Nothing gained and all that Caro, when was the account breached if these charges are unenforceable at law then surely only the first couple of charges was when you breached the account (years ago) surely the rest as far as i can see wouldnt have been breached if the illegal charges hadnt been taken in the first place. They can counter claim me anytime and i will keep asking for a breakdown of costs incurred. Sorted my claim out tonight with Friday being the day i will hand it in to the court. Also asked Mr Neil Mckirdy who would be responsible for making these charges up so as i can request there pleasure in court as a witness, funny thing he never remarked on that one. -

Will be handed in this Friday morning claiming contractual interest, first claim was returned to me 6 weeks ago due to incorrect data and didnt include contractual so was a little lucky, i hope. -

Just completed my summary of charges to go with court forms as will hand in this Friday (giving me time to get it all together) claiming contractual rate and is included as part of £750. -

Sent letter back saying found the offer totally unacceptable, and asked why they can think they can pay less than half the money taken and if there is someone who works solely with charges in the bank whom i can call on at court, cheques gathering dust. Neil Mckirdy replied confirming that was the banks final say in the matter and that encashment of the cheque will be accepted as full and final payment. -

Hi Davyg got cheque last week less than half and letter saying for goodwill gesture, my arse. Sent refusal of offer template saying would accept cheque as part payment sent back today. -

Got letter with cheque for half the amount being claimed as full and final offer through door on friday, dont think so i aint having them dictate to me what i will get, paid in full or court you shall go,lol. -
Hi Cadencealex, no matter how you ran your account the banks have taken your money making you get in this mess in the first place, I would wait until you got your reply and tot up all the charges, whilst waiting for it to come through please read all the faqs and as many posts as possible as this will give some light on your next move, when you send in your prelim letter asking for it back also make it a condition that you want any bad remarks on your credit file removed as this was down to these penalties, keep with the tried and tested process and you will get there in the end, good luck mate.

This is what amazes me i have a current account and a business account with a branch and when any cheques are presented to the business account it takes 2 days to clear yet the current account takes 5 days. This day and age 5 days is beyond belief.

As i see it this Neil mckirdy is the person who responds to most, certainly at the later stages of claims, if he was cited then surely he himself would be pursuing the settlement of the claim before such an appearance was required. My 28 days is up this week and this neil mckirdys only response was that he may need more time to get further information, sure ive read a post previous where someone phoned him up and got a settlement offer without the need to file, be nice to put a voice to the name anyway, shall phone him to see if he has all the info and update him of claim to court this week.

These peeps are tough to crack eh, they need more time to collect further information, they have had over 10 weeks to investigate due to me sending 2nd prelim, lba with contractual interest, times running out for CB and this neil mckirdy, be at court next week and hope to get my day to make them all out for what they are EDITBAR-STEWARDS. **Moderator Note: Edited due to libelous content. -
yipee, got my default removed with a grovelling apology, and quite rightly so, i would advise anyone with this shower to check what your interest rate should be and what they are actually charging you as they could be taking more than your contract says.

The default entered against me by lewis who are the collections division of welcome finance had the £49 balance from 1999 and in 2002 when the £49 reached £337 due to interest and penalties they then went for default but i can honestly say i never received it. TOTAL BACK STREET MONEY LENDERS, STEER CLEAR IF POSS.

Ive been on the phone to three different departments of them today, they denied ever receiving my CCA until i asked them by balance and found it had been reduced by guess what .............£1 i suggested to them it was the postal order sent to them with the CCA and they finally admitted getting the letter, i advised them to remove the default as it was a mistake by them and if they dont do so before tomm evening i will start court proceedings where i may pursue damages for they have acted illegally. They admitted it should never have been put on my file and have promised action tomm, CRAs have been informed by me today and will be checked tomm again, one point of interest is that they said back in 1998/99 a lot of people got interest payments back due to wrong rates being taken so anyone out there with these statements it would be worthwhile checking.

when you sent lba you would have stated it was up to the date it was sent, just add them on when you go to court and file.
