  1. Hi Thankyou for replying to my post. The charges on this account go back to August 2001 and the amount of the charges they owe me come to more than the overdraft, proof that it is the charges and interest (about £100 per month for the last 4/5 years) on the charges that make up all the overdraft. It wasn't just one lifestyle event in particular that caused the charges, it started off as a few charges which as I was living on my own paying a mortgage and earning an OK salary but not enough to cope with the charges, meant I quickly headed into the usual downward spiral which has now left me 'owing' Nat West about £9k. They, however, owe me nearly £11k without adding on the statutory or compound interest which I am also claiming. I have written to them today to ask that they make the amount they have offered me available for withdrawal or sent to me by cheque as I need the amount to pay priority debts etc. This is in the hope that they agree to letting me have at least some of the money for myself. I am also remaining positive in the meantime that the next phase of the test case will rule that all charges have to be paid back and I will get the rest of my money. I have charges on the bank account I currently use and so does my husband on his. Regards
  2. Hi All Urgent help please!! My claim with Nat West was put on hold of course due to the test case, I appealed but the Judge said it wouldn't benefit me for her to rule against the hold. However, I have recently put in a claim under the hardship rules for Nat West to look at my case again now. They have agreed my claim for hardship and offered me a payment, which is a result in the general scheme of things. However, my predicament is that due to the amount of charges and then interest on top over the last eight years I now have a large overdraft on the account (now closed) and the money they have offered me will not even cover the overdraft. They are not chasing me for the overdraft and I am not currently making any payments on it. If I accept this offer then the money they are offering me will get swallowed up in the overdraft and I will be no better off. I desperately need the cash as my house was repossessed at the end of last year, I am behind in all my bills, and can barely afford to buy food to feed myself and my family. The bills keep mounting up and the Council have already taken me to court over unpaid council tax (I am now only a month behind but they will enforce the laibility order unless I can pay in the next couple of weeks), I am also very close to having my gas cut off, just as it's getting colder, I owe my mum money as I have had to borrow off her and am constantly being hassled by creditors and still receiving many bank charges each month. I need cash urgently. Is there any way I can get them to send me a cheque as the amount they have offered is enough to sort out the most urgent bills as well as pay off a couple of loans etc. that are crippling me? Can I write back to them and request that they pay me the full amount they owe me? I don't know what to do, if anyone can advise me please it would be greatly appreciated. Thank you
  3. I have now received a notice from Leeds Court to say that I am to attend an Application Hearing on 7 January for my case and two others (an hour being allocated). I'm not sure what an application hearing entails. Do I need to prepare anything? The letter doesn't say so.
  4. Please see my thread in Nat West forum. Cobbetts have advised me they have applied for a stay. I filed at Moneyclaim but Leeds Court seem business as usual so I wish I had gone through them now. I intend to appeal against the stay though in particular as am being taken to court for repossession order on house (for the third time in two years - other two got suspended orders which eventually got removed but am now in same position again which has been due to spiralling debt mainly caused by all the bank and credit card charges and high interest I have to pay!) - in court for this on 22 October so all this is adding to the pressure .....
  5. I finally found the £250 to pay for the court claim a few weeks ago. Cobbetts have now sent a letter ackowledging the claim and advising me that in light of the OFT Test Case have applied for a stay which obviously concerns me because not only does it protract things even further and I need the money now but will I get it back at all? My claim is now for just over £12k and has been ongoing since February. Can I object against the proposed stay? And if so how is it best to go about this? My overdraft currently stands at approximately £6,500 and I have been paying £80 per month on standing order towards this debt which has been and is causing me considerable stress. I can no longer afford the £80 due to other financial pressures and as I have filed a claim I have reduced the standing order to £10 per month which I intend to write to inform them about. I have presumed that as I am still paying something towards the debt they have caused me and as the account is now at court then I am OK to do this. They will probably argue not and that I have defaulted on the agreement but I think as long as I am paying something it's OK? It's only if I stop paying altogther that I could get into trouble? Help as always appreciated...
  6. I filed a claim for £279.71 (plus court fee of £30.00) on 3 August 2007 which has been acknowledged. Last week I received a cheque from RBS for only £129.00 in full & final settlement, conditional on me writing to the court to discontinue proceedings and to keep terms of the settlement stricly p&c (although letter isn't marked 'without prejudice'! I presume I should just send it back as you do with offers before claims are filed. Or should I accept it as part settlement only (not sure I can do that with wording of letter). I can't believe they have only made a part offer after the claim has been filed. Any advice appreciated please .
  7. Hi Thanks. I rang Barclays after they put the defence in and asked for settlement. They faxed me the letter the week after. The money should be going into my bank account but not appeared as yet..... Munchkin ps Test case is for Banks only - shouldn't affect credit card claims

The reason for this posting is twofold - First to make Barclays (and other) Contents Insurance holders aware of certain endorsements which may be on their policy, some like me might be unaware of certain conditions and secondly to get advice on how to take my complaint further. About 3 weeks ago I was burgled for the first time in my life. The burgler entered through my dining room window in the middle of the night (my husband, my 2 year old and myself were upstairs sleeping), shut my dog in the room and took only 3 items (fortunately!?). My dog didn't bark and we never heard a thing. We called the police and then I rang my insurance company to report the claim as you would. My dining room window is quite difficult to access. It is quite high up as their are steps to my back door and it is small top opening window. Also I have an alarm box at the rear of the house, there is a street light right outside and I have a dog. I live in a quiet area where crime is low (the fingerprint lady said it was the first time in 3 years she had been to my area). I thought I would be a very low target. Particularly in the summer, and as my dog sleeps in the dining room, I often have the window open. On this occasion the window had been open but had been pushed shut when the wondow cleaner came round, hence I neglected to lock the window. Being an honest person I advised the insurance company of this and as a result of 'minimum security endorsements' being on my policy they won't pay out for the approx. £1,300.00 of items taken (one of which I still had £500 left to pay on). Now I don't have much money and work hard for what I have. I can't afford to replace any of these items and won't be able to for some time which is very inconvenient. I do admit that I have been notified of these endorsements which are not in my policy booklet but are on the back of my policy schedule. I admit I hadn't read it properly or taken it in. Basically, when you are asleep in bed you are only allowed to have windows open in the rooms which are occupied, so even if you have the window open in your spare bedroom for example this would invalidate your policy. As I look around my street, in the day and at night I notice that many people leave their windows open. I wonder if they realise that their insurance may not pay out if they were burgled? So please take note, read your insurance endorsements and make sure you don't get caught out like me. I was lucky that it didn't happen whilst I was out and had my house cleared completely. I did complain to Barclays regarding this and received a letter basically saying they weren't budging. I had asked them to reconsider as I have been a loyal customer of Barlcays for over 20 years, first time burgled, small claim to them (not to me!) etc etc but they won't budge. I have been advised by an insurance underwriter (nothing to do with any party in this case) to threaten to sue and then they will pay up. Before I try this I feel I need some advice and help. I'm not sure about how to take this further but I don't want to let it rest. I'm not sure if I have a leg to stand on with the endorsements being stated in my policy (the underwriter said this didn't matter). Can anyone help please? Munchkin PS Norwich Union also wouldn't pay out when my grandad's garage roof blew off - gave some flimsy excuse! So beware of Norwich Union!

  11. Received letter this week. Offer now increased to £1000 against claim for £1168. After much deliberation decided to accept on this occasion as doing claim on behalf of my mum really. Already filed 5 claims and another 4 to go so this is the only one we're giving in on! Looking forward to receiving money!

  13. Thanks for your replies. I filed that particular claim with just statutory in the end but I have sent another LBA to Citi for my claim with them advising I am now including contractual. They've kept me waiting nearly 4 months now anyway. Only thing is I've just changed the calculation on the simple spreadsheet to work out the contractual as the compound spreadsheet looks a bit of a pain to fill in. They told me the daily rate is the annual rate divided by 365 so I think it should be OK. I realise there's some complicated process which means you should use the complicated spreadsheet but I'm just hoping that if my calculation is wrong they'll soon let me know!

  15. Hi I'd really like some advice here. I have 5 claims ready to file at court. I have now decided to claim contractual interest as well but have not previously claimed this in my prelims or LBAs. 1. Can I therefore still claim contractual in the court claim? 2. I have found out the rates, which vary from (daily) 0.038 to 0.083, however, when I look at the spreadsheet (I have just added another column in the simple spreadsheet and amended the formula) for the 8% interest column the formula is 0.00022 not 0.022. If I put in the daily rate as e.g. 0.038 it comes up with a ridiculous figure, however, if I put the 2 extra 0s in e.g. 0.00038 it looks OK. Why are there 2 extra 0s? I'm not much good with figures and don't really understand interest rates but if someone could just clarify that I have put the correct figures in to work out the contractual rate then I'll be happy I'm doing it right. 3. I've read somewhere that if you claim contractual then you aren't entitled to statutory 8% as well however I've noticed lots of threads saying WON WITH BOTH CONTRACTUAL AND STATUTORY. How come if your'e not allowed to ask for both? What should I do - just claim for both and see what happens? Munchkin

  17. I didn't even have a court date when they settled. Krysta advised me to phone her when I received a copy of their defence and ask to settle out of court which I did and they did. Sent back agreement last Friday by fax and the money was in my account by close of play.
  18. As you've now received a copy of their defence ring the number on it for their litigation department, speak to the person in charge of your claim and ask to settle out of court. They will do so in full. Good luck.

  23. Hi Consumer I don't mind at all about the letter - it's there to help. Good luck with it and I'm sure you will receive an offer letter for the full amount you are claiming very soon. They sent mine within a few days of receiving that letter and then they paid up quick too. Munchkin
  24. I received the offer of half the charges end April and sent off a rejection letter. I have now received a 'Final Response' from Monument advising the half offer still stands but they will be unable to accommodate my request for a refund if I intend to pursue the remainder through the court. Up until now I had been quite positive about filing court claims especially as with the ones I have in process at the moment, I have received an offer letter from one and have been told that the offer letters will be posted soon for the other two. I have got 5 further claims I am waiting to file but can't afford the court fee at the moment so I was hoping not to have another one. However despite the particular circumstances I can’t help but be a little put off by the Lloyds victory (I have another claim to put in for Lloyds as well! L ) Has anyone had any success with Monument before date of hearing or at court at all?
