Have just had a 'chat' with Alison Follet, and explained that a little more would be more than acceptable, she thought about it and agreed to another amount now 90% of claim, so I have adjusted the agreement she sent me accordingly and am going to post it off.   4. Offer received 7th November approx 80% of my claim, am thinking of accepting it as xmas is coming and the cash will be nice. So I shall be contacting them to see if I can get any more out of them first and then make my final decision, although my heart says accept the offer my head is telling me to go all the way and claim the total amount. Oh decisions, decisions!

  8. Hi Austen Don't be too shocked will you, I started a claim against Barclays (my old Personal a/c) on 2nd October and have received an offer today, which I may add I am seriously considering. Its a bit less than I hoped for but hey ho Xmas is coming etc etc. So will write back asking for a little bit more, and telling them that I need a cheque because I no longer bank with them. So indeed they do seem to be pulling their fingers out. I've been dealing with:Allisson Follett, Customer Relations Manager, Freepost RLTA-CSUE-TCHC, Head Office Customer Relations, London E14 5HP.
  9. Got this reply dated 25 October. I'm sorry you have had to contact us about the commission and interest charges levied on your account since Oct 2003. I'm looking into your concerns and will let you have a response or update as quickly as I can but not later than 13 Nov. So I will wait and see what happens next.
  10. Received this letter today from James Ball, Customer Services Manager, Executive Complaints. Dear Sir, Thank you for your letter dated 1 November 2006. I have now fully investigated the matters raised. Default charges are charges payable if customers do not make the required minimum payment by the payment due date, if they exceed their credit limit, or if a payment to their credit card account is returned unpaid. The amount of these charges, and the circumstances in which they are applied, is set out clearly in HFC Bank's credit card agreements. We believe that HFC Bank's charges to customers are fair and reasonable. The OFT has recently published the findings from its enquiring into default charges on credit cards. HFC Bank has carefully considered the OFT's publication and does not accept its findings. However, the OFT's investigation has led to a change in market practices and HFC Bank has therefore decided, for commercial reasons and in the interests of customers, to reduce its credit card default charges for the future. These changes do not affect charges that have already been applied. Accordingly, I regret that we are not prepared to make any refund of default charges or provide any compensation payments. I hope I have been able to clarify HFC Bank's position on credit card charges. Thank you for taking the time to contact me to bring this matter to my attention, I am only sorry it was necessary for you to do so. I hope that matters have now been resolved to your satisfaction.   11. Have phoned and checked that they have bought the a/c from the Shoe Tailor. So have sent a CCA 1974 letter 1/11.
  12. Ok guys I found a copy of a utility bill which is indeed in my adopted name, so have sent a copy off. Received this letter back (cheeky bugger). I thank you for your letter dated 1/11. We are now in the process of retrieving your information from the system and will forward it to you when it is received. Please also note that under the Data Protection Act 1998 we have 40 NOT 14 days from the date we receive sufficient information from the subject to process the request. So do I now start counting 40 days from 1/11 or as before 16 August, if so I suppose its time to progress to the next stage.
  13. Right guys here's a short outline as to why i'm dealing with Thames Credit. In 1994 my 'ex' took out a loan with the Halifax and stupidly i signed the paperwork (I had just lost my father and wasn't thinking straight at the time). Anyway over the years payments were NOT made by him, and then we split up. Halifax 'sold' debt to Thames Credit and 'chased' myself and my new partner for the debt which we have been paying off monthly ever since. So sent off a CCA 1974 letter on the 19th October 2006, to see what would happen really. Got a reply back 31st October 2006 saying Dear Madam, We refer to your previous correspondence. Halifax PLC have confirmed that they are unable to supply any copy statements or a copy of the original application form. Please find enclosed your cheque for £1.00. We can confirm that we have written off your account and you will receive no further communication from Thames Credit Ltd with regard to this matter. Yipee I found out that the outstanding balance was £6,880.00. But now does anyone know can I claim back the monies that we have paid them and if so is there a letter lurking around that I can send to ask for the money.
  14. Right this ones different, its Royal Bank of Scotland Equipment Finance. We financed a sunbed for our shop from these shysters. We owe them £2,127.09. Have had a request from Buchanan Clark & Wells Collection Agents for £9,105.84. (I have written to them and told them this a/c is in dispute). Must admit have had a few requests from company called Debt Enforcement Services before regarding this, but stupidly was ignoring it. Received this reply today. I inquire in regards to your 'requesting a refund'. Have you requested this in writing to BOSEF? If so, have they responded in writing? A hold will be placed on your a/c for max 14 days from date of this letter. By which time you should have forwarded your payment proposals. Next bit says we are not able to access credit reference files etc. And are not in breach of DPA 1998. To assist you with settleing this outstanding account we can accept £6 K as a one off payment to clear your debit. How can a debt jump up £6,977.86 is that just interest etc. What the hell do I do now. HELP Please.

  16. Have received from from Philip Harland, Data Protection Office (this guy really things he is something else). I referred your application for SAR to Office of the Information Commissioner as I was not satisfied that you had sufficiently discharged the obligation on you to identify that you are entitled to access the account in question. The Information Commission shares this view. They recommend you be asked to prove your identity as ..........., This can be bt way of a statutory declaration signed in the presence of a solicitor or it can be by means of, perhaps, a utility bill bearing the name you say you have adopted, namely ......... The documents you have provided do not discharge the burden of proof and in this context it is worth noting that, notwithstanding your assertion that you have adopted your partner's surname, all correspondence with me has been in another surname entirely, namely ....... (my single name) I await to hear from you. So guys any ideas what I do now.   17. Received letter re claim offering me a full and final settlement of £120 and to go away. Now my problem is this: I owe them £441, my claim is for £313, they have offered £120. At the same time NCO have 'bought' this debt and I have sent them a CCA 1974. Shall I say thanks you to cap one for the money, and continue against NCO (hopefully to get the debt cancelled), therefore making me in profit for £120. If I have made myself clear. Anyone got any ideas on this pls.
  18. I sent a CCA request to NCO & Thames Credit on 13/10. 12 days 1/11 & 30 days = 1/12/2006. Hope i'm doing the right thing here peeps.   19. Oh Dolfos I do feel for you. We also have a small business. We had to close our last business in Feb. 2006 largely due to guess what - yes charges etc etc. Anyway we have recently started a new business and believe me I shall be keeping a very close watch on the account this time. I shall also be keeping a close watch on your thread as I too have our business a/c's in line for claiming. Good luck and keep smiling and remember you have lots of support here.

  21. HELP PLEASE !!!!!!! Just had a call on my mobile, from a guy at NCO regarding my capital one card account. I sent a prelim request for £314.00 on 3/10. And I only owe Cap One £441.01. This guy was so rude it was unbelievable. He threatened me with all kinds of things, ie sending people (thugs) round to the house etc etc. I told him that I have sent them a letter confirming that the a/c is in dispute, and also a CCA 1974 he told me i was thick and no way was I going to get away with all of this. Anyway I basically told him to F**K OFF and not to contact me again, unless its by post. He then informed me that they will be calling me whenever, and wherever they like and there is nothing I can do about it. Has anyone any idea what I can do now.
  22. Yes hag, I think they forgot that bit don't you, goes to show that companies do change their minds. Anyway thanks for all your support everyone, and a massive thanks to Hagenuk for helping me write such wonderful letters. Oh and I think I shall be using Hag's letters a lot more in the future.
