  4. please enlighted me as to why you are willing to pay commission to achieve what you can do yourself. It seems rather daft to me. If you need any help etc just shout there are plenty of people around who can help you, and you will save on commission etc.

Brilliant just been informed that HFC/Marbles solicitors - Restons have placed an Interim Charging Order on the house, and now its going to court on 19th December for a judge to decide whether the charge should continue (with or without modification). Am now seriously p.....d off, so have sent this letter to Restons, hopefully to 'slow down' things a little bit to allow me to get finances together to pay some of this off. Dear Sir, I am in receipt of your letter dated 22nd November. I am writing to clarify that I am currently in the process of requesting a refund of charges unlawfully made to my account. I note from your correspondence that you have issued an Interim Charging Order on my property. I need to make you fully aware that I am disputing the sum owed and, as such, you must refrain from any further action until this dispute is fully resolved. I respectfully request that you stop this action and do not proceed further. Hope this is ok, any help appreciated peeps.
  7. Letter dated 16 November, and he has offered £500. So have accepted it, and will now wait for the cheque to arrive.

  9. This was 90% of original claim, it didn't go as far as court.

Have now had 5 phone calls and 2 letters asking me where my payment is, I am now fed up with explaining that the a/c has been written off so have now pennned this letter to them, Oh and I'm asking for the money back that I have paid them as well. Here's the letter: Thank you for your letter dated 30th October 2006. In which you state that the debt has been written off and the account is now clear. However I am now writing in relation to the quantity and frequency of letters and telephone calls that I have been receiving from your company, which I deem to be personally harassing. I have verbally requested that these stop, but I am still receiving correspondence and calls. I now require all further correspondence from your company to be made in writing only. I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997. If you continue to harass me by telephone, you will also be in breach of the Wireless Telegraphy Act (1949) and I will report you to both Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine. Please be advised that any further telephone calls from your company will be recorded. Furthermore I request you to supply me with a full list of monies that I have paid to yourselves, and will require repayment in full of this money within 14 days or I shall begin a claim against you for the full amount plus interest plus my costs and without further notice. Hope i've done right because i've posted it anyway.
  11. Ok I sent off the prelim letter and received this back. Dear ...... etc etc. The charges you refer to are in line with our Tariff of Charges. We provided you with a copy of our applicable tariff of charges with the mortgage offer and annual statements. We enclose another copy. We refer you to condition 10.3(b)of these mortgage conditions, which makes it clear that the tariff is part of your mortgage contract. (10.3) The companys right to recover costs and expenses entitles it: (b)to recover its internal costs by charging administration fees in accordance with its published tariff. The charges have been properly debited to your account in accordance with the conditions of the mortgage and it is not appropriate for us to refund them to you. You have indicated that you may make a court claim against us if we do not refund these charges and so we have referred this matter to our legal team. Your letters should be marked for their attention should you choose to proceed. The address is GMAC-RFC Ltd, Eastern Gate, Brants Bridge, Bracknell, Berks RG12 9BZ. We will not treat your letter as a formal complaint. However if you choose not to make a court claim, our complaints procedure is still available to you and we enclose details if you wish to pursue this. Well thats it WHAT DO I DO NOW please anyone

  14. Hi Hagenuk I too am claiming for an old Halifax Mortgage Oct 1994 - Oct 2002. Have tried calling them various times for an explanation as to what the 'sundry' entry is for. The last guy is spoke to said we can't really tell you anything as its and old account but I think its a charge. Well thats good enough for me so I'm going to add it to my spreadsheets along with the others that you mention in no:7. Anyway I shall keep watching your thread with interest hun xxx.

Just completed letter as supplied by Zootscoot No 14 http://www.consumeractiongroup.co.uk/forum/other-institutions-successes/19501-zoot-halifax-mortgages.html I have adjusted it slightly because i don't understand compound interest stuff. Anyway wish me luck guys. Oh and thanks to Zootscoot for the letter.
  18. We received our statements within a few days of our letter, so judging by that you won't have long to wait hun. If you don't get them within the time limit, you can always go to the next stage and send the a non-compliance letter. That usually does the trick and wakes them up a but IMHO. darling
  19. Bloody hell peeps its just taken me over an hour to scan this thread. Anyway I've had a reply from Thames Credit, in which they say that they cannot supply agreements etc and have indeed written off my account, and there will be no further contact from them. I would dearly love to now try to claim back the money that we have already paid them and get default (if there is one) removed. Is there a template letter for this, as I dont wan't to send one written by me, as my letter writing skills are not up to the 'standard' that is in the library and I don't want to mug myself off by saying, hello you owe me £...... give it back oh and by the way remove any default etc. I just think that something a little more polished will work wonders. Thanks in anticipation guys.
  20. This claim is for £190 so not a great amount in the big scheme of things, they offered £90 at first, so I called and 'negotiated' a bigger amount. She (or the person who I took to be her) seemed to be quite pleasant, and to be honest I think that they cannot really be asked to go through the court thingy, mind you I did make it quite obvious that I was willing to go the whole way down the court route. So my advice is be very firm but respectful and pleasant, I have found that to be a good way of 'winning' any argument. Hope this helps you with your quest, and I will post again when/if I receive a cheque, because after all of this I am still not overly confident anyway.
  21. Just sent a 2nd LBA directly to James Ball, he seems to be the one who's dealing with all of this, and I've highlighted the section about 'if I don't hear from you within 14 days etc etc' so he's having a second chance. I must be going soft or something.

  24. Ok have written back rejection of offer, and have received another offer back, which comes to 90% of the total claimed. Due to financial situation and xmas coming I have decided to accept the offer, and have signed and returned the acceptance slip, although I shan't be getting a cheque at least the total owed will be reduced and that is a good thing to happen anyway. Thanks all for your support. Another one for the filing cabinet.
