  15. Hi Pat If cobblers have not asked for clarification or more information by means of a CPR 18 request then in my opinion I would leave your schedule of charges as you have submitted it. I would start entering the charge type onto your spreadsheet for your own use and also to save time if they do actualy request the clarification , you are already prepared . As hedgey and caz also suggested it may be a good idea to re-enter the information onto one of the spreadsheets in dellers link http://www.consumeractiongroup.co.uk/forum/bank-templates-library/182-6-interest-calculation-spreadsheets.html as the members etc on here are more familiar with these. Hi Bill I think there are already enclosed areas for discussion within the site and as a security measure we as members ( and potentially the banks spy`s) are quite rightly unable to access these areas. I have worked on many forums before and there are always `privelidged` areas only accessible by admins and authorised users , I have no doubt whatsoever that these areas exist within CAG and for very good reasons. As for any summaries and progress being openly issued from time to time , I would assume that would be the `Announcements` or `stickys` found at the top of each forum. I have every confidence that the team are constantly debating , adapting and campaigning.Obviously the Whistleblower programme will have been under construction long before we heard anything and quite rightly these plans will have been held `off forum` I think how the site is structured undoubtably has flaws , nothing in life is perfect , but as the membership no.s and successes show (and that does not include the ones who never post through fear of `spies`) the site is working pretty well. Many members of the site do not appreciate the work that goes on in CAG and are quick to criticise if a post goes unanswered or a matter is not dealt with swiftly . I thank Bankfodder for posting this information and keeping us all informed as much as he can , I only hope this quenches some of the `doubters` sometimes derisory comments I am sure Bankfodder , Dave and the team would appreciate any positive words on this thread from other members willing to show their appreciation One day we may finally get the beggars;) Jules

  19. Hi Mat, A very strong and well presented piece , well done. HOWEVER, I am very sorry to say that I know a lot of people on this site myself being one of them , for who this may be a step too far in the glorification of getting the message across . Although I like the piece I do not feel it is appropriate to be accessible through CAG . I have talked to many people on here in the past who have contemplated suicide whether it be because of financial difficulty or otherwise , I have even been very close myself in the past. I feel I really must object to this being assosiated with CAG. I am sure everyone will disagree with me but , I have to air my own opinion as i STRONGLY OBJECT. I respect the fact that you have pre-warned people of the content but as in life , wherever it says `wet paint ` we still touch it Thanks Jules
  20. Hi Achuaran, At this stage you should only be asking for the amount totalled for your charges if you are intending to ask for the stat 8%. The stat 8% should only be included when you have submitted a claim to the court . By all means mention the fact that if they decline to refund your charges before court action is taken , then you will be persuing the charges + 8% interest + costs. Also don`t forget to ask for your £10 SAR fee back within the Prelim , LBA and in fact any further refund request. Hi Enron The OFT ruling actually states 1 EXECUTIVE SUMMARY Overview 1.1 This statement sets out the Office of Fair Trading's (OFT) view of the principles credit card1 issuers should follow in setting default charges in their standard contracts with consumers in order to meet the test of fairness set out in the Unfair Terms in Consumer Contracts Regulations 1999 (UTCCRs). The principles have wider implications for analogous standard default terms in other agreements including those for mortgages, current bank accounts and storecards. 1.2 The statement stems from an OFT investigation into the fairness of standard terms in credit card contracts imposing charges for defaults, including failure to pay on the due date, exceeding a credit limit and failure to honour a payment made. It has been prepared in the light of discussions with eight leading credit card issuers and their legal advisers of a set of proposals from us, and with the Association for Payments and Clearing Services (APACS). It takes account of empirical information the credit card issuers have provided. It also takes account of the arguments they put forward, but it is a statement of the OFT's position and should not be taken as representing a consensus view. It is intended to set out a consistent basis on which we believe it is possible to calculate fair default charges for the purposes of the UTCCRs. 1.3 The statement sets our view of the law, which is in essence that default charge provisions are open to challenge on grounds of unfairness if they have the object of raising more in revenue than is reasonably expected to be necessary to recover certain limited administrative costs incurred by the credit card issuer. It goes on to explain how we think the relevant legal principles apply in practice to credit card agreements. The statement is intended to provide guidance for financial institutions setting default charges. Office of Fair Trading 1 1 For this purpose references to 'credit cards' do not include 'store cards'. But this does not mean that GE money have not profited from a penalty charge so therefore it is my understanding that the charge is unlawful. The best way to resolve this is by first contacting the card company and asking for a refund of the charge , sometimes with one of charges like this it only takes a civil ( not irate) phonecall.
