  1. I requested all information from Experto Credite back in July 2010, only today have they responded with a letter, stating that I need to go back to MBNA to get this information. However Experto want me to propose to them repaying the outstanding balance. Is there any recourse in the fact that Experto admit they have limited information but are not providing it as requested as well as the time it has taken them to respond? Also can I not refer the debt back to MBNA as a result of the response from Experto, given that MBNA hold all the information?
  2. I guess there is also a question that an interest rate hike is considered Unfair, so is there a route via to getting it reduced citing the UTCC Act?
  3. No she didnt get that choice, and she had a couple of overlimit fees, that was because they didnt take enough on the minimum amount.
  4. interesting reaction there from Halifax - when did your interest rates hike start? Also you state recent laws, I havent been on this site for a little while, can you show me a link to this law?

  6. Hi all Been a while, hope you are all well and fighting the good causes. Need some advice from members here on what to do about a situation that has been ongoing for my wife and her Halifax Credit Card. My wife has had her card for a little while now, she started off on zero % interest for a period of time, during which she made each month regular minimum payments, via direct debit, after the period of 0% interest, it went up to just above 15% as per her agreement, again direct debits each month, minimum payments. However what Halifax decided to do was, they increased her interest rates from 15% to 29%, they cited that she was a high risk customer hence why her interest has gone up. She has still and always paid each month the minimum, which Halifax adjusts and takes on direct debit. It is recently that the minimum they have been taking is never enough as because of the interest, it keeps her above her limit. The advice I seek is, does this not fall under the UCCTA, as they are penalising my wife unfairly, even though she has been making monthly payments and they are unfairly charging her high interest. She spoke with Halifax and even the person in Customer Services said her interest rate was extortionate. thanks in advance guys/girls
  7. thanks CB - who do I write to though given that my debt has been passed/sold on to Experto Credite? Experto were the ones who requested the Credit Agreement from MBNA - but if I want all my information to include bank charges, notices of defaults etc, do I request this from MBNA or from Experto?
  8. anyone have a view on how i should approach this, I was thinking I should write to Experto asking them to confirm if they have sent me everything under the SAR - just to make sure they have nothing further up their sleeve. Also want to obtain from them a list of all charges, when and for how much. I think there is a case under the UTCCR to reclaim all my charges back Any help/guidance would be appreciate
  9. so you are basically saying Ida, i dont have any recourse? Even though they didnt provide me with a copy of this CCA some 50 days later? The fact that they have increased my interest rate from what was agreed at 15.4% to over 35%? Anyone else have an opinion on this issue?
  10. how could that be, i havent signed for anything, and this agreement could have been knocked up by anybody - the dates could have changed, etc?
  11. exactly, and as far as I can recall, they sent me out a form which i signed and sent back to them. I requested from them a signed copy of my application, and they have informed me that this is all they have. Thanks for your help and input, much appreciated
  12. Hi Citizen B There was no signature on this - what you see, with the exception of my personal details ie address and credit card number is the entire agreement. My application was online and yes it did have payment protection.

    MBNA CCA Valid?

    Hi Guys and Girls I requested back in October a copy of my original CCA from Experto Credite as my debt had been passed over to them. It took them nearly 6 weeks to send me a copy of what they have on file. Given that they exceeded the statutory limit to return, I have now put my account in to dispute. However I have recently received from Expoerto my supposed CCA. Here is the full copy of it Any advice or suggestions on what I should next would be greatly appreciated. thanks in advance Ali
  15. Hi Guys Applied for my CCA in October to which Experto only today responded with what they say is what MBNA have on file as my agreement. Not sure what to make of this, as this isnt the agreement I would have signed and returned to them when I made my application for Credit Card. Basically what they have sent back is 5 pages of what they say is my agreement. It is titled "Credit Card Agreement Regulated By The Consumer Credit Act 1974", what sticks out like a sore thumb is the lack of signature on this "agreement". On page 4 is has a section with a ticked box in it, is this supposed to be my signature? I guess without a signed document, this agreement is inadmissable as anyone could have put this document together. What do you guys/girls suggest I do as my next form of action? cheers
  16. i believe the question Bozalt is asking is whether he should continue to try and settle with MBNA rather than go the legal route. My only suggestion would be, and this is coming from many months of trying to resolve this directly all to no avail, is to go the legal route. That I think is my only real option now. I am going to put my account formally in to dispute direct with MBNA, while sending an assigned letter to Experto Credite

I must admit I have been pretty stupid, by burying my head in the sand on this issue, as I have a bit of a problem also with MBNA - I requested several times already that I wish to put my account in to dispute, I have not ye started any proceedings against them, simply because I was hoping to reach an agreement with them about charges etc. My debt has now been sold to another company called Experto Credite, with a huge charge on top. I guess I should start proceedings against them.
  18. what i dont understand is, why would you not want to pay your credit card bill, ok, i can understand you may not want to pay the interest or the charges, but hell, if you spent for example £4000 on buying items or a holiday, shouldnt you pay that back? I dont condone what MBNA do, but not paying back what you spent is like stealing. I have a friend who just settled his credit card bill, paying 40% of what he owed them - surely that is more acceptable then not paying a single penny, even though he spent the money
  19. ok got an provisional offer from RBS this morning for £2424. Actual claim was £3800. What RBS are saying is that in the Charges are the fees for being a Royalties Gold account holder therefore this monthly charge has been deducted from her account. Anyone else get the same excuse, if so, did you settle or did you pursue, and what has been the outcome? thanks Ali
  20. no problems and its not confrontational either to ring them. I had a nice conversation with them about it, and they sent me an email followed by letter, confirming that they will not be pursuing breach of confidentiality. It just makes banking the cheque that much sweeter and quicker.
  21. well done, looks like you and I both have had good easters did you get the standard confidentiality bit in your letter? If so, ring up Cobbetts and tell them that you have the right to speak to whoever you wish to about your claim and that you want this removed. I did and they subsequently sent me a letter informing me that this condition is removed.
