  3. Following on from above post, I feel as though my claim is being delayed yet again. So, I have requested a Subject Access Request so I can compare the information I have against the information Hastings has. I have also requested copy of all telephone recordings and will soon request a Subject Access Request from Swinton - the insurance agent. Quick question - since Hastings have not upheld my complaint in relation to the amount of time it has taken to sort this claim out, can the copies of my telephone recordings be used within court? The reason I ask is that I have lost my 5 years no claims bonus since I did not have money quick enough to purchase another car. Had the claim been sorted out quickly, then I would have purchased a replacement car and would have not lost my no claims bonus discount! Since the claim was not sorted out quickly then I didn't purchase another car and consequently due to the length of time, I have lost my no claims bonus! The telephone recordings were made using a cheap old voice tape recorder which I wired up myself - just 2 wires from phone extension wire connected to microphone input wires of tape recorder. The sound quality is perfect as its a direct connection... The recordings to Swinton and Hastings were for my own records only... But, my question is - can the recordings be used as part of my evidence to back up my complaint that there had been a considerable delay caused by Swinton / Hastings / Third party agent acting on behalf of Hastings? Can such recordings be sent to Financial Ombudsman?

A lengthy email received from Hastings - their reason why they can not accept a photograph of the document and require a scanned copy is as follows: I do not see any difference between that of a scanned document and that of a photograph of a document since both are digital images. I will now possibly wait until I return to UK and persist in sorting this out when I am in UK. With any luck, maybe I will be paid sometime this year.
  5. hello, I am not sure if this will help you... A few years ago, LPA receivers took a buy to let house from me, - I thought the tenants were paying the mortgage and they weren't. Stupid of me to trust the tenants and i should have been checking the mortgage myself. Like you, the mortgage company wanted an extreme amount of money to get rid of the LPA receivers. I couldn't find this money so quickly and the fees were building up at a considerable rate. The way out of this for me? I informed the mortgage company and the LPA receivers that I was living in the property myself. The mortgage company / receivers then took me to Court for trespass! Within court, - the trespass case, the Judge would not allow the trespass charge against me. Also, the judge let me use 'norgan' criteria in order to keep the house being repossessed. Basically the norgan criteria allows you to pay any arrears on the mortgage over the remaining length of the mortgage. That was the only way I could get rid of LPA receivers - by informing them that I was now living in the property myself. I am not sure if this is the correct advice though it worked for me and allowed me to get rid of LPA receivers quite quickly without having to pay their high demand of money.
  6. hi, not sure what your concern is? as honeybee said it would probably be better if you start your own thread highlighting your concern. this is an old thread, but just wanted to add my thoughts to a suggestion made earlier in thread that said leave the domain name expire and then purchase it again. i'd advise against that since some registrars keep the domain name themselves when expired, some companies such as 'maltuzi holdings' a few years ago purchased almost all expired domain names.
  7. hi, i am not so worried about the train travel in russia, it is just the bus without the aircon in EU. Russian law = corrupt... usually the person with the most amount of money wins in a legal case. if someone is sick & vulnerable and not helped, penalty for not helping is upto 12 months in the gulag (forced labor camp) or few months in prison.

  9. hello honeybee... no, i could never ever fly, - many reasons but all due to fear. friends and family have always tried persuading me. about the duty of care, i assume it would fall under russian law when i am in russia, and EU law when i am in europe. i received email from ecolines (bus company) who have said that if their air conditioning doesn't work on a hot day then I can leave the bus and the stewardess will arrange replacement ticket for me on the next available bus - the day after. hello stu007. yes i have the EHIC card. i don't have any travel insurance because of the amount of time spent living here. im not sure if my unconsciousness from heat exhaustion is a pre existing condition since it comes from heat and only happened on one occasion a long time ago in non air con bus. temperature here at the moment is +32c with a storm on its way... in winter it can get -30c but luckily im out of here before then! anyway - bus company has said they will allow me to travel on next bus if their air con doesn't work but my experience of ecolines is far better than eurolines and they have always had high standards. just wanted to check what my rights were if it happened again.
  10. thanks, but I could never fly. I know it would be a lot cheaper, easier and a lot quicker, but I can not do this. I dont have a fear of flying as such, more of a fear of being up there and not flying.. just falling..
  11. Thanks for your help.. I can understand what you are saying, yet my opinion is that the duty includes that of a comfortable temperature inside a bus of say 60 people travelling for 30 hours. Hopefully the weather / temperature will be a cooler when I travel or the air con is working. Just wanted to know what my rights are if I have to leave the bus for the sake of my health and whether the carrier would be responsible for giving me a replacement ticket to continue my journey on another bus.
  12. its impossible to travel by train all the way, no trains in baltic. i could never fly, even if it were a fear of flying course, nothing would make me go on the aeroplane. If a coach company advertises air conditioning and wifi, and has a clause to say that wifi may not work in some areas and may not be available on some destinations, that implies that their air conditioning will always work since they do not state that the air conditioning may or may not work on some destinations etc as they stipulate with their wifi. So, as air conditioning is advertised and it does not work, then, if the heat is unbearable again, surely they are responsible for providing me with free ticket for another bus in their company?   14. hello, In a few weeks I will have to travel constantly for about 7 - 8 days. This is 3 days by train 4 days by bus. Everything is usually fine whilst I travel through Russia by train and the Baltics, Poland and Germany by bus. I usually experience problems within Netherlands / France / UK - when air conditioning does not work in the bus. In 2010, I was unconscious because the air conditioning didn't work on a bus and my body could not cope with the heat. I don't want heat stroke again and certainly don't want to be unconscious again since it took me ages to recover as I felt ill for weeks after this. I shall travel in August. My question is: If I am on a bus and the air conditioning is not working and it is a high temperature, I know I have to leave the bus for the sake of my health. Is the bus company then responsible for my financial losses such as replacement bus ticket for the rest of my journey? The first 2 times without air conditioning on bus, I sent complaint letter to National Express / Eurolines who then gave me % off voucher for my next travel. The third time it happened when I was unconscious, National Express didn't answer my complaint. I then changed companies to Ecolines since I found they run a bus directly to UK over 2 days (constant travel). So, if I find myself in a position on Ecolines direct bus with extreme heat and no air conditioning, can I get off the bus and would Ecolines then be responsible for giving me a free ticket to continue my journey on a bus with air conditioning? I realise this may sound petty but my body can not cope with heat for a long period of time and I'd like to know my rights if this happened again, because really I am not looking forward to this travel and I do not want to experience heat stroke or heat exhaustion / unconscious again.   15. hi Jessicaa, It is obvious from your thread that you are clearly distressed and scared about this situation. Please ignore such stupid comments re Interpol international arrest warrants etc. The only other advice I can give to you is to enjoy your holiday and don't feel as though you should not leave the country because of your fear. Post 10 and 24 provides you with good advice. I believe it is highly likely that this will not go to court provided that you create a paper train / email offering to pay their admin fees, value of ticket etc, just generally following the adivce in the post above mine.

As this is such a long time ago, I am not sure whether it is worth me making a Subject Access Request with them.   22. hi, If I were in your position, I would be looking to reject the goods and make a reclaim of everything you have paid so far. The claim would be for the payments made for the TV as well as payments made in respect of the insurances. Then, with the money you would probably be able to buy an equivalent specification TV from another retailer, - therefore not being tied into the HP agreement and also saving yourself money by not paying an overly inflated price. If however you have already accepted the replacement TV, you should ideally be thinking about making a claim for the insurances you have already paid so far to this "retailer".
  23. This has been ongoing since 2007. I do know that in the last few years I had simply forgotten about the claim due to the previous amount of times I had contacted Hastings, Hastings agent and my insurance broker (Swinton). I feel as this is yet another delaying tactic used by Hastings. I can appreciate that Jamie (Hastings rep on CAG) is trying his best to rectify this for me, however, the above experience (delay) is in my opinion indicative of past experiences whereby the claim was delayed, open > closed, repoened > closed etc... Asking for a scanned letter and not accepting a photo of the letter is in my opinion ludicrous and just shows further delays. The photo of the letter is also far better quality than that of a scan, it also includes my passport copy, something which was not asked for. Despite this, Hastings are still delaying.
  24. Hello, There is an extremely good advisor called Ellenn here who will be able to provide you with more advice. Perhaps in the meantime you can give details such as: 1. The total amount of arrears 2. How long is left on the mortgage. If this does go to court, the judge would require evidence that the arrears can be paid off. My suggestion is that you should not let the bank bully you into making possibly unrealistic payments over a short term, since the arrears can be repaid over the entire length of the mortgage. As for the mortgage company switching to interest payments, they would need to be contacted and needs to be requested. Failing this, it may be possible to switch to another mortgage provider who will offer interest only payments. As I've said, there is an extremely good advisor Ellenn who will be able to provide you with better advice.

As you are scared, then I would suggest you call the police and explain to them what is happening and you need assistance from the police in order for them to firstly remove the rep from your property and secondly for the rep to be informed that his implied right of access to your property is denied. The police are there to protect you in this instance - despite the rep may say otherwise.
