    new procedure?

Hi All, I was speaking to the halifax earler regarding a £40 charge versus the 40p I was short and said "we both know it does not cost £40 for a computer to reject a DD" at which point the person on the other end of the phone went into robot mode "we can not disclose that information due to data protection!" and I had not even asked the question! thats a new one on me! Cheers Paul
  7. Hi All, I originally started trying to go through the process with BAG when the site first started ages ago but basically for one reason and another stalled and forgot/left/moved house etc. Since then I have never had a charge levied etc however I have just been charged £39.99 for being 40p short for a direct debit which was due on the 10th but was attempted to be taken on the 8th (I put more money in to cover the DD on the 9th thinking 10th is sunday the DD will take monday). I have telephoned them and explained the situation but they flatly refused to reverse it even when I explained it is ridiculous to charge £39.99 for being 40p short! especially as in their logic with their charge they wouldnt mind me going approx £29 overdrawn by applying their penalty charge but they wouldnt let me go overdrawn by 40p! Anyway all this has provided me with renewed vigour to get ALL of my money back from the Halifax so they have done themselves no favours today. 11/12/06 - S.A.R - (Subject Access Request) sent Thanks for listening I will keep the forum updated. Paul

  21. got this in email which is dated 4 days after the letter:- I am sorry to hear that your request still has not received a response. I have been in contact with our customer care department to find out the procedure for your request. I am pleased to confirm that I have forwarded the request directly to the department who would action this. I am informed that you will receive an acknowledgement of receipt and the request will be actioned within 40 days. Please do not hesitate to contact me again in case of further problems and I will chase the department taking action. I hope this will find a final resolve.
  22. "If you do not know the amount that they owe you over the past 6 years, then write to them asking for a comprehensive list of charges. Make sure that they are obliged under the Data Protection Act (1998) to furnish you with this information within 20 days of receipt of the request. If they deny that bank statement information is covered by the act, refer them to the Durant v FSA (2004) case, in which the judge presiding ruled that ALL bank statement information is personal information and is indeed covered by the DPA. "
  23. Hi, I have had a letter thus:- "i refer to your recent enquiry regarding previous chges on your account. All charges are detailed on charge letters sent out on the day each charge is incurred and dated charges are applied and detailed on the account statements which are issued to you on a regular basis. We cannot send out duplicate charge letters however if you require duplicates of these statements please note a fee of £5 is charged for this service. If you want more help please phone 08457 203040" ironically the place I phoned in the first place which told me they could not help me! so if I pay the £5 will i still be in receipt of enough info or does it need to be more detailed? cheers Paul
