with filing for divorce, just ordered me to get it done in this country) wouldn't the BS have had a copy of this and I think he possibly had to sign some paperwork (so long ago I'm not sure) when I wanted to remortgage. I'll phone them tomorrow and ask the question.
  7. was the PPI part of the endowment policy then or separate. BS had said that the policy was in my name only (presumably after we divorced).
  8. I have a copy of my solicitors letter dated 13 January 1998 to the BS regarding 'their (me and my ex) proposed discharge of the society's mortgage. Would you please let us have the title deeds upon our usual undertaking not to part with the same pending discharge of the mortgage and to return the same to you upon demand.' Then there is another letter dated 21 July 1998 in reply to a BS letter apparently dated 14 July in which my solicitors advise they have received no further instructions for the time being from myself with regard to the transfer of the property into the joint names and that they are returning the Deeds. It also states they will apply in due course if I proceed (in what?) We divorced in 1998 and in a letter from to BS February 2004 I advise that my ex had signed over the endowment policy and mortgage to me alone as I was not working the BS took the decision to keep his name on the policy (they sent me a copy of this so are they delaying things in an effort to get me to stop). Then finally I have found a letter in with my name only in 2004 on the mortgage due to the fact I was remortgaging elsewhere. Is this sufficient proof - don't they have to do some checking if I bring this to their attention with my sending copies of the above? They settled my original claim for unlawful bank charges without bringing up my ex so they must have been aware of the mortgage situation then as I went back to when it was a joint mortgage.
  9. Thank you - I should have said they did send me the FOS cq. Will just have to wait and see if I get all the money or just my share up to when I divorced and then the full allocation. Better than nothing, whatever..................... I have saved a copy of the cq just in case I need to apply to the FOS. Damm - they have sent me another qs. To investigate the PPI they say they need the agreement of the other party - well he lives in America and signed the mortgage package over to my solely in the 1990s. Any suggestions?

The above wern't very helpful but I had a happy thought - used to pay debts via CCCS and I contacted them - they are now called Step Change and they have sent me all debtor information they held when they started dealing with my financial problems in 2004 - so I can send Egg account details. Will this result in any PPI though - had information back from Sainsbury's and no PPI is showing.
  11. Time wasters - they say I haven't returned their PPI form - going to send commissioners one again and advise they did not send their own last month anyway. Final response is due from them by 30/10/17 apparently.
  12. They sent me a PPI form so I'm going to send it back. It does say my ex-partner may be entitled to some of the refund - he signed the house over to me and we have no contact - is the fact we divorced relevant to my claim?
  13. Received the following from west brom Thank you for your email dated 28 September 2017 regarding the loan protection insurance premiums. Due to the length of time that has passed since the mortgage redeemed the data we hold in our department is limited. The mortgage statements we hold for the time the mortgage was held, do not differentiate between the two insurances linked on your account. What you need to do next If you are seeking this information in order to make a complaint regarding the miss-selling of these insurance policies, we can forward your request on to Customer Relations who will be able to look in to your complaint and may be able to provide you with additional information. . The statement shows a start date in 1988 with yearly insurance premiums totallling 274.40 yearly advising of a renewal date in 1994 (what?) with monthly mortgage payments including an insurance premium of £38.40. Their answer above seems vague so I am proposing using this £38.40 as my monthly PPI figure - am I correct?
  14. Heard back from them advising loan protection insurance was held from inception to almost 2000 when the insurance was cancelled. They state they only have limited information as to why it was cancelled. I probably found out it was not appropriate as I wasn't working then relying on maintenance payments!!!! I really don't have the mental ability to go for maximum amount I could get through the courts I would use the 1st spreadsheet - is that right - and I won't enter an end date on that spreadsheet.
  15. Good suggestion - will ring them as I think Egg are being difficult - had this problem a few years ago on rereading my thread then.
  16. I don't believe it - sent them a photo of my passport, recent utility bill and this year's council tax bill - they still want certified copies in reply dated 13 September. I even told them nothing has changed in 35 years. Shall I write back a strongly worded letter stating that unless they respond and supply the data within the remaining days of the 40 I allowed again I shall contact the Ombudsman. Nobody else wants these additional proofs.

  18. I used the wrong spreadsheet - the single premium PPI one - not one of the others. See, don't start these things when recovering form major surgery. Too late to rectify now I suppose?

  20. Thank you both. I will write to them and ask for clarification of various insurance amounts against the appropriate dates. One of them does disappear before 2000 so it may well be the buildings insurance then.
  21. Information has now arrived and I have a few queries. I was expecting PPI to be taken on a monthly basis but can it be taken out of the mortgage account on a yearly basis and if you have mortgage arrears will the amount change? We had buildings insurance etc so would that show as being on the mortgage account? On top of that we were told we had to have an endowment policy!!!!! No wonder it was a struggle. Statements shows 'insurance premium' with 'insurance premium tax' on the same date - would I claim both and is this likely to be the PPI? Yes I will be checking with the BS before I make an idiot of myself. You had to tick the box 'load protection scheme' if you didn't want it................... If this was subsequently claimed there would have been paperwork wouldn't there but I seem to remember we used the redundancy payment from former employment. Not sure I have all the information from them and it's arrived in different formats - not very helpful.

  24. I sent a SAR off in July and have now received a reply from Egg that they cannot trace me and has my name/address changed. Well no it hasn't and they are the first company to have this 'problem'. They want me to provide all sorts of evidence including a valid account number (obviously I don't have this as I would have provided it) details of previous names/addresses and proof of my DOB. Other companies have just supplied the information where I don't know account numbers so shall I write to them again advising nothing has changed and I will be complaining the the Ombudsman if they do not respond within another 40 days. They do say they have destroyed my cheque as there is no charge for this service.
