  1. HP MUM, there is so much you haven't told us to make an informed assessment and therefore give the best advice. Does the bank know that he has been outside the UK for ten years but still has a mortgage on a 1.5 million property? Who lives in this property? Who lives in the property abroad? Is it a state pension? I take it That the country he is residing in has a pension agreement, like Spain, to pay the pension at the rate of ten years ago (as it does not increase and you say he has been out the country for ten years)
  2. Dx, the person does not reside outside the uk. They are just abroad at the moment
  3. how does the debtor provide proof that the car is not his? The debtor does not have too. Its the person who claims the goods belong to to prove they own them
  4. He can write to the court. Lasting power of attorney will not help you. That only kicks in in law when someone becomes incapable medically. Your friend is not incapable in that sense Couple of questions. Why cant he return to the UK? If there is valuable art you could sell it tomorrow to a dealer to raise cash Why cannot a bridging loan be taken out if the art cannot be sold asap? There is a huge LTV in the property
  5. Then I suggest you do look at the different police forces websites. They are written by lawyers. What I'm saying is that at the time payment could not be made and yes, maybe the garage were too quick to send off the info without the involvement of the police. BUT If now payment is not made, as suggested by the OP, then there lies the caveat of willfully or intentionality of permanently depriving.
  6. They are bothered about where you live as she is claiming for single person allowance and you have lots of bills in your name at the address in question. A simple credit search will give them that info. But your explanation seems reasonable. Who are the DWP to question if you pay for SKY in her house for your kids? All they are doing is making sure its a genuine claim.
  7. https://www.avonandsomerset.police.uk/advice/vehicles-and-roads/non-payment-of-fuel/ https://www.west-midlands.police.uk/your-options/leaving-petrol-station-without-paying https://www.kent.police.uk/advice/theft/fuel-theft/
  8. The courts will not recognise you. Your not the defendant. Your not a solicitor Your not a QC Your friend needs to write to the court explaining they are overseas and ask for a later date or get home soon and represent themselves
  9. By the VERY FACT of you fueling up your representing that you have the means to pay. Just because the garage uses alternative means without getting the police involved means they are paid quicker and YOU have less chance of being charged. Yes it is a criminal offence. It Is not a civil matter if the police get involved. Do not do this. The garage will report you to the police. Qouted from Kent police. Non-Payment of Fuel A customer has left without paying for their petrol If a customer has left a petrol station or garage forecourt without making payment, (known as bilking) staff should first make a report to the police. If there is evidence of a criminal offence, such as false number plates or involvement of a repeat offender, we will continue to investigate using the regular process. Recover outstanding payment Genuine mistakes can sometimes happen and in these cases garages and petrol stations are able to recover any outstanding payments through civil recovery. This allows a garage or petrol station to obtain the vehicles details via the DVLA and contact the owner to arrange for payments to be made. If after a reasonable attempt at civil recovery the fuel is not paid for, further action can be taken. I have received a civil recovery letter If you have received a civil recovery letter, it means the garage or petrol station that is writing to you, believe you have left without making payment for your fuel. Failure to respond or make payment may lead to further action being taken by the police.
  10. A friend cannot represent someone in court. They can represent themselves, known as a litigant in person. The litigant in person can have someone there advising them and take notes but they CANNOT address the courts directly. This is a McKenzie friend. The courts can decide wether the litigant can have one or not. The only exception is were someone has a lasting power of attorney for financial if the person is incapable. Your friend is not incapable. Your friend is not in small claims court so a lay representative is not appropriate (you have to be present anyways for them to speak on your behalf)
  11. So, technically, you have stolen fuel. By fueling up your pertaining that you have the means to pay for it. You could of done a few oter things like phone a friend to make an over the phone payment etc etc. The garage uses other "routes" to make sure its paid. They could of reported you straight to the police and you would of been arrested and possibly charged.
  12. 1 yes 2 yes 3 they wont, your not the claimant 4 tough, there is a duty of care to the taxpayer to investigate possible fraud
  13. My thoughts exactly, refuse collection workers are not thick. Its a job. I wouldn't get married.. You'll have money for 60inch tvs, go pub when you want, stay out all night, go play golf or play on xbox till The wee small hours... I jest obviously!! Get married but be prepared to prove what is yours in accounts and assets if needs be.
  14. Really? I have routinely seen police lead staff members out the store in handcuffs
  15. Ds3 are supplied when new with a compressor and latex bottle ( emergency repair kit) but its up to the prospective buyer of a used car to check they are still there. You can buy a space saver or spare wheel but that is an optional extra
  16. Could the original poster confirm or deny please. If true then its a summery dismissal and youl lose all monies owed, ie holday pay and knowing the major supermarkets they will hand over all evidence to the police and ultimately the cps for consideration of the criminal charge of theft from an employer
  17. Firstly its assurance not insurance. What type of tumor was it. That's important. A letter from your consultant would help but it all depends on the tumor type. L&G, at the moment, consider you as too much of a risk but a letter may change there minds but you could be paying a fortune.
  18. L&G's response is not uncommon. At the time ofyour illness did you have life assurance /critical illness/income protection? Did you make any claim on those if you did? My Mrs cannot get critical illness cover as she got breast cancer, at first it was a DCIS and no critical illness cover pays out on that but she was claiming income protection. However the pathologist was not happy and wanted a bigger margin for the lumpectomy as it was just becoming invasive. The Halifax paid out critical with no fuss after getting the reports, but she cannot get critical illness cover again even tho she has had the 5 year all clear and is no longer taking medication for it.
  19. Car is missold/ not as described They cannot sell a car sold as seen, they are a dealership. Send them a letter before action if your willing to take them court, but you should be rejecting the car and asking for a full refund to give your claim validity
  20. They wont have any info on you that goes back 28 years, sar wouldn't produce anything of significance. If they did then they are breaking the law. Unreasonably holding personal data. If it was an accident, and it sounds a serious one, did the health and safety get involved with an investigation?
  21. The paper you sign IS a statement saying I admit to using a tv that I capable of watching live broadcasted programs. You've signed your own death warrant really. But the goon at your door will not tell you this as they work for capita on commission. Warning to others, if the tv licencing goons come knocking, tell them to foxtrot Oscar. They have NO right to enter, they can assume anything they want. Tell them to go away and shut the door.
  22. If your cautioned thensay nothing, apart from I wish to seek legal representation before answering questions.
  23. How long were you off work. Was it paid compassionate leave or not?
