  2. He has told me that if I pay the owing balance, he will clear the default. I have asked for written confirmation it will be removed from credit history and not just marked as satisfied.
  3. Doesn't that contradict this statement from a previous email below?? .................. Unfortunately I can only echo what my colleagues have stated before, in regards to backdating your tariff. We list all our tariffs on leaflets included with the bills that we send out, and on our website. Our customers are given this information so that they can switch to a different tariff anytime. As the account ****1 811 was closed on 30 June 2012, this is too long ago to backdate. However, as I’ve backdated the tariff to the start of your last bill on your current account (for the period 4 August 2012 to 11 January 2013), this has reduced your balance down to £230.77 (for account ****5 348) and I’ll send an amended bill for you in the post. I can appreciate that this isn’t the response you were hoping for, however if you have any further questions or wish to discuss your payments, please call on 08457 919 155, where we’ll be happy to help.   4. This response... Dear Mr B We will not backdate tariffs onto bills older than 30 days. WaterSure is a tariff which is bound by strict rules, as set down by the Government when they introduced this tariff for vulnerable customers. We have to abide by these and cannot deviate from them. We also have to be fair and consistent to all customers, therefore, we would not consider backdating your bills when we have declined others. We will not backdate any tariff on to your account except for applying this to your latest bill from 4 August 2012 as detailed below.   6. You've lost me there DX, sorry. So the default sum registered on my CRA file is correct to include charges. However the default notice they sent me that gives me 14 or 28 days to rectify should only include the owing amount?
  7. So is there any legislation governed by anyone that states default sums cannot comprise of charges? I mean like roughly 2100% of the original amount owed? lol
  8. Still looking into it although the person I'm speaking with is graham.taylor@bt.com Just out of interest do they not have to abide by any guidelines set out by CCA or anyone to place defaults?
  9. Can anyone clarify if they are allowed to backdate previous accounts and debts? They reckon they can only backdate one year, or this current bill... Something like that. If they can get the arrears down to an acceptable level I would be willing to pay a little more to reduce it significantly.

  12. I was £4.76 overdrawn, and they inflated that amount to £105 which is what it defaulted at.
  13. So what they are saying is they consider whether to agree to an informal overdraft, then (sometimes) charge me for the privilege. Then when a direct debit comes out and im already in minus figures, they also consider paying it, refuse payment and charge me for it all. Double whammy.
  14. Fighting a losing battle then eh? All for going £5 overdrawn when I was out of work. It's quite a catch 22 really. I'm £5 overdrawn so struggling anyway, a direct debit comes out and they whack a charge on making me £35 overdrawn - Making situation worse.

  18. Can anyone clarify the situ on the above statements? What do we class as genuine arrears? Any more input here chaps?
  19. Do BT not have to follow specific guidelines in order to record a default against my CRA?
