  1. Hi Tightbum- (Nice name!) The order of events was got 2 letters dated 9th July- one saying they would defend, one offering settlement if I signed, accepted conditions and returned the letter 16th July I wrote back accepting the money as partial settlement (they had missed off the interest) 26th July money was credited to my account (minus the interest still) I called SCM to chase the interest and they said they have frozen all claims for the time being while they wait for the outcome of the court case. On the back of this I decided to accept the settlement in full and drop the case. I hope this helps, good luck with your claim.

  3. Well, money was deposited in my account yesterday, still short of the interest, but I have discovered it is my fault as I filled in the MCOL incorrectly. Anyway- With an eye to the recent developments with the test case and the inevitable delays ahead I have decided to bit the bullet and settle. Many thanks for the help and info posted on this site- donation on its way!
  4. Thanks for the reassurance christina but I filed the claim 2 months ago! Surely I am too late to change it now and I am sure Lloyds will quote that they will only settle the amount in the 'Amount Claimed' bow
  5. Lloyds have offered to settle and today deposited a sum in my account- which is great news but they have only included around £15 of interest when I calculated the figure to be around £600. I have started to doubt myself as although I included the recommended text in my MCOL about charging interest at 8%, the amount of £588 to date and the daily rate of £0.37 per day until settlement or judgement I think I may have messed up when filling in the MCOL paperwork. On the printout of my claim it shows in the 'amount claimed' box I put in only the charges- (not including the interest) I now suspect that I should have put in the bank charges plus the interest... Can anyone offer any advice as I am now kicking myself!! Can I still ask for the interest or will lloyds only payout what is on the particulars of claim form?
  6. There seem to have been an awful lot of people recently who like me, received 2 letters dated the same one offering settlement with conditions, one stating that they will defend. Has anyone actually had the money credited to their account yet - either with accepting the conditions or by accepting the money but refusing the conditions? My letters were dated 9/7/07 but due to postal delays I didn't receive them until 15/7/07. I wrote back on 16/7/07 but have not had the money credited yet.
  7. With a renewed fire in my belly following my sucess against Lloyds bank I have decided to pick a fight with GE Capital Woodchester on behalf of my husband for excessive charges in 2002/2003. I can't quite believe that they can justify a 'service charge' of up to £67 per late payment- furthermore the charges seem to vary between £26, £41, £52 and £67 for no apparent reason- proving to me that once again these financial intitutions take what ever the hell they please from their paying customers. It is my belief, (as my husband was earning a reasonable salary at the time and was just terrible at saving money) that GE Capital acted in bad faith, because as soon as I began helping my husband (then boyfriend!) with his finances and simply moved his standing order to the 1st of the month, he never missed a payment again. Why could GE Capital not have done this I ask!?!- because it would have lost them revenue.... Anyway, rant over- S.A.R - (Subject Access Request) going out in the post today by recorded delivery.

Hi Alphageek, I am just subscribing to your thread as I am about to begin the claim process against GE Capital Woodchester and you seem to be progressing nicely- Must say, I am looking forward to the fight- I have just won against Lloyds and have got the fire in my belly!! Good luck with your claim- I am going to post my SAR today and will start my own thread to log progress.

  10. I've won!!- well partially. I got the letter this morning offering settlement in return for a load of conditions/ terms unfortunately the ammount is quite short as they have only included £15.14 interest not the £606.48 which I claimed. I am going to write back correcting the figures and refusing the terms but- HURRAH!!!!!
  11. I am going through my evidence to compile my bundle and have come across a potential problem- can anyone help? I sent my SAR and prelim request out before I found this web site and as such, didn't ask for details of any manuel intervention on my account. I was thinking of sending the following letter to Lloyds (and a copy to [problem] as they have defended the claim already) it will serve 3 purposes as far as I can see... 1) to ask for details of manual intervention, 2) to ask for copy of original T & C's (which I don't expect they will supply so at least it will show the court how unreasonable they are being) 3) extra work for Lloyds and [problem] Does anyone have any comments- is it worth sending? Data Protection Act 1998 Subject Access Request Dear Sir/Madam ACCOUNT NUMBER: Please supply me with information detailing occasions where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my banking business with you. If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response. I authorise you to withdraw the statutory maximum fee of £10 from my account for supplying these details. Furthermore I request that you provide me with a copy of the original terms and conditions applied to my account on the date I opened it (1998) You have 40 days in which to comply.
  12. I sent my LBA on 4th May, they ignored me so I submitted me app to court (on-line) on 25th May. They acknowledged the claim (giving themselves 28 days to defend it) and defended it on 13th June. I then received a notice from the (on-line) court saying it would be transfered to my local court and a copy of the defence. I am currently waiting for Judges directions and a court date... Hope this helps give you an idea of time scales...
  13. Congratulations Louise! Were the letters dated the same day? What stage were you at with the court? I received the standard defence this week but nothing directly from [problem].
  14. Received notice yesterday that my case has been transfered from MCOL to my local Court and that a MCOL judge recommends that the AQ is dispensed with. Does any one know if I have to wait for mny local Judge to confirm this or is it a certainty now? I will phone the court shortly to see if an AQ payment is still required. Along with the document was the boring old 9 point defence from Lloyds-no surprise there then.
  15. Well done!! Poor old lloyds sharholders must be sobbing this week!- I wonder how much **** are charging Lloyds for all of their 'work'!!??
  16. Lloyds have defended the claim today so I assume the case will be transfered to my local court and a court date will be given... BRING IT ON! (has anyone got T & C's from Jan 1998 they can send me for my bundle?)

  18. Lloyds have acknowledged my claim today ( Lloyds are getting a bit quicker it would seem- they still had 4 days to go...) Anyway- I guess I should expect a defence by the 3rd July. Clock is ticking...

  21. Glad you were well prepared and ready to face the Judge Gillin. I have just submitted my MCOL so I am a few steps behind you. It just goes to show that this process shouldn't be seen as a get rich quick scheme as I am sure there would be plenty of people out there who would have not known what to do in your place!
  22. Quick update... Submitted MCOL on 25/5/07 and backed it up with a letter to the Court Manager attaching my schedule of Claims. The Claim was 'Issued' on the 30/5/07 and was 'deemed served' on the 4/6/07 giving Lloyds until the 18th June to do something about it. I am peeved that Lloyds have not even bothered to write to me since my initial refund letter ( and even then the response was a standard 'bog off- one-size-fits-all' typeletter) I got nothing after my LBA and nothing since.. I am beginning to think they don't care... (HHMMMM!!!) lol
  23. Can anyone give me an idea how long it takes to get a court date after the MCOL has been submitted? I am just wondering if I should be starting to produce my bundle now or wait a bit...
