  1. As far as I am aware, the only Royal Mail service that covers consequential loss will be special delivery up to £750 compensation without the optional extra cover up to £2500. Royal Mail has various crown immunity and claims with normal 1st/2nd class post. You will also need to prove the true value of the item, not what you sold it for, as well as the original purchase price from new receipt.. You need to do a lot of reading. Not saying it is impossible, but you need a real understanding of what you are facing before submitting any claim.
  2. Was this Royal Mail or Parcel Force? Was it sent special delivery and with any of their so-called insurance?
  3. You need to go through each point and do a rebuttal why you think it is untrue. They only need to prove on the balance of probability you are responsible.

  6. The ET1 claim with the three months' time limit with instigating a claim that starts from your last day of service, not from when your new job starts. Without that Acas conciliation number, there can be no valid claim and the time limitation continues to tick down until you get that number. Think the problem you have is that you did a paper ET1 by post, and not online.

  9. Just a quick question Being spamed using my original google mail email address not used in four years since address and password appeared on the dark web. Used this address when signed up for virgin mobile. As far as I am aware was to be used for marketing etc and offers. What happens if they send a letter of claim using this email address instead of Royal Mail? Is it valid under Pe action protocol as served through electronic means? Have acknowledged no email sent by them, or blocked them
  10. Just a general query. Just received my Experian report and my score has gone down by 151 points. States as a reason for two new credit accounts. This does not bother me as after six months, it will be back to normal. Now expect the score to decrease a little as just closed a credit card account and moved to a new balance transfer card, but the second credit account left me bemused. Back in March used Swinton for my home insurance and paid by monthly direct debit. Close Premium Finance provided finance and they have now, some six months later, registered the account on my credit file. Besides not being happy, when I come to renew my home insurance, will they do another hard search? My car insurance is also through Close Premium Finance, but with Hastings in which I will get a renewal quote at the end of this month.

Latest one saying sign into portal to receive a substantial discount? Must think I am stupid, do that will acknowledge the alleged debt. Silence is golden.
  12. That is why you let the insurance company sort it. The insurance company would expect pictures on his phone with metadata for a start that will put him at the house date and time, what medical treatment received, etc/ Yo can also tell the age of the injury in a picture as well, being recent or a few days old. The insurance company will demand this before substantiating any claim from the claimant.
  13. Have to agree with the previous comment. The Equality Act is there to limit treating disabled people less favourable than non-disabled people, not exceed. Issue with lithium batteries and excess weight apply to all who use airlines. When you book your ticket, they ask if you have a disability, so they can make special arrangements to assist you at the airport. If you did not notify them before arriving at the airport, then how can they make alternative arrangements?
  14. As previously advised, it is most important you let the insurance company sort this out, and not you personally. All we have is an allegation at the moment. Nothing more to substantiate your dog caused the injury, In 2015, they changed the law because of the epidemic of attacks on postal workers by dogs. The law now states owners have to keep "Reasonable control" of their dogs, even on a private residential address. The dog injured an individual on the property will be enough of a lack of reasonable control. But proving it was your dog that caused the injury is another matter. Best let the professionals deal with this one.
  15. Been looking into this for confirmation with Pre-Action Protocol Understand a letter before action has to be sent by snail mail and give 30 days for the respondent to contact the creditor. Litigation cannot begin within the thirty days. My question? After the 30 days have expired, can the creditor issue a claim with no further contact, or do they still have to give a further 14 day's notice of intent to issue a claim form?
  16. And Tracked is a separate commercial product outside of the Postal Services Act. Another thing to consider is that the Universal Service Obligation stipulates Royal Mail has to provide an Insured Item service? Royal Mail does not offer an insurance product, only a compensation policy for consequential loss
  17. As far as i am aware nothing in the Statutory Act, only existing case law which is obsolete as it deals with internal industrial relations and delays with postal items. But Royal Mail still cites and reference.

The above is the Postal Services Act and liability. But that means nothing, as Tracked items are outside of the Act and the Universal Service Obligation being a new commercial product.

You need to understand the relevant case law, That being Harold Stephen & Company Ltd v Post Office [1977] EWCA Having paid for the extra insurance is a separate contract outside of the Postal Services Act. Tracked items as well are not covered under the Universal Service Obligation being a separate commercial enterprise.

  21. Have you sent a rebuttal in writing reference to the PDA Data excuse and alleged negligence and did they respond?
  22. The Three D mapping software that they use is their own. Did they tell you this in writing or on the phone?
  23. Then Royal Mail is in breach of contract, What did they say when the GPS data showed they did a misdelivery of your item?
  24. When delivering postal items, they use a Personal Digital Assistant (PDA) that records the delivery. Does not matter if the item requires a signature or not. Even normal postal packets have a Three D barcode on them scanned at the point of delivery. These PDA units ping the GPS position when scanned at doorstep[. If Royal Mail suspects the recipients are pulling a fast one, then you can request that GPS data, then your claim will be with those recipients.
