  1. Thanks. I have already written to them stating the 'rules of engagement' twice now, but they still seem to think its OK to charge me interest!!! 'If you make the minimum payments etc etc' is on the statements too! Im just not so sure about the 'no debt' tho - as Im sure I read something about them being able to prove that you were aware of the debt as you used the card!?!?! Thoughts?

  3. Just called the bank. The money was transferred into my acct on Friday. I WON!!!!! Ill fill out the questionaire when I get five. thanks for all the help from this site. I couldnt have done it without you!
  4. I have written confirmation (twice) that a CC Company cannot provide me with the CCA. I today received another statement charging me interest! I have written to them explaining that this is not permitted as the acct is now in dispute/default/unenforceable. But they dont seem to listen! Is there anything more I can do? And whilst I apprecaite that fixed credit (S77 is it???) may allow the debt to be 'written off' - how could that work for rolling credit (Sec 78??).

  9. OK, so I faxed them a crossed/struckthrough copy of their letter and should have the money in the bank tomorrow
  10. My claim was with Barclays. Court date was 5/4/07 IIRC. Had a call on Wednesday about settlement. Asked me what my figures were as I was away from my desk. They were slightly out. I didnt know for sure what they were, so guesstimated. Got home to find an email from the guy and an attached letter with the guesstimated figure as a full and fianl settlement. I double checked the figures and it was about right, so I took it. Should have the money in the bank tomorrow
  11. Court date was 5th April I think (havent checked LOL) I wouldnt call it a WIN just yet, but its definitely getting a WHOLE heap nearer! Money should be in the bank this time next week
  12. Ive emailed him just now with a copy of the letter I have drafted accepting the provisonal offer. If they strike the terms and make the offer firm that will be nice Ill keep you posted in my thread
  13. Weird. I had a call today from Charlie Sparling at their legal Dept offering full and final settlement and wanted confirmed figures. I gave him a 'near as damnit' figure over the phone as I was not at my desk and was greeted by an email when I got home offering me the amount I had given him over the phone as the final figure! Im gonna take it. It covers everything Just need to figure out how to ammend his letter as it contains the usual confindentiality bit which obviously I wont accept
  14. I had a call today from their Litigation Dept offering full settlement but I coudnt work the figures as I was not at my desk. I think ll be settling tho - now that I have seen all the figures their figure is about right. just off to find the acceptance letter
  15. Exactly what I was thinking! So when they send you a renewed card and no CCA, (whooooaaaa 1995 was that???) they defaulted on Sec 85. So could I ask for all interest and payments back from then?
  16. Yeh that smy thoughts on it too. Look at it like this - a policeman enforces the law. You have to obide by the law or you get knicked! So if youre saying that an agreement can not be enforced (unenforceable) it means (to me at least) that the 'rules' by which it is made up of are no longer valid.
  17. The timescales are WELL out now. I submitted the request on 2/1/07. That makes it approx 23rd Feb that they ran out of time. So over two weeks now. Thats why I hadnt contacted them - but I receieved the statements last week and thought I shoudl get on it - but I have been real busy lately. Id just like further clarification that I am not stating anything I shouldnt in the letter above.
  18. Its not a DCA - its the CC company. But some of his parting words were 'Look, Im just doing my job and I was told to call you to let you know that if you dont make the payments then the acct will be passed to a Debt Collection Agency' The tone and manner with which he spoke to me - its no wonder he wouldnt give me his name. But I think that once I hit this letter out, the manager of the dept will probably pull the file / tapes off of my acct to see who it was speaking to me. I ALWAYS ask who Im speaking to for future reference... I asked. Long pause. I said Hello???? Long Pause........... I said Hello???? 'THE OTHER PERSON HAS CLEARED' Great

  20. I didnt want to but he RATTLED me so much with his mood and tone! I am ammending the letter after looking at other examples (incl yours)
