  1. Hi, Sorry to sound really dense but how can I tell if I have paid PPI?? I have looked back on many statements but cannot see any reference to ppi, so does that mean I haven't paid any??
  2. I was the same, worrying constantly, but it didn't make the slightest bit of difference to my claim the fact they didn't bother responding to any of my letters.
  3. Don't worry at all, when I put in a claim I heard nothing at all for prlim or LBA I went on to file my court claim which they did acknowledge and said they were going to defend the claim, and then paid up 5 days after acknowledging

Yes it is quite normal, for my first claim once they acknowledged and said they intended to defend the claim I had the money paid into my account 5 or 6 days after, even before I received their letter to say they were paying up. I have just completed my second claim with them and this time it took them approx 12 day to pay up after they acknowledged my court claim.

Well panic over, The day after I received the leter to say they are not paying a second claim and are closing my file, I recieved the letter to say that although they are right in their charges they will however pay up as it will cost them more in court charges (the normal payout letter)etc etc..... So for anyone thinking of claiming a second time go for it, they paid me and it was no harder than the first time I claimed.

Hiya everyone, I am still persuing this second claim and filed with the court on March the 6th, Halifax too ages to acknowledge it but finally did on the 19th March, with my first claim they paid up within about 5 days of acknowledging, so I have eagerly been constantly checking my account and have not yet had anything credited. My problem now is that today I have received a letter from Halifax saying the following: Dear XXXX We are in receipt of your letter of 29th January in connection with further charges that you have incurred on the above account. I note from our records that this is not the first time you have raised concerns over these charges and on several occasions we have written to you to advise that we will not now or in the future refund any further charges as a result of you not conducting your account within the terms and conditions laid down. Your file will once again be closed and no further action will be taken surrounding refund of charges on your account. The thing is this letter relates to a letter I sent on 29th January, and since then as I said above I have filed a court claim on the 6th March, so don't know what to do next. do I reply to this letter or do I just wait for their response to court action. If anyone can help I would realy appreciate it.

  9. It all seems very confusing to begin with, but once you get going theres not too much to it, I would say you are better to do it yourself.

    MCOL Help!

    I was told by people on here to send two copies of it to moneyclaim, the Northampton address on the website, and make sure you mark it with your claim reference number. I have done it everytime I have filed a claim now so seems to be the correct procedure.
  11. Is there anyone that can help me with the above, just need to know if I can go ahead with moneyclaim or do I need to start again with prelim letter as I have left it so long.
  12. What something Just like a small letter of some sort saying I authorise XXXXXXX to act on my behalf dealing with the issue of charges on my bank account, then his signature?? Does that sound ok or should it have a bit more detail in it.

  14. Hiya just a quick question, I am doing all the paperwork for a claim for a friend who works away alot so he thought it would be easier. I am just starting it out and have done the DPA letter what I want to know is can I get around the signiture the it needs on the letter(as he is away at the mo and wanted to get this going asap), for instance can I sign it on his behalf, if so how do I go about that?

  16. Hiya, I started my claim against Mint sometime ago but then what with christmas & lack of funds to start court action etc... it got left. After I received a letter from them basically saying they were not going to refund my charges I then sent my LBA on 18th October and that is the last I did, so as it stands I was supposed to file a money cliam at begining of November but as I said above I did not have the money to file the claim. What I would like to know is have I left it too late or can I start the money claim online now?

    Just a quick update as I forgot to put it in here before. I accepted £440.00 which was the total of charges, I had tried to get interest on top of that as people were saying MBNA were also handing out contractual interest but when they settled the £440.00 they put in the letter they would not pay inerest so I accepted that as I thought at the end of the day you only add interest on when you are at the point of court which I didn't get too as they settles beforehand. Anyway about a month after they paid the money into my account in full and final settlement I received another letter to say that after my correspondence to them they were going to credit £164.00 in addition to the £440.00 all ready paid!!!! Well I was gobsmacked to say the least as, as far as I was concerned MBNA had paid up and I was happy, well I am even happier now and I didn't even have to ask for it.
  21. I am claiming from Halifax for a second time I sent my prelim letter and have received the letter below shall I give up or shall I carry on with it, will they still pay up? My last claim was in September but before that claim was completed I was charged again so the charges I want to claim back now are from back then, I havn't used the account since my last claim as I opened a parachute account just incase they closed this one, so the fact they say about transfering my account to another organisation isn't a problem as I plan to close my Halifax account anyway. This is the reply I got from my prelim letter: Thank you for you recent letter. I would advise that as we have already refunded charges on this account in September I am not prepared to refund any further charges. I regret that our service does not meet your expectations. Considering the comment you have made, I can see no value in continuing an assotiation, which gives you repeated cause for complaint. In the circumstances you may wish to transfer your account to another organisation, who I hope will be able to meet your requirements.

Hiya as Barclaycard have said they intend to defend I have been sent an Allocation Questionnaire, I have been reading through the notes on this and have understood most of it I am just wondering if anyone can help me out on section G, my claim is only for approx £200.00 so do I need to put the following or is that just for claims over £5000.00? or do I just put in the bit about the hearing lasting no more than an hour? I am respectfully requesting that my claim be allocated to the small claims track. This issue is not a complicated one; it is an issue of fact and not of law. The issue is only whether the money levied by the Defendant in respect of its customer’s contractual breaches exceed their actual costs incurred. I am happy to pay their actual costs and I am surprised the Defendant did not counterclaim for these, because I would have paid them without argument. However, the continuing problem is (in common with the 100s of other cases currently being brought by other bank customers) that the banks refuse to reveal the details of their penalty-charging regime. As the banks have a fiduciary duty towards their customers, they have a duty to deal straightforwardly and in utmost good faith. Accordingly, I would respectfully ask that the court in this case, not withstanding allocation to the small claims track, order standard disclosure. I understand that it is in the courts discretion to do so. I believe this would bring a rapid end to this litigation. I estimate that the hearing should last no longer than one hour
