  1. Been reading up and seen how to do it under license from OFT, but don't see anywhere about 6 years on credit reference files,

Where in UK Law does it state that a 3rd Party outside of a contract can hold information on my credit history for a set amount of time (6 years), my contract with my creditors has been terminated so want right does the 3rd party have to hold my data protection information for this period of time ? ...if so does that mean I can hold a publish your own credit history and call myself a credit agency ?

Long story Short, got turned down for a loan and Harrington Brooks contacted me saying "new government legislation" saying to help debt ladened people over £15,000 could get debt frozen and pay off interest free, basically they got my credit cards defaulted and now Im screwed. As of last month I am clear of all debt, but I still have 3 Defaults on my credit file, 1 of which was sold to Cabot and they recorded the default too ie. 1 + 1 = 3. Now looking at my contract to one of the credit cards in the "data protection act notice" it says that they can share info with credit agencies (equifax, experian, callcredit). My questions are if my contract has been terminated (monies owed paid off) then why is my credit information still with a third party organization ? Where in UK law does it state that they are allowed to hold this information for 6 years ? Ive looked through the Limitations Act 1980, and not seen anything, where in UK law does it state the CRA can hold information that is defamatory to me on record ?
  4. It can take credit agencies months to get rid of their error's I'd raise a on-line complaint (credit agency) to get it looked into, but if can take up-to a month, its great that companies pay credit agencies and so do we for the information, so who is the client ?

  6. Firstly I think tipex would be good on your Name and Address also the reference number of your egg account details, because Im sure "they" look around here, also your giving anyone sinister enough information for ID fraud. (we can see through the pen) Delete your PDF's and try again

  8. After trying to get loans to cover my expanding Credit Card debts, and failing. I was contacted by Fresh Start Finance, to help me manage my Debt, now I'm not knocking them as their monthly administration fee is much lower than my Credit Card interest, out of 3 Credit Cards they froze 2 of the accounts interest. After 3 month's the "frozen interest" accounts recorded to credit agencies that I had defaulted on my payments (even thou it was an arrangement to pay had been agreed) now one of the accounts Egg.com has "sold" the debt to Cabot Financial and now I am seeing on my credit file 3 defaulted status's, 2 for the same account. Shouldnt the Egg.com Account be closed and status updated to "paid" and "settled" & the Cabot account be not in default since it wasnt their debt agreement in the first place ? The Cabot Account is showing the file information from the Egg.com account ?? (personally I dont know why they bought it when they arnt getting any interest on the debt out of me ) **In 6 months time all debt will be gone **

My mate is about to start going for a claim against LloydsTSB, just looking through their account and looking at different charges, my question is which of these can be claimed against since some of the codes are vauge ie. FEE = Account Charge £5.00 DEB = Cash Charge £2.17 (why it's their money,even when in the account is in the black ?) CHG = UNPLANNED O/D FEES £30 Brit

Ok one year on, since making the last post , Ive had the June 2008 letter informing me about "Overdraft Complaint - OFT v HBOS plc" and the stay, but since then I stopped, but since in last few days they've got another extension Im getting a bit threaders with it, so can I procced straight to court stage even thou all that time has passed ?

  19. Yay First letter in today Dear Mr Blah Thank you for your communication, we acknowledge receipt of your complaint about bank charges. We Believe that your complaint concerns the level, fairness or lawfulness of the charges. If it concerns something else, such as an administration error, please let us know. We believe the charges are fair, transparent and lawful, Please be advised the bank (along with a number of other banks) has now become involved in legal proceedings with the Office of Fair Trading (OFT) in relation to bank charges which we belive will resolve the legal issues regarding the fairness and legality of your bank charges. It would be our normal approch to resolve your complaint through our internal complaints process as quickly as possible. However, until the determination of the legal issues in the above proceedings, we have asked the Financial Services Authority (FSA) to suspend the normal timetable for dealing with bank charges complaints, and the FSA has agreed to this request subject to conditions that protect your rights. We can assure you we have registered and stored your complaint. Please retain your bank records, as this will make it easier for you to support your complaint on resolution of the test case. Once the legal proceedings between OFT and the banks finish, we will resolve your complaint as quickly as possible We are sorry that we have not been able to respond in full to your complaint now, but we (together with the FSA and the OFT) think that it is necessary to resolve the key legal issues before we decide how we should respond to your complaint. Obviously exactly what will happen next will depend on the courts. We do not know how long the case will take - we have promised to proceed as quickly as possible but inevitably given the importance of the issues being considered this may take many months to finally resolve. But we can assure you that once the legal proceedings are completed we will resolve your complaint as quickly as possible. If at that stage you do not agree with our conclusions you will of course be able to refer your case to the Financial Ombudsman Service (FOS) (or to the courts). Given this court case we have asked the FOS not to proceed with any other case they are hearing until the test case is resolved. FOS has indicated that as a general proposition it will indeed not proceed with cases which rely on the legal issues being considered in the test case. Similary, you should be aware that if you choose to issue a claim in the courts, the bank will immediately apply to the Court for an order to stay your action until resolution of the bank's proceedings with the OFT. ....well few more day's until the LBA
  20. I Personally wouldnt show Lloyds the letter you took to court, but reply and say thay you are declining their request unless they wish to pay up, just as a courtesy. Then hopefully the Court wont be one of the ones that will put a stay on the process Good Luck

BBC NEWS | Business | Lloyds TSB plans bank charge cut Lloyds TSB plans bank charge cut The bank hopes fewer customers will get a nasty surprise Lloyds TSB has become the first High Street bank to cut its charges for unauthorised overdrafts in the face of a continuing customer revolt. The bank, one of eight facing a High Court test case next year, will introduce the charges on 2 November. Lloyds will cut its interest rates for unauthorised borrowing by about a third and charges for going into the red and bouncing cheques will also be reduced. Other High Street lenders may now also cut their charges, analysts said. Richard Hunter of stockbrokers Hargreaves Lansdown said that Lloyd's move was probably the "thin end of the wedge". Refunds Earlier this year, the bank revealed that it had had to refund £36m to customers in the first half of 2007, after they threatened to sue for the return of allegedly unfair charges on their unauthorised overdrafts. Lloyds TSB said, however, that its decision to reduce the cost of running into the red for its current account holders was simply a response to consumer feedback, and not an attempt to anticipate the outcome of next year's test case with the Office of Fair Trading. "We want to help our customers avoid accidentally slipping into the red and are giving them the tools to do just that," said Ian Larkin of Lloyds TSB. "We understand that it can sometimes be difficult for customers to keep tabs on their account and we want to make it easier," he added. Lower charges Instead of charging customers £30 a day if they go into the red without permission, the bank will now charge £15 a month and then between £6 and £20 a day on a sliding scale, according to the size of the overdraft. Its charge for bouncing a cheque, standing order, or direct debit is going down from £35 to £20. And the interest rate applied to the unauthorised borrowing will be cut by about a third to bring it into line with the bank's interest rate for authorised borrowing. The bank believes that most of its customers who go into the red do so accidentally. So any customer in this position will given until 3.30 pm that day to get in contact with the bank and make up the shortfall, thus avoiding any charges at all. To help them do this the bank is offering an extra text message service, which will alert customers if they are within £50 of their overdraft limit, or if they have actually gone over it. "Customers who do accidentally go over their limit, will be better off as they have the chance to top up their account and get themselves back on track," said Mr Larkin. Scepticism The move by Lloyds TSB was greeted with scepticism by the Consumer Action Group (CAG), which has been leading the customer revolt against bank charges. Marc Gander of the CAG said the revised charges were still excessive. "I think they are still well over the top," he said. "On the basis that the real cost of sending a letter or bouncing a cheque is about £2.00, then the mark-up is still very high."
