  1. Hi Guys, Sorry I got a letter from aqua a week ago saying they are going to increase my credit limit to £1750 from £1000. As my car has just badly failed the MOT i thought this was ideal. The letter stated contact them if I do not wish to increase my limit. So I looked at the beginning of the week, and sure enough my limit was £1750 I then paid off a bill onto it. Today, i came to pay for some car repairs and it got declined twice. On checking my balance, not only has my limit miraculously been put back to £1000, I have been charged an over limit fee!!! Before I call them, what rights do I have? Surely I needed some notice before a decrease? I haven't spent on the card since I got the letter until I checked my balance was increased at which point I paid the debt (put me £20 or so over £1000). Any help would be much appreciated.
  2. Hi Guys, looking for some advise, I was terrible with my finances years ago but after a long battle Im back on track, my girlfriend however, isnt. She struggled with the 28 day statement cycle (ridiculous system in my opionion) and fell into debt with Very. In the past she received a claim form from the courts while I was away. She admitted the debt and offered to pay a sum each month. We've just got back the acceptance part but now I can see it I'm not 100% convinced. How can you tell these forms are real? The form is not stamped but a printed on stamp, there is a claim number and the address given if for Northampton county court bulk center. It might all be legit but I no the levels these DCA's stoop to and didn't want to be tricked into something. Any advise would be great.
  3. Ok I have issued all my info to the ICO to show the debt is statuate barred and the default was placed unfairly years after the default. How long does this process take? Is there anything I can send to Lowell to spend up the default removal?
  4. So what does that mean? What can I do? Data that is reported on your credit file must be fair, accurate, consistent, complete and up to date. Its not accurate or fair.
  5. I never received a response from my SB letter. What's my next move?

I'm going to send the standard SB letter with the addition of, Further to this, the default you have placed on my credit file was over 4 years after the default notice was sent and the default date recorded on my credit file as 30/11/2011. This is entirely inaccurate information and I refer you to the ICO guidelines below; 4. If you fall into arrears on your account, or you do not keep to the revised terms of an arrangement, a default may be recorded to show that the relationship has broken down. As a general guide, this may occur when you are 3 months in arrears, and normally by the time you are 6 months in arrears. I require the unlawful default removing from my credit file or I will be forced to inform the ICO and begin legal proceedings. Is that worded ok?
  7. Thanks I will send it off today. Shall I attach evidence from the SAR and point Lowell towards it or let them do that? Also, will they remove the attributed default if it is indeed statuate barred? The default date is still wrong as my last payment was 27/11/07 and the defualt notice was sent according to the OC 11/11/08 (1 year after last payment) for it to be recorded by Lowells 30/11/2011 (4 years after last payment). Surely something can be done to remove the default as it should have been placed within 6 months, not 1 year or 4 years later!
  8. So if thats the case shall I get a letter together with the evidence they sent me and ask for it to be removed?

Ok so I have a list of transactions and here are what I consider to be the important line: 27/11/07 payment thank you 29/11/07 Payment reversal 12/12/07 Admin fee From then until 29/09/08 all there is is admin fees and interest. So from the info here, the last time I acknowledged the debt was 27/11/07.
  10. I really don't understand this info at all. It's a lot of screen printouts that don't really tell me a lot. I have the original statement which states no ppi. Not sure what this means but I'm more interested in getting this default moved. It states "default notice was sent out on the 11/11/08 and if customer does not respond within 90 days it will be registered at the bureau". Do i now have the info to get the date changed?
  11. Ok I've received the SAR back. Its all mumbo jumbo to me so what am I looking for specifically?
  12. Ok, I'm 99% sure that's whats happened and the SAR will provide me with the ammo to fight it. I'm guessing the usual response is to change the default date not remove the default altogether? The 6 years will be up in 4 months any how.
  13. So a debt collector can purchase a debt with no default placed, effectively hound me for 3 years then add a default to enable them to continue to do this for 6 years longer?
  14. Even if it had not been recorded by the OC, can a debt collector such as Lowell just add a default when they please? I thought it was in the guidelines that a reasonable time was 3 months since the contact ceased. Not sure where I remember that from though.
  15. This is a letter from Lowells, referring to the original letter which I dont have. It states they sent a letter stating their intention to send a DN after 90 days without remedy.
  16. A default notice telling me to remedy the account within 90 days, to then actually place the default 3 years later surely can't be correct. The default date on my credit report is 2011, when the actual default was placed by the OC I'm not sure, hopefully the SAR will shed some light. All I know is I have not acknowledged or paid anything towards this debt for over 5 years.
  17. Ok so I'm still awaiting the SAR, 40 days is up in a week or so. I raised a dispute with my credit reference agency who looked into it and found nothing wrong. However, I have since then received a letter from Lowell confirming that they replied to a recent enquiry and that the default notice was sent to me in 2008 and that I can feel free to pay them now (haha). What should be my steps from here? On my credit report the default date is 2011. Shall I now write to Lowell with the attached letter, or my credit reference agency, or the OC to amend the date? The default has been placed on my account 3 years after the notice which surely isn't fair.

To save time I sent a certified copy of my drivers license to speed things up making it clear that they should need proof ID as they have been sending me letters etc to my address and should they have any doubts it should have been rectified a long time before sending me bank statements etc. On another note, I raised a dispute with the credit reference agency and it has been marked on the debt as "in dispute". Is this a good sign or just standard procedure? Its passed the 28 days limit thats why its been marked as in dispute.
  19. Right I got round to posting SAR 08/02/14. Got a reply yesterday telling me they need a certified copy of my passport or drivers license etc as "original seen" by a doctor, accountant etc. They letter was also written by HSBC who deals with the HFC accounts. Can I just go into branch to sort this or shall I just get a certified copy to stop the games and get my SAR?
  20. And shall I include a utility bill in my first letter as proof of ID?
  21. Few quick questions. Going to post the SAR tomorrow. Who do I make the postal order payable to? Also, should I include a utility bill with the request to avoid any ID delaying tactics?
  22. So all they need is what's on the template? My name and address? Sorry for all the questions I just want to get it right first time!
  23. When sending an SAR, can I still get the info without an account or reference number?
