Halifax have filed a defence disputing the interest calculations:mad: and returned £834.72 to my account without telling me:) Back on the phone to Rachael Hinchliffe i think:rolleyes: Shes away until 9/11 !!!

sent MCOL 6/10 561.66 . 295 charges +266.66 interest +105.14 8% +80.00 court fee = 746.80 Now had a letter saying because payments go FIRST to fees charges etc they cant agree with my interest calculations. Has anyone else encountered this argument?Ive not come across it in 10 other claims:confused:

Just received another offer £834,apparently they disagree with my interest calculations:mad:but still dont want to pay interest they have unlawfully taken from me,plus 8% statutary.Have phoned Rachel Hinchliffe and told her I want both(it isnt as if I've asked for contractual interest)total£1120,she said she will phone back after taking advice from her superior:confused:

Hi Aardvark Ive been a couple of days away from you all through:( MCOL issued 2/10 deemed served 7/10, but like you aknowledged 4/10 but thats where we differ, I havnt heard anything since:mad: I know now they have until 4/11, it's so unfair:mad: but CONGRATULATIONS to you!! -

Now had a reply to my rejection of offer letter:o ''if you do not wish to accept this offer and you now intend to start legal proceedings it would appear we are unable to reach an amicable resolution '' Basically ,see you in court:eek: -

I have also sent a complaint to the information commissioner and issued a court claim (N1) against barclaycard re their refusal to send charges information:o -
LBA sent 27/9 £4678.61 4/10 offer of £1000 rejected 17/10 taking N1 to court asked for £2266.07 contractual interest or £725.14 statutary interest:)

Sent LBA 21/9 for £429.69. Heard nothing sent MCOL 6/10. Received a letter dated 9/10 saying will be looked into within ten days !! 12/10 cheque received £429.69:) Asked for extra £71.80 interest and £80 court costs re. MCOL. Does one hand know what the other is doing:rolleyes:

My letter from DG Solicitors also had a confidentiality clause,which i crossed out.I had a reply today 'the agreed sum will be credited in the next day or so' !!.No mention of the clause.However they don't have much confidence in the bank,it continues' If the credit does not appear within the next week please telephone the writer'!! -
Good luck,I've heard nothing more my MCOL goes in saturday as well:) I may have a go at a N1 ,I want to get everything right and theres not much room on the MCOL form for particulars of claim

Accept the offer ONLY if you tell them you are carrying on for the rest There is a template letter for this purpose

Pay the £3 per statement if you can afford it,claim it back as costs
