  1. very true lol I can't see a judge finding in their favour but it will be down to judge lottery with the evidence ive got I wouldn't be surprised if I get a settlement email after the bundles are exchanged
  2. no idea, there's no DQ or AQ in NI so I don't know if they will attend once a case is defended it automatically gets listed for a hearing you then have to send your WS to the court and other side 10 days before the hearing date a lot quicker over here than in England and Wales

  4. That was my thinking, he's trying to worm out by saying he's not the controller but I have the evidence to say he is does my WS read ok? I know it'll prob need changing etc

  6. Well all as a final update to this, I've just had a call from Lending Stream requesting my bank details so they can process the payment Hopefully this will be the end of this they have also stated they will forward all the missing items from my DSAR within 7 Days

  8. well FK, they have filed a defence/dispute today, a day before the deadline I can't view it online as yet but as soon as I can I will redact and upload they didn't file a counter claim as threatened

The OP did send a valid DSAR The company failed to comply within the 30 days and only asked for the ID after they received the LBA Yes they can go over the 30 Days but they must inform you within the 30 Day limit that they are going to take longer you can ask for it to be struck out when you do your witness statement the next stage will directions from the court on when the hearing is and it will state when your witness statement is to be sent in
  10. I have no problem doing that Andy, but my problem is no one seems to know how to transfer a CCJ from Northern Ireland to an English Court The enforcement of judgments office in NI has no jurisdiction in England
  11. thanks Andy but they can't help as the value of the claim is under £600 I'm trying to get hold of the local court to see how to get it transferred but cant get through
  12. Well, lending stream didn't contest or defend the claim so I've applied for a default decree @andyorch do you know how I would go about enforcing this in England as it is a NI decree?

  15. the OC is the only person that can issue a DN, DCA's cannot issue them
  16. yes the court will send you a copy of the judgment usually take a week or so
  17. They can only appeal if the judge made an error in law in his decision and in this case he was correct under the CCA 1974 plus they would have asked at the end of the hearing for permission to appeal
  18. They can't try again Betty without a dam good reason and the courts permission, so I wouldn't stress about that possibility
