  1. Just simply check if the claim number is for one of your UKPC claims. You've got three, haven't you? A McDonald's one where you're stuck with the CCJ, the shopping centre where you won, and another McDonald's one which is ongoing.
  2. Looks superb to me. I like the way you want not only the invoice sent to you to be cancelled but for them to sort out this mess for other motorists.
  3. You have a magnificent case, made even better by this news that the fleecers won't turn up in court. However, there is the danger that you snatch defeat from the jaws of victory by not arguing the case properly before the court. We need to see, in particular, the documentation where you and the driver informed the fleecers of who was driving, your application for set aside, and the court order of what to prepare for 2 October. Bankfodder did ask on 1 August.
  4. Not "illegal", "unlawful". There is a big difference. And yes, write back and tell them although you understand it takes time to properly consider a complaint, Parking Eye have strict deadlines for payment and appeals, and really all the Complaints Team need to do is walk round to that bit of the hospital and note the lack of signs.
  5. It's not a matter of being right or wrong, plenty of times we suggest avenues that don't come off, it's a case of not giving in and trying every means possible of beating the fleecers. I half expected a "there is nothing we can do" reply but I see they consider it a complaint - and I know from experience that hospitals do not like complaints. I was hoping the tone of the mail would convince them that you were a sack of trouble and so best to get rid of the PCN and thus get rid of you. So send them the info they want. This is a double-edged sword. The fleecers MO is to get a contract, put up no signs so they can get on with fleecing galore, later put up decent signage, then lie and pretend it was there all the time. So get as many photos you can of the signage, or lack of, now. As you have been doing.

  7. Send off what I drafted. Normally something like that would work with a hospital. However, the staff may be working from instructions that they can intervene with one ticket but not two (even though PE refused to respect what the hospital said the first time) and refuse to cancel. You can but try.

What has happened here is that you have invited in these vermin to infest the hospital car parks, they have deliberately not put up signage regarding parking restrictions, so motorists are entrapped and sent these invoices for £100. My son followed instructions on signage to the letter on XXXXX. He fell foul of restrictions because they are not shown on any signs. I am not going to waste my time appealing to the very charlatans that are deliberately entrapping motorists. You can either face up to your responsibilities, or otherwise when Parking Eye take me to court I will add the NHSPS as a Third Party and invite every local and national media outlet I can along to the court hearing. You may have heard recently in the news that NHS management have not been seen in the best of lights. Well you can deal with the publicity of allowing your agents to drag an elderly lady to court because her son was entrapped by the parasites you have let loose in the hospital. Yours, XXXXX Whether it will work - who knows? It depends on what internal policy they have regarding these invoices.
  10. OK, but we need to see the WS too. Barristers will have a much better overall knowledge of law than CAG - but not necessarily of the tactics of outwitting private parking companies in court.

There is the generic, bland defence that we use in 99% of claims. However, in another case where the fleecers had added huge amounts of interest fellow Site Team member Andyorch underlined that the charlatans should be challenged about this in the defence which is why I suggested something like saying that it is unreasonable for the Claimant to delay litigation for nearly five years and to add nearly £70 in interest. Also experience shows that the fleecers do not like taking on people who live abroad, thus the suggestion of the paragraph you drafted mentioning The Netherlands. There are no guarantees but it might push them a bit towards discontinuing. It's up to you but personally I would add those two extra paragraphs but nothing else.

  13. Writing to Parking Eye will get you nowhere - indeed people who appeal invariably throw away their protection under Schedule 4 of the Protection of Freedoms Act 2012. Writing to McDonald's will get you nowhere, (a) because they have a policy of not cancelling these invoices and (b) because it will be the retail park who called in the fleecers, not McDonald's. But writing to the retail park may well work. Lay it on thick about being a genuine customer, about using a restaurant, having a young child, etc. Worth a try.
  14. No it won't! The will refuse to show the contract and planning permission doesn't exist. So you can say in your WS that they promised to show this evidence but then reneged on the promise. Won't look good to a judge.

  17. OK, I've hidden my post above which is misleading. Talking of misleading - so the first sign says "Patients & Visitors Only" and then suddenly you get a second sign with "STAFF ONLY". It's obvious patients will get confused. Did you park in the first part before the "STAFF ONLY" sign? Also, can we see the PCN please to see what the fleecers are accusing you of? The charlatans will not pursue people living abroad, so I have an idea. Let's see what you e-mail exchange produces first however.
  18. If there are no signs showing parking restrictions quite obviously patients going for multiple appointments are going to get multiple tickets.
