They're trying to play the same old time wasting game they did with Bank Charges ... however , this time the FSA hasd not given them a waiver ... so all complaints must be dealt with as normal ... or they should be reported to the Ombudsman ..... They have been told to deal with these ... they should not get away with flouting the rules and resorting to the same old corrupt fiddles to get out of it ... IMHO the FSA helped them out of it the last time ... let's hope this time they show some backbone and order compliance .... without the banks being allowed to drag this lot all the way to the Supreme Court again ...I think it's abuse of the system ....

Hi Daisy , dx has got it sussed .... if they start offering discount , they're getting desperate ... just hang in there , ignore them ... they can't go to court without documentation , and if they have documentation they have to let you have copies of it all ... Btw , I suppose you know they're not allowed to turn up on your doorstep unannounced without a court order . .... if they do , chase 'em - and call the police if they won't shift ... Also , I think you know by now not to call them under any circumstances , you'll only get hassle ... Hang in there and keep us posted ...
  5. Thank you all soooo much for your birthday wishes .... I'm kinda lost for words , which is unusual for me ... as most of you know .. I had a lovely time though ... and now have the family for the week -end ... so , it's parrrrrrrrty time ! And thanks to Tills for starting the ball rolling (I think)... memory like an elephant she has ....
  6. Hi Pete , great to see you posting again ... I've been a bit quiet (CAG-wise ) myself lately .. Now I find myself needing some advice for my son , I hope you , or someone can help ... He's had his case stayed in Court since the (disastrous) OFT case kicked in - the bank were just on the verge of paying up when the shutters came down He's now had a letter from the court asking what his intentions are and giving him a time limit to reply ... Now , I've still got your (IMHO) excellent POCs pete , but unfortunately they didn't seem to work in your court .... Have you any suggestions , or would he be better asking the court to keep the stay until the Scottish cases are resolved .... ? Your advice would be much appreciated mate .. TIA

Hi hotdog , Haven't you got a contact at FOS that you can speak to by telephone ....usually you are assigned to an adjudicator who should see it through to a conclusion for you , especially if they've already made an order for the bank to cough up ... try contacting FOS ... Of course if FOS have not ruled on the 23% that may be a different ball game .... and it be as well to accept what they've said .... but don't let it go with out checking with FOS would be my advice ... Also , IMHO , if the bank have got nothing to hide I can't see why they're offering a "goodwill " payment ... that , in my experience means they're trying to divert your attention from something better ....... r

That is the crux ..... the moral part being that the banks were telling customers (in writing) that what they were charging was what it cost them to administer the overdraft being exceeded , then they admitted to the highest court in the land that it was 'Part of their core business '..... Why the SC didn't censure them for that at least , I find it difficult to comprehend ... especially as Lord Phillips said the otyher night that , had he gone with his instincts he'd have found in favour of the customers .......... just goes to prove , the Laws , which should benefit the people ,, in many cases don't ... therefore the law is an ass .. in this case ... in my humble submission ..you honour ! Rant over ..... lol
