  1. I beleive so although thoughts on how to approach the contractual issue would be appreciated

Difference is just over £1k applying 8% s69 which is what I assume they included in the settlement but I dont really know, ive also claimed contractual at 18.2% diff £3k and 29.8% diff over £6k . If they dont intend showing at court they must be confident the Judge will reject the contractual element of the claim but im well armed and intend giving it my best shot, ive been working toward this since last July! I beleive theyve made it worse for themselves by settling short and then refusing to discuss the details. This might contribute to their undoing as the Judge is going to have to review the entire claim at the hearing and I cant see for the life of me how he can fail to come down on my side. So Lloyds will be without representation at the hearing, sounds good to me
  3. Thanks Guido Ive been all over the calcs again and im sure im right. If i was to guess id say theyve used their own calcs provided with the SAR which were incomplete but since they wont talk to me I cant confirm this! I will bang out a letter to the court for tomorrow and fax to SC&M. Thanks for your help
  4. Have just been told by the court that they have a letter from Lloyds saying that they have settled claim. (thats the first communication since their defence went in) They are claiming that the claim has been paid and consequently there is no need for them to attend court on Friday. Creates an interesting? position which id be grateful for some advice on. Yes, Lloyds made a payment directly into my account back in Feb but have refused to enter into any communication about it. They have never confirmed what it represents despite numerous letters and calls from me. Problem is that the payment is lower than the amount claimed. Whats the position likely to be in court? Will Judge look at paperwork before him and determine whether the payment was sufficient? If he decides payment is insufficient is he likely to order Lloyds to pay more? Will this then lead to a further stay? Anyone got any ideas on how I can strengthen my position, weaken Lloyds? Cheers It does not match
  5. If your in the same position as I am you will find the attached websites of use. These pdf's contain the Lloyds TSB annual accounts for 2002, 2004 and 2006. Because they each show the prior years results you also have figures for 2001, 2003 and 2005 covering the last 6 years in full I am in court on Friday putting my case for contractual interest so im gathering as much evidence as I can.   7. I am in urgent need of T & C's / contract for a TSB current account opened in 1995. (no lloyds involvement back then) This now called the Lloyds TSB 'classic' account Lloyds are unable to provide! Anyone able to help?
  8. Hi Mindzai & Lucid Im trying to compile a list of successful Lloyds contractual interest claims to use as leverage in court on June 1st. I will need the County Court referenece numbers, looked for yours but could not find them in your thread or in litigation concluded. Is this something you could let me have, by pm if you prefer?   10. Bundle with court in plenty of time, will be with SC&M recorded delivery first thing tomorrow, court were happy with that, in was in post before deadline anyway! Missed that point, needed to be with court and the defendant before deadline so I really should have got my bundle out a couple of days ahead of deadline to allow for the post. Hearings not for another 4 weeks so have plenty of time for Lloyds non compliance, thought id give them until early next week then issue letters, see how patient im becoming! Sent bundle recorded as recommended, your right, id have been sick if it had gone missing in the Lloyds internal post!

  13. For the court bundle - If your refering to another case for reference/argument purposes at the hearing how should it be cited? Do i need to summerise what each case is about?

  16. Hi Allen I had a look at your thread, thanks and good luck. Im not as far advanced as you yet, my court bundle needs presenting by May 3rd, im pretty much following the recomendations on here plus doing some further research on contractual interest. In terms of what wil be included in the bundle im going to lay my hands on and include anything that might support my arguments, I might end up focusing on only a couple of points but I want to keep as many avenues open as possible at this stage, it can only help when it comes to fighting my corner during the hearing and as more information becomes available. Although I have to hand in docs by May 3rd ive until June 1st to research my CI arguments, I intend to make the best use of the time i can. If I come up with anything helpful I will let you know.
  17. Gary Thanks for the Orton letter, I added the info to your emal and sent it back to you, let me know if its gone missing. SC&M sent an agent (thats what he called himself anyway) I think it was a Mr West from Essex to my allocation hearing.

  19. Hi Just received new instructions from Judge. Claim has been allocated to small claims track. Events so far have been - 1 Feb 5th allocation hearing scheduled 2 Feb 2nd lloyds paid 'penalties' only direct into account - they have never explained what was included in the payment, it does not match my own figures. contractual interest not paid nor discused by lloyds. 3 allocation hearing takes place feb 5th, one month stay granted to allow lloyds to explain payment and for both parties to negotiate settlement. 4 During stay I wrote 4 letters to SC&M but no response to any. Lloyds have made no attempt to communicate 5 Stay expired March 5th and as id heard nothing and claim not settled I complete another AQ as instructed in which I respectfully asked judge to apply directions as per CAG draft order or apply standard disclosure. I understand court has not heard from lloyds. 6 Today receive the following notice/instructions from court Hearing June 1st, 2 1/2 hours allocated. Each party shall deliver to every other party and to the court copies of all documents (including experts report) on which he intends to rely at the hearing no later than May 3rd. Original documents shall be brought to the hearing Witness statements must be included in documents served and filed It should be noted that the defendants witness statements should include a statement from an employee of sufficient rank or authority to clearly set out the basis upon which the charges levied are calculated and justified So ive got 3 weeks to put together my court bundle!
  20. Hi all Final date for stay has been and gone, I submitted another AQ, understand Lloyds have submitted nothing. File will now go before judge, Im hoping he will grant my request for a hearing and for draft order directions or standard disclosure. Have written, faxed and called scm (all detailed in my new AQ) but received no response and they have yet to explain what the payment in early feb was about! Will let you know when i hear something

  22. My claim continues for payment of the penalties plus contractual interest. Is there a list of sucessful contractual interest claims or do I need to go through each settled claim to establish if statutory or contractual was charged? I intend using this info to support my claim Cheers :grin:
