  1. We did that 10 months ago its still pending! and yes they got all the details and we had ping pong of letters e-mail over entitlement and back dated during the last 8 months
  2. long story edited highlights ... My mother claimed income support and council tax benefit in March 2010. The IS was turned down so appealed and reclaimed IS which was successful on second claim. The CTB was paid from when IS was successful. The IS appeal was successful and payments back dated to March. Council will not backdate council tax even though IS was received for that period. They have now issued summons for CT to obtain a liability order with the view to make deductions from earning / benefit or instruct bailiffs. Council has been phoned and the benefit claim handler wont take call or phone back to discus the case, council tax people say council tax is due until benefit has been calculated. The council were notified of the successful appeal 10 months a go and have stated they have evidence IS was not awarded for that period even though they have been sent entitlement letter and details of the appeal. Basically if they back dated the CTB to 1st April 2010 then there would be no CT due as per IS appeal Recovery team have said they are entitled to recover the money and its pointless turning up at the court as you wont get to explain this to the magistrate. were do we go from here ...

  4. I have a similar prolem with Santander. I actually have / had an account with Abbey when they merged with Santander (2007) they did a big data merge on to Santander systems. This is the start of my problems. It seems the data merge has merged similar names and DOB together. I had all the address on my accounts changed and my statements going to the wrong address (ones I’ve never lived at). In 2008 I had to go in to a branch with ID (photo and utility bills) to get my accounts changed back. I complained to abbey and the ICO got me nowhere. Several years on (2009/2010) I started being chased by DCA for accounts (current account, loan etc) that are not mine luckily these were statute barred. They have however linked all these address on my credit file which I can’t get removed. I have since closed all but mortgage with them. Santander sent me copies of the account applications forms with a similar name (same first & last name) and DOB (year difference). I wrote to them complaining about it got nowhere complaint went back to FOS and ICO ICO - won’t do anything FOS on-going Santander have also bought banks (Bradford and Bingly, Alliance and Leicester etc) and accounts from other banks this data has also been merged with Santander’s and created a new set of accounts I’m being chased for a few are joint accounts and I’m single never had a joint account. Have you had any accounts with these other institution (open closed or dormant) which could be merged to an existing account that’s not yours?
  5. As far as I’m aware it’s not unlawful or against the law to use a pre-paid card to pay for goods or services as they what they are issued for. It may be in the terms of contract between you and the card issuer which restricts the type of transactions you can use it for. They usually restrict recurring transactions or foreign currency. Most merchants are set up so when the transaction goes through the card issue knows the type of transactions when it authorises payment. So if the card issuer has processed the payment then they must not have restricted that type of transaction.
  6. Sound like what happened to me the forms go to atos not DWP .... Did you send recorded post (i did). If they lost it or not recieved then they end your claim. Also check with your GP see if atos have reguest a medical report. I also photo copied my form for two reasons one in case it gets lost two to remind me what's on it i.e. before medical incase of appeal. Few people get ESA without a medical but your GP will need to have supplied them with a report.
  7. Same happened to me they messed up my ESA transfer and stoped my IB and IS in July. After many phone calls appeals (made a appeal in writing to IB and ESA) and sent letters to my MP. DWP then made a manual IB payments end of Aug but I had to wait 3 to 4 weeks to get sorted and they missed a payment and then paid me double but it caused me major proplems. They still paying me manually every 2 weeks and it goes in later then it used to. When they close an IB claim they can't reopen it so I'm told I also got a P45. I have to wait for a decision on my ESA claim.... Still waiting for a medical date ... It's been 3 months since I sent in my IB to ESA form I'd get on to them first thing Monday get a letter off to your MP and get in an appeal for stopping you IB and IS. Hope this helps .... Think they got so many transfers they can't coupe or keep track.
  8. Unfortunatly they can change your terms and conditions and rates of pay providing they give you notice as outlined in yourcontract. So if they have paid you 37h in the past they can change that going forward by giving you notice to change your terms and conditions to only pay you 32h even if the past over payment has been seen as a custom and practise.

  11. To confirm do you work 37h or 32h a week or is it that you only work 32h on the backshift but 37h on all other shift. The would mean 5h less pay on the backshift but the same pay on the other 2 shift
  12. I think what curry are saying is they wont replace it unless the manufacture authroise them to. Under the Sales of Goods Act (SAG) the goods have to be of satisfactory quality and fit for purpose .... which you would say the goods are not So the item is faulty. You first have to prove to the store that you bought the item from them. Secondly If you are returning the item within what would be considered a reasonable time for you to have inspected the goods. You are entitled to a full refund or, if you prefer, you can ask for a repair or replacement. The store may try to claim that you have had the goods for 9 months and thefore have had enouugh time to inspect the goods and reject them. Therefore you have accepted the item so can no longer demand a full refund but you may be entitled to a repair of replacement. So far you have had 3 or 4 repairs is it diferant fualts or the same thing?
  13. Its arguable that the extra 2 hours paid come under "custom and practise" and i would think that it would apply. However I'm sure the employer would not. An employer can change your rate of pay but would need to give notice .... what dose your contract say about notice period or variations of contract?

  15. I belive the worst case is that they can inforce the term of the contract so if you have 6 months left they can inforce 6 months payment. As your moving premises can they provide servies at the new prenises, if so is there any charges in doing so? It may be worth considering the options then move to another provider in April? or paying them off to get out of the contract? Businness have very litle protecting compared to Consumers, there was talk of extening that protection to small business but as yet thats not the case.
  16. The best advise is to get a solicitor, you can get one on legal aid (same as at a police station) best to find a local solicitor that specialises in benifits or fraud.. If you are represented then the solicitor will meet with the person doing the IUC they will then be told every thing and shown all the evidance. The solicitor will then meet with you and you can discuss this and get advise on what is the best thing to do. you will then proced with the interview If you dont have a solicitor with you then will drip feed you and ask you question which they can then produce evidance they can try to trick you or misslead you If you dont go at all they can stop your benifits full stop.
  17. 14 days from date on bill ... it should say on your bill when payment is to be recived by BT .... if it is not then they bar outgoing call and apply a "fee" on top oof their payment processing "fee" for non direct debit payments ....
  18. Thats intresting as a frirend had to covert to a Uk driving licence they only got a provisional and was told their oginal licence would stop being vaild as soon as the provisional bacame vaild. Unless they set the start date of the provisional to start at the expiry of the 12 months? But then you cant take your UK test till the licence is vaid - confused ...
  19. Also note form what I understand that when you get you provisional licence you will need to take the UK driving test (theory and pratical) as you will only have UK provisional entitlement. You must pass the theroy before you can drive on the road and must have Ll plates and a driver supervising who is over 21 and holds a full licence untill you have passed the full UK test. The provisional entitlement starts as soon as you recive your UK provisional licence .... even if your 12 months has not yet expied. I relise this is not good news but if you get your prosional licence in Sept you wont be able to drive untill you have passed the UK test. I only mention this so you can plan ahead.
  20. Rang the Land Registry filed in UN4 and set fax to county court for copy of CCJ set-a-side ... Will then post UN4 plus the set-a-side order to the land registery for removal.
  21. Just paid and dowlonded the Title Register and the charging order is still showing.... It shows: (25.03.2008) Equitable charge created by an interim charging order of the xxxx County Court dated 11 March 2008 in favour of XXXXXX.
  22. yes it was registered by the DCA as that how i found out about the charging order .....the letter from the land rigistery
