  2. As the title says, I was wondering how long people waited before getting their cheques afetr being told they would recieve a 'goodwill gesture'? Capital One have until 15th December (14 working days) to send me my cheque-which they claimed they sent on 28th Nov! Em

  4. I have recieved a letter from capital one informing me that as a gesture of goodwill and without admission of liability they are refunding the full amount of my claim!!! I also had a copy of the defense in the post!! Do I need to send a letter back or do I wait for the cheque which they say they sent on 28th Nov? Can some lovely mod change this to Won?

  7. Ok Guys, Here is the latest update, when I check MCOL I am presented with this little piece of info: Defence You are unable to take any further action online on this claim. The Defendant disputes the whole amount you have claimed. Your claim cannot proceed online and will be transferred to the appropriate court for continuation. You will receive confirmation to where the claim has been transferred to shortly. I am now very nervous incase I am the one person that is made an example off! Is anyone at a similar stage to me? I am in need of some reassurance here!! Em x x
  8. I have recieved a copy of the achknowledgment from the legal dept of capital one, My question is should I send the legal dept another copy of the schedule of charges? I sent the court a copy to be included.
  9. I didn't sign the form, I sent them a letter declining the offer for settlement but stated in the letter that I would accept as part settlement. hope that helps.
  10. I sent a letter stating that I would accept the money as part settlement and that I reserve the right to start court action to persue the rest, and I gave them two weeks to respond, they didn't so I started court proceedings.
  11. Sorry haven't updated for a while. Have recieved notification that Capital One have achknowledged on 17th November and intend to defend all the way!! Fingers crossed I should have a big fat cheque soon!!! Em x
  12. Hi guys, Here's an update. I recieved notificaction from MCOL that Capital One would be served with the court claim on 11th November and they would have till 25th to achknowledge, as yet I haven't heard anything. I have been checking MCOL and it hasn't changed since the claim was issued. :-| Does it usually take this long to hear back? I'm worried incase they decide to take me to court!!:o Anyone have any words of advice?
  13. as far as i am aware you should be recieving an offer soon, from what I have seen they will achknowlegde and then pay up. I haven't had the pleasure of capital one achknowledging my claim and they have till next sat!!
  14. if you go on moneyclaim you fill in the forms on there, otherwise it's an N1 form which you get from your local court and then take back once filled in. i done moneyclaim as I can check on the website each day, and as I was claiming just over £1300 I paid £120 which is the max. Em
