  1. Yeah, that sounds like a good idea re the copy to the local branch. So far I've only dealt with head office as the branch I used has been closed and it's responsibilities handed to a neighbouring one, but they still have all the relevant stuff so will send them copies as well.
  2. Two letters drafted tonight, one for charges and one for ppi, thought I'd keep the two requests seperate thought it might be easier in the long run. Think I'll send them to head office tomorrow and see what ensues.
  3. Lou, don't know if this is normal speed or I'm just unlucky, I'm sure I've seen posts on here by people getting their cheques within the week.
  4. That's my understanding too, So I made a quick call to Welcome today and it is exactly what has been said a penalty for early repayment. Well I'll be drafting a letter tonight asking for that and the other eighty quid in fees back, plus I'm also going to have a go for the PPI, as I have no knowledge of a) asking for it b) wanting it c) being told anything about it except that I had to have it to get the loan. To be honest I will push this one all the way with this lot and I'm not really that bothered about the outcome.
  5. Well, no post again today. I can honestly say that I'm so glad I no longer have a Cap One account, they are, without doubt clueless and incompetent. I did have to phone, (I resisted the temptations to wait till someone answered and cut them them off:) ) The upshot is after much debate and wrangling trying to speak to anyone with any idea or authority, that my cheque is in the post:rolleyes: . Hmmm, let's see if it turns up tomorrow, hope so, because if it doesn't it looks like I may have to wait up to another 14 working days, well if that's the case my letter from the court will be being returned tomorrow stating that I do want to continue the claim as payment has not been made, I informed Cap One of this, so it will be interesting to see if they get their finger out.
  6. Nope, the account has been paid up and closed. As I said I rang them on friday, after being on hold for quite a while I was told it should be paid by monday. Hope so, as I'm going to be giving someone a bit of grief otherwise:).
  7. Well if that's the case regarding this 'penalty fee' I will be having that back too.
  8. I've received my info from Welcome, must give credit, pretty quickly. However the info contained is pretty 'grim' . Looks like I've been charged £1311.82 in PPI for a period of 16 months! Charges only ammount to £80, but I'll be having that back. The other interesting item on my statements near the end of the loan is an item marked as 'penalty fees' £641.37, does anyone know exactly what it is? If not I'll be calling Welcome asking them to explain it to me.
  9. I hope Capital One are true to their word, phoned on Friday as Monday is the 14th working day since I received their offer to pay up (as per their letter), and still no cheque. I was told it had been actioned and should be on its way. I do hope they manage to get it here for tomorrow or I might have to ring them several times a day to hassle them about payment(does this sound familiar to anyone?):grin: Has everyone elses cheques taken as long as this or am I just unlucky?
  10. To my knowledge the only thing you need to do is wait for your cheque from Cap One and then inform the court that you do notwish for your claim to proceed.
  11. I'd wait for the cheque before informing court if I was you. Still waiting for my cheque after receiving the same letter dated 15/11. Time for a phone call tomorrow I think. Oh yeah congratulations on the win.
  12. Sounds interesting, I've had a letter back asking if my SAR relates to 'anything in particular as we may be able to find it quicker'. Errrr no, I'll just have everything please.

Yeah, expect a letter tomorrow, from Cap One usual story, we do not accept that the fees are blah blah blah....but we'll give you all the money you've claimed out of the goodness of our heart:D . That is their defence, they've paid you. You'll also get a letter from the court saying the same thing. Nice one,another victory:)
  14. I got that with mine, had two letters the following day. One from the court and one from Cap one, both saying as the amount in full had been paid there was no case to answer. Expect them to fold within a couple of days.:grin:
  15. Keep an eye on MCOL, don't be surprised if it changes to 'a defence has been entered, you can do no more on line etc' That is what happened to me last week. You will then get a letter through from both the court and Cap One saying the full amount has been paid and that is there defence.. I too was getting nervous their 28 days were up today, only received notice that I'd won on Friday. Can't see you having any problems.

Can take a while, for example the timescale on mine was MCOL issued 19/10 Served 24/10 Acknowledged26/10 then MCOL stayed the same till yesterday when it altered to say a defense had been entered. Received paperwork from court and Cap One that the defense was that the amount claimed had been paid. I too was getting aprehensive as everyone else posting seemed to be getting their claims sorted out and nothing was happening with mine.
  17. Letter today from Cap One, usual story about not accepting liability and of course our charges are correct, but we'll give you the money you've sued us for out of the goodness of our heart:). So all in all very happy:D. Donation to this site will follow asap.
  18. Yeah, it appears that this is there normal way, My claim was acknowledged 26/10 . Today, MCOL altered stating that a defense had been entered, reading through other threads this seems to happen and a letter turns up with an offer for the full amount you're claiming. I suppose their defense is if they've paid you, there's no debt.
  19. Hi all, just read through all this thread, glad to see a few having a go at Welcome. I had the miss fortune to have dealings with this lot a few years ago. Definately had a few charges, can't remember anything about PPI, and certainly had a hefty early repayment charge. Time to send an S.A.R - (Subject Access Request) I think:)
  20. I'm another one on the same sort of timescale, received an acknowledgement of service 26/10/06 and still waiting:( Now getting fed up waiting for the post. Oh well, they've only got a week at most so will have to wait it out.

  23. Well not updated this for a bit, that nice Mr Uday wrote to me several times to offer me the princely sum of £304, hmmmmmmm thanks but no thanks Mr Uday.   24. 39 days for me, and that was only after ringing them. Still didn't send them all, either.
  25. Well this will be a pretty short thread. A couple of weeks ago I received a letter from MBNA about a credit card I thought I had long since paid off and closed the account, but no, turns out I have a £0.67 credit balance. Having decided I was going to have a go at Cap One about all these charges, thought, well might as well find out if I've any charges on this account. Quick phonecall to Gareth Tunicliffe, yes there are some charges and I received a letter detailing £198 worth. Another call to the Mr Tunicliffe and the result was a complete refund of charges, plus interest and most importantly my 67pence:-) Didn't even have to listen to 'our charges are fair we'll give you......'. You know what I want, I know what you're going to say lets just get it done with! Anway can't see them all being this easy but was a nice start to my 'reclaiming career' Cheque to be with me in 7-10 days, donation will be made asap.
