  1. Dont know if this helps in trying to work out this one, have to say i am wholly confused. Just looked at the paperwork for this. The form is titled Application for advance of salary for season ticket purchases for travel from home to work. There are no terms and conditions either on the application form, however there is a second page entitled notes fro completion. The only signature required is that "i give authority for the advance to be recovered over a period of: 11 or 12 months (the applicant ticks one of the two boxes.
  2. Here's my take on it. Has your employer at anytime carried out any manual handling training. Has your employer at anytime spoken to you about any risk assessments, or carried out a risk assessment on your return to work? On the Occ health side of life, has your supervisor/ occ health or indeed anyone regularly reviewed you? I might be worng here, but i think that if the matter went to tribunal they could well find in your favour but there is a bit of a kick back in that since april 2009 if they judge that you have contributed to the resultant termination of your employment they can reduce an award by up to 25%. Now we have only basic details, and there are those here that are far more experienced and wiser in such matters, and i will happily stand corrected on any point. In preperation for any meetings with advisors over this you need to set out in chronological order what has happened, giving a decent level of detail. Collate everything you have from the employer, doctors etc into a sensible order and make copies of everything (tiem consumign i know but it helps make sure you do not loose anything. Keep a diary now of what goes on, dates, times, names and details etc.
  3. I was wondering if anyone had any experince of Employers schemes regarding Travel Card/ Season ticket loans. Very briefly the scheme applicable in this case is this. An employees can apply for a travel card/ season ticket loan, the loan is offered on a interest free basis is is repaid from source by the employee on a monthly basis over a period of 12 months.. My questiosn are. 1. Is this legally classed as a advance of salary. 2. If it classed as a loan would it be covered by the likes of the consumer credit act etc. 3. if it isnt covered by any consumer law hwo could an employer enforce the rpeayment if it was to becoem an issue. Apologies for being very bague about this, there is a very good and genuine reason as the matter involves very sensitive confidentiality issues. I may well need some heavy duty expert opinion on this one as its bound to be complicated. And the case does not apply to me, as i am not covered by the confidentiality claueses of the person concerned.
  4. I would be very wary of what you say to them both before and indeed during any interview. It appears he his suggesting theft of a motor vehicle, be wary of agreeing with him, be as none specific on precise terms as you can be. The reson i say this is becuase if for example they were to go down say a particlar route it can be very easy to disprove it. If you were hyperthetically speaking agreeing with him on suspected robbery it woudl be easy to disprove robbery, end of story no case to answer and it all goes away. They are looking for what they call NFA no further action, anything for an easy life. In all likelyhood he will not come alone but will have a side kick, its doen purely to put you on edge, he may well ask you what you want done about it, again be non specific and go along the lines of i will wait and see what your investigations turn up and seek advice at the appropriate time. It would be helpful if you had someone with you too, it puts them a little at unease if you have a witness to what is said etc.
  5. One can only think the complaint was passed on by the Sgt who visited you. The Police like anyone else doesnt like complaints, so will (for the sake of diplomacy) try and deal with matters as quickly and informally as possible. Sounds to me like he has gone away and realised you arent going to go away. Dont expect too much to come of this with regards to the policing side of things i reckon the best you can expect is a conclusion of words f advice being given to the officer concerned. However whatever the outcome as long as it reflects your contention the car was removed unlawfully can only back up your claim in the future.
  6. You might also want to do a bit of digging around your local force and find the contact details of thier professional standards dept. A two pronged approach will get some reaction, copy the IPCC letter to the professional standards dep't and watch the sudden flurry of activity. They will do thier best to go for "local resolution", it looks better on thier statistics, whether you choose to accept that is of course entirely a matter for you. I know what i would do. Light blue touch paper and retreat a safe distance and wait for the pretty fireworks.
  7. The disputed or unpaid item proceedure isnt that difficult to follow really. Ebay though, are very apt at looking for any excuse not to refund monies and not following the laid down proceedures is just one to the ways around it. The problem is that if you try and follow the process now, you coudl end up with a bit of an issue. Say Ebay are abel to track down the original buyer and he says he will pay for the item. That leaves you in a bit of a sticky situation, as you have sold the goods to another. That is why they put these processes in place.

  9. A lot of employers are now requiring employees and potential emplyees to take copies of passports and other forms of ID as part of their checks for eligabilty to work in the UK. Some will even tell you it is a requirement.

  12. I have been advised that the latest edition of the Ilford Recorder is offering photographs for sale. I wish to make it crystal clear that i am now quite satisfied that only those images taken by Jules Dann and not mine are being offered for sale.

  14. Batty. I am curently looking at several methods of ensuring or at least lessening the chances of this happening again. How precisely i will implement this i have yet to decide, as diffeent organisatiosn have different requirements and or expectations. it is looking highly likley that this will actually be work done on the website itself. But it is very clear that i need to take some form of action to better protect my work.
  15. Buzby. It doesnt surprise me that this happens all the time, but in this case i would certainly expect the Ilford Recorder to have known better. One of the issues that this has brought up for me at least is that having done a deal with the Evening Standard (i did make this clear in my email to the Recorder) i did not want the same images being sold and published again. But by using the material they did this has happened. So given that i am looking at the NUJ and others as one of the gatekeepers for issuing of press cards i have had a bit of a double whammy. Firstly the issue of credits for the pictures and secondly if i were to use the Ilford Recorder items as eveidence of published material it would be almost identical to that already published. It is difficult enough trying to breakthrough into this line of work, so the press card issue is crucial to me especially at the moment being recently made redundant therefore unemployed. I dont think i would be overstating this state of affairs and the delays in the process as being the difference between being able to have the opportunity to start earning money and continuing to struggle to make progress. There were plenty of other images that could of have been used that i would of been more than happy to supply in this case, that would have been useful to me and provide evidence that this was not a one off couple of shots, but part of a series covering the whole incident that had been well thought out and considered. I don't expect things to be handed on a plate and i dont mind working to get what i want, this though i feel is well and truly out of order and has had serious consequences for me.

  19. This seems to eb a new ply by HFC. They settled my claim a few months ago, Weightmans wrote to em and informed me that the file was closed, this was after pressing them for the CCA documents which they failed to supply. I get a letter from Weightmans last week stating that Phoenix has been assigned the debt and i owe them xxxxx and ot contact Wrightmans to arrange payment. Oddly the amount they are asking for is exactly the amount before settlement of my claim. Have written to them reminding them of all this. Doubt it will make much difference though knowing there track record on such matters
  20. Yes i did consider the watermarking of images. The problem being of course they can interfere with the image and for the most part is a very time consuming effort. It is a trade off that one has to calculate. In this case though, one could reasonably expect that a media organisation would know better and be aware of any issue regarding copyright infringement. That said the main page of my site clearly states images are not to be used etc etc and each subsequent page has copyright notices on it. There is really no contention over the copyright owner and indeed how the images were obtained, they have pretty much held their hands up on this. It is the options available to remedy the situation that is the bone of contention. My view is perhaps over simplified in that the pictures have been put inot the public domain and credit given to someone else. The best anology i can think of is perhaps this. If a movie was released and was liked by the public and people went to see it in increasing numbers, but the credits were given to say Spielberg as opposed to Joe Bloggs, then joe bloggs's does not suffers in that he does not get the recognition that should be his. Then the movie producers dont pay Joe Bloggs for his work or tell him his work is being aired then joe bloggs suffers as a result.
  21. Thanks for the reply, that does seem to make sense with regards forcing a reprint. That being the case though, i would have to think along the lines that damage is likely to have been caused as the photograph has been printed and credited to someone else. As an aspiring photographer looking to getting into the news type area, this has not done me any favours at all. Speaking to a couple of people elsewhere, they are seeking the views of copyright specialists. I appreciate it may be difficult for some to understand what all the fuss is about, but it is really important to me.
  22. Something a little different hopefully. I am a budding photographer, and recently got some very good action shots from a fire local to me. I offered some of the pictures to several news papers, and sent copies of some of the images to one paper that used them. Other than the newspaper that used my pics, i did not send anyone else any pictures but referred them to a website where they could be viewed and if interest they should contact me. So far no problem. Last night my other half came home with the local paper the Ilford Recorder, lo and behold 3 of my pictures were in there, they didn't even acknowledge my email and certainly did not get any images from me. The Ilford Recorder is a weekly news paper and is part of a large media related group, Archant. The pictures 7 in total throughout the 4 pages covering this incident have been credited to two photographers namely Tony Barclay and Jules Dann. Jules Dann being listed on the Ilford Recorder website as an in house photgarpher. I am thinking this was perhaps a mistake but will be trying to establish if both or either Tony Barclay and Jules Dann have or are claiming any of my images to be theirs. One of the images in particular is attracting a lot of interest, so as someone trying to make headway in this field it is vitally important that exposure of my work is properly credited, it can mean the difference between a decent sale or not. I contacted the editor of the newspaper who did everything he could to evade the questions being asked and informed me that the images were supplied to him from a third party. To cut a very long story short, what has happened is the newspaper has gone to my site and taken images from it and printed them as part of their four page story on this incident. I offered to settle the matter very quickly by inviting the paper to pay for the images at a slightly higher rate than normal and re print them with the proper credits in the next edition. The reason for the reprint is to ensure that the credit matches the photo. The Editor has now got all stroppy and says he will pay the asking price but will only add a clarification statement (if anyone has ever noticed one of these it is hardly noticeable) and would not identify any particular image so in essence the credits to the published images would remain unaltered. So i have declined this offer, and stated firmly but politely why, i also indicated that if they wish to contend copyright of the images how they were obtained and not settle i would have no option to to look into the legalities of the matter. The reply was straight forward, thats our final offer take whatever action you want. So what options do i have here? If there is anyone who could point me in the right direction i would be very grateful. Money isn't the issue here it is principle and the fact the images were taken from a site that clearly states nothing is to be copied, reproduced edited etc etc without my permission, each page contains a contact link.
  23. Well it took a lot of time, effort and patience but i got there in the end. Having spoken to the bailiff this morning i am now assured that the crapsters have coughed up the money and finally paid. Money is due for release from the court today. Cap 1 have in my experience acted is a wholly disgraceful, unprofessional and underhand manner. I am very confident to say on record they are [EDIT], having given false information to my local county court and the bailiffs on more than one occasion. Even when given a Warrant of Execution they have lied and wriggled in order to avoid payment in this matter. Anyone tackling this organisation has my total sympathy and support, i have never experienced such blatant behaviour from a company before. Never ever be put off by this bunch, stay focussed and determined and you will no doubt win in the end, just don't expect it to be a simple ride. My claim has taken well over a year to be finally settled.
