Hi DS I made no contact with Natwest, I followed all the correct procedures, upon which, after the Order for Directions was made, I responded with all the evidence which was requested, and sent full copies, including letters to the court about Cobbetts behaviour, to Cobbetts. I received a cheque literally after 2 weeks I submitted my court bundle to the courts, so I didnt even get so far as a court date. I have now completed my Notice of Discontinuance and sent back to the courts and Cobbetts. Cobbetts in their settlement letter made it conditional that I enter a confidentially agreement and that I dont pursue any further charges. I spoke with Cobbetts over the phone yesterday and stated that these 2 conditions are unacceptable to me, they have sent me an email detailing that they wont pursue the breach of confidentially and that i can pursue further claims. I have read a few negative emails about Cobbetts, but in my experience with them, they have been quite diligent and forthright in their approach. In some respects you have to feel quite sorry for them, as they dont know whats hit them, and they are being inundated with all these claims. Anyway good luck to you all, i am now focussing my attention on my fiances claim, so you will still see me about and feel free to PM. cheers Ali
  3. Thanks for the kind words No - didnt get that far I did have an Order for Directions put in place when I submitted my AQ. When I received the formal Order from courts I submitted my evidence within 14 days.

  9. Hi Just a quick intro, I have completed my own claim against Natwest and am now at Court stage with Cobbetts. Now doing my fiancees' claim for a total of £4262.35 with RBS Will post updates as they occur. All the best Ali
  10. definitely send another copy to Cobbetts, you have nothing to lose by doing so, plus it shows to the courts you are cooperating. I sent my letter to the Court, and it didnt have an adverse reaction to my claim. I also sent copies to Cobbetts. good luck and keep checking the forums
  11. Update: Took to the courts today, my court bundle, after judge consented to Order for Directions. It is now up to Cobbetts to comply with the order. Will post an update shortly. Off to make another claim now
  12. hi All Just to let you know, today I took down to the courts, my completed Court bundle. Its up to Cobbetts now to fulfill their part of the Order for Directions as directed by the judge. I hope I have done all and included all. Big thanks to GaryH for his help. Now to start on my fiancees' claim. I am also going to start on a new claim commencing from 1st November.

I have a standard letter regarding fee charge for non payment on my loan account, it states the charge of "£38 has been debited to your account to cover the cost of the work involved". Do you think this is ok to submit as evidence in my court bundle? thanks Ali

  15. Hi Michael I saw that, but I am unsure about which one to use at its Natwest, and what would be good is if there is one which is Natwest specific. Also I dont have the indepth information that GaryH has used. This is where I fall short Account Contract - requested again copies from bank Office of Fair Trading report, April 2006 - where do i get this from? House of commons early day motion, May 2006 - where do I get this from? All pre-litigation correspondance between the parties - attaching copies of all correspondence with bank/cobbetts thanks Ali

  17. Update Judge has consented to my Draft Order for Directions - this will really put the pressure on Cobbetts to settle or disclose. Anyway I am posting to keep you up to speed, and now have 14 days to respond to the Order. This is the context of the Order a) A Schedule setting each charge repayment of which is sought, showing the date, amount, and reason given (if any) for the change being made - Sorted, will include schedule of charges again b) Copies of any statement or other document relieved upon as showing that each and every charge has made Sorted, will send copies all bank statements with charges highlighted c) A statement of evidence of all matters relied upon as tending to show that the charges are irrecoverable as penalties or otherwise Need Help Here - any examples of this statement? d) Copies of decided cases and other legal materials to be relied upon Need Help Here- any examples I can send? This is quite a sizeable claim, approx £12K so want to make sure I do this right, so any help would be appreciated thanks Ali

  21. yay they found my file got an update from the Court, there is a letter from the Judge to both parties, the letter is a consent for a "Order for Directions". Which will mean I have 14 days to send again what I have already sent to Cobbetts and the bank twice now Any suggestions? ali
  22. already drafted my letter. It also means they would have lost of all Cobbetts papers also, so what has taken 3 months as a process, means I may be back to square 1. If that is the case, I should expect more delay tactics!!!
  23. My case took an amazing turn today. I wrote to the courts on the 26th February asking the judge to complain about Cobbetts delay tactics. I received a letter this morning from the Courts, some 11 days after I sent my letter, to inform me that they are unable to locate the Court file at the present time. Also that my letter will be processed within the next ten working days. So that means I have to wait another 2 weeks for them to respond to my letter of 26th February. Is this standard court procedure, that they:- 1. Take 11 days to respond to acknowledge a letter? 2. Inform you that they have lost your Court file? 3. That I have to another 10 working days for a response to my origiinal complaint? What should I do in this instance, any advice would be appreciated? thanks Ali
