  1. Excellent. Thank you. Snottiest of letters printed and enveloped. Will be going out tomorrow morning. In the meantime I've found more documents on the planning page, but I still can't find anything regarding the signage for the parking company. Looking on Google Street View's History there was a Parking type sign there prior to the Mercedes Garage going away (which seems to be the key planning item on the site), but it's impossible to work out who it was back then to narrow down when to look for planning info for.
  2. Other problem I have is how long ago it was. January 2017 they're going back to. But I'll see what I can do. I've made it my own below. So don't fill out the dispute form? Just send the below? BW Legal Enterprise House Apex View Leeds West Yorkshire LS11 9BH Dear Rachael and Sean, Thanks for your Letter of Claim. I am not sure if you intended it to be taken seriously or not, but I found it amusing. So thank you. From what I hear, it is fairly usual for you to have done no due diligence prior to writing these letters, and this seems to back that up. You should know as well I do that this will lead to nothing but an embarrassing and day in court for you and your clients. I note the inclusion of £54 to feed your unicorn. Hummels-like own goal there. I very much doubt a judge would be impressed by that. Your clients can either go to VAR and drop this nonsense now or carry on and be beaten in court, where I will go for a unreasonable costs order under CPR 27.14(2)(g) which I’ll spend on a very expensive foreign holiday. I will even send TPS a postcard! I look forward to your deafening silence, My Name COPIED TO TOTAL PARKING SOLUTIONS I've found Planning Permision for Halfords to have a "Non-illuminated pictorial panel sign and opening hours panel" added but that's not it.
  3. Thank you. I made a point to switch on notifications last I was here but seems I confused "notification" with "email" anyway, by the by. I'll have a dig and get something drafted. There's a form to tick to say "I dispute the debt". I guess that's worth completing to show some willing?
  4. Anything in particular I need to include here? Knowing what I do about this place I'm guessing there's a template? The letter wasn't signed for at all, so surely they have no proof that I ever received it?
  5. Sorry for the delayed replies I'm not getting notifications via email. It is a letter of claim, and I've missed the 30 days. just sorting posting it now. 2021-05-04 BW PAPLOC.pdf
  6. Hi, since the above, I've started getting hounded with letters from bwlegal regarding this "Contravention". All the usual threats of court, fees etc., have come my way. Now, against advice, and due to the awful employer I previously worked for, you'll see I had to reach out to TPS previously and advise them that I was provided sole driver of the vehicle during the period they questioned. I didn't mention anything else. I'm happy to continue ignoring these letters, but aware that that's often not the best advice, and I've already gone against that once Any guidance would be greatly received.
  7. Nothing ever happened about this at all btw. Thanks all.
  8. This one went away by itself by the way (sorry, I'm not getting notifications of new posts any more). Some scary letters threatening they'd "advised their clients that they could take court action" then they suddenly stopped.
  9. I've not emailed them since the first email. They haven't replied any further by email. I have however received two letters (no emails), the latest is attached. TPS Final Demand.pdf
  10. Apologies for the delay, I didn't get email notification. I mentioned I had emailed in post 16. As you say, an email can be spam filtered. I'll do all by letter from now though, I was just in a rush to ensure it was accepted before I left my old company so they didn't deduct from my final pay. Should I just wait for the next email before any further action? Thus far I've just had the one...
  11. Mission accomplished thus far, they have emailed me and given me 14 days to make my appeal. Uhm... Help?
  12. Oh yes, I just needed to stop my company from paying it first thing on Monday morning once I've gone. Happy to go with your guidance from here on, and very much appreciate it.
  13. As I've said, my company would just have paid it to shut them up and then taken it out of my pay in hand. They say they don't have the supporting documentation the paperwork requires to refer to a driver (it asks for a signed copy of the hire-lease agreement and the statement of liability associated with the driver), and wouldn't listen to any argument as to the legality of the charge. My contract states fines, and any excess parking charges. And let's be honest, even if it didn't, I wouldn't have the time/inclination to take them to court to claim back £70. I had to make a decision before today or they would have paid it. How do you suggest I proceed from here?
  14. I've just emailed TPS and told them I was driving the vehicle, which should do just that.
  15. My company won't tell them that I was driving as they don't have on/off-hire documents... Not really sure what that means, but they're pretty adamant. I know what will happen if this isn't resolved is they'll pay it and deduct me. I'll drop TPS a line to tell them I was the driver and that I'm preparing an appeal. I have no way of getting down there to get pictures of the signage unfortunately. I wasn't there on business, but I was spending money in Halfords, they then closed for the day, and I went somewhere to eat. I genuinely had no idea that the car-park had a time limit.
  16. I'll await your research! Thanks. I visited Halfords, went in and out via the two Halfords entrances if that's of any use? Can I tell them I was driving? My company are just weird and may not want to get involved.
  17. I've been told by work to fight it or pay it. Done it in the past and fought and won. I guess I'd just have to name myself as the driver, which I'm happy to do. Unfortunately the car park is nowhere near me, but I honestly had no idea that the carpark had a time limit, so it can't have been particularly obvious.... I'll get a copy of the PCN marked up and posted shortly.
  18. Hi all, Fairly straight forward I'd imagine, from the text in question 2, but I thought I'd check with you guys for some actual wording for my appeal. For info: Company Car, and to make matters worse, I'm leaving said company on the 24th Feb and they'll take any outstanding fines from my pay. 1 Date of the infringement: 18/01/2017 2 Date on the NTK [this must have been received within 14 days from the 'offence' date]: 06/02/2017 3 Date received: 10/02/2017 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? Yes 5 Is there any photographic evidence of the event? Yes, car entering and leaving, but not enough detail to read the reg, 6 Have you appealed? Not yet, wanted to take the right tack. 7 Who is the parking company? Total Parking Solutions (TPS UK) 8. Where exactly Brighton Road Retail Park, Redhill, RH1 6QL
  19. I'm trying to get the mother-in-law to scan the letters but its a nightmare to be honest. I'm tempted to just appeal on her behalf if need be. There's apparently something about only having 28 days to appeal though, is that enforceable?
  20. 1 Date of the infringement 02/10/16 2 Date on the NTK 04/11/2016 3 Date received 08/11/2016 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? It doesn't appear to 5 Is there any photographic evidence of the event? Yes, in and out of car park 6 Have you appealed? Not yet 7 Who is the parking company? Parking Eye 8. Where exactly [carpark name and town] St Peter's Retail Park Mansfield 9. For either option, does it say which appeals body they operate under. Unsure, it's on the reverse of the NTK, and she's only sent me the front. The letter does say "if you were the driver of the vehicle... you have to..."
  21. So just explain the situation and get away with it? Or are there things to avoid saying?
  22. My Mother In Law has got several scary warnings from Parking Eye for parking without a ticket, despite having bought one. She's found the ticket and she put the wrong reg in. Is it worth replying to, or just keep ignoring it?
