  1. Hi there, thanks for your reply. Luckily, I was able to access the money the next morning with no problem!! So now officially concluded
  2. Apples, my son and I received the same on Monday, checked our respective accounts today and yesterday, both our accounts were credited with the full amounts claimed!! (we have not received written notification of this) Keep checking your account
  3. Checked my account today and found that Halifax have credited my account with all charges/interest/court costs claimed. This was despite receiving notification from the court on Monday of the Halifax's intention to defend. :) I am unable to access MY money at the moment as I was requested to return my cash card the moment I started action against them. They have also put a stop on me transferring funds too. I am going into the local branch tomorrow to speak with them. I posted on what happened this evening when I spoke to the bank above. Will donate soon (hopefully)! Thanks to everyone again who has helped - without you, we could not have done this.
  4. Hi all Checked my account yesterday and found that Halifax had credited my account with the full amount of charges/interest/court costs claimed. This was in spite of receiving notification from the court on Monday of the Halifax's intention to defend. Thanks again to everyone who has helped - could not have done this without you :) Will now donate 5% HAPPY CHRISTMAS Just in case of any confusion: This post should have been posted under my son's name AJ1983!
  5. I have been refunded all my charges but bank have denied me access to this money. Cant transfer it either. I have just spoken to bank who were going to put me through to head office and I was told to contact Robinson Way - I refused and asked them to put me through to head office or I would write to the court - I cannot believe that they have just put me through to Oliver Blair Debt management company without my knowledge - what can I do to force the bank to speak to me and enable me to access my money?????
  6. I have also just come across this post by googeling the above company. I have received a letter from Robinson Way threatening Court Action. I have also received many phone calls from them of which I do not answer. In my case, it is the HALIFAX BANK who are using them to try to recover monies accrued on my account in unlawful bank charges! I am just about to file my MCOL with the Court service against the Halifax
  7. Thanks for your speedy reply Aardvark - I will send another LBA with revised schedule of charges and allow them another 7 days... thanks for that
  8. NEW QUESTION !!! Hi again, Have not been able to keep to my timescales due to illness & am now ready to put in a Court Claim. Since sending the LBA with schedule of charges, I have had further charges applied to my account therefore, could you please tell me whether i need to send my Bank a new schedule of charges before court action commences & if so what sort of letter would I send with that ? Thanks in advance
  9. Have just donated £10; will donate 5% of any monies when received from bank.
  10. Sorry to hijack your post but I too had sent my LBA and included £34.00 (exact amount of interest charged in overdraft interest), I take it then that this is incorrect to add 'any' interest at this stage? Can you please confirm this? I was aware that you can only add the 8% interest on application for court but (wait for it ) thought - christ what was I thinking:confused:. I will re-read all the information again with a view to improving my understanding of it. Many thanks in advance.
  11. I wonder if anyone can help? Roughly 3/4 years ago I was made redundant and had an overdraft of £2000 - Not sure how much was due to bank charges; a time came when I was unable to keep up payments and the debt was sent to debt collectors. I have been paying very small amounts and interest was obviously frozen. I assume my account was then closed. My question is: Does anyone know whether I could still pursue the Abbey for all Bank Charges incurred at any time throughout my banking with them? I could use that money then to pay them off
  12. Hi I agree too - that withouth this site, I would not have known where to start! Will donate as soon as I get a settlement from the Halifax
  13. I am glad I have come across this thread! That's great news Drivers. My son has had problems with extortionate charges by Renault Finance but because he is not a third of the way through his agreement yet, we are holding tight. I will be watching this thread with interest and when the time is right for us, we will go for it.
  14. Hi again Received a reply to my Pre-lim letter stating Halifax will contact me during core hours! have been away so not sure if they tried to contact me by 'phone. I now need to send LBA letter; can someone just confirm that I do need to change the first line where it says "I am very disappointed that you have failed to respond to my letter of the ...." ? to something like " I am dissapointed to have received an inadequate response from you dated ........ in response to my letter dated .... - you have failed to contact me during core hours....."? although this sounds a bit gobbledegook to me, can anybody help please with the wording? Although I have read all notes, could anyone please confirm that I do not include interest on LBA letter and only do so when I go onto next stage, stage five? Thank you in advance.
  15. Hi Mechs Thanks for advice - I will now write to tell them account in dispute etc. Cheers!
  16. When my bank refused by phone to reverse a charge applied to my account a few months ago due to my OD limit being exceeded for 1 day, I cancelled all remaining DD's as I did not have enough money to cover their charges of £39 and £30 plus my DD's; I have not used my account since and the charges have escalated. Ok my question is this; I think a Default has been put on my account as I have just received a letter stating this: "If the payment is not made withihn 5 days of the date of this letter, we may take further action against you." It goes on to say "Upon expiry of the Default Notice, we may instruct a Debt Collection Agency to arrange repayment of the full balance or alternatively commence legal action" "it is in your interest to resolve this matter by making an immediate payment of £212.28" ie (the charges that they have levied against my account which I refuse to pay. Does this mean that I have a Default Notice against my account?
  17. Hi - I am sifting through all of my son's Capital One Credit Card statements for him and will send off Pre Lim letter on Monday. From waht I have read, we could be successful in claiming back all charges.
  18. Hello, this is my first post and hope that I am posting in the right place. I have only recently discovered this wonderful, helpful site thanks to a particular programme on TV bringing it to my attention and of course all those who have supplied a wealth of information on here. I will send my first letter requesting statements for the last 6 years tomorrow. When this one is over, I will challenge: B/card, C/one, Ikano and Abbey but not necessarily in that order having read the b/card threads!
